INTRODUCTORY PROVISIONS

HLAVA I

GENERAL PROVISIONS
§ 1
Subject matter
(1) This law regulates the scope of the building authorities, the spatial planning bodies and the local authorities in the area of spatial planning and the building order, setting out the objectives, tasks and instruments of spatial planning, the requirements for construction and construction rules.
(2) This Act further regulates the conditions for integrated protection of public interests in the planning, authorisation of buildings and construction, the obligations of persons in the preparation and implementation of buildings, the conditions for project activities and the implementation of buildings, certain expropriation purposes, the authorisation of authorised inspectors and the exercise of control.
(3) The purpose of the Building Act is to ensure integrated protection of public interests in the planning, authorisation of buildings and construction and to create conditions for the sustainable development of the territory and to improve the quality of the environment, architecture and building culture.
§ 2
Authorities concerned
(1) The authority concerned shall be bound by its previous opinion, opinion or binding opinion, which it issued as a basis for acts under this law.
(2) The procurement of subsequent zoning documentation shall not take account of the opinions of the authorities concerned in matters decided upon when approving the territorial development policy and issuing the superior zoning documentation.
(3) The procedures under Part Six shall not take account of any observations or binding opinion on matters decided on in the planning documentation or in the territorial measure.
§ 3
Amendment of conditions
(1) A new opinion, opinion or binding opinion may be invoked by the institution concerned in the same case only to the extent of the newly established facts which could not have been established earlier or on the basis of an amendment to the legislation, and to the extent that they have changed the conditions under which the opinion, opinion, opinion or binding opinion has been issued only to the extent that the conditions have changed.
(2) A new opinion, statement or binding opinion may also be issued by the institution concerned if the original opinion was issued on the basis of false, incomplete or distorted data.
(3) A new opinion on the planning documentation may also be used by the authority concerned on the basis of the facts resulting from the greater detail of the planning documentation obtained or from the result of the resolution of the discrepancies.

