laying down directives on the powers of trade unions in connection with the organisation of production units and their statutes, approved by the Bureau of the Office of 5 February 1975
The Decree of the Government of the Czechoslovak Socialist Republic No. 91 / 1974 Coll., on the organisation of and the status of production units (hereinafter referred to as the "Government Regulation ') provides that industrial and construction production centrally managed is generally organised in production units which carry out the activities needed to carry out a comprehensive economic process and create conditions for their development and which are equipped with appropriate means.
The creation of production units shall be based primarily on economic efficiency, in particular technological linkages or the follow-up of production, on a survey of production, on planned basic changes in production structure and on commercial technical and territorial considerations.
The production units (industry, group, trust of enterprises) are in the system of state economic organisations the highest degree of organisation of the production technical base ensuring a comprehensive implementation of the tasks and objectives of the national economic plans and of the state economic policy.
An inseparable feature of socialist democracy and a precondition for successful action is the participation of collective workers in the development of the organisation's management and control of its activities: it focuses primarily on ensuring profitability, technical development, improving labour productivity, quality and cost-efficiency of production, on the quality of the organisation's tasks, on the comprehensive care of workers, on increasing occupational safety and health care, on strengthening labour relations, on the socialistic legality of labour discipline and on improving the qualifications of workers. The participation of workers and their collective representatives in the development, management and control of activities are organised by the authorities of the Revolutionary Trade Union Movement.
This is also related to the application of the trade union's influence on the consolidation of the cadre work of managing economic agents.
In accordance with the principles set out above, the regulation of the Government in Articles 5, 6, 13 and 14 of the Treaty on the Functioning of the European Union lays down the powers of trade unions to:
- the appointment and withdrawal of the Director-General of the Production Unit,
- delegation of professional directors to the management of integrated sections of activity, including the provisions of one of the professional directors to the Deputy Director General,
- appointment and removal of the Director of a National Enterprise (enterprise, special purpose organisation, group enterprise and group special purpose organisation),
- membership of the advisory body of the Director-General - - the Executive Board,
- the issue of the status of the production unit and the integration of the principles of cooperation between the production unit and the ROH authorities.
In giving these trade union authorisations, the Government's regulation uses the wording "competent authority of the Revolutionary Trade Union Movement." The central board of trade unions for the implementation of the provisions of Sections 5, 6, 13 and 14 of the Government Decree provides, within its competence, for the rights of trade unions under the statutes of the ROH:
1. Competent Authority of the Revolutionary Trade Union Movement
- make observations on the appointment and removal of the Director-General by the Minister,
- shall express its views on the mandate of professional managers to manage the integrated sections of the activity and to establish one of the professional directors as Deputy Director General,
- comment on the appointment and removal of the Director of the National Enterprise (enterprise, special purpose organisation, group undertaking and group special purpose organisation),
- is authorised to appoint from among the officials of the senior trade unions a representative of the Revolutionary Trade Union Movement body as a member of the advisory body of the Director-General - Director-General,
- before issuing the status of the production unit.
2. The competent authority of the Revolutionary Trade Union Movement shall be:
(a) for production units managed by federal central government bodies, the central committee responsible for the trade union;
(b) for production units controlled by the central government of the Republic, the competent Czech and Slovak Trade Union Committee;
(c) for national undertakings (enterprises, special-purpose organisations, group companies and group special-purpose organisations) managed by a production unit under the responsibility of the federal central government bodies, the central committee of the trade union,
(d) for national enterprises (enterprises, special-purpose organisations, group companies and group special-purpose organisations) managed by a production unit under the responsibility of the central government of the Republic, the competent Czech and Slovak trade union committee.
3. The Central Committee of the Trade Union (Czech and Slovak Trade Union Committee) may authorise the lower union body to act in accordance with point 1.
The status of the production unit shall be governed by more detailed relations within the production unit in accordance with specific rules. The Statute also includes the principles of cooperation with the competent authorities of the Revolutionary Trade Union Movement. Cooperation in these principles shall be agreed in particular on the following sections:
(a) Organising all forms of participation in production management
- preparation, breakdown, implementation and control of the implementation of the economic plans of the production unit and their organisational components, including changes to the implementation plans during the year, and the development and use of the breakdown reserves,
- establishing and applying economic instruments and rules,
- preparation, conclusion and control of collective agreements and the organisation of production meetings,
- the focus and development of the workers' initiative and the principles of development of all forms of socialist competition, including evaluation and remuneration,
- the use of new techniques and the accelerated introduction of results of scientific and technical progress into production, in particular through the use of comprehensive socialist rationalisation,
- establishing a long-term concept for the development of a creative initiative of technical intelligence and of all workers, in particular the movement of inventors and improvements;
(b) Labour policy
- processing of comprehensive wage policy concepts, development and differentiation of wages within the production unit,
- essential wage policies implemented within the production unit in the field of labour pay,
- a regular evaluation of the results achieved in strengthening material interest in the adoption and performance of progressive tasks and developing quality aspects of production and work;
c) Workers care
- the care of workers, in particular when developing comprehensive programmes for the care of workers and their material and financial security in the plan,
- the establishment and operation of catering facilities,
- breakdown of investment limits on cultural, educational, social and health facilities financed from operational appropriations
- the creation and use of the resources of the cultural and social needs fund,
- setting up and operation of ROH racing and business recreational facilities and pioneering camps
- care for safety and health at work and the creation of a healthy working process,
- strengthening labour relations, socialist legality and labour discipline,
- the development and implementation of measures to make full use of working time;
(d) Political and ideological education and skills improvement
- linking all economic activities with political and educational aspects,
- strengthening the socialist awareness of the working class and its responsibility in the construction of socialism,
- Intensifying socialist relations to work and to combat all survivors in people's consciousness and actions,
- increasing the economic awareness of workers,
- the growth of the education and qualifications of workers.
The provisions of these Directives shall apply mutatis mutandis to the authorisation of trade unions to organise a joint economic activity other than industrial and construction production, unless the organisation is governed by specific provisions. The relevant central trade union committees shall be entitled to provide for the necessary derogations from these Directives, in particular where the competent minister of his or her authority provided for in Article 19 of the Government Regulation is used.
This decree shall take effect on the day of its publication.
