DECLARATION
of 29 December 2014
amending Decree No. 173 / 1995 Coll., on the issue of the Railway Regulations, as amended
The Ministry of Transport provides, pursuant to Article 66 (1) of Act No. 266 / 1994 Coll., on Railways, as amended by Act No. 23 / 2000 Coll., Act No. 77 / 2002 Coll., Act No. 103 / 2004 Coll., Act No. 181 / 2006 Coll., Act No. 191 / 2006 Coll., Act No. 194 / 2010 Coll., Act No. 134 / 2011 Coll. and Act No. 64 / 2014 Coll., ("Act ') for the implementation of § 22 (5), § 35 (4), § 42 (3), § 43 (1), (4) and (7), § 44 (1), § 47 (2) and § 48 (1) Act:
Decree No. 173 / 1995 Coll., issuing the Railway Regulations, as amended by Decree No. 242 / 1996 Coll., Decree No. 174 / 2000 Coll., Decree No. 133 / 2003 Coll. and Decree No. 57 / 2013 Coll., is amended as follows:
1. in § 1 (e), the words "or, in the case of a track, a trolleybus and a railway vehicle, moving at its own force outside the traction line and powered by an independent source, which is primarily intended for use when powered by a traction line," shall be inserted after the words "track (track, trolleybus, rope, etc.)."
2. in Article 1 (m):
"(m) by driving according to the visual conditions of the rail vehicle driving only by the person driving the railway vehicle, at which the driver must stop the train or the sliding part in front of the standing or the same direction of the driving vehicles in the common road and, as far as possible, from any other obstacle to their driving, including the anti-driving vehicles, the maximum permissible speed being not exceeded;"
3. In Article 6, the following paragraph 5 is added:
"(5) In the case of portable signals for electrical operation, portable signals for the electric operation of orange colour or blue with orange frame shall be used to enhance the safety and stability of operation, in particular in the case of lockouts and elimination of demolished traction lines. ';
4. In Paragraph 18, at the end of paragraph 1, the dot is replaced by "a 'and the following point (d) is added:
"(d) the use of components of the integrated rescue system."
5. Paragraph 21 (5) is deleted.
6. the following Section 21a is inserted after Section 21, including the title and footnote 15:
Organisation of railway traffic management with a planned track operating restriction
(1) In the planned track operation limitation, the railway operator shall evaluate the impact of the track operation limitation on the agreed range of runway traffic. When assessing the impact of the planned track operating limitation, the traffic permeability of the section concerned shall be compared at the time of the track operating limitation with the actual range of allocated road capacity.
(2) If the planned restriction on the operation of the runway affects the frequency and scope of traffic, the railway operator shall inform the allocation agent of this fact, unless the allocation is simultaneously the rail operator.
(3) If the planned track operating limitation affects the frequency and extent of traffic, the railway operator shall propose an agreement to the carrier to adjust the allocated capacity. If, even after adjustment or withdrawal of the infrastructure capacity or reduction of unused routes, the transport permeability of the section concerned corresponds to the range of allocated road capacity, the allocation shall be entitled to carry out a recalculation of the allocated road capacity and further reduce the agreed number of trains to all carriers for the duration of the planned track operating limitation, so that the extent of the modifications made to the road capacity is as high as the percentage of all carriers.
(4) The railway operator shall, by means of the procedure referred to in paragraph 3, process an exclusive timetable which shall not be regarded as a change in timetable. When constructing the exclusive timetable, priority shall be given to the routes in the order of Paragraph 22 (2).
(5) The exclusive timetable proposal shall be submitted by the railway operator to the carriers at least 45 days before the date of the planned track operating restriction. The carrier shall be entitled to apply an objection to the proposal for an exclusive timetable within 5 days of the date of service. The railway operator shall, within 10 days of receipt of the carrier's observations, decide on the carrier's objections. In the event that the railway operator does not comply with or accepts only partially the carrier's objections, it shall state the reasons for which it did not comply or only partially accepted the objections.
(6) When drawing up the exclusive timetable, the railway operator shall cooperate with the carriers which have the capacity allocated to the railway section concerned.
(7) When drawing up the exclusive timetable, the carrier is entitled to design its own priorities for the management of trains operated by it on the section concerned within the number of routes allocated. The railway operator shall comply with the requirements of the carrier concerning the routes of public passenger trains which serve to ensure the transport service of the State, then the county and the citizen (15), to the maximum extent required by paragraph 3.
(8) Upon completion of the planned track operation limitation, the runway operator shall ensure that the correct operation of the safety equipment is verified.

7. In Paragraph 34, at the end of paragraph 1, the dot is replaced by "or 'and the following point (j) is added:
"(j) is evaluated by diagnosis from the hot bearing indicator, from the hot hoop indicator or from the incorrectness of driving indicator at a level above the STOP level, if the defect is confirmed by a vehicle inspection without delay or if the same fault assessment of the same vehicle is repeated."
8. in Article 35 (1) (a), the word "demonstrably" shall be inserted after the word "was."
9. In Article 35 (1) (c), the part of the sentence after the semicolon, including the semicolon, is deleted.
10. in Article 35 (1) (d), the words "a permanent device" shall be inserted after the words "movement."
11. in Article 35 (1) (g), the words "or other" shall be inserted after the words "watching" and the words "visible" shall be replaced by the words "visible or permanently or repeatedly transmitted."
12. In Article 35, at the end of paragraph 1, the dot is replaced by a comma and the following points (s) and (t) are added:
"(s) respond adequately to voice or data information or orders transmitted by radio equipment; or
(t) in the event of a fault in the railway operator's equipment, inform the railway operator without delay. ';
13. in Paragraph 35 (2) (a), "seconds" is replaced by "half minutes."
14. in Paragraph 35 (2) (e), the words "the prescribed braking method" shall be deleted;
15. in Article 35 (2), point (f) is deleted;
Point (g) shall be renumbered as point (f).
16. in Article 36 (4), the words "for passenger trains in axles, freight trains" and "and axles" shall be deleted;
17. in Paragraph 37 (4), the words' k 'shall be inserted after the words "Actual braking percentages =';
18. In Paragraph 37 (4), the following sentence is inserted after the first sentence: "If vehicles brake on the train with a manual brake are also included, their braking mass shall be multiplied by 0,75 when calculating the total braking mass of the train. '
19. In Paragraph 37, at the end of paragraph 4, the sentence "The values of coefficient k are set out in Annex 2. 'is added.
20. In Article 37 (5), the words "pursuant to Article 35 (2) (e) of this Decree 'are deleted.
21. In Paragraph 37 (9) of the Introductory Part of the Provisions, the words "in other transport" shall be added at the end of the text.
22. In Paragraph 37, at the end of paragraph 9, the dot is replaced by "or 'and the following point (c) is added:
"(c) if another railway vehicle with an interconnected continuous line has been affixed to the train."
23. In Paragraph 37 (10), the words "for manual registration 'shall be inserted at the beginning of point (g).
24. In Paragraph 46, the sentence "The total insulation status shall be verified in the case of trolleybus track groove vehicles at the end of paragraph 1. 'is added.
25. in Paragraph 50 (2) (b), the word "express" shall be deleted;
26. In Article 54, paragraph 4 is added:
"(4) Timetables shall be published immediately after their transmission to the National Timetables Information System in a way that allows remote access in the form in which they were transmitted to the National Timetables Information System by the Railway Operator. ';
27. in Article 55 (1) (f), the words "clear representation" are replaced by the words "map."
28. In Paragraph 55 (1), the words "and stops' shall be added at the end of the text in point (g).
29. in § 55 (1) (h):
"(h) the place where the contractual terms and tariffs of the carriers are published;"
30. in Article 55 (1), points (i) and (j) are deleted;
Points (k) to (m) shall be renumbered as points (i) to (k).
31. in Article 55 (1), the words "in the train column" shall be inserted at the beginning of point (i).
32. in Paragraph 55 (1) (j):
"(j) the dates for issuing the planned timetable changes;"
33.In Article 55 (1) (k) (8), the word "tariff" shall be deleted.
