DECLARATION
of 2 January 2006
amending Decree No. 302 / 2001 of the Ministry of Transport Coll., on technical inspections and measurement of vehicle emissions, as amended by Decree No. 99 / 2003 Coll.
The Ministry of Transport provides, pursuant to Section 91 (1) of Act No 56 / 2001 Coll., on the conditions for the operation of vehicles on the road and amending Act No. 168 / 1999 Coll., on the liability insurance for damage caused by the operation of a vehicle and on the amendment of certain related laws (Act on the insurance of liability for the operation of a vehicle), as amended by Act No. 307 / 1999 Coll., as amended, ("Act ') to implement § 44 (6), § 45 (1), (5) and § 60 (3), § 62 (2), § 63 (6), § 66 (3), § 67 (1) (b) and (c), § 69 (3), § 71 (3), § 72 (3) and § 79 (5):
Decree No. 302 / 2001 Coll., on technical inspections and measurement of vehicle emissions, as amended by Decree No. 99 / 2003 Coll., is amended as follows:
1. In Article 2 (2), point (e) is replaced by the dot and point (f) is deleted.
2. In the first sentence of Article 2 (5), the words "outside the apparatus referred to in paragraph 2 (e) 'shall be inserted after the words" to measure emissions'.
3. In Paragraph 4 (2), the words "smoking leave 'are replaced by the words" corrected absorption coefficient'.
4. In Article 8 (1), the words "the following types of roadworthiness tests' shall be inserted after the words" they carry out ':
5. In Paragraph 8, the dot is replaced by a comma at the end of paragraph 1 and the following point (g) is added:
"(g) a technical inspection prior to registration of the vehicle.";
6. In Article 8, the sentence "The term repeated technical inspection shall also apply to the types of roadworthiness tests referred to in paragraph 1 (c), (d) and (g) at the end of paragraph 4. ';
7. In Article 8, the following paragraph 9 is added:
"(9) Technical inspection prior to registration of a vehicle means a technical inspection of a vehicle whose technical competence has already been approved, but the vehicle has not yet been registered in the Czech Republic. This technical examination shall be carried out in full, respecting the particularities of the vehicle and its documents as specified in Annex 20 to this Regulation. ';
8. Paragraph 9 (1) reads as follows:
"(1) The applicant for the technical inspection shall provide the technical inspection centre with the documents, depending on the type of technical inspection required, in accordance with Annex 20 to this Regulation."
9. In Paragraph 11 (4), "paragraph 1 'is replaced by" paragraph 2';
10. In Article 12, the following paragraph 1 is added:
"(1) The technical inspection report shall be drawn up immediately after the completion of the technical inspection, according to the information contained in the fault log, which means the form containing the completed vehicle data checked by the control technician and in which, during the technical inspection, it records the defects and notes found. The fault logger shall be kept at the technical inspection station together with the technical inspection protocol which has been issued on its basis. ';
Paragraphs 1 and 2 shall become paragraphs 2 and 3.
11. in Article 12 (2), the following point (j) is inserted after point (i):
"(j) the result of the check;"
Points (j) to (m) shall be renumbered as points (k) to (n).
12. in Article 12 (2) (m), the words "and the registration number of the professional certificate" shall be inserted after the word "name."
13. in Paragraph 12 (3):
"(3) The model of the technical inspection and inspection report is set out in Annex 10."
14. Paragraph 14, including the title, reads:
Technical inspection station information system
(Paragraph 48 (4) of the Law)
(1) The operation of technical control stations is recorded and evaluated in an automated technical control station information system (hereinafter referred to as "automated system"), which is a centralised real-time information system.
(2) The basic function of an automated system is the creation of protocols for technical inspection, registration of control stickers, and real-time collection and storage of data in the system administrator's data repository. This data is archived and evaluated here. Printing of technical inspection logs is possible only from these data and only by the system administrator's programme.
(3) The technical inspection stations shall, via the user interface established by the system administrator, enter up-to-date information on the technical inspections carried out. Communication within an automated system takes place through a permanent internet connection of the technical control station.
(4) The system administrator shall allocate access rights to technical inspection stations for access to the automated system. Access to the application is carried out in a secure way through the public Internet network through an encrypted communication channel using modern, standardised and powerful cryptographic methods and protocols. The multiple authentication and authorization of authorised users is based on the access list of authorised non-changing addresses clearly identifying the client computer on the Internet ("fixed addresses') and on the strong cryptographic identification of users using qualified certificate technology located on the prescribed repository of user's computer environment certificates. The certificate shall only be allocated by the system administrator to a person who has completed the test training and holds an automated system operator certificate. The certificate shall be limited in time.
(5) In order to ensure the operation of the automated system (collection and transmission of information), the technical inspection station shall be equipped with an adequate technique:
(a) by a personal computer,
(b) reliable and fast enough connection to a public Internet network with a fixed address to be registered in the list of authorised fixed addresses of authorised client computers of each technical control station;
(c) prescribed software for safe access to an automated system using virtual private network technology using strong standardised cryptographic algorithms and protocols;
(d) a valid qualified certificate located on the prescribed safe storage site of the user's computer environment certificates (e.g. in a special hardware token, etc.).
(6) A technical inspection station for special vehicles only may be equipped with a connection to the Internet other than that referred to in paragraph 5 (b) for communication within an automated system.
(7) The provisions of paragraphs 1 to 6 shall not apply to technical inspection stations which conduct only technical inspections of vehicles of the Ministry of Interior, Ministry of Defence, Police of the Czech Republic and Security Information Services. "
15. in Article 15, the following point (c) is inserted after point (b):
"(c) a combined technical inspection station for motor vehicles of categories L, M1, N1, O1 and O2, M2, M3, N2, N3, O1, O2, O3 and O4 and special motor and trailers of categories T, OT1, OT2, OT3 and OT4 (technical control stations combined for passenger and commercial cars), ';
Point (c) shall be renumbered (d).
16. in Article 15, the following point (e) is added:
"(e) the scope of the technical inspection station for passenger cars may be extended to carry out roadworthiness tests for special vehicles of categories T, OT1, OT2, OT3 and OT4."
17. in Article 16 (1), the words' be passable and must 'shall be inserted after the words' cars must '.
18. In Article 16 (2), the words "be passable and must 'shall be inserted after the words" commercial vehicles'.
19. in Paragraph 16 (3), the first and second words "Control line capacity" are replaced by "Theoretical control line capacity."
20. In Article 16, the following paragraphs 9 and 10 are inserted after paragraph 8:
"(9) The requirement of equipment in accordance with the requirements of paragraph 8 (d) and (e) shall also apply to technical inspection stations for special vehicles.
(10) The individual workstations of the control line of the technical inspection station shall be equipped with well-readable lists of inspection operations carried out at these workplaces. ';
Paragraph 9 shall become paragraph 11.
21. The following Section 16a is inserted after Section 16, which includes the title:
Method and scope of coverage of the administrative perimeter by technical inspection stations
(Paragraph 54 (6) of the Act)
(1) The method and scope of the coverage of the administrative district by the technical inspection stations shall be determined on the basis of an assessment of the capacity needs of the administrative district and the capacity of the technical inspection stations. The assessment shall not result in an excess of the capacity requirement of the roadworthiness tests of the district area which is part of the administrative district of the region concerned and in which the technical inspection station under consideration is to be operated or of more than 20% exceeding the capacity requirement of the territory of the region concerned.
(2) The method of calculating the capacity needs of the administrative circuit and the theoretical capacity of the control lines of the technical inspection stations is set out in Annex 19. The scope of the administrative coverage of the technical inspection stations' activities is exceeded,
(a) where the capacity requirement for roadworthiness tests of the type of vehicle concerned is lower than the sum of the theoretical or, if known, the actual capacity of the technical inspection stations in the relevant administrative district determined in accordance with Annex 19, including those for which a technical inspection station authorisation has already been granted; or
(b) where the difference between the capacity requirement for roadworthiness inspections of the type of vehicles concerned in the administrative district and the sum of the theoretical or actual capacities of all technical inspection stations in the administrative district constitutes less than 60% of the theoretical capacity of the newly considered technical control line determined in accordance with Article 16 (3).
