DECLARATION
of 26 May 2014
amending Decree No. 238 / 2011 Coll., laying down hygiene requirements for swimming pools, saunas and sanitation limits for sand in outdoor playing areas
According to Section 108 (1) of Act No. 258 / 2000 Coll., on the Protection of Public Health and on the Amendment of Certain Related Acts, as amended by Act No. 151 / 2011 Coll. and Act No. 223 / 2013 Coll., ("the Act '), the Ministry of Health provides for the implementation of § 6a (6), § 6c (2), § 6f (3), § 13 (2), § 18 (3) and § 82a (5) of the Act:
Čl. I
Decree No. 238 / 2011 Coll., laying down the hygiene requirements for swimming pools, saunas and sanitation limits of sand in sandboxes of outdoor playing areas, is amended as follows:
1. Paragraph 1, including footnote 1, reads as follows:
„§ 1
This decree implements the relevant provisions of the European Union1) and provides for
(a) rules for monitoring and assessment of water quality in natural swimming pools, evaluation, classification, deadlines, manner and scope of public information on water quality in natural swimming pools;
(b) hygiene limits of microbiological and physical water quality indicators in the natural swimming pool, indicators and limit values for the reproduction of sinuses, rules for monitoring the occurrence of sinuses and rules for the visual control of water pollution;
(c) methods, rules, frequency, deadlines and scope of laboratory control of bathing water in natural and artificial swimming pools, showering or cooling water, dates for transmission of the report on the result of laboratory water quality control and method of demonstrating equivalence of laboratory methods and rules;
(d) requirements for the breakdown, equipment and operation of natural or artificial swimming pools or saunas;
(e) the limit and maximum limit values for microbiological, physical and chemical quality indicators of bathing water in an artificial swimming pool and cooling in a sauna, microclimatic conditions, hygiene requirements for the breakdown, equipment and operation of artificial swimming pools and saunas and requirements for the quality and viability of the water source for artificial swimming pools and saunas;
(f) hygiene requirements for the performance, quality, treatment and laboratory analysis of the source of water for artificial swimming pools and saunas, disinfection, treatment, replacement and temperature of bathing water, hygiene requirements for the recycling system, its equipment and the intensity of recirculation, the characteristics of the aids and materials of artificial swimming facilities and saunas, their maintenance and storage, the clothing of infants and toddlers during bathing, the microclimatic conditions of artificial swimming pools and saunas and their method of measurement;
(g) the manner and extent of the quality control of bathing or cooling water, the essentials of the operating log and the manner and extent of the records of the results of the checks and measurements in the operating log;
(h) the health limits of microbiological water quality indicators in other surface bathing waters and bathing areas resulting from mining activities, indicators and limit values for sinuses, rules for monitoring the occurrence of sinuses, rules for visual control of water pollution by macroalgae and waste, and the method for assessing water pollution in other surface bathing waters and bathing areas resulting from mining activities, rules for the processing of the monitoring calendar and rules for monitoring the quality of surface bathing waters, rules for assessing these waters, criteria for their classification and the manner, terms and extent of information to the public;
(i) the hygiene limits of microbiological, parasitic and chemical sand pollution in sandboxes on outdoor gaming surfaces.

