amending Decree of the Ministry of Transport No. 223 / 1995 Coll., on the eligibility of vessels to operate on inland waterways, as amended
The Ministry of Transport provides pursuant to § 52 of Act No. 114 / 1995 Coll., on Inland Navigation, as amended by Act No. 358 / 1999 Coll., Act No. 118 / 2004 Coll., Act No. 309 / 2008 Coll. and Act No. 187 / 2014 Coll., ("the Act ') for the implementation of § 9 (6), § 10 (3), § 10 (3), § 10 (6), § 10 (9), § 14 (7), § 17 (1), § 17 (3), § 18 (3), § 19 (3), § 20 (1), § 21 and § 24 (4) thereof:

Decree No. 223 / 1995 Coll., on the eligibility of vessels to operate on inland waterways, as amended by Decree No. 83 / 2000 Coll., Decree No. 186 / 2005 Coll., Decree No. 6 / 2006 Coll., Decree No. 38 / 2006 Coll., Decree No. 173 / 2009 Coll., Decree No. 388 / 2009 Coll., Decree No. 38 / 2010 Coll. and Decree No. 28 / 2014 Coll., is amended as follows:
1. Paragraph 1, including the title and footnote 1, reads as follows:
„§ 1
Subject matter
This decree implements the relevant provisions of the European Union1) and provides for
(a) technical requirements for the safety of the operation of vessels subject to registration and floating bodies, except for vessels whose volume, calculated as the product of length, width and draught, is less than 100 m3, if applicable
1. small vessels, having a hull length of less than 20 m;
2. ferry ships intended for the transport of 12 passengers or more; or
3. floating gear with a length of less than 20 m;
(b) the method of keeping records of vessels in the register;
(c) vessels whose technical competence is verified by the expert panel;
(d) the procedure for carrying out the technical inspection, the organisational security of the technical inspection, the composition of the expert commission, the promise of a member of the expert commission, the manner in which the expert committee has acted and its activities in carrying out the technical inspection of the vessel;
(e) the procedure for carrying out the periodic technical inspection and its scope;
(f) the extent and conditions of liability insurance for the operation of the vessel;
(g) designated technical equipment on vessels subject to supervision, scope of competence and other conditions for obtaining authorisation of persons eligible for their technical examinations and tests;
(h) a model certificate for the vessel;
(i) the sailing zones for which the technical competence of the vessel is approved, the characteristics of each type of vessel and the conditions for the safe operation of the vessel not subject to registration;
(j) the number and professional composition of crew members for each type of vessel;
(k) the vessels for which the marking must be carried out and the conditions for its implementation and the procedure; and
(l) the types of vessels which must bear the load marks and the dialling scales, the particulars of the load marks and the dialling scales for each type of vessel and the manner in which they are placed on the vessel and the logbook by which the vessel must be equipped and the particulars recorded therein.

Commission Directive 2008 / 126 / EC of 19 December 2008 amending Directive 2006 / 87 / EC of the European Parliament and of the Council laying down technical requirements for inland waterway vessels. Commission Directive 2009 / 46 / EC of 24 April 2009 amending Directive 2006 / 87 / EC of the European Parliament and of the Council laying down technical requirements for inland waterway vessels. Commission Directive 2012 / 48 / EU of 10 December 2012 amending the Annexes to Directive 2006 / 87 / EC of the European Parliament and of the Council laying down technical requirements for inland waterway vessels. Commission Directive 2012 / 49 / EU of 10 December 2012 amending Annex II to Directive 2006 / 87 / EC of the European Parliament and of the Council laying down technical requirements for inland waterway vessels. ';
2. After Paragraph 1, the following Section 1a is inserted:
„§ 1a
Waterways sailing zones
(K § 9 (6) of the Act)
(1) Inland waterways are included in navigation zones 1 to 4 with regard to their navigable operating conditions which must comply with the design, technical and operational competence of the vessels provided for in this Regulation operating on them.
(2) The technical requirements for the safety of the operation of vessels are set out in Annex 1 to this Regulation.
(3) The inclusion of the waterways of the Czech Republic in individual navigation zones is set out in Annex 2 to this Decree. "
3. The heading of Section 2 reads:
"Characters of individual types of vessels'.
4. in Article 2 (1), point (b) shall be deleted;
Points (c) to (e) shall be renumbered (b) to (d).
5. in Article 2 (2), (4), (5) and (6), the word "determining" shall be deleted;
6. In Article 2 (3), the word "designating 'is deleted.
7. In Article 2 (4), the words "designation and 'are deleted.
8. In Paragraph 2 (5), the words "not intended for repeated movements on the waterways' are deleted.

„§ 3
Technical requirements for the operation safety of individual types of vessels
(K § 10 (2) of the Act)
(1) The technical requirements for the safety of the operation of vessels covered by this Regulation and the procedure for carrying out the technical inspection are set out in Annex 1 to this Regulation.
(2) Floating equipment,
(a) the length of which is 20 m or more and the volume of which, expressed as product of length, width and draught, is 100 m3 or more, may be operated on a waterway if, in view of the purpose and method of application, it adequately satisfies the requirements laid down in Annex 1 to this Regulation;
(b) whose dimensions are smaller than those referred to in point (a) may be operated on a waterway if, taking into account the purpose and method of use, it adequately complies with the requirements laid down in the Ordinance on the register of small vessels and the eligibility of small vessels to operate on waterways. ";
10. in Article 3a (2) and (3), the words "State Navigation Administration" shall be replaced by the words "The Authority."

„§ 4
Vessels subject to verification of technical competence by expert commissions
(K § 10 (3) of the Act)
The verification of the technical competence of vessels by the expert commission established by the Navigation Authority shall be subject to vessels for which the safety requirements for their operation, including the equipment provided for in this Order, are, except:
(a) floating bodies; or
(b) vessels referred to in Article 2 (1) (a) to (c) which have a valid vessel certificate issued pursuant to Article 22 of the Revised Convention for the Navigation of the Rhine or a valid vessel certificate issued in another Member State of the European Union or another Contracting State of the Agreement on the European Economic Area or the Swiss Confederation. "
12. in Paragraph 4a (1):
"(1) The expert committee shall be composed of at least one staff member of the navigating office, one expert on the construction of vessels and their machinery and one seaman; In so doing, the Agency may establish experts and other experts. ';
13. in Article 4b (4), the words "or any other Contracting State of the Agreement on the European Economic Area or the Swiss Confederation" shall be inserted after the words "the European Union";
14. in § 4c, paragraph 1 is deleted;
Paragraphs 2 and 3 shall be renumbered paragraphs 1 and 2.
15. Paragraph 4e, including the title and footnote 2c, is deleted.
16. in Article 5, the words "small vessels," shall be deleted;
17. In Article 5, the current text becomes paragraph 1 and the following paragraph 2 is added:
"(2) The conditions for carrying out the marking and for its operation are contained in the Order for the marking of inland waterway ships, which is annexed to the Order No 5. '.
18. In Article 6, at the end of paragraph 2, the sentence "The data entered in the logbook are contained in Annex 6 to this decree."
19. In Article 6, at the end of paragraph 3, the sentence "The data entered in the book of oiled waters are set out in Annex 7 to this Decree."
20. Paragraph 6 (4) is deleted.
Paragraphs 5 to 11 shall be renumbered paragraphs 4 to 10.
21. in Article 6 (5), the words', small vessel certificate 'shall be deleted;
22. in Paragraph 6 (8), the word "administration" is replaced by the word "office."
23. The heading of Section 7 reads:
"Time limits for periodic technical inspections and models of vessel certificates'.
24th Paragraph 7 (1) reads:
"(1) The time limit for the submission of an application for a periodic technical inspection, established from the date of approval of the technical capacity of the vessel and the issue of a certificate of the vessel or from the date of the previous periodic technical inspection, shall be:
(a) 4 years in the case of:
1. passenger ships,
2. motor tankers,
3. Tank compression or towing boat; or
4. floating equipment used as a botel or restaurant,
(b) 9 years in the case of:
1. cargo ships, except tanker ships referred to in (a);
2. a pushing or towing boat, except for the tanker referred to in point (a);
3rd tugboat,
4. ferry ships,
5. special ships,
6. floating machines; or
7. floating equipment except floating equipment referred to in point (a);
(c) 4 years in the case of a ship older than 30 years, irrespective of its destination; or
(d) 3 years in the case of a vessel manufactured before 1 January 1950. "
footnote 2d is deleted.
25. in Article 7, paragraphs 2 and 3 are deleted;
Paragraph 4 shall become paragraph 2.
26. in Paragraph 8 (1), "1" is replaced by "2 (1)."
27. in Article 8 (1), point (b) is deleted;
Points (c) and (d) shall be renumbered (b) and (c).
28. in Article 8 (2), points (a) and (b) are deleted;
Points (c) to (f) shall be renumbered as points (a) to (d).
29. Article 9 (1) is deleted.
30. the following Sections 11a and 11b are inserted after Section 11, including the headings and footnotes 10 and 11:
„§ 11a
Number and professional composition of crew members for each type of vessel
(Paragraph 24 (4) of the Law)
(1) The crew of the ship and the pressurised or side-bound formation consist of at least 1 captain and 2 boatmen, unless otherwise specified.
(2) The crew shall be extended by one or more seamen in the event that the machinery, steering or other equipment necessary for the navigation of the necessary equipment requires separate service.
(3) The ship's crew can be reduced to 1 skipper and 1 boatman if the ship
(a) it does not have its own machinery;
(b) has a length of up to 30 m; or
(c) has at least one binding device within the range of the operating position of the machinery and steering gear.
(4) The crew of the transport ship consists of 1 ferry. The crew of the ferry shall be extended by one or more seamen, taking into account the type, place and manner of its operation.
(5) The crew of the floating machine consists of 1 engineer. The crew shall be designated as for ships for the carriage of a floating machine on transport-relevant waterways.
(6) On a ship carrying dangerous goods, at least one crew member shall be the person holding a certificate of competence under the international contract governing the transport of dangerous goods by inland waterway, which is part of the legal order (10).
§ 11b
Mode of registration of vessels in the register
(Paragraph 14 (7) of the Law)
(1) Vessel records shall be kept in the register in the electronic list of technical data to the vessel, data on its owner and operator, the lien on the vessel, data on the technical inspections carried out and data on technical changes made on the vessel affecting the ability of the vessel to operate and changes to the owner or operator of the vessel. In addition, the data list shall include information on the issue of a vessel certificate and the assignment of registration marks, the single European identification number, the identification code of the automatic system for identification of radio stations on waterways and the identification number of the maritime mobile service, if assigned.
(2) All data on the vessel, its owner and operator shall be kept and kept in the register as long as the vessel is registered. If, at the request of its owner, the vessel is deleted from the register, the data on it shall be kept electronically and in the register file under another legislature11).

