DECLARATION
of 28 February 2013
amending Decree of the Ministry of Transport No. 173 / 1995 Coll., issuing the Railway Regulations, as amended
The Ministry of Transport provides, pursuant to § 66 (1) of Act No. 266 / 1994 Coll., on Railways, as amended by Act No. 23 / 2000 Coll., Act No. 103 / 2004 Coll., Act No. 181 / 2006 Coll., Act No. 191 / 2006 Coll., Act No. 227 / 2009 Coll. and Act No. 134 / 2011 Coll., ("the Act ') for the implementation of § 5 (3), § 20 (4), § 22 (5), § 42 (3) and § 43 (1), (4) and (7) of the Act:
The Decree of the Ministry of Transport No. 173 / 1995 Coll., which publishes the Railway Regulations, as amended by Decree No. 242 / 1996 Coll., Decree No. 174 / 2000 Coll. and Decree No. 133 / 2003 Coll., is amended as follows:
1. In Paragraph 6 (1), the word "orange 'is deleted and the words" black or grey' are replaced by the words "orange, black or grey '.
2. In Article 7, the sentence "This provision shall not apply to the track section between the national border and the first border station in the Czech Republic, operated up to a speed of 160 km / h, including, if the track section is equipped with a device providing automatic activation of emergency braking in the event of failure to respect the signal prohibiting the journey."
3. In Article 9, the sentence "The track section between the national border and the first border station in the Czech Republic operating up to and including 160 km / h may be added at the end of paragraph 2, provided that the emergency braking is automatically activated in the event of failure to respect the signal prohibiting the journey; in that case, the receipt of the signal prohibiting the journey need not be registered. ';
4. In Article 9, the following paragraph 5 is added:
"(5) The provisions of this Regulation on the time of visibility of signals, braking distance, braking percentages and the validity of signals shall not apply when driving under the full supervision of the ERTMS / ETCS train safety system, the conditions laid down in the European Union Regulation (14) and shall be adapted by the railway operator in the technological procedures for the operation of the runway and runway.

';
5. Paragraph 32 (4) reads as follows:
"(4) The runway operator shall ensure that an evacuation plan is drawn up in case the passengers of railway vehicles are to leave. The evacuation plan must provide for measures to be taken to restore the operation and evacuation of persons in accordance with the requirements of harmonised technical standard ČSN EN 1909 Safety requirements for cableway installations - Restoration of operation and evacuation. The total duration of the passenger evacuation activities shall not exceed two hours; an exemption from the evacuation period may be authorised by the Railway Administration by the approval of the evacuation plan in the framework of the approval of the operational capability of cableway installations on the basis of an analysis of the safety and complexity of the evacuation facility. ';
6. In Paragraph 37, the sentence "When driving under the full supervision of the ERTMS / ETCS train protection system in accordance with European Union14, the maximum permissible speed shall be determined by the operation of the system. 'is added at the end of paragraph 7.
7. In Paragraph 37, the following sentence is added at the end of paragraph 8: "The maximum permissible speed may be higher than 160 km / h only when driving under the full supervision of the ERTMS / ETCS train protection system under European Union14). In the railway section between the national border and the first border station in the Czech Republic the speed may be allowed above 100 km / h, but not more than 160 km / h, also provided that the train stops reliably from the authorised speed to the distance between the main signal and the signal, which is the prefix of the main signal, when the train is being used."
8. Paragraph 53 (2) is deleted and paragraph 1 is deleted.
9. In Paragraph 54 (2), "15 'is replaced by" 7'.
10. in Article 55 (1), the words "(book edition)" shall be deleted;
11. In Annex No 3, Part II, point 13, the words "200 km.h-1 or higher and shall in addition have pressure-tight cabinets' shall be replaced by the words" more than 200 km.h-1 shall be equipped with pressure-tight cabinets'.
12. In Annex 3, Part II, the following point 18 is inserted after point 17:
"18. If a sandblasting device on a driving vehicle is used to improve braking and traction parameters, the maximum allowed amount of sand sprinkled per sander shall be determined for 30 seconds:
(a) for a speed of less than 140 km / h, 400 g but not more than 500 g; and
(b) for a speed of 140 km / h and more than 650 g but not more than 800 g.
The number of active sandals shall not exceed:
(a) for multiple-letter units, one at a time on the first and last wagon and on intermediate carriages, with at least 7 axles not being sanded between two active carriages; it is permissible to combine and operate all active writers on connected units; and
(b) for locomotive-hauled trains, not more than four sanders on a single rail, unless there is an emergency braking to avert the imminent danger or braking associated with wheel locking, where all the sandals on the vehicle may be used.
Except where emergency braking is used to avert danger, the use of sandblasting equipment shall be prohibited:
(a) in the area of switches and crossings,
(b) in the area of the grapevine from the top of the cosy hill to the last shift;
(c) in a place which is not further driven by other vehicles of the same set; or
(d) during braking at a speed below 20 km / h. ';
Points 18 to 21 shall be renumbered 19 to 22.
Efficacy
This Decree shall take effect on 1 April 2013.
