DECLARATION
of 6 January 2026
amending Decree No. 408 / 2016 Coll., on Management System Requirements
According to Section 236 of Act No. 263 / 2016 Coll., Atomic Act, as amended by Act No. 83 / 2025 Coll., for implementation of § 24 (7), § 29 (7) and § 30 (9):
Čl. I
Decree No. 408 / 2016 Coll., on Management System Requirements, is amended as follows:
1. in Article 2 (a), the word "monitoring" and the word "implementation" shall be inserted after the word "implementation";
2. In Paragraph 2 (c), the word "worker 'is deleted.
3. In Section 2, point (f), at the end of the dot, is replaced by a comma.
4. In Article 2, point (g) is added:
"(g) senior management of a natural person who has the power to make decisions having a significant impact on the policy, resources and direction of the person implementing the management system.";
5. in Article 3 (1) (a), the word "safety" shall be inserted after the word "safety," the words "management system" shall be inserted after the word "safety," and the word "target" shall be replaced by "safety target."
6. In Article 3 (2), the words "the safety objectives of the management system in such a way that there is no negative impact on safety performance when achieving other objectives of the management system and the process and activity requirements' shall be inserted after the word" attaining '.
7. Paragraph 3 (3) reads as follows:
"(3) The processes and activities of the management system must be implemented in such a way as to achieve the safety objectives of the management system and to meet the integrated requirements."
8. in Article 3 (5) (e), the words "integrated requirements" shall be replaced by the words "measures to prevent and prevent the use of fraud," the words "nuclear safety, radiation protection, technical safety, radiation monitoring, radiation emergency management," shall be replaced by "falsified" and the words "security has been permanently secured" shall be replaced by "suspicious items."
9. in Article 3 (5) (f), the words "within the organisational structure" shall be deleted;
10. in Paragraph 3 (5), at the end of point (g), the word "a" is replaced by a comma.
11. in Article 3 (5) (h), the word "security" is inserted after the word "attaining," and at the end the dot is replaced by a comma.
12. in Article 3 (5), the following points (i) and (j) are added:
"(i) established risk management to achieve the safety objective of the management system; risk management must be in the context of the prevention of disagreement
1. a non-compliance which could arise ("potential non-compliance") and its possible causes have been sought,
2. Evaluation of the need for preventive action to prevent potential non-compliance,
3. preventive measures in place appropriate to the possible cause of potential disagreement; for the purpose of determining preventive measures, use shall be made of other persons' own operational experience and operational experience, where available; and
4. preventive measures are monitored and evaluated in the light of the state of its implementation and its effectiveness; and
(j) a uniform method of communication and the language which ensures it. ';
13. In Article 3, paragraphs 6 and 7 are added:
"(6) The members of the senior management must ensure that:
(a) a security policy has been established and its safety objective of the management system has been met;
(b) the objectives of the management system aimed at meeting the safety objective of the management system, the management plans and the tasks of the person implementing the management system are consistent with the safety policy and their impact on nuclear safety, radiation protection, technical safety, monitoring of the radiation situation, management of radiation emergencies and security are taken into account and managed in such a way that nuclear safety, radiation protection, technical safety, monitoring of the radiation situation, management of radiation incidents and security are not jeopardised by other priorities;
(c) the suitability and effectiveness of the management system have been monitored and evaluated; and
(d) self-evaluation and independent evaluation of:
1. the pursuit of the activities of the CS in relation to the safety objective of the management system carried out by the senior management member;
2. leadership capabilities in the field of nuclear safety, radiation protection, technical safety, monitoring of the radiation situation, management of radiological emergencies and security, including culture of safety and fundamental attitudes and behaviour.
(7) The management system must be established and documented before the start of the nuclear-related activity since processes and activities may affect the future achievement of the safety objective of the management system. The management system documentation shall include a management system programme in this case. ';
14. in Article 4 (2) (a) (2), the words "which comply with Article 15 (1)" shall be inserted after the word "management."
15. in Article 4 (2) (c), the word "consistently" is replaced by "regularly" and the word "security" is inserted after the word "established."
16. in Article 4 (2) (e):
"(e) be carried out under the following conditions:
1. documentation relating to processes and activities shall be made available to each person involved in the implementation of processes and activities throughout the process and activity,
2. a continuous check must be carried out on the processes and activities to verify the correctness of their implementation and the quality of their outputs at a certain time;
3. appropriate technical equipment must be used and appropriate working conditions and environment ensured;
4. the interaction between persons implementing and managing processes and activities must be set in such a way as to achieve the safety objective of the management system and to meet integrated requirements;
5. the worker must be qualified to fulfil the procedural role and to carry out the assigned activity and to know the requirements for the processes and activities to which the procedural roles belong;
6. technical equipment for carrying out processes and activities shall be maintained in a state ensuring that the outputs from processes and activities are consistently aligned with the requirements laid down therein; and
7. for the management and evaluation of the processes and activities carried out by the supplier, an adequate number of own personnel of the person implementing the management system shall be provided. ';
17. in Article 4 (3), the second sentence is deleted;
18. In Article 5 (1), the comma is replaced by "a 'and the words" and validation' are deleted.
19. in Article 5 (2), the comma is replaced by "a."