2. In Article 2 (1) (j), the word "therapeutic 'is deleted and after the word" pool' the words "an operating person providing care 'are inserted.
3. The heading of Part Two reads: "Natural swimming pools operating on surface waters, other bathing surface waters and bathing areas resulting from mining activities'.
4. In Article 3 (6), the words "dressing rooms," shall be inserted after the words "dressing rooms,"
5. In Paragraph 4 (2), "4 'is replaced by" 3 working'.
6. In Article 5 (1), the words "which must be monitored at each natural swimming pool 'are replaced by the words" water quality' and the words "listed 'are replaced by the words" established'.
7. In Article 5 (3), the last sentence is deleted.
8. In Paragraph 6 (1), the words "All natural swimming pools' are replaced by the words" Bathing water '.
9. In Paragraph 6 (2), the words "Natural swimming pools' are replaced by the words" bathing waters' and the words "monitored 'are replaced by the words" monitored'.
10. in Article 7, the words "In all natural swimming pools, visual" shall be replaced by the words "Visual" and the words "bathing water" shall be inserted after the words "Control."
11. In § 8 the title reads: "Monitoring calendar."
12. in Paragraph 8, paragraph 1 is deleted;
Paragraphs 2 and 3 shall be renumbered paragraphs 1 and 2.
13. in the first sentence of Paragraph 8 (1), the words "referred to in paragraph 1 (b)" shall be replaced by the words "individual samples and indicators to be determined for each sample."
14. in Article 8 (1) (d), the word "swimming pools" is replaced by "bathing waters" and the word "indicators" is replaced by "indicators."
15. in Paragraph 8, the following paragraph 2 is inserted after paragraph 1:
"(2) Monitoring shall take place no later than 4 days after the date specified in the monitoring calendar. ';
Paragraph 2 shall become paragraph 3.
16. In the first sentence of Article 9 (1), the words "shall be replaced by the words" shall be drawn up by the public health authority "and the words" shall be deleted. "
17. in Article 9 (3) of the introductory part of the provision, the words "results which have been disregarded because of short-term pollution" shall be inserted after the words "except"; the results shall not include samples taken to establish that short-term pollution has ended 'and points (a) and (b) are deleted;
18. in Paragraph 9 (4), the words "in the natural pool" are deleted.
19. in Article 9 (6), the words "For all natural swimming pools it is necessary to" shall be replaced by "Na," the words "several," the words "taking into account the Decree" shall be replaced by "under the Order" and the words "assess" shall be replaced by the words "assess the public health authority."
20. Paragraph 9 (7) is deleted.
21. In the first sentence of Paragraph 10 (1), the words "All natural swimming pools must be replaced by" before, "the word" assess "shall be replaced by" assess the public health authority, "and in the last sentence the word" swimming pools "shall be replaced by" water. "
22. in the second and third sentences of Paragraph 10 (2), the words "when the level 2 limits are exceeded, it is not recommended to bathe and operate water sports in particular for children, pregnant women, allergy sufferers and persons with weakened immune systems. 23. In Section 12, the words "and frequency 'are replaced by the words", terms and manner'.
24. The heading of Part Three reads as follows: "INSTRUMENTS FOR COUPLING AND BUILDING AUTHORISED FOR THE PURPOSES OF COUPLING BY THE NATURAL ELIGIBILITY SYSTEM OF CLAIMING WATER FOR COUPLING."

„§ 13
The requirements for the equipment, cleaning and operation of bathing tanks and structures authorised for the purpose of bathing equipped with a natural bathing water cleaning system are set out in Section 3. '.
26. Paragraph 14 (1) is deleted.
Paragraphs 2 to 4 shall be renumbered paragraphs 1 to 3.
27. in Article 14 (1), the words "in bathing tanks and in bathing sites equipped with a natural water treatment system" shall be replaced by "for bathing."
28. In Paragraph 14 (3), "4 'is replaced by" 3 working'.
29. in Article 15 (2), the second sentence is deleted;
30. Paragraph 15 (3) is deleted.
Paragraph 4 shall become paragraph 3.
31. in Article 16 (3), the words "or, in the case of a water duct, the total organic carbon shall not be checked," shall be inserted after the word "sources."
32. in Article 17 (1), the third sentence is deleted;
33. In Article 17, the following paragraph 5 is added:
"(5) If water from the pool is also used for distribution to the showers, only water can be used at the exit from the recirculation and after disinfection. '
34. In Paragraph 18 (1), the sentence "In the same way, sewerage must be carried out and operationally adjusted for all other communication areas directly connected to the gallery is inserted after the first sentence; all water when cleaning from these areas must flow so that it cannot adversely affect the quality of the water in the pool. '
35. in Paragraph 19 (3), the first sentence shall be deleted and in the second sentence the words "if not the pool for infants and toddlers," shall be inserted after the word "pools."
36. In Paragraph 21 (1), the first sentence is replaced by the following: "; the volume of water in the storage tank shall also be counted into the total volume of pools'.
37. in Paragraph 22 (1), point (c) is deleted;
Points (d) to (n) shall be renumbered (c) to (m).
38. in Paragraph 22 (1), point (f) is deleted;
Points (f) to (m) shall be renumbered as points (e) to (l).
39. in Paragraph 22 (1) (f), the words "walls and bottom" shall be inserted after the words "disinfect."
40. in Paragraph 22 (1) (g), the word "under" shall be replaced by "under the conditions set out in the first semicolon," and the words "after the first semicolon" shall be replaced by the words "only for pools connected to the recirculation system, the pH and coagulation preparations may be used; ozone can be used for water treatment provided that its dosage is included in the recirculation circuit and the water in the pool itself no longer contains it. Algicides may be used for water treatment only for pools operated for the age category over 12 months. The use of other chemical preparations for water treatment of pools for infants and toddlers is not permitted, '.
41. in Paragraph 22 (1) (j), the words' desirable 'shall be replaced by' must 'and the words' (about 0,3 mg / l) 'shall be replaced by' (range 0,2 - 0,4 mg / l) ';
42. Paragraph 24, including the title, reads:
„§ 24
Hygienic requirements for swimming pools operated by caregivers
The hygiene limits of the microbiological, physical and chemical quality indicators of pool water, which are operated as part of a service provided by the care provider, are set out in Annex 8 to this Decree. '
43. In Paragraph 25 (3), the words "the intensity must be automatically measured and recorded separately for each pool 'are replaced by the words" the intensity must be automatically measured and registered for each pool separately except for seasonal swimming pools'.
44. In Paragraph 25 (6), the word 'method' is replaced by 'eventual'.
45. in Paragraph 25 (9), the words "in Order No. 409 / 2005 Coll., Annex No. 4A -" shall be replaced by the words "in Annex No. 4, Part A, of the Ordinance on sanitary requirements for products in direct contact with water and water treatment (13).

