amending and supplementing Decree No. 187 / 1994 Coll., implementing the Road Transport Act
The Ministry of Transport and Communications provides pursuant to § 41 paragraph 1 of Act No. 111 / 1994 Coll., on Road Transport, as amended by Act No. 304 / 1997 Coll.:
Čl. I
Decree of the Ministry of Transport No 187 / 1994 Coll., implementing the Road Transport Act, is amended as follows:
1. Article 1, including the title and notes 1) and 2) shall read as follows:
„§ 1
Means of keeping a record of the vehicle's operation
(Article 3 (2) of the Law)
(1) The carrier shall ensure that the driver of the vehicle keeps a continuous record of the operation of the vehicle under his control and that such record of the operation of the vehicle is kept on board the vehicle, unless otherwise specified.
(2) If the vehicle is equipped with a tachograph or other recording device which complies with the requirements laid down in a specific regulation and resulting from the Europe Agreement on the Work of Vehicle Types in International Road Transport (1), (2) the exit from that recording device is included in the vehicle traffic record if the vehicle traffic record is prescribed for that vehicle. The carrier shall keep it for the same time as the vehicle traffic record.
(3) For vehicles equipped with a tachograph or other recording equipment, the record of driving time, safety breaks and rest periods shall be kept solely by means of the exit of such devices. In other cases, the carrier shall ensure that the driver of the vehicle keeps this information in the vehicle traffic record.
(4) The carrier shall equip the crew of a freight vehicle which is not required to keep a record of the operation of the vehicle with evidence showing the type of cargo and the relationship of the carrier to the cargo in order to determine whether the transport is for own or foreign use. This document shall be kept by the carrier for the same time as the vehicle traffic record.
(5) A carrier that operates more than one vehicle for which it is obliged to keep a record of the vehicle's operation shall keep a record of such records.
(6) In the record of the operation of the vehicle, which must be signed by the carrier before the start of the transport power, the driver of the vehicle shall indicate the following information, unless it is pre-printed or completed in advance:
(a) the registration number of the vehicle traffic record;
(b) the trade name of the carrier;
(c) registration number of the vehicle registration number or in urban bus transport;
(d) type line in freight transport, passenger transport type or category of vehicle, 1)
(e) the name and surname of the drivers of the vehicle,
(f) the date, place and time of the start and end of the daily or multiday transport capacity;
(g) the state of the mileage counter on departure and upon arrival;
(h) the type of cargo in the case of freight transport;
(i) details of driving time, safety breaks and rest periods for the driver, unless the timetable or model record is established;
(j) the freight transport agent;
(k) where appropriate, additional information as required by the carrier.
The carrier shall ensure that the driver signs a record of the vehicle's operation after the end of the transport performance. If the data provided for in this paragraph are recorded at the exit from the tachograph or other recording equipment, they need not be reported simultaneously in the vehicle traffic record.
(7) In regular passenger and freight transport, the carrier may keep a simplified record of the operation of the vehicle. The condition of keeping a simplified record of the operation of the vehicle is the processing of a model record to which reference can be made in the simplified record. In regular passenger services, the carrier shall process a model record following the timetable. The carrier shall ensure that, in the case of keeping a simplified record, the driver also has a model record to which the simplified alert refers. In the simplified record, the driver of the vehicle shall indicate the deviations of the actual transport power from the model record.
(8) The inspection shall be marked on the vehicle traffic record and, in the case of removal of the record sheet from the recording equipment, on that record sheet.

2. after Paragraph 1, the following Sections 1a and 1b are inserted:
„§ 1a
(Article 3 (2) of the Law)
(1) In the taxi service, the recording of the operation of the vehicle is made by automatic printing of the content of the sum counters and the meter storage unit. The operator of taxis shall procure daily and monthly taximeter closures for the purposes of the inspection authorities, submit them to those authorities on request and shall periodically establish them for five years.
(2) A record of the operation of the vehicle in a taxi service means a daily closure, which shall include the following:
(a) the business name of the taxi operator;
(b) the date - the date from which the daily deadline is to be drawn up;
(c) permanent residence or registered office of the taxi operator;
(d) vehicle registration number,
(e) the registration number of the vehicle;
(f) the serial number of the storage unit;
(g) taximeter serial number,
(h) the name of the driver or his personal number, if assigned by the taxi operator;
(i) the driver's signature;
(j) the sum of the kilometres travelled in the taxi service since the last daily cut-off;
(k) the sum of the mileage paid in taxi service since the last daily cut-off;
(l) the total revenue of the fare since the last daily closure;
(m) the sum of the private traffic kilometres since the last daily closure;
(n) the total number of trips paid since the last daily closure.
(3) The monthly closure shall contain the information referred to in paragraph 2 in aggregate for the month in question.
(4) Data on driving times and safety breaks are provided by the driver of the taxi service in a numbered sheet.
§ 1b
(to Article 3 (1) of the Law)
(1) National road transport
(a) vehicles intended for the carriage of goods whose mass of use does not exceed 3,5 tonnes or a total mass of 6 tonnes;
(b) passenger vehicles which, according to their type of construction and their equipment, are intended for the carriage of not more than nine persons, including the driver;
(c) vehicles used for the carriage of passengers in regular services, if the length of any of the connections does not exceed 50 km;
(d) vehicles with a maximum permissible speed not exceeding 30 km.h-1;
(e) vehicles used or controlled by civil defence and fire brigade;
(f) vehicles used for special purposes, for the maintenance and repair of sewerage networks, water, gas and electricity distribution, road maintenance and control, the transport and disposal of waste, telegraph and telephone services, the transport of mail, radio and television broadcasting and the detection of radio and television transmitters and receivers,
(g) vehicles used in exceptional circumstances or in rescue operations;
(h) specialised vehicles used for medical purposes;
(i) vehicles transporting circus and carnival;
(j) special emergency vehicles;
(k) vehicles used in road driving tests for development, repair or maintenance purposes and new or rebuilt vehicles which have not yet been put into service;
(l) vehicles used for milk collection or food supply on regular routes
the carrier shall ensure compliance with the driving time, safety breaks and rest periods provided for in paragraphs 2 to 6 in the organisation of the driver's work.
(2) The total driving time between two daily rest periods or between one daily rest and one weekly rest shall not exceed 10 hours. The duration of the proceedings shall be deemed to be the duration of the proceedings, including the interruption of the proceedings for less than 10 minutes.
(3) The total driving time must not exceed 100 hours in two consecutive weeks.
(4) Every 24 hours, the driver must rest for at least eight consecutive hours. The rest may exceptionally be drawn in two separate parts within 24 hours, one of which must last at least six consecutive hours, not more than twice in a calendar week. In this case the minimum rest period shall be extended to 10 hours.
(5) In urban bus transport, the driver must have a security break at least 30 minutes after four hours of driving. This security break may be replaced by at least 10 minutes' breaks, which will be 30 minutes in total. In national road transport carried out by the other vehicles referred to in paragraph 1, the driver shall have a safety break provided for by a special regulation. 3a)
(6) Continuous weekly rest for the driver is provided for in a special regulation. 3b)

3b) § 92 of Act No. 65 / 1965 Coll., Labour Code, as amended. Decree No. 108 / 1994 Coll., implementing the Labour Code and certain other laws. '
3. in Article 3 (a), the following words shall be inserted after the word "surname": "birth number."
4. In Article 4 (a), the following words are inserted after the word "surname ':", birth number'.
5. In Article 4 (b), the following shall be inserted after the words "trade name ':
6. In the second sentence of Article 5 (1), the following words are inserted after the words "or pneumatic ':" or other rapidly removable'.
7. In the last sentence of Article 5 (1), the words "shall be done in letters of at least 30 mm 'shall be replaced by" and legible with a letter height of at least 30 mm'.
8. Article 5 shall be added to paragraph 4:
"(4) If the commercial name of a regular passenger carrier is not the same as the commercial name of the licence holder for that scheduled bus service or concession for short-term replacement transport, it shall be sufficient if, in addition to the markings referred to in paragraphs 1 and 2, the vehicle is marked in addition to the commercial name of the licence holder or concession on a removable table placed behind the right side glass of the vehicle. The last sentence of paragraph 1 shall apply to the execution of the inscription. ';
9. In Article 6 (1), the word "taxis' is inserted after the words" public regular services'.
(10) Paragraph 6 (2) shall be added as follows:
"(c) other official evidence of the completion of a comprehensive study in a secondary or higher vocational school which, according to a certificate from the Ministry of Education, Youth and Sports, complies with the requirements of professional competence in paragraph 1."
11. in Article 7 (2), the following words shall be inserted after the words "the test shall be composed": "in the Czech language."

"Taxi service
(Article 21 (3) of the Law)
§ 14
(1) The taxis vehicle shall, throughout the period of inclusion in the register of taxis on the outside of the upper part of the two front doors, bear the following marking in the top-down order, which shall not be magnetically or otherwise quickly removed:
(a) an intermittent black and white belt comprising alternately rectangles of 90 x 50 mm, the longer side of the rectangle being horizontal and the distance from the lower edge of the side windows shall not exceed 100 mm, the belt shall start at the front edge of the front door and end at the rear edge of the rear door;
(b) the registration number of the vehicle with a letter height of at least 90 mm;
(c) by business name.
The markings referred to in points (b) and (c) shall be clearly visible, in contrast to the background colour.
(2) The upper half of the outside of the two front doors shall include information on the current price offer for the transport service in the municipality in which the transport service is offered. Paragraph 1 shall apply mutatis mutandis to the attachment of price quote information.
(3) For the determination of the registration number of the taxi service vehicle or its removal from the register:
(a) the registration number shall be fixed by the service operator for each particular vehicle to be used for the operation of the taxi service by the transport authority competent according to the place of issue of the concession. The taxi operator shall immediately communicate in writing the vehicle registration number thus determined to all other transport authorities within whose territorial competence it is entitled to operate the taxi service,
(b) the transport authority shall establish a registration number for the taxi operator on the basis of his written communication of the intention to use a particular vehicle in the performance of the taxi service. This communication shall include the commercial name of the taxi operator, his identification number and his place of residence or permanent residence, a copy of the concession note and the registration number (registration number, type, year of manufacture, colour),
(c) the carrier shall ensure that the driver of the vehicle provides evidence of the allocation of the registration number that the vehicle is duly registered by the competent authority for use for the purpose of operating the taxi service;
(d) the local competent transport office shall issue the registration number no later than seven days from the date on which it received the application containing all the information required;
(e) any changes relating to a vehicle for which a registration number has been established, the taxi operator shall notify the competent authority of the taxi service no later than 15 calendar days after their formation;
(f) the transport office which issued the registration number of the taxi service shall remove that registration number from the register on the basis of a notification by the taxi service operator of its intention to temporarily or permanently stop operating the taxi service by that vehicle or on the basis of a communication from the local competent commercial office that its operator has been cancelled or suspended by a concession authorising the taxi service to be operated. The transport authority shall inform the taxi operator, who shall immediately remove from this vehicle all markings and equipment specified for the taxi vehicle.
(4) No inscriptions or markings other than those prescribed by this Regulation shall be permitted on the outside of the vehicle front door. ';
13. The following Section 14a is inserted after Section 14:
„§ 14a
(1) The taxi operator shall ensure that the driver has, in the performance of the taxi service, his valid driver's licence on the vehicle's dashboard, in front of the right front passenger seat, not covered and clearly legible. The local competent transport authority shall issue the taxi operator a taxi driver's licence after the driver has complied with the prescribed conditions. The model of the driver's cab licence is set out in Annex 4, which is part of this decree.
(2) The taxi operator shall hand over the driver's licence to the transport office,
(a) which has ceased to operate a taxi service for the carrier or has ceased to comply with the prescribed conditions;
(b) if the validity of the licence has expired,
(c) where a concession authorising the taxi service has been withdrawn or suspended by the taxi operator;
(d) if the taxi operator has ceased operating such trade. "
14.
„§ 15
(1) The cab vehicle shall be equipped with a yellow roof lamp marked "TAXI 'on the front and rear of the vehicle, fixed to the roof or bearing element (transverse beam, console) on the vehicle roof and placed perpendicular to the longitudinal axis. The magnetic, pneumatic or other rapidly removable attachment of the roof lamp to the roof of the vehicle or to the supporting element on the roof of the vehicle is not permitted.
(2) The taxi operator shall ensure that the driver of the taxi service vehicle located outside the designated cab station has, if it offers a transport service, a taximeter in the "FREE 'operating position and a lit roof lamp, and that the driver of the taxi service vehicle, when performing a transport service, uses the taximeter in accordance with a specific regulation. (c)
(3) The taxi operator shall ensure that the taximeter located in the vehicle is verified and sealed and that its entire display is freely visible from the passenger's position on the front seat and from the rear seats of the vehicle.
(4) The taxi operator shall ensure that, at the time the taxi service is operated with it, the taxi service is stored in a "Service and registration book of the taximeter 'containing all records of the inputs to the taximeter, the states of the set rates and the taximeter certificate or a certified copy thereof.
(5) The taxi operator shall ensure that the driver of the taxi service vehicle does not perform or offer transport services and, when driving abroad, remove or cover the roof lamp with an opaque cover mounted mechanically on the roof lamp.
3c) Act No. 634 / 1992 Coll., on Consumer Protection, as amended. '
15. in Article 16 (1) (a), the following words are added at the end: "capable of maintaining daily recorded values of vehicle traffic for at least five years,"
16. in Article 16 (1) (b), the words "or the relevant document" shall be deleted.
17. Paragraph 16 (1) (c), including footnote 4a, reads as follows:
'(c) information on the full price offer for the performance of the transport services, including all the rates offered, including the conditions for their use, indicating all the sub-items of which the fare is composed. The sub-item can be the starting rate in CZK, the value of the rate for distance in CZK (CZK / km), the value of the rate for waiting time in CZK (CZK / min), the value of the surcharge in CZK, if it is permitted by special regulations, 4a) or another sub-item chosen by the transport operator. The resulting fare rate means a combination of sub-items; the resulting rate is given in the price information under the number under which it is stored in the taximeter storage unit. The price information shall be placed inside the vehicle in front of the right front seat in the passenger's field of view. The information shall be clearly legible, in capital letters at least 5 mm high in black on the white background.
