amending Government Regulation No 74 / 2015 Coll., on the conditions for granting subsidies on animal welfare measures, as amended by Government Regulation No 113 / 2015 Coll.
The Government orders pursuant to § 2c (5) of Act No. 252 / 1997 Coll., on Agriculture, as amended by Act No. 85 / 2004 Coll., Act No. 291 / 2009 Coll. and Act No. 179 / 2014 Coll., and pursuant to § 1 (3) of Act No. 256 / 2000 Coll., on the State Agricultural Intervention Fund and on the amendment of certain other laws (Act No. 179 / 2014 Coll. as amended by Act No. 441 / 2005 Coll., Act No. 291 / 2009 Coll. and Act No. 179 / 2014 Coll.:
Government Regulation No. 74 / 2015 Coll., on the conditions for granting subsidies on animal welfare measures, as amended by Government Regulation No. 113 / 2015 Coll., is amended as follows:
1. in Article 3 (3), the words "(hereinafter referred to as" the animals') 'are replaced by the words "(hereinafter referred to as" the animal') ';
2. In Article 3 (4), the words "(hereinafter referred to as" the said holding ')' are deleted.
3. in Article 6 (1) (b), including footnote 6:
"(b) on the holding referred to in the application for a subsidy (hereinafter referred to as" the holding "), farmed animals shall be kept in such a way as to avoid their abuse or killing by unauthorised means (6) and comply with the requirements for livestock farming set out in Annex 8 to this Regulation;
6) Sections 2, 4 and 5 of Act No. 246 / 1992 Coll., for the protection of animals against abuse, as amended. '
4. Paragraph 6 (2) reads as follows:
"(2) The relevant period for the determination of livestock unit (8) eligible for grant (" retention period ") is in case of sub-measure
(a) according to Articles 2 (a) and 2 (b), 2 (d) (2) and 2 (e), the period from 1 June to 31 December of the relevant calendar year for which the subsidy is to be granted;
(b) pursuant to Article 2 (c), the period from 1 June to 30 November of the relevant calendar year for which the subsidy is to be granted;
(c) under Paragraph 2 (d) (1), the commitment period. ';
5. In Article 7 (3) (c), the words "the object used by the applicant for animal husbandry under the Agriculture Act 'are replaced by the words" a permanent object under Government Decree No 307 / 2014 Coll. ("the permanent object') '.
6. In Paragraph 7 (4), the words "for an object 'are replaced by the words" for a permanent object' and the words "within 7 days of the date of implementation 'are replaced by the words" at least 30 days before implementation'.
7. In Article 8 (1), the words "§ 2 (d) and (e) 'are replaced by the words" § 2 (d) or (e)' and the words "report on pig daily status (hereinafter referred to as" notification ') shall be replaced by the words "monthly report on pig daily status (hereinafter referred to as" notification') ';
8. in § 9 (1) (b), § 10 (1) (b), § 12 (1) (b) and § 13 (1) (b), the words "objects under the Agriculture Act" are replaced by the words "permanent objects."
9. in Articles 9 (1) (c) and 10 (1) (c), the word 'mentioned' shall be replaced by 'one of those';
10. in Article 10 (2) (b):
"(b) carry out disinsectisation in all the objects referred to in paragraph 1 (b) by:
1. chemical methods shall be carried out on a total of at least 4 applications of the chemical preparation with a duration of up to and including 30 days, in accordance with Annex 3 to this Regulation, once during each calendar month in the period from 1 June to 30 September of the relevant calendar year; in the case of use of a product having an effective time of more than 30 days, carry out at least 1 application of the chemical product during every 2 calendar months in the period from 1 June to 30 September of the relevant calendar year; or
2. the biological methods shall carry out a total of at least 8 applications of biological material in accordance with Annex 3 to this Regulation twice during each calendar month during the period 1 June to 30 September of the relevant calendar year; ';
11. in Paragraph 10 (2) (c):
"(c) keep packaging from chemical products or biological materials which it applies for a period of 1 year from their use or ensure that they are disposed of by an authorised person under the Waste Act. In the event of the removal of packaging by the authorised person, the applicant shall provide a certificate stating the following:
1. the name and surname of the applicant, or its name;
2. farm registration number,
3rd permanent object number,
4. code names of packages,
5. the quantity and content of packaging;
6. the name of the disinfectant containing the container, and
7. identification of the authorised person for the removal of the packaging, indicating the name, address and address of the registered office and the ID, ';
12. in Article 10 (2) (d), the words "or the removal of their packaging" shall be inserted after the words "biological materials."
