DECLARATION
of 9 February 2005
amending Decree No. 451 / 2000 Coll., implementing Act No. 91 / 1996 Coll., on Feed, as amended
The Ministry of Agriculture provides pursuant to § 3 (13), § 4 (11) and § 13 of Act No. 91 / 1996 Coll., on Feed, as amended by Act No. 244 / 2000 Coll. and Act No. 21 / 2004 Coll.:
Decree No. 451 / 2000 Coll., implementing the law on feedingstuffs, as amended by Decree No. 343 / 2001 Coll., Decree No. 472 / 2001 Coll., Decree No. 169 / 2002 Coll., Decree No. 544 / 2002 Coll., Decree No. 284 / 2003 Coll., Decree No. 434 / 2003 Coll. and Decree No. 184 / 2004 Coll., is amended as follows:
1. In Article 1, the following paragraph 1 is inserted, including footnotes 1a and 1b:
"(1) This decree (1a) incorporates the relevant provisions of the European Community (1b) and regulates the details and requirements for the production, import, use, packaging, labelling, transport and putting into circulation of feed, additives and premixtures.
(1a) It shall be issued on the basis and within the limits of the law, the content of which allows the relevant provisions of the European Communities to be incorporated by decree.
1b) Commission Directive 2003 / 104 / EC of 12 November 2003 concerning the authorisation of isopropyl ester of hydroxyanalogue of methionine. Council Directive 70 / 524 / EEC of 23 November 1970 concerning additives in feedingstuffs. Council Directive 96 / 51 / EC of 23 July 1996 amending Directive 70 / 524 / EEC concerning additives in feedingstuffs. Council Directive 96 / 25 / EC of 29 April 1996 on the circulation of feed materials amending Directives 70 / 524 / EEC, 74 / 63 / EEC, 82 / 471 / EEC and 93 / 74 / EEC and repealing Directive 77 / 101 / EEC. Commission Directive 98 / 67 / EC of 7 September 1998 amending Directives 80 / 511 / EEC, 82 / 475 / EEC, 91 / 357 / EEC and Council Directive 96 / 25 / EC and repealing Directive 92 / 87 / EEC. Commission Directive 2004 / 116 / EC. '
Paragraphs 1 to 3 shall be renumbered paragraphs 2 to 4.
2. Paragraph 4 (7) reads as follows:
"(7) Additional feed containing additives of growth promoters including antibiotics, anti-coccidic agents and chemotherapeutic agents shall be administered in the manufacture of compound feedingstuffs, including feed for animal primary production, in a proportion of at least 5% of the feed. Additional feedingstuffs shall not have higher levels of additives than those corresponding, after dilution, to the maximum levels laid down for those additives for complete feed. '
3. Paragraph 13, including footnote 1c, reads:
(1) For premixtures, the data of the test values are considered as still satisfactory
(a) for additives if they comply with the tolerances laid down in Annex 14, Part A, point 3;
(b) for the quality characteristics declared, excluding additives, if they do not exceed the tolerance given in Annex 13;
(c) for quality characteristics other than additives for which tolerances are not specified in Annex 13, provided that they do not deviate from that value more than the uncertainty values resulting from the general eligibility requirements of the test and calibration laboratories (1c).
(2) Where tolerances are not laid down in Annex 13 for quality characteristics other than additives, nor the uncertainty values, the characteristics shall not be evaluated.

4.
(1) For complete complementary and dietetic feedingstuffs, the data of the test values are considered satisfactory.
(a) for additives if they comply with the tolerances laid down in Annex 14, Part A, point 3;
(b) in the case of quality characteristics, excluding additives, declared in accordance with Annex No 26 for feed for farmed animals or Annex No 27 for feed for domestic animals and other declared quality characteristics, excluding additives, and in the case of limit quality characteristics, provided that they do not exceed the tolerance of that value in accordance with Annex No 16 or Annex No 17,
(c) for quality characteristics other than additives for which tolerance is not fixed more than the uncertainty values (1c) in Annex 16 or Annex 17, provided that they do not deviate from that value.
(2) Where tolerances are not set out in Annex 16 or Annex 17 for quality characteristics other than additives, neither the uncertainty values shall be evaluated. ';
5. In Article 29, at the end of paragraph 8, the sentence "In the case of feedingstuffs for domestic animals, where substances with antioxidant effect, dyes used for colouring feedingstuffs or animal products and preservatives are used, the words" with antioxidant ', "with colouring matter' or" coloured with or "with preservative 'shall be added to the labelling and the species of additive used shall be indicated in column 2 of Part C of Annex No 14.';
6. In Annex No 11, Part A, General Provisions I. In point 3, the words "and B 1 which are only applicable to the production of complete and complementary feedingstuffs for domestic animals' are deleted.
7. In Annex No 12 Certain protein feed Part 4. Hydroxyanalogues of amino acids, points 1.2.1. and 4.1., read:

8. Part of Annex No 14 And including the title reads:
General provisions
1. The person responsible for putting the additive into circulation shall be the natural or legal person responsible for the conformity of the additive with the substance authorised for putting into circulation.
2. For the purposes of this decree, micro-organisms shall mean micro-organisms forming colonies.
3. Tolerance
When assessing the test values of additives in substances or premixtures, complete and complementary feedingstuffs or in feed for particular nutritional purposes, the following shall apply:
I. Tolerance involving technological errors:
(a) for contents up to 0,5 units (mg, g, 1000 μg, 1,000 IU, 105 CFU), a tolerance of 40%;
(b) for a content of 0,5 to 1 unit of tolerance 0,2 unit,
(c) for a content of 1,0 to 50 units of tolerance of 20%;
(d) for a content of 50,0 to 100 units of tolerance of 10 units,
(e) for a content of 100,0 to 500 units of tolerance of 10%,
(f) for a content between 500,0 and 1000 units of tolerance of 50 units,
(g) for contents above 1000 units of tolerance, 5%.
II. Tolerances involving random errors arising from sample testing which are expressed by the uncertainty value according to the relevant legislation1c. '
9. In Annex No 14, Part C 1, to Group D. Anticoccidia and chemotherapeutic agents, the following is added to the entry E 766 at the end of column 5 to 9:
