DECLARATION
of 5 March 2019
amending Decree No 289 / 2007 Coll., on animal health and veterinary requirements for animal products not covered by the directly applicable provisions of the European Communities, as amended
The Ministry of Agriculture provides, pursuant to Article 78 of Act No. 166 / 1999 Coll., on Veterinary Care and on the amendment of certain related laws (Veterinary Act), as amended by Act No. 131 / 2003 Coll., Act No. 316 / 2004 Coll., Act No. 48 / 2006 Coll., Act No. 182 / 2008 Coll., Act No. 227 / 2009 Coll., Act No. 308 / 2011 Coll., Act No. 359 / 2012 Coll., Act No. 279 / 2013 Coll., Act No. 139 / 2014 Coll., Act No. 264 / 2014 Coll., and Act No. 302 / 2017 Coll. (a) to implement § 18 (6), § 21 (18), § 25 (5) (a), § 27a (10) (b) and (d) and § 27b (a) (c):
Čl. I
Decree No. 289 / 2007 Coll., on animal health and veterinary requirements for animal products not covered by the directly applicable provisions of the European Communities, as amended by Decree No. 61 / 2009 Coll. and Decree No. 11 / 2015 Coll., is amended as follows:
1. in Article 1 (d) and 7 (3), the word "seasonal" shall be deleted;
2. in Sections 1 (i), 3 (1) of the introductory part of the provisions and (a), Title 6, Title 9 and 32 (1) (c), the words "to circulation" shall be replaced by the words "to the market."
3. in Article 1 (l), the word "Protocol 'is replaced by the word" entry' and the words "and of deficiencies detected 'are deleted;
4. In Article 1 (n), the words "to the official veterinarian 'are replaced by the words" to the Regional Veterinary Administration through the Information System of the State Veterinary Administration';
5. In Article 1, at the end of point (o), the dot is replaced by a comma and the following point (p) is added:
"(p) which food of animal origin is inedible."
6. In Section 4, the word "protocol 'is replaced by" record'.
7. The heading above Section 7 reads: "Requirements for a separate point of sale and rules for the sale of live fish at that point '.
8. Paragraph 7 (1) reads as follows:
"(1) A separate point of sale intended for the sale of live fish and, where appropriate, for their killing, evisceration, cutting or other modifications shall be located and equipped with such that all activities at that point are carried out under appropriate hygiene conditions. ';
9. Paragraph 10 to 11a, including the headings, read:
„§ 10
Fresh poultry meat
(1) A breeder whose annual production is less than 2 000 turkeys, geese or ducks, or 10 000 other poultry, may uncut fresh poultrymeat in small quantities
(a) sell directly to the consumer in his economy, market or market; or
(b) supply to local retail.
(2) A small quantity of fresh poultry meat intended for sale or delivery as referred to in paragraph 1 shall be considered to be uncut meat of up to 10 turkeys, 35 geese, 35 ducks and 35 other poultry sold or delivered within a week.
(3) In the case of the sale or supply of uncut fresh poultry meat, the meat by the seller must be accompanied by a clearly visible and legible warning "Meat not tested by veterinary examination - determined after heat treatment for consumption in the consumer's household '.
§ 11
Fresh rabbit meat
(1) A breeder who keeps rabbits in small quantities may uncut fresh rabbit meat in small quantities
(a) sell directly to the consumer in his economy, market or market; or
(b) supply to local retail.
(2) A small quantity of fresh rabbit meat intended for sale or delivery as referred to in paragraph 1 shall be considered to be uncut meat of up to 35 heads of rabbits sold or delivered within one week.
(3) When selling or supplying uncut fresh rabbit meat as referred to in paragraph 1, the head shall not be separated from the body.
(4) In the case of the sale or supply of uncut fresh rabbit meat, the meat by the seller must be accompanied by a clearly visible and legible warning "Meat not tested by veterinary examination - determined after heat treatment for consumption in the consumer's household '.
§ 11a
Fish and other aquaculture animals
(1) Live fish or other aquaculture animals may be kept in small quantities
(a) sell directly to the consumer on his holding; or
(b) the placing on the market of fresh fishery products when providing catering services on the farm.
(2) A small quantity of live fish or other aquaculture animals sold by the breeder shall be considered to correspond to the normal daily consumption of such live fish or other aquaculture animals in the household of the consumer. ';
footnote 5a is deleted.
10. the following Article 11b is inserted after Article 11a:
„§ 11b
Fresh meat from nutrition
(1) The breeder who keeps the nutrition in small quantities may have uncut fresh meat from the nutrition in small quantities
(a) sell directly to the consumer in his economy, market or market; or
(b) supply to local retail.
(2) A small quantity of fresh meat from nutrition intended for sale or delivery as referred to in paragraph 1 shall be considered to be uncut meat from a maximum of 35 pieces of nutrition sold or delivered within one week.
(3) When selling or supplying uncut fresh meat from nutrition referred to in paragraph 1, the head shall not be separated from the body.
(4) In the case of the sale or supply of uncut fresh meat from nutrition, the meat by the seller must be accompanied by a clearly visible and legible warning "Meat not tested by veterinary examination - determined after heat treatment for consumption in the consumer's household." '
11. in Article 12 (1):
"(1) The user of the hunt may in small quantities the bodies of wild game caught in the skin or feathers (" game ')
(a) to sell directly to the consumer;
(b) deliver to a local retail store;
(c) deliver to a local retail establishment which has been registered by the Regional Veterinary Administration as a game handling establishment; or
(d) sell directly to the consumer in the market or market, if it is small wild game.
In such cases, a clearly visible and legible warning "The knowledge has been examined by a trained person - intended after heat treatment for consumption in the consumer's household" must be attached to the game by the seller. '
12. in Article 12, paragraphs 2 and 3 are deleted;
Paragraphs 4 to 8 shall be renumbered paragraphs 2 to 6.
13. in Paragraph 12 (3), "paragraph 4 (b)" is replaced by "paragraph 2 (b)";
14. in Paragraph 12 (4), the words "paragraph 1 (c)" shall be deleted;
15. Paragraph 12 (5) reads:
"(5) A small quantity of game intended for sale or delivery as referred to in paragraph 1 by the user of each chase shall be considered to be 5 head of large wild game and 35 head of small wild game per week, but not more than 50% by the user of the game caught in one hunt per year, such 50% being free of 120 head of large wild game and 400 head of small wild game. ';
16. Paragraph 12 (6) is deleted.