13. in Articles 10 (2) (e), 11 (3) (c), 12 (2) (d), 12 (4) (d) and 13 (2) (d), the words "in accordance with the model indicated" shall be replaced by the words "with the particulars given."
14. In Paragraph 10 (2), the words "; this shall not apply in respect of births which are individually separated 'shall be added at the end of the text in point (f).
15. Paragraph 11 (1) reads:
"(1) Part of the application for a grant for the sub-measure of access to the dry-cut range is the list
(a) the identification numbers of the dairy cows for which the applicant will fulfil the conditions throughout the retention period and for which the period of delivery shall be 1 July to 30 November of the relevant calendar year for which the grant is to be granted;
(b) the registration numbers of those holdings on which the dairy cows referred to in (a) will be kept by the applicant during the retention period;
(c) the registration numbers of those holdings with the permanent object numbers used by the applicant for the production of dry-cut cows and fulfil the conditions of this sub-measure throughout the commitment period; and
(d) land block parts numbers according to land use records according to user relations under the Agriculture Act in case of access to the range referred to in paragraph 2 (b). ';
16. in Article 11 (2) (b), the words "the object defined in paragraph 1 (b)" shall be replaced by "the object defined in paragraph 1 (c)."
17. in Article 11 (3) of the introductory part of the provisions, the words "from those holdings" shall be replaced by the words "referred to in paragraph 1 (c)."
18. in Paragraph 11 (3) (d), "the object referred to in paragraph 1 (b)" shall be replaced by "the object referred to in paragraph 1 (c)";
19. in Paragraph 11 (4), the words "referred to in paragraph 1 (c)" shall be inserted after the words "on that holding."
20. Paragraph 12 (2) (a) reads as follows:
"(a) has at least one livestock unit of pigs,"
21. In Article 12 (4) (b), the words "permanent" shall be inserted after the words "permanent"; the words "tour operation" shall be replaced by "which are constructed (" tour operation ");" and the words "one day" shall be replaced by "24 hours."
22. in Article 13 (1) (c), "the minimum daily number of weaned piglets" is replaced by "the average number of weaned piglets for the retention period."
23. in Paragraph 13 (2) (a):
"(a) holding at least 1 livestock unit of weaned piglets; a reduction in the number of livestock units which does not exceed 10 consecutive calendar days shall not be considered a breach; ';
24. in Paragraph 13 (3):
"(3) The Fund shall grant a subsidy to the number of livestock units determined on the basis of the average number of weaned piglets found during the retention period for that holding meeting the conditions laid down in this Regulation. The average number of weaned piglets shall be determined as the arithmetic mean of the total number of weaned piglets recorded over the retention period. ';
25. In Section 14, the word "listed 'is inserted after the word" Replacement'.
26. in Paragraph 14 (1):
"(1) The applicant may replace that animal with a new animal from that holding since the submission of the application for a subsidy, but only within 1 calendar day in case of sub-measure
(a) in accordance with Article 2 (a) or (b), provided that the new animal fulfils the conditions for granting the subsidy for the sub-measure;
(b) under Paragraph 2 (c), if a new animal:
1. satisfy the conditions for granting the grant of the aid in question in respect of the replacement of that animal for which the condition laid down in Article 11 (3) (b) has not been met; or
2. is a dairy cow replacing that animal for which the condition laid down in Article 11 (3) (b) has already been fulfilled. ';
27. in Article 14 (2), the word "Others" shall be replaced by the word "New" and the words "Animal mentioned in the application for subsidy to" shall be replaced by the words "Animal in the case."
28. In Article 14 (3), the word "dairy cows' is replaced by the word" animals'; the word "animals' is replaced by" animals'; and the words "14 days from the date of the end of the retention period 'are replaced by the words" 31 March of the calendar year following the year for which the subsidy is to be granted';
29. In Paragraph 14, the following paragraph 4 is added:
"(4) The replacement of that animal shall not be carried out if it is involved in a withdrawal pursuant to Article 3 (1) (e) of the veterinary law which shall last for a maximum period of 10 days. ';
30. in Paragraph 16 (1) (c), "52" is replaced by "63."
31. in Article 16 (1) (f), "65" is replaced by "89."
32. in Article 16 (4), the words "animals' shall be replaced by" permanent objects';
33. in Article 17 (1) (d), the words "or 2" shall be deleted;
34. In Article 17 (2), the word "or" shall be replaced by a comma, and at the end of the text of the paragraph, the words "or, if the applicant has not complied with Article 2, 4 or 5 of the Animal Protection Act, or has not complied with the requirements for livestock farming set out in Annex 8 to this Regulation."
35. in Article 17 (3) of the Introductory Part of the provision, the words "in the case of a sub-measure under § 2 (a) to (c), (d) (2) and (e) or throughout the entire commitment period in the case of a sub-measure under § 2 (d) (1)" shall be deleted;
36. in Articles 17 (5), 17 (6) and 17 (12), the word 'mentioned' is replaced by 'given';
37. in Article 17 (6), "Article 11 (1) (b)" is replaced by "Article 11 (1) (c)";
38. In the second sentence of Article 17 (7), the words "or has not complied with the remaining conditions laid down in Article 10 (2) (b) (1) or (2) 'shall be inserted after the word" applications'.
39. in Paragraph 17 (10), the words "on the said sub-measure" shall be replaced by the words "within the title for the said holding" and the words "sub-measure" shall be replaced by the words "title";
40. In Article 17, the following paragraph 14 is added:
"(14) If the Fund finds that the applicant has failed to comply with the deadline laid down in Article 8 (2), but has submitted a report not later than within the time limit referred to in Article 8 (3), the Fund shall decide, within the framework of a given sub-measure or title for the said holding:
(a) a 3% reduction in the subsidy if the applicant has not submitted 1 report within a given period;
(b) a 10% reduction in the subsidy if the applicant has not submitted two reports within a given period;
(c) a 20% reduction in the subsidy if the applicant has not submitted 3 reports within a given period; or
(d) failure to grant a grant if the applicant has not submitted 4 or more reports within a given period. "
41. In the title of Annexes No 3, 5 and 7, the word "Model 'is replaced by the word" Requirements'.
42. In Annex 3, the word "object 'is replaced by" permanent object' and the column "Date and signature of the person who carried out the disinsection 'is deleted.
43. The heading of Annex 4 reads as follows: "The particulars of the registration of the residence of dry-cut cows referred to in Article 11 (3) (c)."
44. In Annex 4, in the table, the word "object 'is replaced by" permanent object' and the column "Date and signature of the person making the entry 'is deleted.
45. In Annexes 5 and 7, the word "object 'is replaced by" permanent object' and the column "Date and signature of the person making the entry 'is deleted.
46. Annex 6 shall read as follows:

Requirements for livestock farming
| A. | SKOT | 1. | Šířka individuálního kotce pro skot ve věku do 6 měsíců (dále jen „telata“) odpovídá minimálně kohoutkové výšce telete, měřeno ve stoje, a délka kotce je minimálně rovna délce těla měřené od rostrálního okraje mulce po kaudální okraj hrbolu kyčelního vynásobeného koeficientem 1,1. Individuální kotce pro telata, kromě vyhrazených pro izolaci nemocných zvířat, nesmějí mít celistvé stěny, ale stěny s otvory, které poskytují telatům přímý vizuální a hmatový kontakt s ostatními; toto ustanovení se nevztahuje na telata, která jsou chována se svými matkami z důvodu kojení, a stáje, kde je ustájeno méně než 6 telat. Pro telata chovaná ve skupinách je prostor bez překážek pro jedno tele o živé hmotnosti do 150 kg nejméně 1,5 m2; pro tele od 150 do 220 kg živé hmotnosti nejméně 1,7 m2 a pro tele nad 220 kg živé hmotnosti nejméně 1,8 m2. | |
| 2. | Minimální plocha pro individuální ustájení plemenného býka ve věku od 6 měsíců v boxu je 16 m2 a v případě hmotnosti větší než 1000 kg je na každých 60 kg živé hmotnosti plocha zvětšena o 1,0 m2. | |||
| B. | PRASATA | 1. | Využitelná volná podlahová plocha pro každé prase od odstavu do stáří 10 týdnů nebo prasete od stáří 10 týdnů do porážky nebo zařazení do plemenitby chované ve skupině, s výjimkou zapuštěných prasniček a prasnic, činí minimálně: a) pro prase o živé hmotnosti do 10 kg 0,15 m2, b) pro prase o živé hmotnosti od 10 kg do 20 kg 0,20 m2, c) pro prase o živé hmotnosti od 20 kg do 30 kg 0,30 m2, d) pro prase o živé hmotnosti od 30 kg do 50 kg 0,40 m2, e) pro prase o živé hmotnosti od 50 kg do 85 kg 0,55 m2, f) pro prase o živé hmotnosti od 85 kg do 110 kg 0,65 m2, g) pro prase o hmotnosti vyšší než 110 kg 1,00 m2. | |
| 2. | Pro zapuštěné prasničky nebo prasnice chované ve skupinách činí celková využitelná podlahová plocha pro každou zapuštěnou prasničku nejméně 1,64 m2 a pro každou prasnici nejméně 2,25 m2. Jsou-li tato zvířata chována ve skupinách po méně než 6 kusech, je celková využitelná podlahová plocha zvětšena o 10 %. Jsou-li tato zvířata chována ve skupinách po 40 nebo více kusech, celková využitelná podlahová plocha může být zmenšena o 10 %. | |||
| 3. | Kotce pro pohlavně dospělého samce prasete zařazeného do plemenitby podle plemenářského zákona (dále jen „kanec“) jsou umístěny a konstruovány tak, aby se kanec mohl otáčet a slyšet, cítit a vidět jiná prasata; volná podlahová plocha kotce pro dospělého kance je minimálně 6 m2. V případech, kdy se kotce používají také jako místo pro připouštění prasnic, je podlahová plocha pro dospělého kance minimálně 10 m2 a v kotci nesmí být žádné překážky, | |||
| 4. | Prasnice a prasničky se během období, které začíná 4 týdny po zapuštění a končí 1 týden před očekávaným porodem, chovají ve skupinách. Kotec, ve kterém je skupina chována, má strany delší než 2,8 m. Je-li ve skupině chováno méně než 6 zvířat, kotec, ve kterém je skupina chována, má strany delší než 2,4 m. | |||
| C. | OVCE A KOZY | 1. | Podlahová plocha ve stájích pro ovce a kozy musí být minimálně: 1. 0,15 m2 na 10 kg živé hmotnosti u bahnic nebo koz, 2. 0,15 m2 na 10 kg živé hmotnosti u jehňat nebo kůzlat, 3 0,25 m2 na 10 kg živé hmotnosti u plemenných beranů nebo kozlů ve skupinovém kotci, 4. 0,30 m2 na 10 kg živé hmotnosti u plemenných beranů nebo kozlů v individuálním kotci. | |

| F. | BĚŽCI**) VE FARMOVÉM CHOVU | 1. | Minimální velikost výběhu pro 3 dospělé pštrosy je 1000 m2, na každého dalšího dospělého jedince navíc 800 m2; nejkratší strana výběhu není kratší než 10 m a minimálně jedna strana dosahuje délky 100 m. Minimální velikost výběhu pro 3 dospělé nandu nebo emu je 500 m2, na každého dalšího dospělého jedince navíc 250 m2; nejkratší strana výběhu není kratší než 7 m a minimálně jedna strana dosahuje délky 70 m. | |
| 2. | Minimální výška přístřešku pro dospělé pštrosy je 3 m. Minimální šířka dveří a průchodů je 150 cm. Stěny uzavírají přístřešek ze tří stran a uzavírací systém v něm umožňuje oddělení samce. Minimální plocha pro pštrosy je 10 m2 na 1 dospělý kus, pro mláďata se od vylíhnutí do 6 měsíců věku zvětšuje postupně od 0,25 m2 do 2 m2 na 1 kus, minimální celková plocha kotce pro tuto kategorii je 30 m2. | |||
| Minimální výška přístřešku pro dospělé nandu a emu je 2,5 m. Minimální šířka dveří a průchodů je 150 cm. | ||||

Plocha pro nandu a emu dosahuje minimálně 5 m2 na 1 dospělý kus, pro mláďata se od vylíhnutí do 6 měsíců věku zvětšuje postupně od 0,25 m2 do 2 m2 na 1 kus, minimální celková plocha kotce pro tuto kategorii je 20 m2. | |||
| G. | KOŽEŠINOVÁ ZVÍŘATA | 1. | Pro farmový chov norků a fretek se stanoví následující prostory klecí bez budníku: a) jedno dospělé zvíře plocha 2550 cm2, b) jedna samice s mláďaty do odstavu 2550 cm2, c) pro 2 mláďata po odstavu 2550 cm2, d) minimální výška klece 45 cm. | |
