Government Regulation amending Government Regulation No. 515 / 2004 Coll., on material support for the creation of new jobs and material support for retraining or training of employees under investment incentives, as amended

GOVERNMENT REGULATION
of 22 March 2010
amending Government Regulation No 515 / 2004 Coll., on material support for the creation of new jobs and material support for retraining or training of employees in the context of investment incentives, as amended
The Government orders pursuant to § 111 (12) of Act No. 435 / 2004 Coll., on Employment:
Čl. I
Government Decree No. 515 / 2004 Coll., on material aid for the creation of new jobs and material support for retraining or training of employees under investment incentives, as amended by Government Decree No. 578 / 2004 Coll., Government Decree No. 338 / 2006 Coll. and Government Decree No. 68 / 2008 Coll., is amended as follows:
(1) Paragraph 2, including footnotes 2, 3, 7 and 8, reads as follows:
„§ 2
(1) The amount of material support for retraining or training of employees under investment incentives in a territorial area with an unemployment rate of at least 50% higher than the average unemployment rate in the Czech Republic, 25% of the costs of retraining or training employees (2).
(2) If, at the time of the submission of the application for material aid, the applicant is:
(a) small enterprise (3), in the territorial area referred to in paragraph 1, shall be 45% of the aid in kind;
(b) medium-sized enterprise (3), in the territorial area referred to in paragraph 1, the amount of aid in kind shall be 35%
the cost of retraining or training staff (2).
(3) In the case of retraining or training of workers with disabilities or disadvantaged workers pursuant to Commission Regulation (EC) No 800 / 2008 of 6 August 20087, the amount of material aid in the territorial area referred to in paragraph 1 shall be:
(a) small enterprises (3) 55%;
(b) medium enterprises (3) 45%;
(c) large enterprises (8) 35%
the cost of retraining or training such staff (2).
(4) In determining the amount of material aid for retraining or training, the costs provided for in the agreement agreed pursuant to Paragraph 111 (7) of the Act shall be based on the expected costs.
2) Article 38 in conjunction with Article 39 (2) of Commission Regulation (EC) No 800 / 2008 of 6 August 2008 declaring certain categories of aid compatible with the common market (General Block Exemption Regulation), as published in the Official Journal of the EU L 214 of 9 August 2008, in accordance with Articles 87 and 88 of the EC Treaty.
3) Article 2 (7) in conjunction with Annex I to Commission Regulation (EC) No 800 / 2008 of 6 August 2008.
7) Article 2 (18) of Commission Regulation (EC) No 800 / 2008 of 6 August 2008.
8) Article 2 (8) in conjunction with Annex I to Commission Regulation (EC) No 800 / 2008 of 6 August 2008. '
2. Paragraph 3 (2) and (3) read:
"(2) The number of new jobs in the case of the introduction of new production shall be determined on the basis of the average number of employees in the last calendar month provided for in the Agreement for the creation of jobs. If the agreed number of jobs created is not detected during this period, the number of new jobs shall be determined in the case of the introduction of new production according to the average number of employees converted over the period of 3 calendar months following the deadline laid down for the creation of jobs under the agreement.
(3) The number of new jobs in the case of an extension of existing production shall be determined as the difference between the average annual number of employees in the last calendar month provided for in the Agreement for the creation of jobs and the average annual number of employees in the 12 calendar months preceding the submission of the investment project by the employer. If the agreed number of jobs created is not determined in this way, the number of new jobs in the case of the extension of production to date shall be determined as the difference between the average number of employees in the three calendar months following the deadline laid down under the agreement for the creation of jobs and the average number of employees in the 12 calendar months preceding the submission of the investment project by the employer. ';
3. In Paragraph 5 (2), "EUR 1 000 000 'is replaced by" EUR 2 000 000'.
4. footnote 6:

Čl. II
Transitional provision
Pursuant to Article 3 (2) and (3) of Decree-Law No 515 / 2004 Coll., as effective from the date of entry into force of this Regulation, the procedure shall also apply,
(a) if the date laid down under the Agreement for the creation of posts is up to the date of entry into force of this Regulation; or
(b) if the deadline laid down under the Agreement for the creation of posts has not been established before the date of entry into force of this Regulation and the agreed number of posts has not been established in accordance with Government Regulation No 515 / 2004 Coll., as effective by the date of entry into force of this Regulation. "
Čl. III
Efficacy
This Regulation shall take effect on the 15th day following its publication.
