of 1 April 2015
amending Decree No 222 / 1995 Coll., on waterways, navigation in ports, common accidents and the transport of dangerous goods, as amended
The Ministry of Transport provides pursuant to § 52 of Act No. 114 / 1995 Coll., on Inland Navigation, as amended by Act No. 358 / 1999 Coll., Act No. 118 / 2004 Coll., Act No. 309 / 2008 Coll., Act No. 187 / 2014 Coll. and Act No. 250 / 2014 Coll.:
Čl. I
Decree No 222 / 1995 Coll., on waterways, navigation in ports, common accident and transport of dangerous goods, as amended by Decree No 412 / 2004 Coll., Decree No 666 / 2004 Coll., Decree No 423 / 2005 Coll., Decree No 517 / 2006 Coll. and Decree No 44 / 2008 Coll., are amended as follows:
1. In Paragraph 2 (1), the words "Paragraph 3 (4) 'are replaced by the words" Annex 2, Part 1', and the words "Praise 'are replaced by the words" Kunetice'.
2. in Article 2 (2) to (4), "§ 3 (4) 'is replaced by" Annex 2, Part 1';
3. In Article 2 (4), the words "in the section from river km 207,0 to the water flow of Dyje 'are deleted.
4. in Article 3 (a), "177,00" is replaced by "1012,58" and "152,50" is replaced by "987,80."
5. In § 3 (a), after the water flow "water flow Sazava from the river km 2,50 (Pikovice) to the river km 0,00 (Davle, mouth to the water stream Vltava)," a new water flow "water flow Castle Dyje from the river km 12,50 (turning from Dyje) to the river flow of Dyje, including Old Dyje," is inserted after the water surface "Water area of Matylda (Most)," a new water surface "Water surface of Premetry above the Elbe inserted."
6. Article 5 (1) reads as follows:
"(1) The dimensions of the marked part of the water flow with the parameters maintained, or the water flow defined by its banks, taking into account the slope of their slopes (" fairway ") are:
(a) the minimum width of the straight fairway at a depth corresponding to the draught of the design vessel
1. in the river
for classification class 0................. 14 m,
for classification class I........................................... 20 m,
for classification class IV, Va, Vb... 50 m,
2. in the navigation channel
for classification class 0................................................. 6 m,
for classification class I................................... 15 m,
for classification class IV, Va, Vb... 40 m,
(b) the minimum navigational depth shall consist of the sum of the maximum allowable draught and the safety distance between the bottom of the vessel above the water path (hereinafter referred to as safety margins). For new and newly modified waterways, the minimum navigational depth is 1,20 m + safety margins for the waterway classification classes 0, 2,20 m + safety margins for the waterway classification classes I and 2,80 m + safety margins for the waterway classification classes IV, Va and Vb. In the case of a new or newly modified waterway immediately preceding the watercourse downstream of the watercourse with a lower permissible submersion of the vessel, for this new or newly modified waterway, the navigational depth may reach the sum of the allowable dive on the immediately preceding section of the waterway and the safety margin; the construction structure shall in future enable the navigation depth to be reached according to the relevant classification class. Security margins
1. in the river
not less than 0,30 m,
for new and newly modified waterways, at least 0,30 m for classification class 0;
and at least 0,50 m for classification class I., IV, Va., Vb.,
2. in the navigation channel
at least 0,30 m for classification class 0.

(c) the smallest radius of the fairway arc

7. In Article 6 (4), the words "and 0,5 m if the classification class I and 0 are concerned 'shall be inserted after the words" at least 1 m' and the words "by the Authority 'shall be replaced by the words" the Authority'.
8. In Paragraph 7 (1), the word "navigation 'is replaced by the word" signal' and the words "Regulations on navigation safety 1) 'are replaced by the words" Regulations on rules on navigation traffic'.
footnote 1 is deleted.
9. In Article 7 (2), the second sentence is deleted.

„§ 8
Cross-country crossing
(1) The smallest underpass height of newly built or reconstructed bridges which are replaced or substantially modified by the structure is 7,0 m above the highest level of navigation on the waterway. In the case of newly built arc bridges, this height shall be maintained at a width of at least two thirds of the fairway pursuant to Section 5. When reconstructing bridge structures where there is no replacement or major structural modification of the structure, the underpass height must be maintained before the reconstruction. If the value of the underpass height cannot be respected, a movable bridge structure shall be established. Bridge objects shall be so designed as not to cause dangerous reflections for radar navigation on the waterway.
(2) The distance between the different pillars of the bridge opening, measured perpendicular to the fairway axis, shall correspond to the width of the adjacent fairway according to § 5 for new bridges or bridges with new bridge pillars, excluding moving bridges.
(3) The smallest underpass height of newly built or reconstructed bridges which are replaced or substantially modified by the structure is 5,25 m above the highest level of navigation, and the waterway is 4,0 m above the highest level of navigation.
(4) A cableway and communication lines of not less than 15,5 m may be set up over a transport-significant waterway and an electrical line up to 110 kV at least 19,0 m above the highest level of navigation. Electrical lines with a voltage greater than 110 kV may be set up above the waterway by transport significant if their height above the highest level of navigation specified in paragraph 4 is increased by 1 cm per 1 kV by more than 110 kV.
(5) Electric air lines shall not be guided through or in the vicinity of a lock with rays or nests; If they are guided through a waterway, they shall be guided in such a way that they do not cause dangerous reflections for radar navigation on the waterway.
(6) Cable lines or ducts may be placed in the bottom of the waterway by means of a transport-relevant spindle technology, in the groove protected by the bay, or by any other technology which ensures the protection of the cable line or pipe from damage to navigation. The top of the pipes, cables or cable protectors shall be at least 120 cm below the water path and at least 200 cm below the water path. In the case of fit in the groove, at least half of the height of the said stone cover shall be. ';
11. in Article 9, the title shall be deleted;
12. The following Sections 9a to 9c are inserted after Section 9, including the headings and footnotes 9 to 13:
„§ 9a
Scope and content of activities carried out in the management of the monitored waterway
(K § 5 (6) of the Act)
The activities carried out in the management of the monitored waterway are:
(a) periodic checks on navigation depth and removal of detected deficiencies;
(b) regular checks on navigation signs, operational installation, transfer or removal of navigation signs and its proper maintenance;
(c) maintenance and repair of navigational objects and other parts of the waterway, with a minimum limitation of navigation traffic and in accordance with the requirements of the Water Act (9);
(d) the agitation of the ice cell in the ports provided for in the Decree on the establishment of public ports in which ice cells.10).
Requirements for the construction and installation of the port part
(K § 6 (7) of the Act)
§ 9b
(1) The territorial part of each port includes in particular the following structures and facilities:
(a) infrastructure and railways, including roads for the arrival of vehicles of an integrated rescue system to standing vessels;
(b) standing posts for vessels to which permanent ground access must be ensured;
(c) handling spaces along standing vessels with access to vessels;
(d) connecting electricity and water vessels in such a way that all vessels standing in port have the possibility to supply electricity and water from the public network during standing;
(e) service facilities for the collection of solid and liquid waste;
(f) open and covered storage areas allowing for short-term storage of goods;
(g) the operational facilities of the port.
(2) The installation of the land part of the port is preferably located outside the active flood zone under the Water Act (11).
(3) Permanent ground access to each vessel's standing need not be ensured in the period during which the voyage is prohibited. The boarding and exit of persons from the vessel shall be illuminated and reinforced in such a way as to be safely usable even under degraded weather conditions.
(4) In a port to be used for the taking up and leaving of passengers from a vessel, this access from public communications to a vessel shall be ensured from the point of view of safe passage and access of persons with impaired mobility; in such a port, a passenger background comprising basic sanitary facilities and a waiting area for boarding.
(5) The standing position of vessels shall be designed for loading and unloading of goods and for supplying vessels. Ground access to standing positions
(a) allow the operation of vehicles and their short-term parking;
(b) it shall be adapted in such a way as to preserve it when loading and unloading the goods at other places intended for standing vessels.
(6) The port allows handling of items from the vessel and onto the vessel using the crane. In the port where the loading and unloading of goods on vessels intended to carry cargo is carried out, a handling area or equipment shall be established along the standing position of vessels intended for such loading and unloading to allow handling of goods between the vessel and a means of other transport infrastructure or storage space.
§ 9c
(1) The port allows basic repair and maintenance of vessels and fuel fuelling by means of a fixed facility or service vessel. Seats intended for the repair and maintenance of vessels shall include ground handling areas accessible by vehicles and cranes. In or near a port, the collection of waste water, including oiled water from vessels, and the supply of water to vessels shall be ensured. If they are treated in a port with defective substances, this activity is governed by the Water Act (12).
(2) The port shall allow for the safe standing and operation of vessels corresponding to the waterway class listed in Annex 1 to this Regulation. The location and untying elements of a port with a protective function allow safe standing of vessels corresponding to the waterway class listed in Annex 1 to this Regulation from the minimum navigational level up to the level corresponding to the maximum recorded flood. In all this, access to the vessel or to a group of vessels which are interconnected from around the unaffected floods is maintained.
(3) Public port
(a) allow the removal of small vessels from the water and their introduction into the water with access to the infrastructure;
(b) establish the conditions for the possibility of carrying out processing activities directly in a port.
(4) On each section of the waterway which is not more than 100 km long, the possibility of repair, maintenance and technical inspection of the vessels corresponding to the waterway class referred to in Annex 1, including the possibility of their extraction, shall be ensured.

