Communication from the Ministry of Foreign Affairs on the Treaty between the Czech Republic and the Russian Federation on friendly relations and cooperation

The Ministry of Foreign Affairs announces that on 26 August 1993 the Treaty between the Czech Republic and the Russian Federation on friendly relations and cooperation was signed in Prague.
The Parliament of the Czech Republic gave its assent to the Treaty and the President of the Republic ratified it. The instruments of ratification were exchanged in Moscow on 5 March 1996.
The Treaty entered into force on 5 March 1996 pursuant to Article 26 thereof. On that date, the Treaty on Friendship, Cooperation and Mutual Assistance between the Czechoslovak Socialist Republic and the Union of Soviet Socialist Republics of 6 May 1970, published under No 67 / 1970 Coll.
The Czech version of the Treaty is hereby published at the same time.
TREATY
between the Czech Republic and the Russian Federation
on friendly relations and cooperation
the Czech Republic and the Russian Federation ("the Parties'),
building on the traditional relationship of friendship between the peoples of both states,
Taking into account the fact that the Czech Republic is the successor state of the Czech and Slovak Federal Republic and the Russian Federation is a state - a continuation of the Union of Soviet Socialist Republics,
building on deep political and economic transformations in both states, Europe and the world,
convinced that the mutual respect and cooperation between the two states is in line with the interests of the peoples of the Czech Republic and the Russian Federation and serves to strengthen peace, security and cooperation in Europe, to create quality new relations based on equality,
considering the territorial integrity and integrity of the borders of all states as an inseparable part of the new peaceful order in Europe,
managing the rules of international law, in particular the principles of the United Nations Charter, and acting in accordance with the commitments made in the framework of the Conference on Security and Cooperation in Europe, the Paris Charter for a New Europe, helping to transform Europe into a continent of peace, security, democracy and prosperity,
highlighting the importance of unreserved respect for human rights and fundamental freedoms and the principles of democracy, humanism and the rule of law,
Desiring to end definitively the totalitarian past associated with the unacceptable use of force against Czechoslovakia in 1968 and the further unjustifiable continuation of Soviet troops in Czechoslovak territory, the material consequences of which are addressed by the relevant agreement of 1 April 1992,
building on the principles of the Common Czechoslovak-Russian Declaration on the Principles of Mutual Relations and Cooperation of 14 May 1991,
they have agreed as follows:
The Parties shall develop their relations as friendly states. They will consistently follow the principles of sovereign equality, the non-application of force or threat by force, the integrity of borders and territorial integrity, peaceful settlement of disputes, non-interference in internal affairs, respect for human rights and fundamental freedoms, equality and the right of nations to self-determination, the fulfilment of obligations under international law in good faith. They will undertake friendly cooperation in a spirit of mutual respect, understanding, partnership and mutual economic benefits.
The Contracting Parties shall respect unreservedly the sovereignty and territorial integrity of the other Contracting Party.
The Contracting Parties undertake to resolve any dispute which may arise between them solely by peaceful means. They shall refrain from threatening to force or use force against the territorial integrity and independence of the other Contracting Party, as well as from any other act incompatible with the objectives and principles of the Charter of the United Nations, the Final Act and other documents of the Conference on Security and Cooperation in Europe.
The Parties confirm that security is integral and that their security is inseparably linked to the security of all participating States of the Conference on Security and Cooperation in Europe.
They will help to strengthen security and the development of cooperation in Europe in a universal way in order to create an effective pan-European security system. To this end, they will support the establishment and operation of permanent institutions and bodies of the Conference on Security and Cooperation in Europe and will help to create a single pan-European space in all its dimensions.
The Parties will hold regular consultations at different levels to ensure the further development and deepening of their bilateral relations and exchanges of views on international issues.
Meetings at the highest level shall normally take place once a year, as appropriate and expeditiously.
Foreign Ministers will hold regular consultations on issues of common interest.
Regular meetings of leaders of other ministries and other central government bodies of both Contracting Parties are foreseen.
Consultation shall take place without delay at the request of one of the Contracting Parties which considers that its security interests may be compromised. The Parties shall endeavour to reach agreement on measures appropriate to overcome the situation.
If one of the Contracting Parties considers that there is a threat to peace or to international tensions, they will inform each other of possible means of settling the dispute and stabilising the situation.
The Parties will actively assist the nuclear, chemical, bacteriological and conventional disarmament process, further reduction of the armed forces and arms in Europe, strengthening confidence and security measures on a bilateral and multilateral basis, as well as the establishment of permanent structures of pan-European security.
They will contribute to reducing, through binding and effectively controllable agreements, the situation of the armed forces and arms to a level sufficient for defence only.
The Parties shall cooperate to enhance confidence and security and to this end develop mutually beneficial cooperation and contacts in the military field.
The Parties will deepen their cooperation within international organisations and institutions, in particular European ones. They will assist each other in developing cooperation with international organisations and institutions of which one of the Contracting Parties is a member.
The Parties shall create favourable conditions for direct contacts and cooperation at the level of Republics, regions and other self-governing territorial units, cities and municipalities on all matters within their competence.
Particular attention will be paid to the extension of contacts between parliaments.
The Parties shall promote the development of contacts between people, political parties and movements, trade unions, churches, religious, sports, tourism and other associations and associations.
The exchange of youth will benefit from all-round support from both Contracting Parties.
The Parties shall support efforts towards deeper mutual understanding and understanding and to overcome different prejudices.
The Parties shall, as far as possible, contribute to creating and maintaining favourable conditions for economic and social development in Europe and contribute to overcoming the division of Europe as well as in the economic field.
The Parties shall facilitate the development of mutually beneficial economic and trade cooperation.
The Parties shall, in accordance with their legal order and international agreements to which they are parties, create favourable economic, financial and legal conditions for business and other economic activities, including mutual support and protection of investment, and shall not take discriminatory measures in mutual economic cooperation.
The Parties shall facilitate the creation of appropriate conditions for effective cooperation in the field of basic and applied science, modern technology and technology.
The Parties shall cooperate in the field of transport and other communication systems, including improving transit links.
They will develop cooperation in the field of data processing, as well as the dissemination, improvement and harmonisation of telecommunications links and postal services.
The Parties shall enhance cooperation on the protection and improvement of the environment, the prevention of long-range pollution, the rational and economical use of natural resources, the expansion of environmentally clean production and the implementation of highly effective conservation and restoration measures.
They will seek to develop coordinated strategies for international and regional environmental protection aimed at sustainable development throughout Europe.
The Parties shall assist each other in preventing and eliminating disasters and major accidents.
The Parties shall take the necessary measures to strengthen cooperation in the field of energy using energy-efficient technologies.
The Parties shall develop cooperation on education, culture and art.
Building on the traditions of cultural contacts, it will provide its citizens with wide access to the cultural values of the other Contracting Party and will support appropriate state, civil and individual initiatives. They will be instrumental in widening exchanges between artistic ensembles, artists, professionals, cultural and educational institutions both at national, regional and local level.
They will support the teaching of languages by the other Contracting Party, including studies at schools and universities.
They will promote cooperation between schools of all kinds and degrees and scientific research institutes, both through exchange of pupils, students, teachers and scientists, as well as through joint actions and projects.
Each Contracting Party shall provide support in its territory for the activities of cultural and information centres of the other Contracting Party and shall ensure the necessary organisational and legal conditions.
The Parties shall facilitate access to archives, libraries, scientific institutes and similar facilities in accordance with their laws.
The Parties will cooperate in protecting and studying the cultural and artistic heritage of their countries, including the protection of historical and cultural monuments.
The Parties shall promote the development of cooperation and exchanges in the field of information and promote contacts between organisations and representatives of the mass media.
The Parties shall develop universal cooperation in health, in particular in the protection against communicable and other diseases.
They will seek as close cooperation as possible in the field of social security.
Each Contracting Party shall ensure, maintain and access to, and care for military graves and military monuments of the other Contracting Party on its territory.
They will also cooperate in identifying and maintaining the burial sites of citizens of the other Contracting Party, exchanging information on the fate of the deceased and missing persons on their territory.
The Parties shall cooperate in the repression of crime, in particular organised crime, terrorism, illicit trafficking in narcotics and psychotropic substances, acts against the safety of air traffic, the taking of hostages, the smuggling of goods, including cross-border transport, in violation of applicable regulations, arms, objects of art, as well as objects of cultural and historical value.
The Parties shall cooperate on mutual legal assistance matters in civil, family and criminal matters as well as extradition matters.
In accordance with the commitments made in the Copenhagen Human Dimension Conference, the Conference on Security and Cooperation in Europe of 29 June 1990 and other international documents, the Parties will promote the participation of national and ethnic minorities in society and create favourable conditions for developing their ethnic, cultural, linguistic and religious selfishness.
The rights and fundamental freedoms arising from the Universal Declaration of Human Rights, the rule of law and the international treaties by which the Contracting Party in whose territory they are or live are bound shall be guaranteed to nationals of one Contracting Party located or living in the territory of the other Contracting Party.
This treaty is not against anyone. It shall not affect the rights and obligations arising from the bilateral and multilateral agreements in force and agreements by which the Contracting Parties are bound in relation to other States.
This Treaty shall be subject to ratification and shall enter into force on the date of the exchange of instruments of ratification. At the same time, the Treaty on Friendship, Cooperation and Mutual Assistance between the Czechoslovak Socialist Republic and the Union of Soviet Socialist Republics of 6 May 1970 will be terminated.
This Treaty shall be concluded for a period of 10 years and shall then be renewed for the following five-year period, unless one of the Contracting Parties denies it in writing at least one year before the expiry of the relevant period.
This Treaty shall be submitted to the United Nations Secretariat for registration under Article 102 of the Charter of the United Nations.