34. in Paragraph 55 (2) (e), "(m)" is replaced by "(k)";

36. In Article 55, the following paragraph 5 is added:
"(5) Timetables shall be published immediately after their transmission to the National Timetables Information System in a manner that allows remote access, in the form in which they were transferred to the National Timetables Information System by the Administrative Bureau. ';
37. in Paragraph 62 (2), the words "except for the air conditioning of the driver's cabs (persons driving a railway vehicle) of a railway, tramway and trolleybus vehicle with a cooling capacity up to 2000 W powered from 24 V DC circuit; the railway operator shall be obliged to notify the change to the Railway Authority in the case of the installation of such a system. ';
38. Paragraph 62 (2) shall be added at the end of the text in point (v) "; the replacement of parts of designated technical equipment which are not part of other equipment referred to in this paragraph shall not be regarded as a change and in which neither the functional characteristics nor the parameters of the designated technical equipment are changed '.
39. In Paragraph 66, the following paragraph 4 is added:
"(4) Wagons used and wagons moved by cableway installations shall be subjected to non-destructive checks on the anchorages, hinges and any welding connections. The original approval, strength calculation, drawing and technical documentation shall be supported. A calculation shall be made for fatigue and determination of residual life. ';
40. in Paragraph 71 (2), "12" is replaced by "24."
41. In Paragraph 71, the sentences "Portable radio equipment not connected to the electrical circuits of the groove vehicle or to the antenna fixed to the groove vehicle shall be added at the end of paragraph 4. Portable radio equipment may only be used in emergency radio communication mode. ';
42. In Article 71, the following paragraph 5 is added:
"(5) The carrier is obliged to use for operation:
(a) on lines or parts of a line with an operated track-side part of a train radio equipment system to ensure the control of railway traffic or for the transmission of commands, signals, messages or data transmission of a railway vehicle equipped with a compatible functional mobile part of the radio equipment; If the en route part of the train radio equipment allows a signal to be sent to the self-stop of the groove vehicle, the railway vehicle shall be equipped with technical means for its implementation,
(b) on lines or parts of lines equipped with GSM-R train radio equipment providing communication and voice functions or data communication in ETCS, a railway vehicle equipped with a compatible mobile part of the GSM-R14 system. ';
43. in Paragraph 73, paragraph 6 is added:
"(6) Information on the driving of an international train and a national express train shall also be provided in English or German."
44. In Paragraph 74 (1), the words "accident and 'are deleted.
45. in Paragraph 74 (2), the words "accident or" and the words "accident and" shall be deleted;
46. in Paragraph 74 (3), the words "accident or" and the words "accident or" shall be deleted.
47. In Article 76, the following paragraph 5 is added:
"(5) In the case of dated links, only the abovementioned edition applies. For undated references, the latest valid edition of the standard or technical regulation, including any corrections and amendments, shall apply. ';
48. In Annex No 1, Part I. The basic signs on the national, regional and tugboat tracks, point 3:
"3. The signal" Stop, "given by light, flag, target, rectangular red signal plate, target and rectangular plate may be made of reflective material; the warning indicates the place where the face of the groove vehicle must be stopped. If the stop signal is given in the event of an emergency stop, it shall be prelined in such a way that the runway vehicle can stop safely at the specified location. The conditions of use of retro-reflective signals shall be adapted by the runway operator in the internal regulation. ';
49. In Annex No 1, Part I. The basic signs on the national track, the regional runway and the tractor, point 8, including the pictures, shall be as follows:
'8. Indicators for permanent and transient line speed limitation:
8.1. "Speedster," consisting of a white signal board on which the track speed in km.h-1 is marked by black numerals; The shape of the marker plate may distinguish the speed of the speed for different categories of transitions of the groove vehicles, preferably the shape of rectangular and circular. If the speed indicator requires a speed reduction, it is necessary to drive immediately behind the speedometer at reduced speed, if the speedometer commands a higher speed in the next line section, the speed may be increased after the end of the train is passed by the speedometer, unless the additional table on the speedometer (the black image of the locomotive in the white field) is permitted to increase the speed as soon as the front of the train misses the speed indicator.
8.2. The "Forecast," consisting of a signal plate of yellow colour, can also be made with a white edge on which the black digit indicates a tenth of the value of the permissible speed on the prefixed speedometer. The notice shall be placed at a distance of not less than 300 m for speeds up to 60 km.h-1, not less than 700 m for speeds up to 100 km.h-1 and not less than 1000 m for speeds up to 160 km.h-1 before the speedometer. 8.3. The "Forecast Shield" is a yellow triangular plate made of light reflective material, can be even with a white edge on which the black digit is marked in tens of km.h-1 value of temporarily reduced track speed. 50. In Annex No 1, Part I. The base signs on the national, regional and tugboat tracks, item 10, including the pictures, shall read:
"10. Sailors' walkways
The crossing (tribal and repetitive crossing) is a signal that informs the person driving the railway vehicle about the state of the crossing safety. The tribal crossing shall be placed at least at the stopping distance from the crossing and shall be marked with a marking band with black and white stripes of the same width, supplemented by white retro-reflectors in black stripes, unless the marking strip is made of light-reflecting material. The repeated crossing shall be placed at a distance shorter than the braking distance, or in the immediate vicinity of the crossing, and shall not be marked with a marking belt. If the passenger informs of the state of the crossing safety device of more than one crossing, the number of crossings with the crossing safety device shall be expressed by a black digit on the marking strip or on a separate white table.
10.1. "Open crossing 'is a signal at which only two yellow lights are lit on a tribal crossing or a repeated crossing, unless it is replaced by reflectors. On the" Open Crossing' message, a railway vehicle shall be driven to a crossing under the conditions of driving when the crossing safety device does not alert road users that a train or other railway vehicle is approaching the crossing (Section 35 (3) of the Ordinance). If there is no light on the tribe crossing or the repeated crossing, it always means "Open crossing."

10.2. A "closed crossing 'is a signal at which the upper white light and the lower two yellow lights are always lit on the bridge crossing or the repeated crossing, unless they are replaced by retro-reflectors. A train or a railway vehicle shall be allowed to pass at the greatest speed at the" Closed Crossing' signal. The runway operator may, by its regulation, lay down different rules for driving at a low speed, or for driving after stopping behind a crossing.

51. In Annex No 1, Part I. The base signs on the national, regional and tugboat tracks, item 12:
'12. Plates for electrical operation:
Plates for electrical operation according to paragraphs 12.1. to 12.9. are blue square plates built on top, with white edge. Indicative signs are made of white retro-reflectors of circular shape, unless the whole plate is made of light-reflecting material. The label may be illuminated, the marker being expressed by the appropriate illuminating symbol; if the indicator is not on, no indication shall be given. Portable signals for electrical operation, used mainly in lockouts, are orange colour with white border or blue colour with orange border. The signs shall be placed directly in the traction line or on the stand. '

53. Railway vehicles of the national and regional rail, Other requirements of point 5:
"5. The driving track vehicle and the driving wagon shall have a registration speedometer. The registration speedometer shall register the speed depending on the path travelled, the time of standing and driving, the time, the operation of the train alarm button or the device for checking the alertness of the person driving the railway vehicle (if fitted with this device) and the additional values according to the type of speedometer. The driving track vehicle for a speed exceeding 100 km.h-1 shall be equipped with an accurate calibrated digital speedometer with a wheel diameter correction.
Each leading railway vehicle, the driving of which only one person is to be present (with the exception of railway vehicles intended solely for displacement), shall be equipped with a functional safety device with approved operational capability according to the Railway Management Act, which ensures the control of the activity of the person driving the railway vehicle with the function of warning and the subsequent stop of the train, in the event of a negative assessment of the activity of the person driving the railway vehicle. A leading railway vehicle with a design speed of more than 100 km.h-1 intended for operation on lines equipped with a track section of the train protection shall be equipped with a compatible mobile part of the train protection pursuant to Section 9 of this Regulation. If the railway vehicle is to be operated on lines with the control of the train traffic by means of a set of technical equipment and administrative measures for traffic control on lines with simple transport conditions, it shall be equipped with a compatible technical device (terminal) to ensure synergies.
Driving railway vehicles and control vehicles that are newly approved for use shall be equipped with a mobile part of the ERTMS / ETCS train protection system according to the European Union14 Regulation, where they are intended to operate in the territory of the Czech Republic and at the same time (together) in the territory of other EU Member States on lines included in the trans-European transport network.
Driving railway vehicles and control wagons which are intended exclusively for operation on the territory of the Czech Republic and are newly approved to service after 1 January 2017 shall be equipped with the mobile part of the ERTMS / ETCS train protection system according to the European Union14 Regulation) if they are to be operated on lines which are equipped with the approved line part of the ERTMS / ETCS train protection system according to the European Union14 Regulation. '
54. in Annex 3, Part II. Railway vehicles of the national and regional rail, Other requirements of point 7 (c) and (d), the words "at least one group of traction engines' are deleted.
55. in Annex 3, Part II. Railway vehicles of the national and regional rail, Other requirements point 8:
'8. The following control and measuring instruments shall be provided at the station from which the traction traction vehicle is driven unless the track vehicle is equipped with an alphanumeric tell-tale or display:
(a) the rotor meter of the combustion engine;
(b) ampermeter of traction current (in the case of traction vehicles with electric power transmission),
(c) an ampermeter of the braking current if the track vehicle has an electrodynamic brake;
(d) oil pressure indicator in the lubricating circuit of the combustion engine,
(e) the coolant temperature indicator and the oil temperature indicator in the hydraulic gearbox in the case of traction vehicles with hydraulic power transmission;
(f) an indication of the operation of the steam generator, if equipped by the railway vehicle;
(g) signalling of fire-fighting equipment (including for railway vehicles controlled if the railway vehicle is equipped with multi-member steering);
(h) the speed adjustment indicator if the railway vehicle has a stage regulation;
(i) in the case of the use of multiple steering of motor traction traction traction and steering from the lead train vehicle, it is necessary to ensure the signalling of exceeding the limit permitted values, including those ensuring the safe operation of controlled traction vehicles. ';
56. in Annex 3, Part II. Railway vehicles of the national and regional rail, Additional requirements point 10, the second sentence is deleted.
57. Railway vehicles of the national and regional runway, Other requirements point 14 reads as follows:
"14. In the groove vehicles accessible for wheelchair use, safe passage of the trolley to a designated position shall be possible with the possibility of turning; the position of the trolley shall be provided with anchorages against the undesirable movement of the trolley. The minimum width of the vehicle's external and internal doors for wheelchair access shall be 800 mm and the width of the passages shall be not less than 800 mm. Handicap accessible railway vehicles shall have visual information for passengers supplemented by acoustic and optical information elements for persons with reduced mobility and a clear indication of all controls intended for use by passengers. Seats intended for persons with reduced mobility shall be marked with an international symbol. Handicap accessible railway vehicles with self-service control of the external doors shall be equipped with a door control device for persons with blind and mobile disabilities. Such railway vehicles shall have at least one sanitary device adapted for use by passengers on a wheelchair. ';
58. In Annex 3, Part II. Railway vehicles of the national and regional rail, Other requirements point 16, including footnote 16:
"16. The inanimate conductive parts of the boxes and covers of the devices of the groove vehicles shall be reliably connected to the casing of the groove vehicle, which shall be reliably connected to the frame vehicle. At the same time, there must be a visible conductive connection to the chassis structure. The total cross-section of the coupling wires shall be so dimensioned as to ensure sufficient strength and current capacity, at least 140 mm2. The technical conditions of strength and current load shall be deemed to have been met if they comply with a harmonised technical standard or part of a technical standard (16) which contains more detailed technical requirements.

59. in Annex 3, Part II. Railway vehicles of the national and regional rail, Other requirements point 17 reads as follows:
"17. Railway vehicles shall be compatible, with the exception of towed special vehicles, with the means of detection of the train used in a particular line section or part of the vehicle running in order to ensure the correct operation of the safety devices. In the case of the use of track circuits, adequate shunting capability shall also be ensured. The electrical resistance of the railway wheelset, measured between hoops or whole wheels, shall not exceed 0,01 Ohm. The technical conditions for determining compatibility with train detection devices and the way in which compatibility is demonstrated shall be deemed to have been met if they comply with a harmonised technical standard or part of a technical standard (16) which contains more detailed technical requirements. ';
60. In Annex 3, Part IV. The following point 42 is added:
'42. Tram runway vehicles shall be equipped with external and internal passenger information systems, including passengers with reduced mobility and orientation, which shall provide travel and traffic information. ';
