The Ministry of Foreign Affairs announces that on 18 November 1996 the Agreement between the Government of the Czech Republic and the Government of the Federal Republic of Germany on border crossing points at common national borders was signed in Prague.
The Federal Republic of Germany made a declaration on Article 1 (1) of the Agreement, as confirmed by the verbal note of the Embassy of the Federal Republic of Germany of 18 November 1996, as follows:
"The transport of goods to the German part of the customs territory of the European Union outside the places referred to in Article 1 (1) shall, in accordance with the provisions in force in the Federal Republic of Germany, remain without prejudice to customs law, provided that the conditions of national provisions, based on Article 38 (4) of the Customs Code of the European Union, are fulfilled, for exemption from the obligation to use customs routes. ';
On behalf of the Federal Republic of Germany, the Embassy of the Federal Republic of Germany requested the Ministry of Foreign Affairs of the Czech Republic to confirm receipt of the note and the declaration contained therein.
The Ministry of Foreign Affairs confirmed the receipt of a verbal note by a note dated 18 November 1996.
The Agreement entered into force on 28 February 1997 pursuant to Article 7 (1) thereof. This Agreement replaced the Protocol between the Government of the Czechoslovak Socialist Republic and the Government of the German Democratic Republic on the status of border crossing points at the common national borders of 5 August 1971, published under No 51 / 1972 Coll.
The Declaration of this Agreement repeals the First part of the List of Border Tranches at the State Borders of the Czech Republic at the State Borders section with the Federal Republic of Germany, published by the Ministry of Foreign Affairs Notice No. 59 / 1994 Coll.
The Czech version of the Agreement is hereby published at the same time.
AGREEMENT
between the Government of the Czech Republic and the Government of the Federal Republic of Germany
on border crossing points at common national borders
The Government of the Czech Republic and the Government of the Federal Republic of Germany, conducted by an effort to cooperate constructively in the spirit of the Treaty between the Czech and Slovak Federal Republic and the Federal Republic of Germany on good neighbourhood and friendly cooperation of 27 February 1992,
guided by the desire to facilitate transport between the two States,
agree as follows:
1. The crossing of persons and the transport of goods across national borders between the Czech Republic and the Federal Republic of Germany may take place only at border crossing points, except in the cases referred to in paragraph 2 or in other international treaties by which both States are bound.
2. The competent authorities of the two Contracting Parties may, by mutual agreement, in the case of specific interests, authorise the crossing of national borders by persons or groups of persons who fulfil the conditions for entry and residence in the sovereign territory of the States of the two Contracting Parties, at border crossing points by way of derogation from the specified scope of operation or operating time and also outside border crossing points. Special interests are laid down in Article 5 (1) of the Agreement between the Government of the Czech Republic and the Government of the Federal Republic of Germany on small border traffic on tourist trails and in tourist zones and on crossing national borders in specific cases of 3 November 1994.
1. Border crossing points established at common national borders are listed in Annex 1 to this Agreement.
2. The establishment, cancellation of border crossing points, as well as the scope of operation and operational time shall be carried out, except in the cases referred to in Article 3, in agreement with the Contracting Parties, in the form of an exchange of diplomatic notes. Annex 1 to this Agreement shall always be supplemented accordingly.
1. Each Contracting Party may restrict or suspend operations at border crossing points for serious reasons, in particular if there is or may be a risk of an epidemic or other serious threats to health or the environment, public order and security, for criminal prosecution and in cases of disasters.
2. A Contracting Party which intends to restrict or cease operations at border crossing points for the reasons referred to in paragraph 1 may take the necessary measures before notifying the other Contracting Party in cases of unforeseen events. The other Contracting Party shall inform the other Party in writing without delay and no later than 24 hours after their adoption. In the event of other events, a Contracting Party may restrict or suspend operations at border crossing points for the serious reasons referred to in paragraph 1 not earlier than the sixth day following the receipt of the written notification of the intended measure to the other Contracting Party.
3. Where the planned maintenance and reconstruction work on transport routes or facilities serving border handling requires restrictions or closures at border crossing points, the Contracting Parties shall inform each other in writing, as soon as possible and at the latest within one month, of the expected start, termination, likely duration and extent of the restriction or closure of operations before the start of work.
1. The Contracting Parties shall establish additional border crossing points for the carriage of persons and goods as soon as appropriate conditions are established on both sides.
2. Annex 2 to this Agreement lists the border crossing points to be established. The content of Annex 2 may be amended in the form of an exchange of diplomatic notes in agreement between the Parties.
1. The Contracting Parties may agree that designated border crossing points will be used for regional transport by freight vehicles. Authorisations for this type of transport shall be granted on the basis of the conditions set out in Annex 3 to this Agreement. The legislation granting authorisations for freight transport carried out in road freight transport across national borders is not affected.
2. Annex 3 to this Agreement may be amended by mutual agreement between the Parties by means of an exchange of diplomatic notes.
At the border crossing points at which border handling is carried out under the Treaty between the Czech Republic and the Federal Republic of Germany on the facilitation of border handling in rail, road and water transport on 19 May 1995, the Contracting Parties shall, where possible due to spatial possibilities, establish a joint forward border handling post in order to limit the handling by the border authorities of the two States to one stop.
1. This Agreement shall enter into force one month after the date on which the Parties exchange diplomatic notes on the fulfilment of the national conditions for entry into force of the Agreement.
This Agreement shall be concluded for an indefinite period. It may be denounced in writing by each Party by diplomatic means. The denunciation shall take effect 6 months after the other Party has received it.
3. This Agreement will replace the Protocol between the Government of the Czechoslovak Socialist Republic and the Government of the German Democratic Republic on the status of border crossing points at the common state borders, signed in Prague on 5 August 1971.
Dane in Prague on 18 November 1996 in two original copies, each in the Czech and German languages, the two texts being equally authentic.

Note:
With the exception of the road border crossing Stážec - Haidmühle, at which the operating period is fixed from 1.4. to 30.9. from 7.00 to 21.00 and from 1.10.to 31.3. from 7.00 to 19.00, there is continuous operating time at all other border crossing points.
At the railway border crossing Hrádek nad Nisou - Zittau / Žitava, the entry and exit of persons, as well as the loading and unloading of luggage in light transit railway transport on the transit route Liberec - Hrádek nad Nisou - Zittau / Žitava - Varnsdorf are permitted under the conditions laid down by the special contract.

to the Agreement between the Government of the Czech Republic and the Government of the Federal Republic of Germany on border crossing points at common national borders
Regional transport authorisations for goods vehicles may be granted under the following conditions:
1. Authorised are:
(a) Entrepreneurs engaged in a productive and commercial activity who have main or secondary establishments located in the Czech territory in a district situated at the common national borders;
and enterprises (production and commercial establishments) whose main or registered branches are located in the German territory of the district situated at the common national borders, including the free district city,
where the goods vehicles (tractors, semi-trailers, trailers) are registered in the same district and are actually engaged in commercial activities there.
(b) Road transport undertakings or transport undertakings, as the case may be, which fulfil the conditions of paragraph 1 (a) and ensure the transport of goods to entrepreneurs or undertakings, and which are themselves entitled to participate in regional transport by freight vehicles.
2. The holder of the authorisation may only use border crossing points intended to carry out this type of transport, as listed in Annex 1 to this Agreement, for regional transport by goods vehicles.
3. The places of loading and unloading of all goods carried shall be located only in the border counties indicated at each border crossing point for the purpose of carrying out regional transport by freight vehicles listed in Annex 1 to this Agreement.
4. The competent customs authorities of both Contracting Parties shall decide within one month of the application for authorisation. They shall keep each other informed of the authorisations granted.
5. Authorisations shall be issued in writing. In serious cases, the competent customs authorities may, upon request, authorise an exemption from this rule by mutual agreement. Authorisations shall be issued for a period of one year in principle.
6. The authorisation may be revoked in the event of a breach of the provisions of this Annex, in particular in the case of a mere transhipment, change of tractor or temporary storage of goods in the territory of the border counties referred to in point 1 (a), in order to circumvent the above provisions.
7. The model and content of the written authorisations shall be determined by the Ministry of Finance of the Parties by mutual agreement.
1) For the holders of the authorisation for regional transport carried out by freight vehicles registered in the counties of Chomutov (CV), Most (MO), Karlovy Vary (KV), Teplice (TP) and Sokolov (SO) in the Czech Republic and in the counties of Mittlerer Erzgebirgskreis (MEK), Annaber (ANA), Freiberg (FG), Weiβeritzkreis (DW) and Aue-Schwarzenberg (ASZ) in the Federal Republic of Germany.
2) For the holders of an authorisation for regional transport by freight vehicles registered in the counties of Cheb (CH), Sokolov (SO) and Tachov (TC) in the Czech Republic and in the counties of Hof (HO), Wunsiedel i Fichtelgebirge (WUN), Tirschenreuth (TIR) and in the free city of Hof (HO) in the Federal Republic of Germany.
3) For the holders of the authorisation for regional transport by freight vehicles registered in the counties of Cheb (CH), Sokolov (SO) and Tachov (TC) in the Czech Republic and in the counties of Wunsiedel i. Fichtelgebirge (WUN), Tirschenreuth (TIR), Neustadt a. d. Waldnaab (NEW) and Weiden i. d. OPf. (WEN) in the Federal Republic of Germany.
4) For the holders of an authorisation for regional transport by freight vehicles registered in the counties of Tachov (TC), Cheb (CH) and Domažlice (DO) in the Czech Republic and in the counties of Wunsiedel i Fichtelgebirge (WUN), Tirschenreuth (TIR), Neustadt a. d. Waldnaab (NEW) and Weiden i. d. OPf. (WEN) in the Federal Republic of Germany.
5) For transport by motorcycles, passenger cars and buses registered in the Tachov district (TC) in the Czech Republic and in the Tirschenreuth (TIR) and Neustadt a. d. Waldnaab (NEW), including the free city of Weiden i. d. OPf. (WEN) in the Federal Republic of Germany.
6) For transport carried out by motorcycles and passenger cars registered in the counties of Tachov (TC) and Domazlice (DO) in the Czech Republic and in the free city of Weiden i. d. OPf. (WEN) and in the counties of Schwandorf (SAD) and Neustadt a. d. Waldnaab (NEW) in the Federal Republic of Germany.
7) For the holders of an authorisation for regional transport by freight vehicles registered in the counties of Domažlice (DO), Tachov (TC) and Klatova (KT) in the Czech Republic and in the free town of Weiden i. d.