46. In Paragraph 27 (1), the words "when a pool inflow is situated in the corner of the pool, the sampling point shall be moved behind the inflow 'shall be added at the end of the sentence, in the fifth sentence, the words" a separate sample at the inflow and' deleted and after the word "watered 'the word" sample' shall be inserted.

Paragraph 6 shall become paragraph 5.

52. In Paragraph 31 (2), the word "shower 'is replaced by the words" shower area' and the words "covered with tiles or other washable material 'are replaced by the words" easily washable surface'.
53. In Paragraph 31 (3), the first word "shower 'is replaced by" shower' and after the second sentence, the sentence "Their number and arrangement shall be laid down in specific legislation governing technical requirements for construction (3) '.
54. in Paragraph 31 (4), the word "shower" is replaced by "shower room."

57. in Paragraph 34 (1), the second sentence is deleted;
58. In Paragraph 35 (2), the words "with a minimum depth of 50 cm 'are deleted.
59. Paragraph 35 (3) reads as follows:
"(3) Pool water or water to be showered in a cool house shall comply with the requirements laid down for pool water in artificial swimming pools except temperature and shall fulfil the cooling effect. Chemical and microbiological analysis of water shall be carried out once a month to the extent set out in Annex 8 to this Decree. Chemical testing, with the exception of the determination of the free chlorine content of swimming pools equipped with disinfectant equipment, is not necessary in the case of pools in which water is constantly and proportionally changed daily by drinking water, at least 30 litres per sauna visitor, and which are cleaned and refilled daily. No chemical or microbiological analysis of water is necessary in cooling showers connected to the distribution of drinking water. '
60. In Paragraph 35 (4), the word "chlorination 'is replaced by" disinfecting'.
61. In Paragraph 37 (1), the words "water-jet battery for" shall be inserted after the words "effluent with."
62. In Paragraph 37, at the end of paragraph 2, the words "with the exception of the space of the heating plant 'shall be added.
63. In the last sentence of Paragraph 39 (1), the word "generally 'is deleted and the word" normally' is inserted after the word "wind '.
64. In Paragraph 40, the second sentence is deleted.
65. In the title of Annex No 1, the words "operating on surface water, other surface bathing waters and bathing areas resulting from mining activities' are inserted after the words" swimming pools'.

Assessment and classification of bathing water in natural swimming pools operating on surface water, other bathing surface waters and bathing areas resulting from the extraction activity from a microbiological point of view
Unsatisfactory quality
Bathing water shall be classified as "non-compliant 'if, in the set of bathing water quality data over the last period considered, the 90 percentile of the results of the microbiological parameters listed in Annex 1 to this Decree are higher than those for" acceptable quality' set out in column D of Annex 1 to this Decree.

