The Ministry of Foreign Affairs announces that Decision No 6 / 98 was signed in Brussels on 21 December 1998. The Association Council between the European Communities and their Member States, of the one part, and the Czech Republic, of the other part, of 21 December 1998 amending Protocol 4 to the Europe Agreement establishing an association between the European Communities and their Member States, of the one part, and the Czech Republic, of the other part. *) '* *)
Decision No 6 / 98 entered into force on 1 January 1999 pursuant to Article 2 thereof.

amending Protocol 4 to the Europe Agreement
establishing an association between:
European Communities and their Member States
of the one part, and the Czech Republic, of the other part
The Association Council,
Having regard to the Europe Agreement establishing an association between the European Communities and their Member States, of the one part, and the Czech Republic, of the other part, (1) signed in Brussels on 4 October 1993 and in particular Article 38 of Protocol 4; 2)
Whereas the definition of the concept of "originating products" in Protocol 4 should be amended to ensure the correct functioning of the extended system of cumulation, which allows the use of materials originating in the Czech Republic, the European Community, Poland, Hungary, the Slovak Republic, Bulgaria, Romania, Latvia, Lithuania, Estonia, Slovenia, the European Economic Area (EEA), Iceland, Norway and Switzerland;
Whereas it is appropriate to maintain, until 31 December 2000, the system of uniform rates of charges provided for in Article 15 of Protocol 4 in relation to the prohibition of drawback and exemption from customs duties;
Whereas, taking into account the specific arrangements for industrial products between the Community and Turkey, it is also appropriate to extend the cumulation system to those products originating in Turkey;
Whereas, in order to facilitate trade and simplify administrative operations, it is desirable to amend the text of Articles 3, 4 and 12 of Protocol 4;
Whereas account should be taken of changes in production processes and shortcomings in certain raw materials, certain adjustments should be made to the list of processing and processing requirements to which non-originating materials must be submitted in order to obtain originating status,
Decision as follows:
Protocol 4 concerning the definition of the concept of "originating products' and methods of administrative cooperation is hereby amended as follows:
1. point (i) of Article 1 shall be replaced by the following:
"(i)" value added "means the ex-works price reduced by the customs value of each of the materials originating in the other countries referred to in Articles 3 and 4 or, if the customs value is not known or cannot be established, by the first price evidently paid for such products in the Community or the Czech Republic.";
2. Articles 3 and 4 shall be replaced by the following:
Cumulation in the European Community
1. Without prejudice to the provisions of paragraph 1 of Article 2, products shall be considered as originating in the Community if they are obtained there using materials originating in the Community, Bulgaria, Poland, Hungary, the Czech Republic, the Slovak Republic, Romania, Lithuania, Latvia, Estonia, Slovenia, Iceland, Norway, Switzerland (including Liechtenstein) 1) or Turkey2) in accordance with the provisions of the Protocol on Rules of Origin which forms part of the Agreements between the Community and each of those countries, provided that the working or processing carried out in the Community goes beyond the operations referred to in Article 7 of this Protocol. It is not necessary for such materials to undergo sufficient working or processing.
2. Where the working or processing carried out in the Community does not exceed the operations referred to in Article 7, the product obtained shall be considered as originating in the Community only if the value added there is greater than the value of the materials used originating in one of the other countries referred to in paragraph 1. If this is not the case, the product obtained shall be considered as originating in the country in which the highest value of originating materials used in the Community production was added.
3. Products originating in one of the countries referred to in paragraph 1 which do not undergo any working or processing in the Community shall retain their origin when exported to one of those countries.
4. The cumulation provided for in this Article may be applied only to materials and products which have acquired originating status by applying rules of origin identical to those of this Protocol.
The Community shall communicate to the Czech Republic, through the Commission of the European Communities, details of the agreements and their corresponding rules of origin applied with the other countries referred to in paragraph 1. The Commission of the European Communities shall publish in the Official Journal of the European Communities (C Series) the date from which the cumulation provided for in this Article may be applied by the countries referred to in paragraph 1 which have complied with the necessary requirements.
Cumulation in the Czech Republic
1. Without prejudice to the provisions of paragraph 2 of Article 2, products shall be considered as originating in the Czech Republic if they are obtained there using materials originating in the Community, Bulgaria, Poland, Hungary, the Czech Republic, the Slovak Republic, Romania, Lithuania, Latvia, Estonia, Slovenia, Iceland, Norway, Switzerland (including Liechtenstein) 1) or Turick2) in accordance with the provisions of the Protocol on Rules of Origin which forms part of the Agreements between the Czech Republic and each of those countries, provided that the working or processing carried out in the Czech Republic goes beyond the operations referred to in Article 7 of this Protocol. It is not necessary for such materials to undergo sufficient working or processing.
2. Where the working or processing carried out in the Czech Republic does not exceed the operations referred to in Article 7, the product obtained shall be considered as originating in the Czech Republic only if the value added there is greater than the value of the materials used originating in one of the other countries referred to in paragraph 1. If this is not the case, the product obtained shall be considered as originating in the country in which the highest value of originating materials used in the production in the Czech Republic was added.
3. Products originating in one of the countries referred to in paragraph 1 which do not undergo any working or processing in the Czech Republic shall retain their origin when exported to one of those countries.
4. The cumulation provided for in this Article may be applied only to materials and products which have acquired originating status by applying rules of origin identical to those of this Protocol.
The Czech Republic shall communicate to the Community, through the Commission of the European Communities, details of the agreements and their corresponding rules of origin applied with the other countries referred to in paragraph 1. The Commission of the European Communities shall publish in the Official Journal of the European Communities (C Series) the date from which the cumulation provided for in this Article may be applied by the countries referred to in paragraph 1 which have complied with the necessary requirements. ';
3. Article 12 is replaced by the following:
Territorial principle
1. Except for Article 2 (c) (1), Articles 3 and 4 and paragraph 3 of this Article, the conditions for obtaining originating status laid down in Title II shall be fulfilled without interruption in the Community or the Czech Republic.
2. Except for the provisions of Articles 3 and 4, where originating goods re-exported from the Community or the Czech Republic to another country are returned, they shall be considered as non-originating, unless it is possible to demonstrate to the satisfaction of the customs authorities that:
(a) the reimported goods are the same as those exported; and
(b) it has not undergone any operation other than that necessary for its preservation in good condition in the country or at the time of export.
3. The acquisition of originating status within the meaning of the conditions laid down in Title II shall be without prejudice to the working or processing of materials exported from the Community or the Czech Republic and subsequently re-imported, carried out outside the territory of the Community or the Czech Republic, provided that:
(a) the said materials are wholly obtained in the Community or in the Czech Republic or have undergone working or processing beyond the insufficient operations provided for in Article 7 before being exported; and
(b) it may be demonstrated to the satisfaction of the customs authorities that:
(i) the reimported goods have been obtained by working or processing the exported materials; and
(ii) the total value added outside the territory of the Community or of the Czech Republic by applying the provisions of this Article shall not exceed 10% of the ex-works price of the resulting product whose originating status is required.
4. For the purposes of paragraph 3, the conditions for obtaining originating status laid down in Title II shall not apply to working or processing carried out outside the Community or the Czech Republic. However, where the rule in Annex II which is used to determine the origin of the final product determines the maximum value of all non-originating materials used, the sum of the total value of the non-originating materials used in the territory of the Party concerned and the total value added outside the territory of the Community or the Czech Republic by applying the provisions of this Article shall not exceed a fixed percentage criterion.
5. For the purposes of applying the provisions of paragraphs 3 and 4, "total added value 'shall mean all costs incurred outside the Community or the Czech Republic, including the value of materials used there.
6. The provisions of paragraphs 3 and 4 shall not apply to products which do not fulfil the conditions set out in Annex II or which may be considered sufficiently worked or processed only by applying the general tolerance rule laid down in paragraph 2 of Article 6.
7. The provisions of paragraphs 3 and 4 shall not apply to products falling within Chapters 50 to 63 of the Harmonised System.
8. Any working or processing to which the provisions of this Article apply and which has been carried out outside the Community or the Czech Republic shall be carried out under outward processing arrangements or similar arrangements. ";
4. in Articles 13, 14, 15, 17, 21, 27, 30 and 32, the text "referred to in Article 4" shall be replaced by the text "referred to in Articles 3 and 4";
5. in the last paragraph of Article 15 (6), "31 December 1998 'is replaced by" 31 December 2000';
6. in paragraph 1 of Article 26, the reference "C2 / CP3 'is replaced by the reference" CN22 / CN23';
7. In Annex I, note 5.2:
(a) between cuts
"- artificial man-made fibres', and
"- synthetic man-made staple fibres of polypropylene"
the following is added:
"- electroconductive fibres';
(b) the fifth example is deleted ("Carpet with tassels... is met by the mass criterion.");
8. Annex II is amended as follows:
(a) the following rule is inserted between the rules for HS headings 2202 and 2208:
