DECLARATION
of 15 January 2009
amending Decree No 207 / 2004 Coll., on the protection, breeding and use of experimental animals
The Ministry of Agriculture provides, pursuant to § 29 (1) for the implementation of § 17 (4), § 17a (3), § 17b (3), § 17c (4), § 17d (1), § 17e (10), § 17f (6), § 18b (5) and § 18f (8) of Act No. 246 / 1992 Coll., for the protection of animals against torture, as amended by Act No. 77 / 2004 Coll. and Act No. 312 / 2008 Coll.:
Decree No. 207 / 2004 Coll., on the protection, breeding and use of experimental animals, is amended as follows:
1. In Section 1, the following paragraph 1 is inserted:
"(1) This decree implements the relevant provisions of the European Communities (1) and regulates the requirements and conditions for the protection of experimental animals against abuse, conditions for breeding, use and transport of experimental animals.
1) Council Directive 86 / 609 / EEC of 24 November 1986 on the approximation of the laws, regulations and administrative provisions of the Member States relating to the protection of animals used for experimental and other scientific purposes. Directive 2003 / 65 / EC of the European Parliament and of the Council of 22 July 2003 amending Council Directive 86 / 609 / EEC on the approximation of the laws, regulations and administrative provisions of the Member States relating to the protection of animals used for experimental and other scientific purposes. Commission Recommendation 2007 / 526 / EC of 18 June 2007 on guidelines for the location and care of animals used for experimental and other scientific purposes.
Paragraphs 1 and 2 shall become paragraphs 2 and 3.
2. In Article 2 (1) of the introductory part of the provision, the words "persons operating 'shall be inserted after the words" animals'.
3. In Paragraph 4 (1) of the Introductory Part of the provision, the words "persons operating 'shall be inserted after the words" animal welfare'.
4. Paragraph 5 (1) reads as follows:
"(1) The premises for the normal types of laboratory animals shall be equipped with an adequate ventilation system which corresponds to the requirements of the animals present. The ventilation system shall provide sufficient fresh air supply of appropriate quality and the removal of odours, harmful gases, dust and pathogens of all kinds. At the same time, the system shall ensure the removal of excess heat and moisture. The air in the rooms must be replaced regularly, the minimum replacement is 15 air exchanges per hour, in cases where a small number of animals are occupied the air changes may be reduced, but there may not be less than 8 air exchanges per hour. The ventilation system shall be designed in such a way that the noise does not exceed 60 dB and that the flow does not exceed 0,3 m per second at 160 cm above the floor. ';
5. In Paragraph 5, the sentence "In barrier systems, the constant excess pressure shall be at least 40 Pa, while working under pressure shall be at least 20 Pa. 'is added at the end of paragraph 5.
6. In Article 7 (1), the words "when transporting animals according to the physiological needs of each species shall be added at the end of the text in point (a), in accordance with the values set out in Annex 2, Table 1 and Annex 12 to this Decree '.
7. Paragraph 11 (1) (1) reads as follows:
"1. identification of the person operating the user device; ';
8. In Article 11 (1), the following point 5 is inserted after point 4:
"5. the name, surname, title and number of the qualification certificate referred to in Article 17 (1) of the law of the person who directs the activities of the expert committee;"
Points 5 to 24 shall become points 6 to 25.
9. in Paragraph 11 (1) (8):
"8. The purpose of the experiment under Paragraph 15 (1) of the Act,"
10. In Article 11 (1) (12), the words "breeding and 'shall be inserted after the words" data'.
11. in Article 11 (2), the words "User equipment which" are replaced by the words "Person operating user equipment which."
12. in Article 11 (3), the words "User equipment" shall be replaced by the words "Person operating user equipment" and the words "between user equipment" shall be replaced by "s."
13. in Article 12, the word "(g)" is replaced by "(h)";
14. In Section 13, the word "user 'is replaced by" person operating user'.
15. in Paragraph 13 (1), the word "user" shall be replaced by the words "person operating the user."
16. in Paragraph 13 (2) (a), the words "including address, exact location, name or other indication of individual premises where animal experiments are carried out" shall be added at the end of the text of point 6.
17. in Paragraph 13 (2) (b) (3), "5" is replaced by "6."
18. In Article 13 (3), the words "User equipment which" are replaced by "Person operating user equipment which."
19. in Paragraph 13 (4), the words "and the results of the examination of feed and drinking water" shall be added at the end of the text in point (c).
20. in Paragraph 13 (4) (e), the words "Central Commission for Animal Protection (" the Central Commission ")" shall be replaced by the words "Ministry of Agriculture (" the Ministry ")."
21. in Article 13 (4), the following point (f) is inserted after point (e):
"(f) documentation of the animals used in relation to the relevant experimental projects which have taken place since prior accreditation, but for a maximum period of five years, ';
Points (f) to (h) shall be renumbered as points (g) to (i).
22. in Paragraph 13 (4) (g), "Central Commission" is replaced by "Ministry."
23. in Article 13 (4) (i), the words "Central Commission in accordance with Article 17f (5) (b) (2) of the Act" shall be replaced by the words "Ministry."
24. In Article 13 (5), the words "the Central Commission 'are replaced by the words" the Ministry and shall draw up a written assessment by the assessors of the user installation, the model of which is set out in Annex 10 to this Decree'.
25. In Section 14, the words "breeding and supplier 'are replaced by the words" person performing breeding and supply'.
26. In Paragraph 14 (1), the words "breeding and supplier 'are replaced by the words" person performing breeding and supplying'.
27. in Paragraph 14 (2) (a), the words "including address, exact location, name or other indication of individual premises where animals are kept" shall be added at the end of the text of point 6.
28. in Paragraph 14 (2) (b), point 1 shall be deleted;
Points 2 and 3 shall become points 1 and 2.
29. in Paragraph 14 (2) (b) (1), "5" is replaced by "6."
30. in Article 14 (3), the words "and the results of the examination of feed and drinking water" shall be added at the end of the text referred to in point (c).
31. in Article 14 (3) (f), the words "Central Commission" shall be replaced by the words "Ministry."
32. In Paragraph 14, the words "and shall draw up a written assessment by the assessors of the breeding and supply establishment, the model of which is set out in Annex 11 to this Decree 'shall be added at the end of the text of paragraph 4.
33.In Paragraph 16 (1) (c), "10" is replaced by "11."
34. in Paragraph 16 (2), the word "User" shall be replaced by "Expert Panel of Users."
35. in Article 17, "§ 21 (3) (e)" is replaced by "§ 20 (1) (j)" and "§ 12 and 13" is replaced by "§ 13 and 14."
36. in Paragraph 18 (1) (b), "7" is replaced by "6."
37.Paragraph 18 (4) shall be deleted;
Paragraphs 5 to 8 shall be renumbered paragraphs 4 to 7.
38. In the first sentence of Paragraph 18 (4), "7 'is replaced by" 6'.
39. In the second sentence of Paragraph 18 (4), "5 'is replaced by" 6'.
40. In Paragraph 18 (7), "7 'is replaced by" 6'.
41. in Paragraph 19 (1), "7" is replaced by "6."
42. In Annex 2, at the end of the text of the title of Table 6, the words "during the experiment 'are added.
43. In Annex 2, the following Tables 7 and 8 are inserted after Table 6, including the headings:

1) These guidelines apply to menagerie tanks (i.e. in breeding), not to natural mating tanks and superovulation where smaller size tanks are required.
