DECLARATION
of 17 December 2003
laying down details for the assessment of the suitability of the names of varieties of grown plants
According to Section 27 (3) of Act No. 219 / 2003 Coll., on the circulation of seeds and propagating plants and on the amendment of certain laws (the Law on the circulation of seed and seed), hereinafter referred to as "the Act '), the Ministry of Agriculture provides:
Variety name interchangeable with that used for another variety of the same or related species
(1) In particular, as a variety name interchangeable with a name used for another variety, a name differing only by one letter or by a number or by a diacritical sign of letters from the name of another variety of the same or a relative species which has been officially authorised or put into circulation in the Czech Republic or in another Member State of the European Communities (hereinafter referred to as "Member State") 1 or in a State or intergovernmental organisation which is a member of the Union for the protection of new plant varieties (hereinafter referred to as "Member State") 2) or is subject to the protection of rights in those territories; This does not apply in the case of a difference of only one letter in a recognised abbreviation as separate units of the variety denomination.
(2) The species belonging to the same group as listed in the Annex to this Decree or species belonging to the same botanical genus shall be considered as related species unless the species is listed in the Annex to this Decree.
(3) Paragraph 1 shall not apply to:
(a) the name of the variety which is no longer commercially used and which has expired more than 10 years after the date of cancellation of its registration in the State Variety Book (3) or in a similar official list of varieties of another Member State (1) or a member of the Union, (2)
(b) the name of the variety in the form of a code where the reference variety denomination is also in the form of a code.
Variety name giving rise to misconceptions
A name shall be considered as the name of a variety giving rise to misconceptions which:
(a) it is capable of causing a delusion that the variety has a specific characteristic or value;
(b) be able to give rise to a delusion that the variety is related or derived from another variety;
(c) points out the specific characteristic or value of a variety in a way which gives rise to a false impression that that characteristic or value only has that variety, although other varieties of the same species may have the same property or value;
(d) by resembling a known trade mark, but not being a registered trade mark or variety denomination, it is likely to give rise to a delusion that the variety is a different variety or the identity of the applicant, the person responsible for maintaining the variety or breeder; or
(e) contains:
1. comparison,
2. superlative,
3. the botanical name of the genus or species of the plant kingdom or part thereof,
4. the common name of the genus or species of the plant kingdom or part thereof within the group of agricultural plant species, vegetable species, fruit or ornamental plant species to which the variety belongs; or
5. the surname or surname and surname, or, where applicable, the business name of the natural person or business name or the name of the legal person, or any other reference to that person, who is capable of producing a false picture of the identity of the applicant, of the person responsible for maintaining the variety or breeder.
Variety name difficult to pronounce or otherwise inconvenient
(1) The name of the variety which is difficult to pronounce or otherwise inappropriate in a language shall be considered as the name of the variety which:
(a) in the case of a fantasy variety name,
1. consists of 1 point;
2. it consists of, or contains as a separate part, groups of letters which do not constitute an expressible word, except for recognised abbreviations;
3. contains a digit, except where it is an integral part of the name or indicates that the variety belongs or will belong to a numbered series of biologically related varieties,
4. consists of 3 or more units; in the case of a variety already registered in the common catalogue of varietes4) or in the official list of varieties in the Member State or Member of the Union, more than 3 units shall not be considered as an obstacle;
5. is composed of too long a word or too long a word contains, or
6. contains a coupling, a gap, except for the gaps between the units of which it is composed, another mark, a mixture of large and small letters inside the units, a lower index, an upper index, a symbol or a pattern,
(b) where the variety name is in the form of a code,
1. consist only of figures or figures, except in the case of inbred lines or similar specific types of varieties;
2. consists of 1 point;
3. contains more than 10 letters or more than 10 letters and digits;
4. contains more than 4 alternating groups of letters or letters and digits or digits; or
5. contains a link, a gap out of spaces to separate from the pronounceable word, another mark, lower index, upper index, symbol or pattern.
(2) If, on presentation of a proposal for a variety name, the applicant does not indicate whether the proposed variety name should be a fantasy name or a code name, the variety name shall be considered as a fantasy name.
(3) A variety denomination identical or interchangeable with a designation commonly used in trade in goods or which may not be used in accordance with other legislation shall also be considered as a variety denomination otherwise inappropriate; such designation means in particular the name
(a) currencies;
(b) related to measures and weights;
(c) which has become part of the everyday language and whose approval as a variety denomination prevents its use in the circulation of propagating material of other varieties.
Efficiency and validity
(1) This Decree takes effect on 15 January 2004.
(2) This decree shall expire on the date of entry into force of the Treaty of Accession of the Czech Republic to the European Union as regards the agricultural and vegetable plant species listed in the species list in Annex 1 to the Act.
