Ministry of Foreign Affairs
The Ministry of Foreign Affairs states that the Agreement between the Government of the Czech Republic and the Government of the Portuguese Republic on economic, industrial and scientific cooperation was signed in Lisbon on 8 July 1994.
The Agreement entered into force on 30 March 1995 on the basis of Article 9 (1) thereof.
The Czech version of the Agreement is hereby published at the same time.
AGREEMENT
between the Government of the Czech Republic and the Government of the Portuguese Republic
on economic, industrial and scientific and technological cooperation
The Government of the Czech Republic and the Government of the Portuguese Republic, hereinafter referred to as "the Contracting Parties,"
Knowing the importance of economic, industrial and scientific and technological cooperation for the development and diversification of relations between the two States,
in order to develop existing economic relations between the two States on the basis of equality and mutual advantages which would lead to full exploitation of the possibilities of scientific and technological progress,
in accordance with the legal rules in force in both States and international commitments undertaken by them,
having regard to the Agreements concluded by the Czech Republic with the European Coal and Steel Community and the European Economic Community and the prospects for their development,
having regard to the provisions of the Final Act and other documents adopted in the framework of the Conference on Security and Cooperation in Europe, in particular the Paris Charter,
having regard to the provisions of the General Agreement on Tariffs and Trade to which the two States are members,
agree on the following:
1. The Parties shall promote the development of economic, industrial and scientific cooperation between the two States in order to intensify and diversify bilateral relations.
2. Cooperation will take place in particular in the areas listed in Annex I to this Agreement and the Parties will be able, by mutual agreement, to establish other areas, with particular regard to the balanced development of mutual relations and the economic and scientific and technological policy priorities of both States.
1. The Parties shall promote contacts between the relevant institutions of the two States, including the exchange of experts, under conditions agreed by the Parties.
2. In accordance with measures favourable to the development of bilateral cooperation and the rule of law applicable in both States, the Contracting Parties shall:
(a) support initiatives, namely fairs, exhibitions, symposia and other meetings aimed at promoting and developing cooperation between the two States and, in particular, between their respective economic operators and institutions;
(b) facilitate the development of new forms of cooperation, including cooperation between small and medium-sized enterprises, as well as the creation of mixed enterprises, mutual investment, subcontracting agreements, business management cooperation, research, technology exchanges, joint production;
(c) promote the awareness of the economic operators of both States of the specific possibilities for cooperation and the development of bilateral relations;
(d) promote cooperation between economic organisations and undertakings of both States, in particular as regards their long-term programmes, protocols and contracts;
(e) promote the implementation of professional training actions with a particular focus on economic activity aimed at training entrepreneurs and managers, as well as higher and medium-sized mentors in enterprises;
(f) promote cooperation between scientific and research institutions with the aim of promoting the exchange of scientific and technical information and experts, the organisation of conferences and seminars, the preparation and implementation of joint projects in the fields of science, as established by common agreement between the relevant institutions.
3. The Contracting Parties shall, in accordance with the laws in force in both States, facilitate the opening and establishment of offices in the relevant States or any other form of representation of economic organisations and undertakings of the other State.
The Parties shall promote cooperation between the undertakings of both States, including the creation of joint undertakings operating in their or third States.
The Contracting Parties shall endeavour, in accordance with the legal order in force in both States, to create favourable conditions for the financing of work projects implemented under this Agreement.
The Parties shall ensure and strengthen the protection of industrial and intellectual property rights, in accordance with the laws in force in both States.
1. In order to implement this Agreement, the Contracting Parties shall establish a Joint Commission composed of representatives of the competent authorities of the two States, meeting at the appropriate level, as appropriate and at the request of either Party, alternately in the Czech Republic and the Portuguese Republic.
2. The Joint Commission will monitor and coordinate economic, industrial and scientific and technical cooperation between the two States and propose to the relevant governments the measures necessary for its development and will specify, in particular, the sectors in which bilateral cooperation will be most favourable.
3. The Joint Commission shall lay down the rules necessary for its activities.
This Agreement shall be without prejudice to international commitments made by the Contracting Parties.
The Contracting Parties shall be able to agree on amendments to this Agreement, the approval of which shall be in accordance with the procedure provided for in paragraph 1 of Article 9.
1. This Agreement shall be subject to approval in accordance with the laws in force in both States and shall enter into force 30 days after the date of receipt of a later note of such approval.
2. This Agreement shall be negotiated for a period of five years and shall be extended automatically by one year each time, unless one of the Contracting Parties denies it in writing not later than six months before its expiry.
3. The provisions of this Agreement shall remain effective for contractual obligations entered into during the period of validity of the Agreement and lasting at the time of its termination until the commitments have been fulfilled.
Done at Lisbon, 8 July 1994, in two original copies, each in the Czech and Portuguese languages, the two texts being equally authentic.
