of 9 March 2016
amending Decree of the Ministry of Transport and Communications No. 31 / 2001 Coll., on driving licences and on the register of drivers, as amended
The Ministry of Transport provides, pursuant to Section 137 (2) of Act No. 361 / 2000 Coll., on road traffic and on amendments to certain laws (Road Traffic Act), as amended by Act No. 411 / 2005 Coll., Act No. 226 / 2006 Coll., Act No. 274 / 2008 Coll., Act No. 133 / 2011 Coll., Act No. 297 / 2011 Coll., Act No. 230 / 2014 Coll., Act No. 249 / 2014 Coll. and Act No. 48 / 2016 Coll., Implementation § 87b. 5 and § 105 paragraph 5 of the Road Traffic Act:

Decree of the Ministry of Transport and Communications No. 31 / 2001 Coll., on driving licences and on register of drivers, as amended by Decree No. 154 / 2003 Coll., Decree No. 177 / 2004 Coll., Decree No. 194 / 2006 Coll., Decree No. 27 / 2012 Coll., Decree No. 243 / 2012 Coll., Decree No. 1 / 2014 Coll., Decree No. 9 / 2015 Coll. and Decree No. 43 / 2015 Coll., are amended as follows:
1. In footnote 5, the following sentence is added at the end of the text:
"Commission Directive (EU) 2015 / 653 of 24 April 2015 amending Directive 2006 / 126 / EC of the European Parliament and of the Council on driving licences. ';
2. Article 15b shall be deleted, including the title.
3. In Article 17, at the end of paragraph 2, the dot is replaced by a comma and the following point (r) is added:
"(r) records of transport psychological examinations carried out.";
4. In Article 17, at the end of paragraph 3, the dot is replaced by a comma and the following point (u) is added:
"(u) an assessment of the results of the transport psychological examination.";
5. in Paragraph 18a (1) (d):
"(d) psychological diagnostic techniques and standardised tests to perform psychological performance and personality tests."
6. After Paragraph 18b, the following Section 18c is inserted:
„§ 18c
Scope, content and manner of transport psychological examination
(1) Transport psychological examination shall include analysis of anamnestic data on the person under consideration, including data on driving practice, interview, examination of the person under assessment by standardised psychodiagnostic methods, projective methods and observations where appropriate.
(2) The traffic psychological examination shall consist of the following parts:
(a) an initial interview in which the person under consideration:
1. is familiar with the conditions, course and purpose of transport psychological examination;
2. Confirm in writing that her physical and psychological condition allows for transport psychological examination; and
3. communicate information on any previous transport psychological examinations carried out,
(b) examination of psychological performance in terms of quantity and quality
1. intellect,
2. attention, in particular its concentration, distribution and scope;
3. sensory reactivity and coordination, in particular as regards the speed and accuracy of sensory reactions to a series of visual or acoustic stimuli in a time-stress situation;
4. decision-making, in particular as regards speed and reliability in time stress;
5. memories, in particular visual, and
6. other mental functions if necessary,
(c) examination of personality characteristics including, in particular, examinations
1. emotional stability, lability and impulsivity,
2. adaptive behaviour,
3rd tendency to take risks,
4. resistance to load;
5. psychopathic symptoms; and
6. other personality characteristics, if necessary,
(d) an individual interview with the person under consideration to obtain anamnestic or, where appropriate, other data on the person under consideration;
(e) an evaluation of the results of the tests referred to in points (b) and (c), anamnestic data and data obtained from the interview and comparison with objective data; and
(f) familiarisation of the subject with the conclusion of the transport psychological examination and the issue of a written assessment of the result of the transport psychological examination.
(3) The transport psychological examination shall be carried out with the personal participation of the person assessed at the transport psychological centre indicated in the accreditation to carry out the traffic psychological examination.
(4) The model for the assessment of the result of the transport psychological examination is set out in Annex 11 to this Decree. "

The "N 'force unit specified for harmonised codes 20.07, 40.01, 44.09 and 44.10 indicates the driver's ability to control the system.