13) Decree No. 138 / 2000 Coll., on radio-telephony on inland waterways. '
13. The common title above Paragraph 10 reads:
"Ensuring the safe operation of the vessel in port
(K § 8 (6) of the Act) '.
14. in Paragraph 10, paragraphs 1 and 2 are deleted;
Paragraphs 3 and 4 shall become paragraphs 1 and 2.
15. in Article 10 (1), the words "the Code of Navigation Security" shall be replaced by the words "the Order on the rules of navigation."
16. in Paragraph 10 (2), the word "ship" shall be deleted;
Article 17 (11) and (12) are deleted.
18. Paragraph 13 (1) and (2), including footnote 2, are deleted and paragraph 3 is deleted.
19. in Article 14 (1), the words "properly and" shall be deleted.
20. Paragraph 14 (3) is deleted.
Paragraphs 4 to 8 shall be renumbered paragraphs 3 to 7.
21. Paragraph 14 (3) reads:
"(3) Reflectors must be inserted between vessels and between vessels and port walls."
22. In the first sentence of Article 14 (4), the comma is replaced by "or 'and the word" etc.' is deleted.
23. In Article 14 (4), the words "administration and 'are replaced by the words" office' and the words "clear marking 'are replaced by the words" ropes or chains clearly marked'.
24. in Paragraph 14 (5):
"(5) Leaders of vessels standing in port shall, if necessary, allow another vessel to be carried out when the safety or activity of its own vessel is not thereby compromised. This does not apply to
(a) the head of the sailing vessel, the police of the Czech Republic, the municipal police and the water manager,
(b) the master of the vessel of an integrated rescue system operating at the site of the rescue or disposal operations;
(c) a master of a vessel transporting persons under a public timetable; and
(d) a leader of a small vessel using a public port for long-term standing. ';
25. in Article 14 (7), the words "except for the sculptures used," shall be inserted after the words "objects."
26. Paragraph 16 (2) is deleted and paragraph 1 is deleted.
27. In Section 17, the word "adequate 'is deleted and the words" dimensions of at least 1 m x 1 m' are inserted after the word "openings'.
28. Sections 20 to 22 are deleted.
29. In Article 23 (1), the words "or electronically 'shall be inserted after the words" in writing'.
30. Paragraph 23 (2) is deleted and paragraph 1 is deleted.
31. Article 24 shall be deleted;
32. Footnote 3 reads:
"3) Act No. 372 / 2011 Coll., on health services and the conditions for their provision (Health Services Act), as amended. Act No. 166 / 1999 Coll., on Veterinary Care and on the amendment of certain related laws (Veterinary Act), as amended. Decree of the Ministry of Justice of the Czech Socialist Republic No. 104 / 1987 Coll., determining infectious human diseases within the meaning of the Criminal Act. '
33. In Section 25, the words "and the office of departure 'and the words" the administration of navigation' are inserted after the words "the veterinarian '.
34. Paragraph 26 (1) is deleted.
Paragraphs 2 and 3 shall be renumbered paragraphs 1 and 2.
35. in Paragraph 26 (1), the comma after the word "veterinarian" shall be replaced by "a" and the words "and navigation authorities" shall be deleted;
36. Paragraph 28 shall be deleted, including the title.
37.
"Safety advisers for the transport of dangerous goods
(Paragraph 36a (7) and (8) of the Law) '.
38. Sections 35 and 36 are deleted.
39. in § 37 (1) (a), § 37 (2) and § 38 (3), "3" is replaced by "2."
40. In Paragraph 38 (1), the words "or other comparable test ', including the reference to footnote 4, are deleted.
41. in Paragraph 38 (7), "4" is replaced by "3."
42. In Paragraph 38 (7), the words "have" and "have taken part in the training provided for in Paragraph 37 (1) (a) or" shall be deleted.
43. In Annex 1, Part 1B, the words "intended for the operation of passenger water transport 'are replaced by the words" of regional importance' and the words "Local 'are replaced by the words" Regional'.
44. Annex No 2 is deleted.
45. In Annex 3, Part II, point 16, the words "Regulations on rules on navigation and others' shall be inserted after the words" under '.
46. footnote 7 reads:
"7) Act No. 114 / 1995 Coll., on Inland Navigation, as amended. Act No. 254 / 2001 Coll., on waters and amending certain laws (Water Act), as amended. '

Efficacy
This Decree shall take effect on 15 April 2015.