| 2. | Pro farmový chov lišek a psíků mývalovitých se stanoví následující parametry pro prostory klecí bez budníku a) jedno dospělé zvíře plocha 8000 cm2, b) jedna samice s mláďaty do odstavu 20000 cm2, c) pro 2 mláďata po odstavu 12000 cm2, d) minimální výška klece 100 cm. | |||
| 3. | Pro farmový chov nutrií se stanoví následující parametry pro prostory kotců bez budníku a) jedno dospělé zvíře plocha 10000 cm2, b) jedna samice s mláďaty do odstavu 20000 cm2, c) pro 2 mláďata po odstavu 5000 cm2. | |||
| 4. | Pro farmový chov činčil se stanoví následující parametry pro prostory klecí bez budníku a) jedno dospělé zvíře plocha 5000 cm2, b) jedna samice s mláďaty do odstavu 5000 cm2, c) mládě po odstavu 3330 cm2, d) minimální výška klece 100 cm. | |||
| H. | FARMOVÁ ZVĚŘ***) | 1. | Pro chov jelena lesního a daňka evropského se počítá s hustotou chovaných zvířat do 15 kusů na 1 ha podle přírodních podmínek a intenzity přikrmování. Plocha farmy se rozdělí podle místních podmínek do více výběhů, aby se zabezpečila péče o pastviny rotačním systémem pastvy. K rozdělení pastvin se používají pevné pletivové nebo elektrické ohradníky z několika vodičů umístěných nad sebou. Elektrické ohradníky musí být zviditelněny použitím pruhu textilie o šíři 5 až 10 cm. Nelze použít nepřerušovaný elektrický proud, použité impulsy mají mít délku maximálně 2 sekundy. Na zimní období může být vyčleněn pro zvířata zmenšený výběh. | |
| 2. | Při zřizování kotců pro zvířata pro zimní ubytování, karanténu apod. se počítá s plochou a) 2 m2 pro odstavené kolouchy do 25 kg, b) 2,5 m2 pro kolouchy ve věku 5 až 11 měsíců - od 40 kg do 90 kg, c) 3 m2 a více v případě ustájení rocků a dospělých zvířat nad 75 kg. | |||
| 3. | Pokud jsou mláďata umístěna do uzavřených ustájovacích prostor v zimním období, dostačuje pro kolouchy kotec o půdorysu 3 x 4 m pro 5 kusů, pro odchov daňčat kotec o půdorysu 4 x 2,5 m pro 6 kusů. | |||
| I. | KUŘATA CHOVANÁ NA MASO | 1. | Chovatel může provozovat chov kuřat chovaných na maso se zvýšenou hustotou osazení, která překračuje hustotu osazení 39 kg/m2 maximálně o 3 kg/m2, pokud mu bude na žádost a po splnění kritérií pro povolení zvýšené hustoty osazení vydáno krajskou veterinární správou rozhodnutí o povolení chovu kuřat chovaných na maso se zvýšenou hustotou osazení. | |

Transitional provisions
1. The procedure for applications for grants initiated pursuant to Government Regulation No. 74 / 2015 Coll., as effective before the date of entry into force of this Regulation, and which was not definitively completed before the date of entry into force of this Regulation, shall be completed in accordance with Government Regulation No. 74 / 2015 Coll., as effective before the date of entry into force of this Regulation.
2. If the Fund finds that the applicant has failed to comply with the deadline laid down in Article 8 (2) of Decree-Law No 74 / 2015 Coll., as effective before the date of entry into force of this Regulation, but has submitted a report not later than the deadline laid down in Article 8 (3) of the Decree No 74 / 2015 Coll., as effective before the date of entry into force of this Regulation, the Fund shall decide on a 10% reduction of the subsidy under Government Regulation No 74 / 2015 Coll., as effective from the date of entry into force of this Regulation, for 2015.
3. If the Fund finds that the applicant has failed to comply with the condition laid down in Section 12 (2) (c) of Government Regulation No 74 / 2015 Coll., as effective before the date of entry into force of this Regulation, the Fund shall decide to reduce the subsidy under Section 17 (10) of Government Regulation No 74 / 2015 Coll., as effective from the date of entry into force of this Regulation.
4. The applicant who submitted a grant application in 2015 shall replace that animal in accordance with Article 14 (3) of Decree No. 74 / 2015 Coll., as effective from the date of entry into force of this Regulation.
Efficacy
This Regulation shall enter into force on 1 March 2016.
