laying down the method of labelling textile products with information on the composition of the material
The Ministry of Industry and Trade provides pursuant to § 28a (b) and (c) of Act No. 634 / 1992 Coll., on Consumer Protection, as amended by Act No. 104 / 1995 Coll.:
§ 1
This decree implements the relevant regulations of the European Community1), and provides for
(a) details of the labelling of textile products,
(b) an overview of the names of each type of textile fibre and their description;
(c) the contractual increases used to calculate the weight of fibres contained in textile products;
(d) a list of textile products which are not subject to mandatory labelling by particulars of the composition of the material;
(e) a list of products which may be labelled with a common designation.
§ 1a
Labelling of fibres
(1) The names of the fibres used in the labelling of textile products and their description are set out in Annex 1 thereto.
(2) The use of the names listed in the table of Annex 1 to this Decree is reserved for fibres the essence of which is specified in the same heading of the table. These names may not be used for any other fibre, either separately, nor as the basis of the word, nor as an adjective.
(3) The labelling of each fibre type uses their full species names. For textiles intended for further processing, abbreviation may be used instead of full fibre names, which must be explained in the accompanying documents.
(4) The term "silk" may not be used to indicate the shape or special design of continuous textile fibres.
(5) For textile products for which it is difficult to determine their composition at the stage of production, the term "fibre mixture" may be used.
§ 2
Labelling of textile products of one type of fibre
(1) A textile product composed of only one type of fibre shall be marked with "100%" and the name of the fibre. This may be replaced by the name "clean 'or" z' only.
(2) A textile product marked in accordance with paragraph 1 may contain up to 2% of foreign fibres of the total weight of fibres contained in the product, provided that this quantity is justified for technical reasons. This tolerance is increased to 5% for textile products made from carded yarn.
§ 3
Labelling of textile products of two or more types of fibres
(1) A textile product composed of two or more types of fibres, of which one species is at least 85% of the total weight, shall be labelled as follows:
(a) the name of the type of fibre followed by a percentage indication of its weight; or
(b) the name of the type of fibre followed by the expression "at least 85%"; or
(c) full indication of the material composition of the product as a percentage.
(2) A textile product consisting of two or more types of fibres, of which no type is less than 85% of the total weight, is identified by the name and percentage of at least two main types of fibres. This indication shall indicate the names of the other fibres contained in the product in descending order of their proportion of the total weight of the product. The names of these fibres may be supplemented by a percentage.
(3) Types of fibres which make up less than 10% of the total weight of the product may be collectively labelled as "other fibres," indicating their total percentage. However, if the name of the fibre type whose proportion of the composition of the product is less than 10% is given, then the full composition of the material of the product shall be given as a percentage.
(4) Textile products having a pure cotton warp and a pure flax weft, where the percentage of flax is at least 40% of the total weight of the non-pollinated fabric, may be labelled as "cotton-flax mixture" and the specification "pure cotton-warp weft" must be supplemented.
§ 4
Tolerance of the composition of textile material of two or more types of fibres
(1) When indicating the composition of the material:
(a) the quantity of foreign fibres up to 2% of the total weight of the product shall be tolerated if this occurrence is justified by technical reasons; This tolerance is increased to 5% for products that have undergone carding operations,
(b) a production tolerance of 3% between the percentage of fibres indicated in the label and the percentage of the fibre determined by analysis is allowed, (1) in relation to the total weight of fibres in the product after deduction of the weight of foreign fibres, if any, determined in accordance with (a). This tolerance shall also apply to:
1. to fibres listed in descending order according to their representation in the product without indication of the percentage referred to in Article 3 (2);
2. the proportion of wool fibres referred to in Article 5 (2) (b).
(2) The cumulation of tolerances referred to in paragraph 1 shall be allowed only where it is found that any foreign fibres identified during the analysis (1) subject to the tolerance (a) have the same chemical nature as one or more types of fibres in the product.
(3) For special textile products where production technology requires higher tolerances than those referred to in paragraph 1, higher tolerances may be allowed only in exceptional cases and where the manufacturer gives appropriate justification.
(4) It is not necessary to indicate visible and insulating fibres in the material composition data which are intended for decorative purposes only and do not exceed 7% of the total weight of the finished product. The same applies to fibres which are added to the product for achieving an antistatic effect (e.g. metallic fibres), which do not exceed 2% by weight of the finished product.
§ 5
Labelling of textile products containing wool
(1) A wool product may only be labelled with the term "cut wool" if it is composed exclusively of fibres which have not previously been part of the finished product, have not been subjected to any spinning or felting process other than that required in the manufacture of that product and which have not been damaged by processing or use.
(2) The term "cutting wool" may be used to describe wool fibres contained in a fibre mixture if:
(a) all wool fibres contained in this mixture comply with the requirements laid down in paragraph 1; or
(b) the fibre content consists of at least 25% of the total weight of the mixture; or
(c) in the case of a washed mixture, the wool fibres are only mixed with 1 additional fibre.
In such cases the complete composition of the mixture material shall be given as a percentage.
(3) Tolerance justified by production technology is a maximum of 0,3% of fibre additives for the products referred to in paragraphs 1 and 2 and applies also to wool products which have undergone the washing process.
§ 6
Labelling of textile products when they are placed on the market
(1) The textile products covered by this Decree shall be labelled or labelled with a similar label, which shall include particulars of the composition of the material whenever marketed for commercial or manufacturing purposes.
(2) Where textile products are not intended for sale to the consumer, the labelling referred to in paragraph 1 may be replaced or supplemented by commercial documents. In commercial documents, the names of the fibres and other particulars of the composition of the material must appear in accordance with the provisions of this Decree. The use of abbreviations of fibre names is permitted only if they are explained in the document in which they are used.
(3) The information on the composition of the material on labels, tags, packages, directly on the product, in commercial documents, catalogues, etc., shall be clearly printed.
(4) Information which does not relate to the subject matter of the amendment of this Decree is given in such a way that it cannot be confused with data on the composition of the material. This information shall be reported separately. However, where a textile product is intended for sale to the consumer and a trade mark or mark of the entrepreneur is included either separately or as an adjective or as a basis for the word one of the names listed in Annex 1 to this Decree, or an expression which might be confused with it, the trade mark or mark of the entrepreneur shall be indicated immediately before or after the composition of the material.
(5) Where textile products are offered for sale or sold outside the territory of the State, the supplier shall ensure that labelling or additional labelling is carried out in an official language used in the territory of the customer.
§ 7
Labelling of textile products consisting of two or more parts
(1) In the case of a textile product consisting of two or more parts with a different composition of material, the data on the material composition shall be provided for each part. Only the main linings are mandatory for parts which make up less than 30% of the total weight of the product.
(2) The marking of each part shall be made in such a way as to make it clear to which part the material composition data relate.
(3) For the textile products referred to in paragraphs 4 to 9, the labelling of the composition of the material may be made by either indicating the composition of the product as a whole or indicating the material composition of each part.
(4) For the following corseting goods, the composition of the material shall be indicated either by establishing the composition of the whole product or the composition of the following ingredients, either cumulatively or individually:
(a) in the case of bras, inner and outer fabrics of cupcakes and rear parts,
(b) in the case of front, rear and side mounting parts,
(c) in the case of corsets, the outer and inner fabric of the cups, the front and rear reinforcing parts and the side parts.
For corseting products not referred to in points (a) to (c), the composition of the material shall be indicated either for the whole product or, cumulatively or individually, for each part of the product, and the labelling shall not be compulsory for those parts which represent less than 10% of the total weight of the product.
(5) In the case of fabrics etched with printing, the composition of the material shall be reported cumulatively for the whole product and the composition of the basic fabric and of the imprinted fabric may be specified separately.