Acceptable quality
Bathing water is classified as "acceptable quality" water:
1. where, in the set of bathing water quality data for the last period under consideration, the 90 percentile of the results of microbiological indicators are equal to or less than the "acceptable quality" values set out in column D of Annex 1 to this Decree; and
2. if bathing water is susceptible to short-term pollution, provided that:
(i) adequate management measures, including supervision, early warning and monitoring, are taken to avoid the exposure of bathers to pollution by means of a warning or, where appropriate, a bathing ban;
(ii) adequate management measures are taken to prevent or reduce or eliminate the causes of pollution; and
(iii) the number of samples to be omitted for short-term pollution during the last period considered does not represent more than 15% of the total number of samples as set out in the monitoring calendar for that period, or not more than one sample in the bathing season, whichever is the higher.

Good quality
Bathing water shall be classified as "good ':
1. if, in the set of bathing water quality data over the last period considered, the 95 percentile of microbiological indicators are equal to or less than the "good quality" values set out in column C of Annex 1 to this Decree; and
2. if bathing water is susceptible to short-term pollution, provided that:
(i) adequate management measures, including supervision, early warning and monitoring systems, are taken to avoid the exposure of bathers to pollution by means of a warning or, where appropriate, a bathing ban;
(ii) adequate management measures are taken to prevent or reduce or eliminate the causes of pollution; and
(iii) the number of samples to be omitted for short-term pollution during the last period considered does not represent more than 15% of the total number of samples as set out in the monitoring calendar for that period, or not more than one sample in the bathing season, whichever is the higher.

Excellent quality
Bathing water shall be classified as "excellent ':
1. if, in the set of bathing water quality data over the last period considered, the 95 percentile of microbiological indicators are equal to or less than the "excellent quality" values set out in column B of Annex 1 to this Decree; and
2. if bathing water is susceptible to short-term pollution, provided that:
(i) adequate management measures, including supervision, early warning and monitoring systems, are taken to avoid the exposure of bathers to pollution by means of a warning or, where appropriate, a bathing ban;
(ii) adequate management measures are taken to prevent or reduce or eliminate the causes of pollution; and
(iii) the number of samples to be omitted for short-term pollution during the last period considered does not represent more than 15% of the total number of samples as set out in the monitoring calendar for that period, or not more than one sample in the bathing season, whichever is the higher.

"
69. In Annex 4, in the title of Table 1 and Table 2, the words "operating on surface waters, other surface bathing waters and bathing areas resulting from mining activities' shall be inserted after the words" swimming pools'.
70. In Annex 4, Table 2, the following row is added:

71. In Annex 4, in the explanatory notes under Table 2, the second sentence of Explanatory Note 1 is deleted and the following Explanatory Note 6 is added at the end of the Explanatory Notes:
'6. The evaluation of the measured value shall be carried out in the framework of the overall evaluation of the results as set out in Annex 6 to this Regulation. ';
72. In the title of Annex 5, the words "operating on surface waters, other bathing surface waters and bathing areas resulting from extractive activities' shall be inserted after the words" operating on surface waters and on bathing areas' and in the explanatory note under Table 2, the words "feathers of aquatic birds' shall be inserted after the words" fish '.

