DECLARATION
of 21 March 2018
amending Decree No. 177 / 1995 Coll., establishing the construction and technical rules of the runways, as amended
The Ministry of Transport provides pursuant to § 66 (1) of Act No. 266 / 1994 Coll., on Railways, as amended by Act No. 23 / 2000 Coll., Act No. 103 / 2004 Coll., Act No. 181 / 2006 Coll., Act No. 191 / 2006 Coll., Act No. 194 / 2010 Coll., Act No. 134 / 2011 Coll., Act No. 64 / 2014 Coll. and Act No. 319 / 2016 Coll., ("the Act ') for the implementation of § 5 (5), § 20 (4) and § 35 (4) Act:

Decree No. 177 / 1995 Coll., which issues the construction and technical rules of the runways, as amended by Decree No. 243 / 1996 Coll., Decree No. 346 / 2000 Coll., Decree No. 413 / 2001 Coll., Decree No. 577 / 2004 Coll., Decree No. 58 / 2013 Coll., Decree No. 8 / 2015 Coll. and Decree No. 117 / 2017 Coll., is amended as follows:
1. in Article 6 (a) (2), the words "and the safety equipment" shall be replaced by the words "security and communication equipment."
2. In Section 6 (a), the words "; on lines with a speed exceeding 200 km / h, the test runs for the verification of safety-related values in terms of vehicle and road relations shall always be carried out with a gradual speed increase ';
3. in Article 6 (e):
"(e) for construction and reconstruction of bridge and bridge buildings similar to the main inspection, or load tests to verify the design parameters and behaviour of the structure at critical load. The loading test may be carried out during or after the main inspection. The load test procedure is contained in the technical standard set out in Annex 5 under heading 149. Basic static load tests shall be carried out on permanent and long-term temporary bridge structures from a range of 18 m, on temporary bridge structures with a margin of more than 8 m before first use. They shall also be carried out on all bridge structures if they have been designed by the project or according to the result of the main inspection. The dynamic load test shall be carried out if the bridge structure does not conform to the requirements of the repeated static load. On lines of less than 200 km / h inclusive, the dynamic load test shall be carried out on bridges with a distance of more than 50 m, or if the length of the continuous structure is more than 80 m, and on all structures where the project or main inspection results have been prescribed. On lines with a speed exceeding 200 km / h, the dynamic load test shall be carried out on permanent and long-term temporary bridge structures from a range of 4 m, '.
4. In Article 6 (f), the word "photographic 'is deleted.
5. In Section 11 (2) of the introductory part of the provision, the words "up to and including 200 km / h 'are inserted after the word" breakup'.
6. In Section 11 (2) of the introductory part of the provision, the word "minimum 'is inserted after the word" next'.
7. in Article 11 (2) (a), "300" is replaced by "250."
8. in Paragraph 11 (2) (b), "300" is replaced by "250."
9. In Paragraph 11, the following paragraph 3 is inserted after paragraph 2:
"(3) For multi-track lines with normal track gauge for speeds exceeding 200 km / h, the following minimum track axes shall be observed:
(a) on an open track
1. intended for passenger transport and operated at a maximum speed up to 250 km / h of 4,300 mm;
2. intended for passenger transport and operated at speeds exceeding 250 km / h or intended for mixed transport of 4,500 mm;
3. on three and multi-track lines operated at speeds exceeding 200 km / h for each track at least 6 500 mm on one side;
(b) at the railway station
1. on the main tracks as on the open track;
2. between main and non-main tracks 6 500 mm,
3. between the main and the manipulative reversing track without a transport function or outside the range of useful length of such track 4 500 mm,
4. in other cases 5 000 mm;
(c) when more than one line is crossed between the main track and the track which is not the main track of the same line, 6 500 mm. ';
Paragraphs 3 to 10 shall be renumbered paragraphs 4 to 11.
10. in Paragraph 11 (4), "300" is replaced by "250."
11. in Article 11 (10), "5" is replaced by "6."
12. in Article 11 (11), "4, 5 and 6" is replaced by "5, 6 and 7."
13. in Paragraph 13 (8):
"(8) On lines with the operation of freight trains towed by locomotives, the track shall be established in height in a uniform slope and in as long horizontal sections as possible as a constant resistance route. On other lines, the slope of the track shall be determined taking into account the dynamic speed of the vehicles operated, especially at speeds above 200 km / h. The largest slope of the track is determined with regard to the required maximum mass and speed of train running to ensure smooth running and safe stopping of trains. Railways in newly built or upgraded railway stations shall be set up on a horizontal basis, if necessary taking into account local conditions at a maximum inclination of 1 °. On tracks where standing and weaning of railway vehicles is not expected or is necessary from a technological point of view, it is possible to establish a track in greater inclination. A higher-inclination track may also be set up on rails without the operation of freight trains towed by locomotives, where standing is assumed, but not the unsetting of railway vehicles. Details shall be given in the technical standard set out in Annex 5. ';
14. Paragraph 15 (3), including footnote 7, reads as follows:
"(3) The safety in tunnels, their internal spatial layout and the basic safety concept must be in accordance with the European Union Regulation directly applicable).
7) Commission Regulation (EU) No 1299 / 2014 of 18 November 2014 on technical specifications for interoperability relating to the infrastructure subsystem of the rail system in the European Union. Commission Regulation (EU) No 1303 / 2014 of 18 November 2014 concerning the technical specification for interoperability relating to "safety in railway tunnels' of the European Union rail system, as amended. '
15. In Article 15, the following paragraph 4 is inserted after paragraph 3:
"(4) For speeds exceeding 250 km / h, two-track tunnels shall be established only on lines not intended for conventional railway vehicles. ';
Paragraphs 4 and 5 shall become paragraphs 5 and 6.
16. In Paragraph 16 (1), at the end of the first sentence, the words "and on which traffic is operated at speeds up to and including 200 km / h 'are added.
17. In the second sentence of Paragraph 18 (6), the words "200 km / h inclusive 'shall be inserted after the word" national'.
18. In the last sentence of Paragraph 18 (6), the words "at a national track with a track speed of more than 200 km / h 'shall be inserted after the word" sprinklers'.
19. Paragraph 88 (3) is deleted.
20. In Annex 1, point 1, the words "up to and including 200 km / h 'shall be inserted after the words" regional'.

Efficacy
This Decision shall enter into force on 1 April 2018.