(6) In the case of embroidered textile products, the composition of the material shall be reported cumulatively for the whole product. However, the composition of the basic fabric and embroidery yarns may be specified separately. If the embroidered parts form less than 10% of the surface of the product, it is sufficient to indicate the composition of the basic fabric.
(7) For kernel yarns where the kernel and packaging are composed of different fibres, the composition of the material shall be reported cumulatively for the whole product and the composition of the kernel and the composition of the packaging may be specified separately.
(8) In the case of velvet, plush and similar products, data on the composition of the material should be reported cumulatively for the whole product. Where the basic fabric is clearly distinguished in the product and the utility layer consists of other fibres, the composition of these parts may be indicated separately.
(9) In the case of floor fabrics and carpets where the backing fabric and the utility layer are made up of different fibres, only an indication of the material composition of the utility layer may be given, which must be named.
(10) Where two or more textile products form one sales unit and the material composition of such products is the same, they may be labelled with only one label.
§ 8
Textile products not subject to mandatory labelling with material composition information
The textile products listed in Annex 3 to this Decree are not subject to mandatory labelling with regard to the composition of the material. However, where such products are labelled or otherwise marked, the method of labelling shall be governed by the provisions of this Order.
§ 9
Textile products which can be labelled with a common label
(1) The textile products listed in Annex 4 to this Decree, which are of the same type and composition, may be labelled with a common label containing the particulars of the composition of the material provided for in this Decree.
(2) The data on the material composition of textile products sold in the piece or on the canvas intended for sale shall be marked.
(3) The products referred to in paragraphs 1 and 2 shall be marked in such a way that the consumer can fully understand their composition.
§ 10
Ingredients not taken into account for the determination of the material composition
(1) When determining the percentage of fibres in textile products, the ingredients referred to in paragraphs 2, 3, 4 and 5 shall not be included in the total product weight.
(2) All textile products are disregarded:
(a) non-textile parts, trimmings, labels and labels, bordums and braids, provided that they do not form an integral part of the product, buttons and buckles covered with textile material, accessories, ornaments, ribbons, elastic yarn and strip incorporated in specified and specified places of the product;
(b) visible and insulating fibres of a purely decorative nature and antistatic fibres referred to in Article 4 (4);
(c) fatty substances, binders, fillers, scouring and preparation products, impregnating materials, dye and printing aids and other textile auxiliary preparations; the quantities of such ingredients shall not mislead the consumer.
(3) In the case of floor textiles and carpets, all parts not forming a useful surface shall not be taken into account.
(4) For covering fabrics, hinges and curtains, binding and filling warp and weft yarns which do not form part of the face of the fabric shall not be taken into account.
(5) For other textile products no account is taken of:
(a) underfabrics, reinforcing liners, stiffeners, linings, linings and other reinforcing elements;
(b) sewing thread and linking thread, unless they replace warp or weft yarn in the fabric;
(c) fillings, unless they have an insulating function;
(d) lining, provided that the provisions of Section 7 (1) do not apply to them.
(6) The base or base materials of textile products which serve as a basis for the use of the surface, in particular for blankets and double fabrics, and the reverse side for velvet, gums and similar products, shall not be regarded as removable ground fabrics.
(7) Reinforced inserts and pencils means yarn or materials incorporated into the specified places of the products in order to increase their stiffness or thickness.
§ 11
Methods for sampling for determining the material composition
(1) The verification of compliance of the composition of textile material with the information provided under this Decree is carried out in accordance with specific rules. (1a)
(2) The contractual increases listed in Annex 2 to this Decree shall be used to calculate the shares of each fibre type.
§ 12
Decree No. 132 / 1996 Coll., laying down the details of the labelling of textile products with data on the composition of the material, is hereby repealed.
§ 13
Efficacy
This Decree shall take effect on 1 July 1999.