"Annex No 6 to Decree No. 238 / 2011 Coll.
Rules for the evaluation of water quality in natural swimming pools operating on surface water, other bathing surface waters and bathing areas resulting from mining activities
Each analysis shall be evaluated according to the following rules:
WATER FOR BEEPING (water quality indicator = 1)
General description: Defective water with low probability of developing health problems in water recreation with suitable sensory properties.
Make: The color of the mark is blue.
This degree shall be used if all the following facts have occurred:
- Sinuses did not reach the level I values listed in Annex 4 to this Decree at the last collection, or it is a swimming pool for which there is no need to monitor the sinuses in accordance with Section 6 (2).
- After evaluation of the microbiological parameters listed in Annex 1 to this Decree at the end of the past bathing season, the quality of the water in the swimming pool was classified as excellent.
- In the last sampling, the sensory properties of the water were not impaired and the transparency was greater than 1 m
WATER COMPLETELY BASED (water quality indicator = 2)
General description: Defective water with low probability of developing health problems in water recreation especially with impaired sensory conditions, if possible it is advisable to take a shower.
Make: The mark color is green.
This degree shall be applied if at least one of the following has been established, and none of the categories "water quality deterioration '," bathing water' and "bathing ban 'are used:
- Transparency in the last sample was less than 1 m. Decreased transparency shall not be evaluated if it is caused by typical natural opacity for the site but does not originate in the present organisms. However, in the case of reduced transparency, saving the weavers is difficult.
- Bathing water has been contaminated during the last collection (indicator 1 referred to in Annex 5 to this Decree) at level 1 and / or there is pollution of natural origin (indicator 2 referred to in Annex 5 to this Decree), at level 2.
- Following the evaluation of the microbiological parameters listed in Annex 1 to this Decree at the end of the past bathing season, bathing water quality was classified as good.
Water quality (water quality indicator = 3)
General description: Slightly increased probability of developing water recreation health problems, some susceptible individuals may already experience health problems, it is recommended to take a shower after bathing.
Make: The colour of the mark is orange.
This degree shall be applied if at least one of the following facts has been established, and none of the categories "water not suitable for bathing 'and" bathing ban' are:
- Sinews and chlorophyl- and from the last analysis exceeded the level I limits set out in Annex 4 to this Decree.
- After assessing the microbiological parameters listed in Annex 1 to this Decree at the end of the past bathing season, the quality of bathing water was classified as acceptable.
- Allergic reactions in susceptible individuals are shown to be associated with water recreation, but the observed water quality indicators correspond to the categories "Bathing water" or "Bathing water with slightly impaired properties."
WATER UNSUFFICIENT TO BACKGROUND (water quality indicator = 4)
General description: Water does not comply with hygiene requirements and presents a health risk to users, bathing and operating water sports cannot be recommended especially for children, pregnant women, people with allergies and people with weakened immune systems.
Make: The colour of the mark is red.
This degree shall be applied if at least one of the following facts has been established, and none of the "bathing ban 'categories are:
- Sinews and chlorophyl- and from the last analysis exceeded the level II limits set out in Annex 4 to this decree.
- After evaluation of the microbiological parameters listed in Annex 1 to this Decree at the end of the past bathing season, the bathing water quality has been classified as non-compliant.
- Bathing water has been contaminated during the last collection (indicator 1 referred to in Annex 5 to this Decree) at level 2 or 3 and / or present pollution of natural origin (indicator referred to in Annex 5 to this Decree), at level 3.
- Some other sensory properties such as odor, oil film, foam on the surface are such that recreational use of the site is practically excluded.
WATER UNSAFETY TO COUPLING
General description: Water does not comply with hygiene requirements and there is a risk of acute damage to health, a bathing ban is declared.
Make: The color of the mark is black.
This degree shall be applied if at least one of the following facts has been established:
- The last collection exceeded the level III limit values for water flowering or sinus and chlorophyll- and (the indicator in Annex 4 to this Decree). Bathing water is included in this stage even in the event of a water bloom exceeding the level III limit values outside the standard sampling point, provided that there is a real possibility for it to be quickly moved to the standard sampling point in the event of a change in the direction of the wind or in the case of a sinuses not forming water flowers, the level III limit values for the indicators of sinuses and chlorophyll- and (the indicators listed in Annex 4 to this Decree) have been exceeded.
- Repeatedly, at least one of the microbiological indicators referred to in Article 9 (7) has been exceeded.
- There is a reasonable suspicion that the health of bathers may be seriously jeopardised, in particular in the unexplained massive mortality of fish, even if the bathing water quality indicators are correct, or if an increased incidence of acute disease, the epidemiological signs of which indicate bathing water as a source of the disease, even if the specific agent is not found in the water.
Derogations from the procedure:
In the event that, in view of the circumstances, in particular the nature of the natural swimming pool and the sampling point, knowledge of other water quality data, the development of water quality on the assessed site in the past, the weather, the circumstances of sampling and analysis and other local specificities cannot be followed when assessing the quality of the water in the natural swimming pools, the above general procedure may be deviated from it in order to achieve a correct and up-to-date assessment of the water quality in the swimming pool.
Information to the public
Information to be submitted to the public pursuant to Article 12 (2) shall include:
