DECLARATION
of 24 July 2025
on documents confirming acquired rights to be submitted at the same time as evidence of formal qualifications as a general nurse or midwife
The Ministry of Health provides, pursuant to § 90 (2) (j) of Act No. 96 / 2004 Coll., on the conditions for obtaining and recognising eligibility for the pursuit of non-medical medical professions and for the pursuit of activities related to the provision of medical care and on the amendment of certain related laws (Act on non-medical medical professions), as amended by Act No. 282 / 2025 Coll.:
Basic provisions
This decree implements the relevant provisions of the European Union1) and regulates documents issued by the competent authority or institution of the Member State of origin confirming the acquisition of the acquired right to pursue the health profession and the conditions under which such documents are certified in the Member State of origin.
Recognition of evidence of formal qualifications as a general nurse or midwife
(1) The Ministry of Health shall recognise as evidence evidence of formal qualifications not satisfying all the training requirements of Article 31 or 40 of Directive 2005 / 36 / EC issued by the competent authority of the Member State of the tenderer which:
(a) allow access to the professional activities of a nurse or midwife;
(b) it demonstrates the successful completion of the training started before the reference date referred to in points 5.2.2. or 5.5.2 of Annex V to Directive 2005 / 36 / EC; and
(c) be accompanied by a certificate issued by the competent authority of the Member State certifying that the tenderer has actually and lawfully carried out the activities in question for at least three consecutive years during the five years preceding the date of issue of the certificate.
(2) In accordance with paragraph 1, the procedure shall be followed unless otherwise specified in the provisions of Sections 3 to 13.
Recognition of evidence of formal qualifications acquired in the territory of the former German Democratic Republic
The Ministry of Health shall recognise evidence of formal qualifications not meeting all the minimum training requirements of Article 31 or 40 of Directive 2005 / 36 / EC which:
(a) allow access to the professional activities of a nurse or midwife;
(b) has been obtained in the territory of the former German Democratic Republic; and
(c) confirms the successful completion of the training started before 3 October 1990.
Recognition of evidence of formal qualifications issued by the institution or institution of the Slovak Republic
(1) The Ministry of Health shall accept as evidence evidence of formal qualifications which:
(a) has been awarded by the Slovak Republic's institution or institution to a tenderer whose training began before 1 January 1993; and
(b) allow access to the professional activities of a general nurse or midwife;
where the competent authority of the Slovak Republic certifies that the document is of equal validity in the territory of the Slovak Republic as evidence of formal qualifications which it issues as regards access to the professional activities of the general nurse or midwife and the pursuit of such professional activities.
(2) The certificate referred to in paragraph 1 shall be accompanied by a certificate issued by the same authority certifying that the tenderer has actually and lawfully carried out the activities concerned within its territory, including taking full responsibility for the planning, organisation and conduct of patient nursing care, for at least 3 consecutive years during the 5 years preceding the date of issue of the certificate.
Recognition of evidence of formal qualifications issued in the former Soviet Union
(1) The Ministry of Health will recognise as evidence of formal qualifications, which allows access to the professional activities of a general nurse or midwife, issued in the former Soviet Union by a candidate whose training started in the former Soviet Union,
(a) for the Republic of Estonia before 20 August 1991,
(b) for the Republic of Latvia before 21 August 1991; and
(c) for the Republic of Lithuania before 11 March 1990;
where the authority of one of those States certifies that the document is of the same validity on their territory as evidence of formal qualifications which it issues as regards access to the professional activities of the general nurse or midwife and the pursuit of such professional activities.
(2) The certificate referred to in paragraph 1 shall be accompanied by a certificate issued by the same authority certifying that the tenderer has actually and lawfully carried out the activities concerned within its territory, including taking full responsibility for the planning, organisation and conduct of patient nursing care, for at least 3 consecutive years during the 5 years preceding the date of issue of the certificate.
Recognition of evidence of formal qualifications issued in the territory of the former Yugoslavia
(1) The Ministry of Health shall accept as evidence evidence of formal qualifications which allows access to the professional activities of a general nurse or midwife, issued in the former Yugoslavia by a candidate whose training began in the former Yugoslavia,
(a) for the Republic of Slovenia before 25 June 1991; and
(b) for the Republic of Croatia before 8 October 1991,
where the authority of one of those States certifies that the document is of the same validity on their territory as evidence of formal qualifications which it issues as regards access to the professional activities of the general nurse or midwife and the pursuit of such professional activities.
(2) The certificate referred to in paragraph 1 shall be accompanied by a certificate issued by the same authority certifying that the tenderer has actually and lawfully carried out the activities concerned within its territory, including taking full responsibility for the planning, organisation and conduct of patient nursing care, for at least 3 consecutive years during the 5 years preceding the date of issue of the certificate.
Recognition of evidence of formal qualifications as a general nurse issued in the Republic of Poland
The Ministry of Health shall recognise evidence of formal qualifications not meeting the minimum requirements for training a general nurse in accordance with Article 31 of Directive 2005 / 36 / EC which:
(a) has been awarded in the Republic of Poland to a tenderer whose training as a general nurse ended before 1 May 2004; and
(b) be accompanied by a diploma "Bachelor" obtained on the basis of a special programme for career advancement referred to in Article 33 (3) (b) (i) (2) or (ii) (3) of Directive 2005 / 36 / EC, in order to verify that the general nurse concerned has a level of knowledge and skills comparable to that of the general nurse holding the qualifications referred to in point 5.2.2. of Annex V to Directive 2005 / 36 / EC.
Recognition of evidence of formal qualifications as a general nurse issued in Romania
(1) The Ministry of Health shall recognise evidence of formal qualifications not meeting the minimum training requirements of the general nurse referred to in Article 31 of Directive 2005 / 36 / EC referred to in Article 33a (2) (a) (i), (ii) or (iii) of Directive 2005 / 36 / EC which:
(a) has been awarded to a tenderer in Romania; and
(b) it shall be accompanied by a certificate certifying that the tenderer has actually and lawfully carried out the activities of the general nurse in Romania, including taking full responsibility for the planning, organisation and conduct of patient care, for 3 consecutive years during the 5 years preceding the date of issue of the certificate.
(2) The Ministry of Health shall also recognise evidence of formal qualifications not meeting the minimum requirements for general nurse training referred to in Article 31 of Directive 2005 / 36 / EC referred to in Article 33a (2) (a) (ii) or (iii) of Directive 2005 / 36 / EC which:
(a) has been awarded to a tenderer in Romania; and
(b) be accompanied by evidence of formal qualifications as referred to in Article 33a (2) (b), second sentence of Directive 2005 / 36 / EC, obtained on the basis of a specific programme for career advancement (4), supplemented by an addendum to the diploma stating that the candidate has completed a specific programme for career advancement.
(3) The Ministry of Health shall further recognise evidence of formal qualifications at post-secondary level 5) not meeting the minimum requirements for general nurse training referred to in Article 31 of Directive 2005 / 36 / EC referred to in Article 33a (2) (c) of Directive 2005 / 36 / EC which:
(a) has been awarded to a tenderer in Romania; and
(b) be accompanied by evidence of formal qualifications as referred to in Article 33a (2) (c) of Directive 2005 / 36 / EC obtained under the specific programme for career advancement (6).
(4) In the case of Romanian evidence of formal qualifications as a general nurse, only the provisions on acquired rights referred to in paragraphs 1 to 3 shall apply.
The Ministry of Health shall recognise as evidence evidence of formal qualifications as a midwife satisfying all minimum training requirements in Article 40 of Directive 2005 / 36 / EC issued by a Member State before the reference date referred to in point 5.5.2 of Annex V to Directive 2005 / 36 / EC by tenderers who:
(a) does not meet the requirement of one year of professional experience followed by proper training for a midwife of at least 18 months, subject to the acquisition of evidence of formal qualifications as a general nurse referred to in point 5.2.2. of Annex V to Directive 2005 / 36 / EC; and
(b) be accompanied by a certificate certifying that the tenderer has actually and lawfully carried out the activities in question for at least two consecutive years during the five years preceding the date of issue of the certificate.
Recognition of evidence of formal qualifications as a midwife acquired in the territory of the former German Democratic Republic
The Ministry of Health shall accept as evidence evidence of formal qualifications as a midwife satisfying all minimum training requirements in accordance with Article 40 of Directive 2005 / 36 / EC issued by tenderers who:
(a) confirms the completion of training started before 3 October 1990 in the territory of the former German Democratic Republic;
(b) does not meet the requirement of one year of professional experience followed by proper training for a midwife of at least 18 months, subject to the acquisition of evidence of formal qualifications as a general nurse referred to in point 5.2.2. of Annex V to Directive 2005 / 36 / EC; and
(c) be accompanied by a certificate certifying that the tenderer has actually and lawfully carried out the activities in question for at least two consecutive years during the five years preceding the date of issue of the certificate.
Recognition of evidence of formal qualifications as a midwife issued in the Republic of Poland
The Ministry of Health shall recognise evidence of formal qualifications as a midwife not meeting the minimum training requirements of Article 40 of Directive 2005 / 36 / EC, which:
(a) has been awarded in the Republic of Poland to a tenderer whose training ended before 1 May 2004; and
(b) be accompanied by a diploma "Bachelor," obtained on the basis of a special programme for career advancement as referred to in Article 43 (4) (b) (i) (7) or (ii) (8) of Directive 2005 / 36 / EC, in order to verify that the applicant has a level of knowledge and skills comparable to that of a midwife who holds the qualifications referred to in point 5.5.2 of Annex V to Directive 2005 / 36 / EC.
Recognition of evidence of formal qualifications as a midwife issued in Romania
(1) The Ministry of Health shall recognise as evidence for the performance of the activities of the midwife a certificate of formal qualifications (assistant medical obstetrică-ginecology) not satisfying the minimum training requirements of Article 40 of Directive 2005 / 36 / EC which:
(a) has been awarded to a tenderer in Romania before 1 January 2007; and
(b) it shall be accompanied by a certificate certifying that the tenderer has actually and lawfully carried out the activities of a midwife in Romania for at least five consecutive years during the seven years preceding the issue of the certificate.
(2) In the case of Romanian evidence of formal qualifications as a midwife, only the provisions on acquired rights referred to in paragraph 1 shall apply.
Recognition of evidence of formal qualifications as a midwife acquired in the Republic of Croatia
Paragraph 2, 6 and 9 shall not apply to evidence of formal qualifications as a midwife acquired in the Republic of Croatia before 1 July 2013, namely:
a) viša medicinska sister ginekoloskoskoopstetričkog smjera (chief nurse in gynecology),
b) medicinska sister ginekoloskole- opstetričkog smjera (nurse in gynecology),
(c) viša medicinska sister primaljskog smjera (head nurse in the field of maternity assistance),
(d) primaljskog smjera (nurse in the field of maternity assistance),
(e) ginekološka-medicinska sister opstetrička primalja (gynecologico-midwife); and
(f) primalja (midwife).
Efficacy
This Decree shall take effect on the 15th day following its publication.

FREE MOVEMENT OF SERVICES.
(2) Article 11 of the Law of 20 April 2004 amending the Law on the occupation of nurses, nurses and midwives and certain other legislation (Official Journal of the Republic of Poland, 2004, No 92, No 885 and 2007, No 176, No 1237) and the Decree of the Minister for Health of 11 May 2004 on the conditions for the education of nurses, nurses and midwives who hold a document of completed secondary education (maturities - maturities) and attended secondary medical school and other medical training for the profession of nurses, nurses and midwives (Official Journal of the Republic of Poland, 2004, No 110, p. 1170 and 2010, No 65, p. 420).
(3) Article 52.3 (2) of the Law of 15 July 2011 on the profession of nurse, nurse and midwife (Official Journal of the Republic of Poland, 2011, No 174, No 1039) and the Decree of the Minister for Health of 14 June 2012 laying down detailed conditions for the provision of higher education to nurses, nurses and midwives who hold a document of completed secondary education (graduation - graduation) and have completed a secondary medical school or other medical training for the profession of nurse, nurse and midwife (Official Journal of the Republic of Poland, 2012, p. 770).
4) Article 3 (2) of the Joint Regulation No 4317 / 943 / 2014 of the Minister for Education and Health of 11 August 2014 approving a specific programme for career advancement in the case of initial training of nurses responsible for general care obtained before 1 January 2007 for graduates of post-secondary and higher education (Official Journal of Romania No 624 of 26 August 2014).
5) Article 4 of Regulation No 5114 / 2014 of the Minister for Education on the approval of the methodology for the organisation, implementation and termination of the special programme for career advancement in the case of initial training of general nurses obtained before 1 January 2007 for post-secondary education graduates (Official Journal of Romania No 5 of 6 January 2015).
