Communication from the Ministry of Foreign Affairs on the negotiation of the Agreement between the Government of the Czech Republic and the Government of the Republic of Poland on cooperation in the field of environmental protection

Ministry of Foreign Affairs
The Ministry of Foreign Affairs announces that the Agreement between the Government of the Czech Republic and the Government of the Republic of Poland on cooperation in the field of environmental protection was signed in Prague on 15 January 1998.
The Agreement entered into force on 19 May 1998 pursuant to Article 12 thereof. The Agreement between the Government of the Czechoslovak Socialist Republic and the Government of the People's Republic of Poland on the Protection of Air from Pollution of 24 September 1974, published under No 80 / 1975 Coll., and the Agreement between the Government of the Czechoslovak Socialist Republic, the Government of the German Democratic Republic and the Government of the Polish People's Republic on Environmental Cooperation of 1 July 1989, expired on that date.
The Czech version of the Agreement is hereby published at the same time.
AGREEMENT
between the Government of the Czech Republic and the Government of the Republic of Poland on cooperation in the field of environmental protection
Government of the Czech Republic and Government of the Republic of Poland ("the Contracting Parties')
- governed by the provisions of the Treaty between the Czech and Slovak Federal Republic and the Republic of Poland on good neighbourhoods, solidarity and friendly cooperation of 6 October 1991,
- recognising the need to implement the conclusions contained in the UN Conference on Environment and Development in Rio de Janeiro in 1992,
- convinced that close cooperation in the field of environmental protection, which aims to improve the quality of the environment and is implemented on the principles of equality and reciprocity, is mutually beneficial and contributes to strengthening good neighbourly relations,
agree on the following:
1. The Parties shall cooperate closely in the field of environmental protection and the rational use of natural resources. They will create conditions for the continuous improvement of the quality of the environment, in particular air, water, soil, forests, flora and fauna.
2. The Parties shall pay particular attention to the maintenance and improvement of the quality of the environment in the border zone. They shall jointly identify areas with a high level of threat or specific natural value and agree on measures to protect the environment in these areas.
3. The Parties shall process and implement joint programmes, exchange information on the state of the environment, sources and levels of pollution, environmental programmes, legislation, results of scientific research and new techniques and technologies used to save the environment.
1. The areas of cooperation will be:
(a) air protection;
(b) protection of surface and groundwater;
(c) conservation of nature and landscape;
(d) forest protection;
(e) soil protection;
(f) the protection of mineral resources;
(g) improving the waste management system in order to reduce the environmental burden;
(h) environmental impact assessments, in particular beyond national borders;
(i) environmental monitoring;
(j) evaluation of environmental risks in the areas of chemical, biological and physical pollution;
(k) synergies between environmental control services;
(l) environmental education and education,
m) Common Czech-Polish Biosphere Reservations.
2. Cooperation will take the form of meetings of experts, consultations, joint research and scientific work, exchanges of scientists and experts, scientific events, exhibitions and training.
1. The Parties shall cooperate to prevent, reduce and eliminate pollution crossing national borders to an extent that does not have harmful effects on the environment in the territory of the State of the other Contracting Party.
2. Each Contracting Party shall gradually implement, within its own State, measures to prevent, reduce and eliminate pollution as referred to in paragraph 1.
The Parties shall cooperate in the fulfilment of the obligations arising from international environmental agreements by which both Parties are bound.
1. The Contracting Parties shall be informed of cases of extreme environmental pollution where there are reasonable concerns that such pollution may have harmful effects on the environment in the territory of the State of the other Contracting Party.
2. The Contracting Party of the State in whose territory there has been extreme environmental pollution undertakes to immediately introduce effective measures to eliminate the causes of such pollution and to inform the other Contracting Party thereof.
3. The Contracting Parties shall use effective warning and information systems to indicate in advance the risk of extreme environmental pollution.
4. In order to prevent cases of extreme environmental pollution or to limit their harmful consequences, the Contracting Parties shall agree joint programmes of measures.
The Parties shall promote the creation and development of contacts and cooperation between public authorities, self-government and environmental organisations.
1. The Parties shall appoint a Joint Commission on Environmental Cooperation (hereinafter referred to as "the Commission ') in order to implement this Agreement.
2. The co-chairs of the Commission will be the Minister of the Environment, the Minister for Environmental Protection, Natural Resources and Forestry from the Czech Republic.
3. The Commission will work on the basis of the Rules of Procedure, which will be adopted at its first meeting.
4. The Commission's tasks will include, in particular, the identification of cooperation guidelines and objectives, the appointment of working groups to implement them, the discussion of the results of cooperation and the adoption of relevant decisions.
5. Commission meetings shall be held at least once a year, alternately in both States.
Upon written agreement of the other Contracting Party, each Contracting Party may transmit to the third party the results of the cooperation which are the subject of this Agreement.
The Contracting Parties shall bear all their costs resulting from the implementation of this Agreement, unless otherwise specified in each case.
Disputes concerning the interpretation or implementation of this Agreement shall be settled by diplomatic means.
This Agreement shall not affect the rights and obligations of the Contracting Parties arising from other international agreements concluded by them.
This Agreement shall be subject to the national approval of each Contracting Party and shall enter into force on the date of service of a later note of such approval.
On the date of entry into force of this Agreement, the Agreement between the Government of the Czechoslovak Socialist Republic and the Government of the People's Republic of Poland on the protection of the air against pollution of 24 September 1974 and the Agreement between the Government of the Czechoslovak Socialist Republic, the Government of the German Democratic Republic and the Government of the Polish People's Republic on cooperation in the field of environmental protection of 1 July 1989 shall cease to apply between the Contracting Parties.
This Agreement shall be negotiated for an indefinite period. Each Contracting Party may terminate the Agreement in writing no later than six months before the end of the current calendar year, ending on 31 December of that year.
Dane in Prague on 15 January 1998 in two original copies, each in the Czech and Polish languages, the two texts being equally authentic.