20. in Articles 5 (2) and 5 (3), the words "and validation" shall be deleted;
21. in Article 5 (3), the comma shall be replaced by "a."
22. in Paragraph 6 (1) (a), the words "created and implemented" are replaced by the words "designated."
23. In Articles 6 (1) (a), 8 (1) (a), 9 (1) (b) and 15 (1) (a) (1), the word "security" shall be inserted after the word "achievement."
24. in Article 6 (1) (b), the word "everyone" shall be replaced by the word "leader," and the words "performing activities to ensure and increase the level of nuclear safety, radiation protection, technical safety, monitoring of radiation situations, management of radiation emergencies and security" shall be deleted;
25. in Article 6 (1) (c), the words "management system plan" and the words "improved quality of management system plan" shall be replaced by the words "assessed in terms of accuracy and accuracy and kept up to date."
26. in Paragraph 6 (1) (d), "management and" shall be replaced by "management and its."
27. in Article 6 (1) (d), the words "improving its quality" shall be deleted;
28. in Paragraph 6 (1) (e), the words "the elimination of non-conformity in" shall be replaced by "the achievement of results" and the words "as referred to in (d)" shall be added at the end of the text.
29. In Article 7, the following paragraph 7 is added:
"(7) Where a change in the management system does not affect nuclear safety, radiation protection, technical safety, monitoring of the radiation situation, management of a radiological emergency or security, the requirements of paragraphs 2 to 5 shall not apply. ';
30. In Paragraph 10 (1) of the Introductory Part of the Provisions, the words "change of system 'are replaced by the words" system', the words "including processes' are inserted after the word" management 'and the words "change in processes and activities' are replaced by the words" activity '.
31. in Article 10 (1) (a), the word "security" shall be inserted after the word "achieve."
32. in Paragraph 10 (1) (c), the words "having the appropriate powers to implement it" shall be inserted after the word "worker."
33.In Article 11 (1) (e):
"(e) requirements are laid down to prevent inappropriate treatment of processes and activities and their inputs, outputs or sources of non-compliance;"
34. in Paragraph 11 (1) (f), at the end of the period, "a" is replaced by "a."
35. in Article 11 (1), the following point (g) is added:
"(g) in the event of the detection of a fraudulent, falsified or suspected item, the Office shall be informed without delay.";
36. Paragraph 11 (3) is deleted.
37. in Article 12 (1) (a), the words "lay down qualification requirements, including the duration of professional experience, corresponding to the type and importance of the process and activity carried out by the worker," shall be replaced by the words "determine qualification requirements, including the length of professional practice, and the requirements for language and communication skills corresponding to the type and importance of the process and activity carried out by the worker,"

§ 13
Development and evaluation of a safety culture
(1) The continuous development of a safety culture in the management system of the person implementing the management system must be:
(a) effectively ensure the clarity and awareness of the key principles of the safety culture for leaders and practitioners,
(b) effectively ensure the search for information on the achievement of the management system safety objective by the lead worker and their sharing with other personnel of the person implementing the management system;
(c) effectively create the conditions for informing the lead worker of the way in which the management system's security objective is achieved by the person implementing the management system of the personnel of that person;
(d) effectively ensure that the activities of senior staff will lead to the development of a safety culture in its entirety appropriate to the focus of the person implementing the management system, including for workers, leaders and organisations, in particular:
1. supporting the reporting of nuclear safety, radiation protection, technical security, monitoring of the radiation situation and management of radiological emergencies;
2. developing a query approach; and
3. rectification of actions or conditions which may have an adverse effect on nuclear safety, radiation protection, technical safety, monitoring of the radiation situation and management of the radiological emergency;
(e) effectively ensure the preparedness of the worker of the person implementing the management system to act to achieve the safety objective of the management system, using his / her competence to be maintained by the person implementing the management system from his / her internal resources, including:
1. competence to lead to nuclear safety, radiation protection, technical safety, monitoring of the radiation situation and management of radiological emergencies at all levels of management,
2. competence to promote and maintain a strong safety culture; and
3. expertise in understanding technical, human and organisational aspects or activities to ensure nuclear safety, radiation protection, technical safety, monitoring of the radiation situation and management of radiological emergencies,
(f) the worker of the person implementing the management system led by the lead worker to seek opportunities to improve the management system and processes and activities and to create conditions for such search;
(g) the management system is used in a way that leads to the achievement of the safety objective of the management system and to the improvement of the level of nuclear safety, radiation protection, technical safety, monitoring of the radiation situation, management of a radiological emergency and to the development of a safety culture by providing nuclear safety, radiation protection, technical safety, monitoring of the radiation situation and management of a radiological emergency
1. are taken into account in any decision; and
2. are not threatened by decisions taken;
(h) the adequacy, suitability and effectiveness of the resources are assessed in accordance with paragraphs 8 to 10; and
(i) knowledge and information within the organisation managed as a resource.
(2) The person misleading the management system must ensure that the leader contributes to the continuous development of a safety culture by:
(a) all personnel of persons implementing the management system contribute to the development of a safety culture;
(b) promote and call for confidence, cooperation, consultation and communication through its behaviour and conduct;
(c) apply measures to promote interrogatory access and learning access at all levels and avoid self-satisfaction, ignorance and conscious inaction in areas related to nuclear safety, radiation protection, technical security, monitoring of radiation situations and management of radiation emergencies;
(d) use a systemic approach taking into account interactions between technical, human and organisational factors; and
(e) carry out a regular self-assessment of the safety culture according to the procedural role it holds.
(3) The person implementing the management system must ensure that the periodic assessment of the safety culture is:
(a) carried out at least once a year at all levels of management and for all positions in the organisational structure;
(b) carried out at least once a year in the form of self-evaluation of the leaders in the field of nuclear safety, radiation protection, technical safety, monitoring of the radiation situation, management of radiological emergencies and safety culture, using experts in the evaluation of management and safety culture; and
(c) documented including the conclusions of the evaluation and the measures taken to develop the safety culture.
(4) The outcome of the assessment of the safety culture shall be notified to each worker of the person implementing the management system and its supplier of the product or service.
(5) The person implementing the management system shall ensure that, on the basis of the conclusions of the assessment of the safety culture, measures are taken to support and maintain the safety culture, in particular to improve the leadership for nuclear safety, radiation protection, technical safety, monitoring of the radiation situation and management of the radiation emergency and to support the learning approach. ';
39. in Paragraph 14 (a) of the introductory part of the provision, the word "description" shall be deleted;
40. in Article 14 (a) (1), the words "safety description" shall be inserted at the beginning and the comma shall be replaced by "a" at the end.
41. in Article 14 (a) (2), the words "the management objectives" shall be replaced by the words "the overall objectives and orientation of the person implementing the management system in relation," the words "quality assurance and improvement" shall be replaced by "the security objectives of the system," and the words "processes and activities and their outputs," shall be replaced by a comma.
42.Paragraph 14 (a) (3) shall be deleted;
43. In Paragraph 14 (b) of the introductory part of the provision, the words "a description of the management system containing the description" shall be replaced by the words "a document containing a description of the management system, which is a management system programme, if the person implementing the management system referred to in Article 29 (1) (a) of the Atomic Act must have it to the extent."
44. in Article 14 (b) (4), the words "processes and activities, their outputs and their interactions based on the security policy referred to in (a) and containing information on their preparation, review, validation, implementation, evaluation and improvement and recording of data relating to processes and activities and their outputs and" shall be replaced by "processes and activities, their outputs and their interactions based on the security policy referred to in (a) and containing information on their preparation, review, verification and validation, where required, implementation, evaluation and improvement and recording of data relating to processes and activities and their outputs and."
45. in Paragraph 14 (e):
"(e) other documentation of the person implementing the management system used to manage processes and activities in achieving the safety objective of the management system; such documentation shall be in particular contracts, programmes, plans, lists, documentation for authorised activities and internal rules. ';
46. in Article 15 (1) (c), the words'; the change in the documentation of the management system must be approved by the worker who approved the documentation of the management system and, if this is not possible, approved by the worker with the same procedural role 'shall be deleted.
47. in Article 15 (1) (d), the words "structured from general to specific," shall be inserted after the words "readable," and "interconnected," the words "complete" shall be inserted after the words "unambiguous," and the words "easy" shall be deleted;
48. In Article 15 (1) (f) of the Introductory Part of the Provisions and Article 15 (1) (g), the words "with the exception of documentation relating to planning in the Management System" shall be inserted at the beginning.
49. in Article 15 (2) (b), the word "security" shall be inserted after the word "performance."
50. in Article 15 (3) (a), the words "radiation protection, technical safety, monitoring of the radiation situation, management of radiological emergencies and security," shall be added at the end;
51. in Article 15 (3) (c), the words ", radiation protection, technical safety, monitoring of radiation situations, management of radiological emergencies and security" shall be added at the end of the text.
52. in Article 16 (e) (2), the words "if required" shall be inserted after the word "validation."
53.In Article 16 (e) (6), the words "services, and 'are replaced by the words" services, and its capabilities. "
Čl. II
Final provision
1. This Decree was notified in accordance with Directive (EU) 2015 / 1535 of the European Parliament and of the Council of 9 September 2015 on the procedure for the provision of information in the field of technical and information society services, as amended.
Čl. III
Efficacy
This Decree shall take effect on 1 February 2026.