(3) The provisions of paragraphs 1 and 2 do not apply to technical inspection stations which only carry out technical inspections of vehicles of the Ministry of Interior, Ministry of Defence, Police of the Czech Republic and Security Information Services. "
22. In the heading of Section 17, the words "K § 57 (3) of the Act 'are replaced by" K § 57 (5) of the Act'.
23. in Paragraph 23 (4):
"(4) An emission measurement station may also be operated by a technical inspection station operator if it complies with the conditions set out in paragraph 3, or whose personnel meet the requirements of specialised mechanical training referred to in paragraph 7, and if it has technical equipment and documentation for the vehicles of the factory brands for which the emission measurement will be carried out. The emission measurement site shall be separate and shall be situated outside the control line of the technical control station. ';
24th Paragraph 23 (7) reads as follows:
"(7) The mandate of the vehicle manufacturer or the manufacturer of the emission system, represented by the trade agreement on the service representative (the contract repairer), may be replaced by the specialised training of mechanics in training equipment aimed at diagnosing and repairing vehicle emission systems. Training facilities shall be entrusted to the Ministry for this purpose. The provision of educational services shall not be linked to other business activities and documentation shall be provided at a reasonable and non-discriminatory price. ';
25. In Annex No 1, footnote 1, the words "Institute for the Research of Motor Vehicles s. r. o. 'are replaced by" TÜV UVMV s. r. o.';
26. In the fourth sentence of paragraph 3 of Annex 3, the words "approved type 'are replaced by the words" approved requirements'.
27. In Annex 5, the second sentence is replaced by the following: "The emission measurement certificate shall be 19 cm × 7 cm and shall be folded in half of the length. '
28. in Annex No 12, the following point 8 is inserted after point 7:
'8. Vehicle identification marks (group checks 100) '.
Points 8 to 16 shall be renumbered 9 to 17.
29. In Annex No 12, the following point 16 is inserted after point 15:
"16. Prescribed and special equipment (group checks 900 operations) '.
Points 16 and 17 shall become points 17 and 18.
30. the following Annexes 19 and 20 are inserted after Annex 18:

Method for calculating the capacity needs of the administrative circuit and the capacity of the technical inspection stations
In order to determine the capacity needs of the administration circuit (in terms of ensuring the necessary number of technical inspections), the number of vehicles registered in that administrative circuit shall be based on the number of vehicles registered in that administrative circuit. The different types and categories of vehicles shall be converted by calculation into the basic type of vehicle which is a passenger car (OA) or utility car (UA). In particular, the number of vehicles of categories M1, N1, O1, O2 and L is converted into OA, M2, M3, N2, N3, O3 and O4 into UA. This gives the so-called adjusted number of OA or UA, hereinafter referred to as OAU or UAU.
1. Calculation of the necessary capacity (number) of roadworthiness tests for the administrative district
In addition to the number of vehicles registered in the administrative district, the calculation shall include the different performance of the roadworthiness tests (hereinafter "TPr ') of vehicles of categories O and L with regard to car vehicles. The operation of TPr of vehicles of categories O and L is approximately half of the vehicle and is expressed in kp (kp = 0,5).
The calculation shall also take into account the different deadlines for the regular TPr against passenger cars, as follows:
(a) for trailers, by a coefficient (double period, four years, a = 0,5);
(b) for motorcycles, by a coefficient b (period 2 or 4 years, b = 2 / 3),
1.1. Required STK capacity for OA
The adjusted number of OA for the given administrative circuit shall be calculated from the formulae:
OAu = M1 + N1 + a.kp.O1 + O2 + b.kp.L
After setting the coefficients:
OAu = M1 + N1 + 0.25.O1 + O2 + 0,33.L
The required annual capacity of OA, PKOA roadworthiness tests shall be calculated by multiplying the adjusted number of OAU by the coefficient kOA. The kOA coefficient shall take into account:
(a) number of OA under 4 years coefficient c (it is considered that 14% of OA is below 4 years; c = 0,14)
(b) the need for repeated roadworthiness tests, the oOA coefficient (10% of repeated inspections are expected; oOA = 0,10);
(c) the period of periodic roadworthiness tests of the OA coefficient lh = 2 years;
(d) the need for registration checks, which represent an increase in capacity entitlements by 7%. It is expressed by the coefficient eOA = 0,07.
kOA = 1-c.1 + oOA.1 + eCOA / lh
kOA = 1-0,14.1 + 0,10.1 + 0,07 / 2 = 0,506
Capacity requirement of STK roadworthiness tests for OA:
PKOA = kOA.OAU = 0,506. OAU
1.2. Required STK capacity for UA
The adjusted number of UA for a given perimeter shall be calculated from the formula:
UAU = M2 + M3 + N2 + N3 + kp.O3 + O4
After setting the coefficient:
UAU = M2 + M3 + N2 + N3 + 0.5. O3 + O4
For commercial cars, 15% of repeated inspections (oUA = 0,15), the period of periodic roadworthiness tests (lh = 1 year) and 2% registration checks (ecUA = 0,02) are expected.
kUA = 1 + oUA.1 + ekUA = 1 + 0,15.1 + 0,02 = 1,173
Capacity requirement of STK roadworthiness tests for UA:
PKUA = kUA.UAU = 1,173. UAU

3. Calculation of actual capacity of technical inspections of control lines STK
The actual capacity of the control line shall be determined by the actual effective daily working time (h), the number of productive days per year (d), and the number of control technicians on the control line (p) in the appropriate formula referred to in points 2.1 or 2.2.

2) Repeated technical inspection:

(b) in the case of a vehicle manufactured individually:

- the documents provided by the approval authority for carrying out the technical inspection provided for in the conditions of the decision, if any.
(c) in the case of rebuilding the vehicle:
- vehicle registration,
- a vehicle registration certificate or a technical certificate,
- a certificate of measurement of emissions if the measurement of emissions is required according to § 41 of Act No. 56 / 2001 Coll., as amended,
- emission measurement protocol if emission measurement is required according to § 41 of Act No. 56 / 2001 Coll., as amended,
- the documents provided for by the approval authority for carrying out the technical examination provided for in the conditions of the decision, where these are provided for.
5) Technical inspection before registration of the vehicle:
- vehicle registration,
- a certificate of measurement of emissions if the measurement of emissions is required according to § 41 of Act No. 56 / 2001 Coll., as amended,
- the emission measurement protocol if the emission measurement is required according to § 41 of Act No. 56 / 2001 Coll., as amended.
6) Technical inspection of ADR:
- vehicle registration,
- a vehicle registration certificate or a technical certificate,
- a regular technical inspection report, if already carried out (not applicable to new vehicles first put into service),
- evidence of first or periodic tests carried out on fixed or replaceable superstructure under the ADR Agreement, issued by the designated organisation. In general, it consists of two parts, namely the test report (e.g. inspection reports) and the subsequent certificate (inspection certificate) of compliance with the applicable requirements of the ADR Agreement. In the case of a tank, the certificate issued after 31.12.2002 must always indicate the code of the tank and, where appropriate, the specific provisions which the tank complies with,
- proof of the leak test of the superstructure under the ADR agreement issued by the designated organisation (if the superstructure already has it according to the previous certificate),
- an ADR certificate, if it has previously been issued to a vehicle.
7) Technical inspection at customer's request:
- only those documents related to the required scope (full, partial, partial to the scope of the registration) of the technical inspection. ';
Efficacy
This decree shall take effect on the date of its publication, except for point 14, which shall take effect on 1 July 2006.
