DECLARATION
of 28 February 2013
amending Decree No. 177 / 1995 of the Ministry of Transport Coll., which publishes the construction and technical rules of the runways, as amended
The Ministry of Transport provides pursuant to § 66 paragraphs 1 and 4 of Act No. 266 / 1994 Coll., on Railways, as amended by Act No. 23 / 2000 Coll., Act No. 103 / 2004 Coll., Act No. 181 / 2006 Coll., Act No. 191 / 2006 Coll., Act No. 227 / 2009 Coll. and Act No. 134 / 2011 Coll., ("the Act ') for implementation of § 5 paragraph 3, § 6 paragraph 2 and § 20 paragraph 4 of the Act:
Čl. I
Decree of the Ministry of Transport No. 177 / 1995 Coll., which is published in the Construction and Technical Regulations of Railways, as amended by Decree No. 243 / 1996 Coll., Decree No. 346 / 2000 Coll., Decree No. 413 / 2001 Coll. and Decree No. 577 / 2004 Coll., is amended as follows:
1. Paragraph 11 (6) reads as follows:
"(6) A free, workable and handling space for the safe movement of persons and the handling of material shall be maintained between the structures, fixed installations or other obstacles and the gauge provided for adjacent track. The requirements for a free space for work and handling including provisions on which obstacles may interfere shall be laid down in the technical standard set out in Annex 5 under heading 157. ';
2. Paragraph 11 (7) and (8) are deleted.
Paragraphs 9 to 12 shall be renumbered paragraphs 7 to 10.
3. In Article 11 (10), the comma after the figure 5 is replaced by "a 'and the words" and 7' are deleted.
4. In Paragraph 14, at the end of paragraph 3, the sentence "When applying the design arrangement of the railway superstructure, which allows this to be done by design, the basic horizontal width of the base surface of the railway underfloor may be determined by way of derogation in the design documentation discussed in the construction procedure. '
5. In Paragraph 15 (3), the first sentence is: "In tunnels, rescue nicks shall be set up not more than 25 m apart in cases where this is necessary to ensure the safety of work in the operation of the runway and railway transport and under the conditions laid down in the technical standard set out in Annex 5 under item 175. ';
6. In Article 17, the following paragraph 5 is added:
"(5) On a track in line sections operating at speeds exceeding 160 km / h and in the cases specified in the related technical standard referred to in Annex 5 under heading 165, the crossing shall not be permitted in order to ensure the safety of runway operation and road traffic. ';
7. In Paragraph 18, paragraph 12 is added:
"(12) The provisions of paragraphs 5, 6 and 7 shall not apply in the application of the design arrangement of the railway superstructure, which, by its construction technical solution, ensures the safety of the operation of the track by non-conventional design, as specified in the project documentation discussed in the construction procedure. ';
8. Paragraph 20 (6) is deleted.
Paragraphs 7 and 8 shall be renumbered paragraphs 6 and 7.
9. in Article 23 (1) (d), including footnote 6:
"(d) transmit to the leading railway vehicle information on the command prohibiting, authorising, or limiting the journey:
1. if the track speed is higher than 100 km / h,
2. regardless of speed, if it is a line without variable signals (excluding lines with simplified track traffic control and lifts),
3. if the line is included in the European rail system, the ERTMS / ETCS train safety system according to the European Union Regulation (6), the proposed and built gradually in accordance with the ERTMS National Implementation Plan; or
4. if the line (part of the track) has a track speed exceeding 160 km / h, the ERTMS / ETCS train safety system according to the European Union Regulation (6).
The provisions of point 1 need not apply between the national border and the first border station on the territory of the Czech Republic, unless the line speed is higher than 160 km / h and the line section is equipped with a device providing automatic activation of emergency braking when the signal is not respected,
6) Commission Decision 2012 / 88 / EU of 25 January 2012 concerning the technical specification for interoperability relating to the control-command and signalling subsystems of the trans-European rail system. Commission Decision 2012 / 696 / EU of 6 November 2012 amending Decision 2012 / 88 / EU concerning the technical specification for interoperability relating to the control-command and signalling subsystems of the trans-European rail system. ';
10. In Paragraph 66 (4), the comma shall be replaced by a dot and the words "only if the railway track is not electrified 'shall be replaced by the words" if the railway track is electrified, the construction technical solution and operational measures shall ensure the safe operation of both runways, including when the trolleybus is stuck on a crossing. When crossing a railway track with a trolleybus track at track level, rail transport shall take precedence over the trolleybus track operation.';
11. in Paragraph 88 (3), "160" is replaced by "200."

Efficacy
This Decree shall take effect on 1 April 2013.
