DECLARATION
of 19 February 2024
amending Decree No 470 / 2012 Coll., on the use of toll-charged infrastructure, as amended
The Ministry of Transport provides for the Act No. 13 / 1997 Coll., as amended by Act No. 102 / 2000 Coll., Act No. 80 / 2006 Coll., Act No. 97 / 2009 Coll., Act No. 347 / 2009 Coll., Act No. 152 / 2011 Coll., Act No. 196 / 2012 Coll., Act No. 64 / 2014 Coll., Act No. 268 / 2015 Coll., Act No. 225 / 2017 Coll., Act No. 193 / 2018 Coll., Act No. 227 / 2019 Coll., Act No. 284 / 2021 Coll., Act No. 178 / 2022 Sb.
Decree No. 470 / 2012 Coll., on the use of toll-charged infrastructure, as amended by Decree No. 307 / 2015 Coll., Decree No. 434 / 2016 Coll., Decree No. 458 / 2017 Coll., Decree No. 247 / 2018 Coll., Decree No. 243 / 2019 Coll., Decree No. 485 / 2020 Coll., Decree No. 528 / 2021 Coll. and Decree No. 368 / 2022 Coll., are amended as follows:
1. In Section 1, the introductory part of the provision, including footnote 5, reads:
"This decree implements the relevant provisions of the European Union5)
5) Directive 1999 / 62 / EC of the European Parliament and of the Council of 17 June 1999 on the levying of charges for the use of infrastructure by vehicles. Directive 2006 / 38 / EC of the European Parliament and of the Council of 17 May 2006 amending Directive 1999 / 62 / EC on the charging of heavy goods vehicles for the use of certain infrastructures. Directive 2011 / 76 / EU of the European Parliament and of the Council of 27 September 2011 amending Directive 1999 / 62 / EC on the charging of heavy goods vehicles for the use of certain infrastructures. Directive (EU) 2022 / 362 of the European Parliament and of the Council of 24 February 2022 amending Directives 1999 / 62 / EC, 1999 / 37 / EC and (EU) 2019 / 520 as regards the charging of vehicles for the use of certain infrastructures. ';
2. In Article 1 (d), the words "electronic toll system 'are replaced by the words" toll data'.
3. In Article 1 (f), the words "and proof of payment of tolls' are deleted.
4. in Article 1, the following point (i) is inserted after point (h):
"(i) the method of determining the CO2 emission class of the vehicle in the electronic toll system; and ';
Point (i) shall be renumbered as point (j).
5. In Section 5, the words "electronic toll system 'are replaced by the words" toll data'.
6. In Article 5 (1) and (2), the words "toll data 'shall be inserted after the words" Registration'.
7. In Article 5 (2), the words "copies of a technical card, if issued, 'are replaced by the words" on the basis of a similar document issued by a Member State other than a Member State of the European Union'.
8. In Article 5, paragraphs 3 and 4 are added, including footnotes 6 and 7:
"(3) If it is a vehicle in an electronic toll system registered in the Czech Republic, the electronic toll system operator also records toll data on the basis of data issued to it from the road vehicle register.
(4) The CO2 emission class of the vehicle in the electronic toll system shall be determined and recorded in the Toll Data Register
(a) on the basis of data from the register of road vehicles,
(b) on the basis of the information contained in the vehicle registration certificate or similar document issued by a Member State other than a Member State of the European Union,
(c) on the basis of the data contained in the declaration of conformity of a vehicle to a type of vehicle (6) or a set of information for customers under the directly applicable European Union regulation governing the determination of CO2 emissions and fuel consumption of heavy goods vehicles (7), if one of these documents has been submitted by the vehicle operator and contains the data necessary to determine the CO2 emission class of the vehicle; or
(d) in accordance with the procedure laid down in Article 17a (3), second sentence.
6) Act No. 56 / 2001 Coll., on the conditions of use of vehicles on the road, as amended.
7) Commission Regulation (EU) 2017 / 2400 of 12 December 2017 implementing Regulation (EC) No 595 / 2009 of the European Parliament and of the Council as regards the determination of CO2 emissions and fuel consumption of heavy duty vehicles and amending Directive 2007 / 46 / EC of the European Parliament and of the Council and Commission Regulation (EU) No 582 / 2011, as amended. ';
9. In the title of Section 7, the words "toll data 'shall be inserted after the word" registration'.
10. In the second sentence of Article 8 (1), the words "or the registration 'are deleted.
11. In Section 9, the words "and proof of remuneration 'are deleted.
12. in Article 9, paragraph 3 is deleted;
13. In Section 13, the words "as indicated in the vehicle technical licence or in the combination technical licences' are deleted.
14. In the first sentence of Paragraph 14, the words "or European toll providers' shall be inserted after the word" tolls'.
15. The heading of Section 15 reads:
"Description of the costs incurred for the toll infrastructure, the return of which is to be achieved by imposing tolls'.
16. in Article 15 (1) (c), the words "(e.g. documentation of the environmental impact of the project, for territorial decisions, for building permits)" shall be deleted;
17. Paragraph 15 (2), including footnote 8, reads:
"(2) The maintenance and repair costs of toll roads include, under the Decree implementing the Road Law (8), all costs of:
(a) routine maintenance;
(b) continuous maintenance;
(c) corrections; and
(d) winter maintenance.
8) Decree of the Ministry of Transport and Communications No. 104 / 1997 Coll., implementing the Road Act, as amended. '
18. in Article 15 (5) (a), the words "until the date of entry into force of this Decree" shall be replaced by the words "until the date of updating the cost calculation" and the words "10 June 2008" shall be replaced by the words "the date of updating the cost calculation."
19. in Article 15 (5) (b), the words "on the date of entry into force of this Decree" shall be replaced by the words "on the date of updating the calculation of costs."
20. The heading of Section 15a reads:
"Description of the costs incurred by air pollution in the operation of toll road vehicles whose return is to be achieved by imposing tolls'.
21. In Section 15a of the Introductory Part of the provision, the words "out of service on toll roads' are replaced by the words" in the operation of vehicles in an electronic toll system on toll roads whose return is to be achieved by imposing tolls'.
22. in Article 15a (e), the words "the use of which is directly related to air pollution from operation" shall be replaced by the words "directly caused by air pollution in the operation of vehicles in the electronic toll system."
23. The heading of § 15b reads:
"Description of noise-induced costs in the operation of toll road vehicles whose return is to be achieved by imposing tolls'.
24. In Section 15b of the Introductory Part of the provision, the words "out of service on toll roads' are replaced by the words" in the operation of vehicles in an electronic toll system on toll roads whose return is to be achieved by imposing tolls'.
25. in Article 15b (c), the words "the expenditure of which is directly related to noise from traffic" shall be replaced by the words "directly generated by noise in the operation of vehicles in the electronic toll system."
26. After Paragraph 15b, the following Section 15c is inserted:
Description of CO2 costs incurred in the operation of toll road vehicles whose return is to be achieved by imposing tolls
The costs incurred by CO2 emissions in the operation of vehicles in the electronic toll system on toll roads, the return of which is to be achieved by imposing tolls, are the costs of:
(a) achieving energy savings in transport and transport infrastructure;
(b) promoting renewable energy sources in the field of transport and transport infrastructure;
(c) the construction of charging and filling stations and other structures and equipment for the sale or supply of alternative fuels for the propulsion of means of transport;
(d) a change in the procedures for the construction and management of transport infrastructure resulting in a reduction of CO2 emissions;
(e) adaptation to climate change; and
(f) compensation for damage caused by climate change. ";
27. In Section 16, the words "on toll infrastructure 'are replaced by" whose return is to be achieved by imposing tolls'.
28. In the first sentence of Paragraph 16, the words "spent on toll roads, air pollution costs on toll roads and noise costs on toll roads' are replaced by the words" the recovery of which is to be achieved by imposing tolls' and the words "and 15b 'are replaced by the words" 15b and 15c'.
29. In the first sentence of Paragraph 17 (1), the words "subject to tolls' are replaced by the words" in the electronic toll system '.
30. In the second sentence of Article 17 (1), the words "and 15b 'are replaced by", 15b and 15c'.
31. in the third sentence of Article 17 (1), the words "subject to tolls" are replaced by the words "in the electronic toll system."
32. In Paragraph 17 (2), the words "spent on toll infrastructure 'are replaced by the words" whose return is to be achieved by imposing tolls'.
33. the following Section 17a is inserted after Section 17, including the title and footnotes 9 and 10:
Method for determining the CO2 emission class of the vehicle in the electronic toll system
(1) The CO2 emission class 5 shall be determined for the vehicle in an electronic toll system which uses electricity or hydrogen exclusively as fuel.
(2) A vehicle in an electronic toll system which does not use electricity or hydrogen exclusively as a fuel, belonging to a subgroup of vehicles pursuant to a directly applicable European Union regulation on CO2 emission performance standards for new heavy-duty vehicles (9) and which was first registered after 30 June 2019, the CO2 emission class 1, 2, 3 or 4 shall be determined in accordance with the European Union Regulation on the collection of charges for the use of infrastructure vehicles (10). The electronic toll system operator shall determine the CO2 emission class of the vehicle in accordance with Annex 3 to this Regulation according to the sub-group to which the vehicle belongs, its specific CO2 emissions and the date of its first registration.
(3) A vehicle in an electronic toll system other than those referred to in paragraphs 1 and 2 shall be identified as CO2 emission class 1. This CO2 emission class shall also be determined to a vehicle for which the CO2 emission class No 2, 3, 4 or 5 cannot be determined on the basis of data from the road vehicle register or data contained in the vehicle registration certificate or similar document issued by a Member State other than the European Union, unless the vehicle operator has submitted the electronic toll declaration system operator to the vehicle type (6) or a set of information for customers in accordance with the directly applicable European Union regulation on the determination of CO2 emissions and fuel consumption of heavy goods vehicles (7) containing the data necessary for the determination of the vehicle CO2 emission class.
(9) Regulation (EU) 2019 / 1242 of the European Parliament and of the Council of 20 June 2019 laying down CO2 emission performance standards for new heavy vehicles and amending Regulations (EC) No 595 / 2009 and (EU) 2018 / 956 of the European Parliament and of the Council and Council Directive 96 / 53 / EC.
10) Article 7ga (2) of Directive 1999 / 62 / EC of the European Parliament and of the Council of 17 June 1999 on the levying of charges for the use of infrastructure by vehicles, as amended. '
34. The following Section 18a is inserted after Section 18, including the title:
Exemptions from this decree
(1) Paragraphs 5 to 8, 10 (3) and 11 shall not apply where a vehicle operator does not have a contract with an electronic myth system operator and has a contract exclusively with a European electronic toll service provider.
(2) In the case of vehicle operators with a contract to provide a European electronic toll service, entry in the toll data register shall be made on the basis of data provided by the European toll provider to the electronic toll system operator. ';