31. in Article 13a, the comma after the word "travel" shall be replaced by the word "and" and the words, "vessels intended to carry a maximum of 12 passengers other than crew and recreational craft under special legislation" shall be deleted;
32. in Annex 1, in Chapters 10.03a., 10.03b., 10.03b.6. (a), 10.03c., 10.03c.1, "Fixed fire systems" is replaced by "Fixed fire extinguishers."
33. in Annex 1, Chapters 10.03a.1 and 10.03b.2 (a), the words "fixed fire systems" are replaced by the words "fixed fire extinguishers."
34. in Annex 1, Chapters 10.03a.2 and 10.03a.9, the word "systems" is replaced by the word "equipment."
35. in Annex 1, Chapters 10.03a.3 to 10.03a.6, the word "Systems" is replaced by the word "Equipment."

The waterways of the Czech Republic do not contain this sailing zone (these are coastal areas of the sea, estuaries into the sea, and large inland lakes).

Order for marking inland waterway ships

Část 1

General provisions
1. The feeling of the ship shall be measured directly on the ship. A part of a ship located between the waterline plane corresponding to the largest dive at which the ship can sail (upper calorific plane) and the empty water line (lower calorific plane) is subject to a feeling. A horizontal plane passing through the lowest point of the body may also be used as the lower grade plane.
2. The plane of the empty ship's waterline (lower grade plane) is a plane passing at the water level when
(a) there is no fuel or moving load on the ship and there is only equipment, supplies and crew normally present on the ship for navigation, but the supply of drinking water must not substantially exceed 0,5% of the maximum displacement of the ship or water which cannot be pumped from the ship's premises by normal means of pumping;
(b) machinery, boilers, pipe systems and equipment for the movement of ships, for heating or cooling contain water, oil and other liquids necessary for their operation;
(c) the ship is situated in fresh water, i.e. in water whose density is equal to 1000 kg / m3.
3. If, at the time of measurement, the ship does not meet the conditions set out in point 2 or the conditions giving the same dive and approximately the same tilt, then the difference in load and water density shall be taken into account in the calculation.
4. Centipede space is the space between the outer walls of the ship's body limited by the upper calibration plane and the lower grading plane.
5. The upper grade plane is determined by the safety distance and free side prescribed or customary for the waterway for which the ship is intended.
6. In the case of vessels which are unladen with a larger stern dive but are in a steady-state position when loaded, the upper grading plane shall be determined in such a way that the mean straight part of the bottom or keel is observed to the safety distance and the free side prescribed or normal for the waterway on which the vessel is to sail.
7. The accuracy of the grading must be such that the error in the values of the displacement recorded in the rating card (whether the highest displacement corresponding to a certain difference in the dive) does not exceed
(a) 1% for discharge values up to 500 m3;
(b) 5 m3 for discharge values from 500 m3 to 2000 m3; or
(c) 0,25% for discharge values above 2000 m3.
8. The load on the ship, corresponding to the draught of the empty ship, shall be indicated on the rating card.

Část 2

Caging of ships intended for the transport of goods
1. The measured part of the ship shall be broken down into the calorific layer by horizontal planes or, if the upper and lower calorific planes are not parallel, the planes passing through the line representing the intersection of these planes. The height of the grade layer shall be chosen in such a way that, taking into account the shape of the body, it is sufficient to accurately calculate the volume; for the calculation of the volume in the moulded parts, the distance between horizontal planes or the mean height of the measuring layer between the cutting planes is the same and generally equal to 10 cm.
2. The volume of the calorific layer bounded by horizontal planes shall be calculated by multiplying the half of the sum of the surfaces of the upper and lower planes by the height of the layer. The volume of the calorific layer bounded by the cutting planes shall be calculated in a similar manner, with the length of the vertical line bounded by the upper and the lower plane passing through the centre of gravity of the surface of the centre part of the calorific layer being selected at the median height. For simplification, the length of the vertical passing through the centre of gravity may be used for all grade layers.
