on the negotiation of the Agreement between the Government of the Czech Republic and the Government of the Republic of North Macedonia on the provision of spare parts, consumables, repair of parts and other aircraft services operated by the Ministry of Defence of the Republic of North Macedonia
The Ministry of Foreign Affairs states that on 15 December 2023 an Agreement was signed in Skopje between the Government of the Czech Republic and the Government of the Republic of North Macedonia on the provision of spare parts, consumables, repairs of parts and other services for aircraft operated by the Ministry of Defence of the Republic of North Macedonia.
The Treaty entered into force on the date of signature of its Article 8 (1).
The English version of the Agreement and the English version, which are relevant for its interpretation, shall be published simultaneously.

The Government of the Czech Republic and the Government of the Republic of North Macedonia, hereinafter referred to as "the Contracting Parties',
Desiring to strengthen friendly links and cooperation between the two countries,
Taking into account the Arrangement between the Ministry of Defence of the Czech Republic and the Ministry of Defence of the Republic of Macedonia on mutual cooperation, signed in Skopje on 17 February 2000, and the Memorandum of Understanding between the Ministry of Defence of the Czech Republic and the Ministry of Defence of the Republic of North Macedonia and the Ministry of Interior of the Republic of North Macedonia on technical cooperation, signed in Skopje on 11 May 2021,
Taking into account the Treaty between the Czech Republic and the Republic of Macedonia on the exchange and mutual protection of classified information, signed in Prague on 27 August 2008,
seeking mutually beneficial long-term cooperation based on mutual respect, trust and interests of each of the Contracting Parties,
recognising the ability of the defence industry of the Czech Republic to provide spare parts, consumables, repair and overhaul of components, maintenance and training of technical personnel for aircraft operated by the Ministry of Defence of the Republic of North Macedonia,
agree on the following:
Purpose and scope
1. The purpose of the Agreement is to adapt the general principles of cooperation between the Parties in the process of providing spare parts, consumables, repairs and general repairs of components, maintenance services and training of technical personnel for helicopters Mi8MT / 17 with TV3-117MT engines, Bell 206B3 helicopters and Zlin 242 L aeroplanes operated by the Ministry of Defence of the Republic of North Macedonia.
2. Cooperation between the Contracting Parties shall be carried out in accordance with the applicable legislation of their States and relevant international law standards.
3. The implementation of cooperation may require the specific agreement of the competent authorities of the States of the Contracting Parties, in accordance with the applicable legislation of the States of the Contracting Parties. This Agreement shall not in itself give rise to entitlement to such cooperation without the consent of the competent authorities of the States of the Contracting Parties.
Implementing authorities and authorised organisations
(1) The authorities of the Contracting Parties for the implementation of this Agreement (hereinafter referred to as the implementing bodies) shall:
Czech Republic - Ministry of Defence of the Czech Republic,
for the North Macedonian Party - Ministry of Defence of the Republic of North Macedonia.
2. Powerful organisations for the provision of spare parts, consumables, repairs and general repairs of components, maintenance and training of technical personnel for Mi8MT / 17 helicopters with TV3-117MT engines, Bell 206B3 helicopters and Zlin 242 L aeroplanes, technical consultations and other support under this Agreement (hereinafter referred to as "authorised organisations") shall:
for the Czech Republic - LOM PRAHA, state enterprise,
for the North Macedonian Party - Ministry of Defence of the Republic of North Macedonia.
Implementation of the Agreement
1. The implementing authorities shall manage, supervise and evaluate cooperation under this Agreement.
2. Provision of spare parts, consumables, repairs and overhauls of components, maintenance services and training of technical personnel for Mi8MT / 17 helicopters with TV3-117MT engines, Bell 206B3 helicopters and Zlin 242 L aeroplanes and their conditions will be adjusted on the basis of commercial contracts negotiated between authorised organisations. The implementing authorities will assist in the negotiation and implementation of these trade agreements.
3. The total value of spare parts, consumables, repairs and overhauls of components, maintenance services and training of technical personnel for helicopters Mi8MT / 17 with TV3-117MT engines, Bell 206B3 helicopters and Zlin 242 L aeroplanes operated by the Ministry of Defence of the Republic of North Macedonia pursuant to the Letter of the Ministry of Defence of the Republic of North Macedonia No 18 / 2-14 / 43 of 7 June 2023 and LOM PRAHA offer No LOM / 2023 / AD-2209 of 24 July 2023 shall not exceed EUR 5,000.000, - EUR.
4. The Contracting Parties recognise that the implementation of certain activities under this Agreement requires support or cooperation by third parties. Each Contracting Party shall make every effort to ensure such support or cooperation between third parties.
Working groups
In order to facilitate cooperation under this Agreement, working groups may be set up as necessary. These working groups shall be composed of the competent representatives of the States of the Contracting Parties. The implementing bodies shall set the dates of the meetings, the status of the working groups and the manner in which they shall work.
Protection of information and intellectual property
1. The Parties will protect classified information transmitted, exchanged or generated under this Agreement in accordance with the Treaty between the Czech Republic and the Republic of Macedonia on the exchange and mutual protection of classified information, signed in Prague on 27 August 2008.
2. The Contracting Parties understand that any information obtained in the framework of cooperation under this Agreement may not be shared with third parties without the prior written consent of the other Contracting Party and may not be used against the interests of the States of the Contracting Parties.
3. The Contracting Parties shall ensure that intellectual property rights transferred or created under this Agreement are protected in accordance with the relevant national law and applicable international treaties.
Dispute settlement
Any dispute between the Contracting Parties relating to the interpretation and implementation of this Agreement shall be resolved only through negotiations and consultations between the Contracting Parties.
Amendments
Any amendments to this Agreement shall be made by mutual agreement of the Contracting Parties. Such amendments shall be made in the form of separate protocols forming an integral part of this Agreement and shall enter into force in accordance with Article 8 of this Agreement.
Final provisions
This Agreement shall enter into force on the date of signature.
2. Each Contracting Party may terminate this Agreement. The denunciation shall enter into force six months after the date of receipt of the notice of denunciation by the other Contracting Party.
3. Termination of this Agreement shall not affect the validity and duration of trade agreements concluded in the framework of the implementation of cooperation under this Agreement.
This Agreement has been signed by the duly authorised representatives of the Contracting Parties.
Dane v Skopji on 15.12.2023 in two original copies, each in the Czech, Macedonian and English languages, each text being equally authentic. In the event of irregularities in the interpretation of this Agreement, the English version shall be decisive.