(4a) The purpose of the Ministry of Finance No 01 / 98 of 4 December 1997 issuing the list of goods with regulated prices published in the Price Bulletin of the Ministry of Finance of the Czech Republic on 12 December 1997. "
18. Article 16 (2) reads as follows:
"(2) The information placed on the door of the taxi service vehicle referred to in Paragraph 14 (2) shall include the current price offer for transport services in the territory of the municipality in which the transport service is offered and shall include all sub-items from which the resulting rate is composed. The sub-item can be the starting rate in CZK, the value of the rate for distance in CZK (CZK / km), the value of the rate for waiting time in CZK (CZK / min), the value of the surcharge in CZK, if it is permitted by special regulations, 4a) or another sub-item chosen by the transport operator. The number under which the relevant rate is stored in the taximeter storage unit shall be indicated in the upper right-hand corner of the price information. The price information shall be clearly legible, made in black on a white background by letters at least 20 mm high. '
19. Paragraph 16 shall be added to paragraph 3:
"(3) The taxi operator shall ensure that only vehicles fully equipped and labelled in the prescribed manner are used to operate the taxi service. ';
20. Article 17 (1) is added as follows:
"(1) The taxi operator shall ensure that, as soon as the paid journey is complete, the driver switches the taximeter to the operating position of" NUCLEAR '. The amount of payment for the performance of the transport service shall be determined solely by the data deducted from the taximeter display after the end of the journey. The taxi operator shall ensure that the driver issues a receipt after payment of the ticket. The proof of payment is exclusively the output from the meter printer, manually supplemented with additional information provided by this Regulation. The taximeter shall be set to the immediate automatic printing of the ticket payment document when the fare is switched to the "LOW" operating position.'.
Paragraph 17 is renumbered paragraph 2.
21.
'(b) the business name, registered office or permanent residence of the taxi operator;
(h) all sub-items on which the resulting rate is composed; ';
22. § 22 is released.
23. in Paragraph 23 (1), the words "for the transport of goods" are deleted.
24. in Paragraph 23 (3) (a), the following words are added at the end: "or by a permit under Section 7 of the Act,."
25. In Article 23 (3) (c), the following words are added at the end: "or proof of payment of the advance on road tax,"
Article 25 (3) (f) reads as follows:
"(f) operated by vehicles which meet the requirements laid down in specific regulations and international agreements in terms of environmental protection and safety of operation;"
27. Paragraph 25 shall be added to paragraph 4:
"(4) The assigned entry permit shall be duly completed by the carrier."
28. In Article 26 (3), the following shall be inserted after the words "the carrier attests':" no later than the 10th working day of the month following the end of the quarter '.
(29) Paragraph 26 (5) and (6) are added as follows:
"(5) The place of issue shall be entitled to include in the costs associated with the allocation of a foreign entry permit:
(a) the direct costs associated with the allocation of foreign entry permits, including the costs of preparing and printing documents and the costs of taking over and transmitting foreign entry permits between the Czech Republic and other States;
(b) indirect costs involving operational and administrative overheads and reasonable costs for the further development of the allocation system.
(6) The costs associated with the allocation of foreign entry permits shall be budgeted for each type of foreign entry permit depending on the number of permits distributed. The fee fixed shall be paid by the carriers to which the foreign entry permit has been allocated, on their issue. ';
30.
„§ 27
(1) Carriers who have used a falsified, illegally modified foreign entry permit or foreign entry permit or a copy thereof which has not been allocated to them or who repeatedly violate intergovernmental agreements in the field of road transport shall not be granted a further foreign entry permit authorising entry into the competent State during the subsequent distribution period.
(2) Paragraphs 24, 25 and 26 do not apply to international passenger transport. '
31. Annex 1 is replaced by the new Annex 1.
32. Annex 3 is replaced by the new Annex 3.
33. In the text of the Decree, "Ministry of Transport 'is replaced by" Ministry of Transport and Communications'.
Čl. II
Transitional provisions
(1) As from 1 January 1999, the Decree of the Ministry of Interior of the Czech Socialist Republic - Transport Administration No. SD / 33- 1908 / 75 on the determination of the working time of road and urban transport drivers (registered in the amount of 33 / 1975 Coll.), as amended by Decree No. SD / 33- 2831 / 77 (registered in the amount of 2 / 1978 Coll.), shall not apply to road transport.
(2) In national road transport carried out by vehicles used for the carriage of passengers in regular services, if the length of any of the connections does not exceed 50 km, the procedure laid down in Paragraph 1b shall be followed only from 1 January 1999. Until 31 December 1998, it shall be governed by specific rules. 8)

Final provision
This Decree shall take effect on 1 April 1998.
