GOVERNMENT REGULATION
of 8 April 2015
on rules for the organisation of the Office
The Government orders pursuant to § 205 (a) of Act No. 234 / 2014 Coll., on the Civil Service:
§ 1
Basic provisions
(1) The organisational structure of the Office shall consist of the organisational departments and posts, posts and, where appropriate, posts where work is carried out in the context of other legal relations (hereinafter referred to as the "systematic post"), which are included in or outside the organisational unit.
(2) The organisational body is the department, department and section. The Ministry of Foreign Affairs also has a representative office.
(3) In particular, a systemised place classified outside the organisational unit shall be the place of a member of the government, a Deputy Member of the Government, a Head of Staff and a representative of the Head of Staff, if the systemised post establishes other legislation.
§ 2
Systemised sites
(1) Systemised sites included in the organisational unit generally contain related administrative activities or work.
(2) Systemised site
(a) the place of employment, shall include the administrative activities required to carry out it and shall be classified by the grade to which the most demanding administrative activity is included in the catalogue of administrative activities;
(b) a job, comprising the work required and classified by the grade in which the most demanding work is included in the catalogue of public service work and administration;
(c) the registered office shall be established at the head of the organisational department in which the public service or the service office is served and shall be classified by the grade in which the most demanding administrative activity carried out in the organisational unit or in the service office of which the head is situated is included in the catalogue of administrative activities;
(d) the post of Head of Staff shall be set up at the head of the organisation body in which the public service or the service is not performed and shall be classified as a grade in which the most demanding work carried out in the organisational unit or in the service office of which the senior staff member is headed is included in the public service and administration catalogue.
Organisational services
§ 3
(1) A separation may be established if it is made up of at least 6 systemised sites.
(2) If the average number of systemised departments in the service office is not less than 6 after rounding to an integer, the department may be established if it is at least 4 systemically located. The calculation of the average number of systemised sites forming departments shall not include systemised sites included in the separation pursuant to § 6 (2) and § 7 (2) and in the organisational unit under § 8, if it is a separation.
(3) The Head of Department in the Ministry or Government Office shall be under the direct authority of the Director of the Department, the Head of the Representative Office, the Head of the Section, the Secretary of State, the Chief Secretary of State or a member of the Government. The Head of Unit in another Staff Office shall be directly under the authority of the Director of the Department, the Director of the Section, the Head of Staff or his representative, if this systemised post establishes any other legislation.
§ 4
(1) The Department may be set up if it consists of at least 13 systematic locations, including at least 2 systematic positions of the Heads of Unit.
(2) If the average number of systemised posts in the service office is not less than 13 after rounding to an integer, the department may be set up if it consists of at least 9 systemically located locations including at least 2 systemically located units of the head of department or at least 1 systemically located department head and at least 2 systemically located places directly subordinate to the head of department. The calculation of the average number of systemised sites forming the department shall not include the systemised sites included in the section referred to in paragraphs 3, 6 (1) and 7 (1) and in the organisational unit referred to in paragraph 8, if it is a trade union.
(3) Department
(a) a place of work which carries out tasks within the limits of the territorial scope of the service or which forms part of such work;
(b) part of a non-national office; or
(c) part of an office whose organisational structure is always approved by the head of it;
it may be set up if it consists of at least 9 systematic locations including at least 2 systematic positions of the Head of Unit or at least 1 systematic position of the Head of Unit and at least 2 systematic locations directly subordinate to the Head of Department.
(4) The Head of the Department in the Ministry or Government Office shall be under the direct authority of the Head of the Section, the Secretary of State, the Secretary of State or a member of the Government. The head of the department in another service office shall be directly under the authority of the Director of the Section, the Head of Staff or his representative, if he establishes any other legislation in this systemised post.
§ 5
(1) A section may be set up if it consists of at least 40 systematic locations including at least 2 systematic positions of the directors of trade unions or at least 1 systematic position of the head of the department and at least 1 systematic position of the head of the department directly subordinate to the head of the section or the head of the section. The minimum number of systemised posts of the directors of trade unions or heads of departments shall not include the systemised position of the head of the head of the head of the head of the section or the office of the head of the section, if the office of the head of the section is the department.
(2) The section headed by the Secretary-General of State or the Secretary-General of State may be set up even if it is composed of a number of systemised sites less than those laid down in paragraph 1.
(3) The Head of the Section is under the direct authority of a member of the Government or of the Head of the Government Office. The Head of the Section shall be under the direct authority of the Head of Staff or his representative, if he establishes any other legislation on this systemised post.
§ 6
(1) The office of representative shall have the status of department. Paragraph 4 on the minimum number of systematic posts shall not apply to the representative office.
(2) The Plenipotentiary Office may be divided into departments. Paragraph 3 on the minimum number of systematic posts shall not apply to the department of the representative office.
(3) The Head of the representative office shall be under the direct authority of the Head of the Section.
§ 7
(1) The cabinet of a member of the Government shall have the status of department. Paragraph 4 on the minimum number of systematic posts shall not apply to the cabinet of a member of the government.
(2) The cabinet of a member of the government may be divided into departments. Paragraph 3 on the minimum number of systematic posts shall not apply to the cabinet of a member of the government.
(3) The Cabinet Director of a Member of the Government shall be directly subordinate to a member of the Government in the Ministry and in the Government Office.
(4) The cabinet of a member of the government shall include the posts of advisers and staff who carry out other activities falling within the competence of a member of the government.
(5) The number of posts included in the cabinet of a member of the government shall be determined proportionally in relation to the total number of posts systemised in the service office and taking into account the scope of the service office.
§ 8
(1) As a general rule, a government member's office shall be established in the Ministry and in the Office of the Government, which shall be an organisational body, in particular providing support to a member of the Government in the exercise of his or her management activities and in the performance of his or her duties as a member of the Government. As a rule, the head of the office of a member of the government is directly subordinate to a member of the government.
(2) As a general rule, an office of the Head of Staff shall be set up in a service office without a member of the Government, which shall be an organisational unit, in particular providing support to the Head of Staff in the performance of his management activities. As a general rule, he who heads the Office of the Head of Staff shall be subject to the authority of the Head of Staff.
(3) It is possible to establish in the Ministry and in the Office of the Government the office of the Head of the Section, which is an organisational body, in particular providing support for the Head of the Section in the performance of its management activities. The head of the head of the head of the head of the section is directly subordinate to the head of the section.
(4) In the Civil Service section, it is possible to set up an office of the Secretary-General of the State, which is in particular an organisational body ensuring the support of the Secretary-General of the State in the performance of his management activities. The head of the Office of the Secretary-General of the State is directly subordinate to the Secretary-General of the State.
(5) It is possible to establish an office of the Secretary of State in the Ministry and the Office of the Government, which is an organisational body, in particular, ensuring the support of the Secretary of State in the performance of its management activities. The head of the State Secretary's office is under the direct authority of the Secretary of State.
(6) The office of the Director of the Section may be set up in another service office, which is in particular an organisational body ensuring the support of the Director of the Section in the performance of its management activities. The head of the office of the head of the section is directly under the authority of the section director.
§ 10
The name of the organisation body shall include the designation "separation '," department' or "section '. Where it is not possible or appropriate to indicate this designation in the name of the organisation body, the organisational structure of the service office shall indicate to such organisation body which organisational unit of the service office is responsible for.
§ 11
(1) The Secretary-General shall be subordinate to an organisational unit which shall ensure the organisational matters of the Civil Service, the administration of professional, labour and other legal relations which are the subject of work and remuneration.
(2) In addition, the Secretary-General may be subordinate to an organisational unit which performs cross-cutting tasks for all fields of competence of the Office or tasks related to the organisation, property, economic, technical or other similar security of the Office's activities.
Characteristics of the post
§ 11a
(1) The characteristics of the post in the section concerning the description of the post shall include:
(a) an identification number of the post under the civil service information system or an identification number of the post under the office's operational information system;
(b) the designation of the official office and the organisational department;
(c) an indication of the branch or branches of the civil service;
(d) an indication of the grade; and
(e) the code of the most demanding administrative activity and its citation according to the catalogue of administrative activities or the designation of the most demanding administrative activity not specified in the catalogue of administrative activities; the code of the most demanding administrative activity including the citation of the most demanding administrative activity or the designation of the most demanding administrative activity shall be indicated for each branch of the public service.
(2) The characteristics of the post in the section concerning the description of the post may also include:
(a) an indication of the duration of the post;
(b) an indication of the place of work or the place of employment;
(c) an indication of the required education, provided that the service authority has determined that the post may be filled by a civil servant or a person who has obtained a lower education than that provided for in the Civil Service Act for that post,
(d) an indication of the prohibition of competition, where provided for in the place of employment;
(e) an indication of the requirement for citizenship of the Czech Republic, if specified for the post of service,
(f) an indication of the requirement of the field or training, if specified for the post of service;
(g) an indication of the requirement for the level of knowledge of a foreign language, if specified for the post of service;
(h) an indication of the requirement to have access to classified information under the legislation governing the protection of classified information, where provided for by the service post;
(i) an indication of the requirement for the duration of the previous performance of a national service or activities similar to those provided for in the post;
(j) an indication of any other requirement needed for the performance of the public service, if provided for in the post;
(k) an indication that the post is financed from sources other than the State budget; and
(l) other information as specified by the Office.
(3) The characteristics of the post in the section concerning the description of the activities required to be carried out at the post include other administrative and other activities required to be carried out at the post, marked as follows:
(a) activities carried out under conditions associated with neuropsychological stress and the likely risk of life and health or of the difficult performance of the public service including the degree of neuropsychological burden and the likelihood of life and health risk;
(b) activities carried out in a difficult working environment;
(c) night-time activities; and
(d) activities classified in the second, third or fourth categories according to the degree of occurrence of factors which may affect the health of workers and their risk to health under the legislation governing the protection of public health.
(4) The characteristics of the post in the section concerning the description of the activities to be carried out at the post may also include:
(a) an indication of the activities the execution of which requires the conclusion of an agreement on liability to protect the values entrusted to the public servant for billing; and
(b) other information as specified by the Office.
(5) The characteristics of the staff member may also include the part concerning the description of the duties relating to the performance of the activities required at the post. The characteristics of the post may include, in the part referred to in the first sentence:
(a) an indication of the authorisation to represent the representative, including the designation of the post of employment and the extent of the activities in which the representative is represented;
(b) an indication of the extent of eligibility to have access to classified information under the legislation governing the protection of classified information;
(c) an indication of the authorisation for the processing of personal data and an indication of the conditions and scope of that authorisation;
(d) an indication of the signing authorisation and an indication of the conditions and scope of that authorisation; and
(e) other information as specified by the Office.
(6) The administrative activities required to be carried out at the post shall be determined in accordance with the competence of the Office and taking into account its organisation and division between the departments of the Office.
§ 11b
The service authority shall present the characteristics of the post, if requested by the Ministry of the Interior or the competent central administrative office in connection with the submission of a draft systemisation or its amendments or proposals for the organisational structure of the service office or its amendments, or if requested by the administrative authority in the process of service relations.
§ 12
Transitional provision
The Office shall bring its organisational structure into line with this Regulation by 30 June 2015.
§ 13
Efficacy
This Regulation shall enter into force on the day of its publication.