„§ 12b
Details of tests carried out which laboratories are required to submit to the Regional Veterinary Administration and the date of their submission
(1) A laboratory which has been issued a certificate of accreditation to carry out an examination of game or fresh meat from nutrition, a State Veterinary Institute and a laboratory which has been issued by the Regional Veterinary Administration pursuant to Paragraph 50 (3) of the Act of Authorisation for this type of investigation shall submit to the Regional Veterinary Administration, through the Information System of the State Veterinary Administration, data on tests carried out on game or fresh meat from nutrition for the presence of muscle (Trichinella) once a year by 15 January for the period preceding the calendar year.
(2) The report referred to in paragraph 1 shall contain:
(a) the name of the laboratory which carried out the tests;
(b) identification of the client of the examination, which is:
1. in the case of game, data on the user of the chase referred to in Article 12a (3) (a);
2. in the case of fresh meat from nutrition, the name and, where applicable, the name, surname and address of the place of residence, if any, of the natural person, or the name, registered office, identification number and location of the organisational unit, if any, of the legal person, the breeder of the nutrition,
(c) for cloven-hoofed game, the seal number of the wild game caught;
(d) in the case of cloven-hoofed game and badger, the name or number of the cadastral hunting area where the game was caught;
(e) date of the examination;
(f) result of examination for the presence of muscle (Trichinella),
(g) the method used to test for the presence of muscle (Trichinella). ";
18. in Paragraph 13 (1):
"(1) The breeder may, with the agreement of the Regional Veterinary Administration, have raw milk in small quantities
(a) sell directly to the consumer on his holding at the place of production; or
(b) to sell directly to the consumer through a vending machine for consumption in his household. "
19. Paragraph 13 (2) is deleted.
Paragraphs 3 to 7 shall be renumbered paragraphs 2 to 6.

„§ 14
Fresh eggs
(1) Breeders may keep unpacked fresh eggs in small quantities
(a) sell directly to the consumer in his economy, market or market; or
(b) supply to local retail.
(2) The fresh eggs referred to in paragraph 1 may be sold to the final consumer no later than 21 days after laying, the minimum durability being 28 days from the laying date.
(3) Fresh eggs, supplied by the breeder in small quantities to the local retail trade, must be illuminated and must be accompanied by clearly visible information to the consumer on the minimum durability of the eggs and the name and, where appropriate, the names of the breeder and the address of the breeder where the eggs were produced.
(4) No more than 60 eggs shall be considered as small quantities of fresh eggs which may be sold by the breeder on his own holding, on the market or on the market directly to one consumer.
(5) A small quantity of fresh eggs which may be the subject of one supply of such eggs by the farmer to the local retail trade shall be considered to be not more than 600 eggs during a period of 1 week. '
21. The heading of Section 15 reads: "Honey and royal jelly."
22. in Paragraph 15 (3):
"(3) A quantity not exceeding 2 tonnes per year shall be considered as a small quantity of honey intended for sale by the breeder directly to the breeder's household, the breeder's holding, the market or the marketplace, or to be delivered by the breeder to the local retail store. '
23. Paragraph 15 (4) is deleted.
24. Title 8, including the title:

26. In Annex 3, Part A II, Article 7, including footnote 13, reads:

Authority carrying out national veterinary surveillance
(a) take samples,
(b) duly indicate the samples taken;
(c) make a record of sampling;
(d) ensure the packaging, storage and dispatch of samples taken under special legislation13) by laboratory testing in such a way as to avoid any changes or confusion.

27. Annex No 4 is deleted.

Technical Regulation
This Decree was notified in accordance with Directive (EU) 2015 / 1535 of the European Parliament and of the Council of 9 September 2015 laying down a procedure for the provision of information in the field of technical and information society services.
Čl. III
Efficacy
This decree shall take effect on the 15th day following its publication.
