DECLARATION
of 13 February 2007
concerning the marking of certain other mineral oils
According to Article 139 (3) of Act No. 353 / 2003 Coll., on Consumer Taxes, as amended by Act No. 217 / 2005 Coll. and Act No. 575 / 2006 Coll., (hereinafter "the Act '), the Ministry of Industry and Trade provides for the implementation of § 134l (2), § 134m (3) and § 134p (3), paragraph 6 (d) and paragraph 7 of the Act:
This Decree was notified in accordance with Directive 98 / 34 / EC of the European Parliament and of the Council of 22 June 1998 laying down a procedure for the provision of information in the field of technical standards and regulations and rules and of rules on information society services, as amended by Directive 98 / 48 / EC.
Type of marker
For the labelling of certain other mineral oils referred to in § 134m (1) (a), (f), (g) and (h) of the Act (hereinafter "mineral oils'), a marker whose chemical name is N-ethyl-N- [2- (1-isobutoxyethoxy) ethyl] -4- (phenylazo) aniline with the identification colour shade SOLVENT YELLOW 124 shall be used. At least 6 mg of marker per litre of mineral oil shall be used for marking.
Method of sampling
(1) To take a sample of mineral oil (hereinafter referred to as "sample"), the authority referred to in Article 134v (1) of the Act (hereinafter referred to as "the competent authority") shall invite the person who, at the relevant time, possessed or manipulated the mineral oil or the technological equipment for which the mineral oil was intended (hereinafter referred to as "the obliged person"); where this is not possible, the competent authority shall invite any impartial person eligible for legal action to take a sample.
(2) When sampling, the competent authority shall follow the procedure:
(a) as specified in ČSN EN 14275 Motor fuels - Assessment of the quality of automotive petrol and diesel fuels - Sampling of dispensing pistols from public and private service stations; or
(b) laid down in ČSN EN ISO 3170 Oil and petroleum products - Manual sampling; where applicable, according to ČSN 01 51 12 Sampling of liquids and pasteurised materials, where sampling cannot be carried out in accordance with (a).
(3) The competent authority shall, at all times, carry out immediately prior to the collection of the flushed sampling equipment in the presence of the person referred to in paragraph 1. The flushing is carried out by the procedure set out in ČSN EN 14275 Motor fuels - Evaluation of the quality of automotive petrol and diesel fuel - Sample from the dispensing pistols of public and private service stations or set out in ČSN EN ISO 3170 Oil and petroleum products - Manual sampling, or ČSN 01 51 12 Sample of liquids and pastes.
(4) The competent authority shall carry out sampling by a set capable of identifying on the ground the presence of the marker referred to in Section 2 in the sample, by mixing the mineral oil sample with the reagent, shaking and removing the lower layer.
(5) The minimum volume of this sample taken shall be 210 cm3, i.e. 3 x 70 cm3, in the event that the obligor requests the sample for his own use. In the case where the obligor does not require a sample for his own use, the minimum sample volume shall be 140 cm3. For the relevant accredited person, at least 70 cm3 shall be separated and for a control deposit of at least 70 cm3. The sample taken shall be stored in a sample panel of dark glass or other material which does not release light, which shall be sealed and marked.
(1) At each sampling, the competent authority shall draw up a report.
(2) The Protocol shall contain:
(a) the serial number of the report registered by the competent authority;
(b) the designation of the competent authority which carries out the collection;
(c) the date, time and place of sampling;
(d) the identification details of the obliged entity;
(e) the type and marking of the container or container from which the sample was taken; if the sample is taken from a container in conjunction with the vehicle, the vehicle registration number if the vehicle is marked with such a mark;
(f) method of sampling;
(g) the purpose of using mineral oil;
(h) a declaration by the obliged entity of taking the sample (whether or not the obliged entity requires a sample for its own use);
(i) the seal number, the marking of the sample and the quantity thereof;
(j) the names and surnames of the persons involved in the sampling and, where appropriate, their signatures;
(k) the name, surname and function of the sampling person and its signature.
(3) The Protocol shall be drawn up in duplicate. A copy of the report shall be kept by the competent authority to be entered in the register of samples taken. The second copy of the protocol shall be received by the obliged person. The model of the Protocol is set out in Annex 1 to this Order.
(4) Where a sample is delivered to the relevant accredited person, the competent national authority shall draw up a movement note for analysis by the relevant accredited person, which shall include the identification data relating to the sample taken; However, the accompanying document shall not contain details of the obliged person, the place and date of collection.
Means of keeping records
(1) Natural and legal persons who manufacture, process, transport, store, purchase or otherwise acquire, sell or consume mineral oils shall keep a record of the types and quantities of mineral oils and of the data of entrepreneurs and natural persons (1) and of the legal persons who supply mineral oils to them, as well as of the legal and natural persons to whom they issue mineral oils.
(2) Labelling manufacturers shall keep a record of the quantities and composition of the branded substances produced, of the natural persons involved (1) and of the legal persons to whom they supply the label. The users of the label shall keep a record of the quantity and composition of the label taken over, its use, business persons1) and legal persons supplying the label.
(3) The records kept in accordance with paragraphs 1 and 2 shall include the following information on natural and legal persons:
(a) for entrepreneurs (1) the name, names and surname, residence, place of business and identification number of the natural person, if any, of the company or name, registered office and identification number of the legal person, if any;
(b) in the case of natural persons, the name and, where applicable, the name, surname and address.
The records shall be kept for 10 years from the first day of the month following the month to which they relate. The method of keeping records is similar to that of keeping accountancy records under the Accounting Act (2).
The list of mineral oils which, pursuant to Section 134m (3) of the Act, may not be labelled if they are intended for use in which marking would be a defect is given in Annex 2 to this Decree.
This Decree shall take effect on the 15th day following that of its publication.