HLAVA II

INJURY
§ 4
Intent
(1) The purpose of this Act is to build, set of structures, equipment, maintenance of completed construction, change of land use, division or consolidation of land and the establishment of a protection zone.
(2) The EIA's intention in this Act is to mean an intention under paragraph 1 which is subject to an environmental impact assessment under the Environmental Impact Assessment Act.
§ 5
Construction
(1) Construction is defined in this Act as a construction work which arises from construction or assembly activities of construction products, materials or structures for use in a specific place. A product fulfilling the function of the construction is also considered a construction.
(2) The structures are:
(a) the small ones listed in Annex 1 to this Act;
(b) simple as set out in Annex 2 to this Act;
(c) reserved as listed in Annex 3 to this Act; and
(d) others.
(3) The set of structures is defined in this Act as interrelated constructions which, within the framework of a single project, take place in a continuous territory or for a common purpose.
(4) The construction of the main set of buildings in this law means the construction which determines the purpose of the construction of the set of buildings. A secondary construction in a set of structures is a building that is connected or related to the construction with the main purpose of use or location and which ensures the usability of the building or complements the purpose of the main use of the building.
(5) Temporary construction means a building for which the construction office will limit its duration in advance.
(6) If the concept of construction is used in this Act, it also means a part of it or a change of the completed construction, as the case may be.
§ 6
Change and maintenance of completed construction
(1) The amendment of the completed construction is understood in this Act
(a) the superstructure which increases,
(b) an extension which extends the construction plan and which is interconnected in an operational manner with the existing construction; and
(c) a construction arrangement whereby the external floor and height limits of the building are maintained.
(2) The amendment of the completed construction is also understood as a change in the use of the construction consisting of a change in
(a) how the construction is used;
(b) operating equipment of the building,
(c) the method of manufacture or the substantial extension of production;
(d) activities the effects of which could endanger life or public health, life and animal health, safety or the environment; or
(e) the duration of the temporary construction or the change of the temporary construction to permanent construction.
(3) The maintenance of the completed construction is meant in this Act as maintenance work which ensures a good engineering condition of the construction in order to reduce as far as possible the risk of a defect or an accident of the construction and not to degrade the construction.
§ 7
Equipment
(1) The provision of this Act means technical equipment or advertising equipment, unless it is a construction which is created for use at a specific location.
(2) Advertising equipment is defined in this Act as a panel, pane, plate or structure which serves to disseminate advertising or other information. Advertising equipment with a total surface area of more than 8 m2 shall be considered a construction.
§ 8
Terrain treatment
Terrestrial treatment in this Act means land work and changes of terrain which significantly alter the appearance of the environment or outflow conditions, mining and similar and related work, not for mining or mining activities.
§ 9
Construction site
(1) The construction site is defined in this Act as the place where construction, equipment, landscaping or maintenance work is carried out or where construction, equipment or landscaping is removed.
(2) The construction site shall comprise a building plot or part of it or part of it or, where appropriate, to the extent defined by the construction office, another plot or part of it or part of another building necessary for the construction, installation or landscaping of the construction or removal of the construction, plant or terrain.
§ 10
Public infrastructure
(1) Public infrastructure means land, buildings and facilities serving public needs in this Act,
(a) transport infrastructure, in particular infrastructure, rail, waterways, air structures and related buildings and equipment,
(b) technical infrastructure, in particular the systems and networks of technical infrastructure, and related structures and facilities for water supply, drainage and treatment of waste water, energy, including generation and energy sources, energy storage facilities, recharging stations and gas storage facilities, production ducts and electronic communications, as well as structures and installations to reduce the risk in the territory and to improve the state of surface and groundwater or waste management;
(c) the green infrastructure, which is a planned, predominantly continuous system of areas and other elements of vegetation, water and water management, of a natural and semi-natural nature, which, by virtue of its target status, enable or significantly promote the fulfilment of a wide range of ecosystem services and functions; Part of the green infrastructure is also the territorial system of ecological stability of the landscape,
(d) civil facilities, such as buildings, facilities and land, to ensure the basic needs of the population, in particular for education, education and sport, social and health services, culture, public administration and protection of the population;
(e) publicparties1).
(2) The technical infrastructure network is defined in this Act as the line or spatial management of the engineering network, including fittings, equipment and structures for the management and its terminal elements, which ensure connection to the various types of media used.
(3) Technical infrastructure networks are, according to their purpose, in particular energy, water and sewage, electronic communications and pipelines.
§ 11
Public utility construction and measures
(1) Public works in this Act are the construction or installation of public infrastructure intended for the development or protection of the territory of a municipality, region or State as defined in the territorial planning documentation and the construction and installation related to it or subject to its implementation.
(2) A public measure is a measure of a non-building nature designed to reduce hazards in the territory, to create elements of the environmental stability system (2) and to develop or protect the natural, cultural and archaeological heritage defined in the planning documentation.
§ 12
Basic concepts of spatial planning
This law means:
(a) a change in the territory of a change in its functional use or spatial layout, including the placing of structures or their changes;
(b) the building plot of the land, part of it or a set of parcels defined and intended for construction;
(c) a built-up building plot, a plot registered in the cadastral of real estate as a building plot and other land parcels, normally under common fencing forming a continuous functional and spatial unit with structures which determine the function in that building;
(d) the area of a part of the territory consisting of one or more parcels or parts thereof, as defined in the territorial development plan, the principles of territorial development or the zoning plan, and, where appropriate, in the territorial planning documents, taking into account the current or desired use method or its importance;
(e) the corridor of the territory defined for, as a rule, the liner project of transport, technical infrastructure or measures of a non-construction nature;
(f) area or corridor of national importance, the area or corridor which, by its meaning, scope or use, affects the territory of several regions or states;
(g) the area or corridor of supra-local importance, which, by its meaning, scope or use, affects the territory of several municipalities; in the case of the capital city of Prague, the area or corridor of supra-local importance shall be considered to affect the territory of several urban areas by its significance, scope or use;
(h) the built-up territory of the territory defined by a separate procedure under this law (hereinafter referred to as the "definition of the built-up territory") or the territorial plan;
(i) a stable area for construction as defined in the territorial development plan, the principles of territorial development or the territorial plan;
(j) non-established territories of territories not included in the built-up territory or in the built-up area;
(k) the transformation area of the area intended to create a completely new character of the territory or to restore the degraded or neglected territory for the purpose of its reuse, as defined by the territorial development plan, the principles of territorial development or in the built-up territory of the territorial plan;
(l) the area of the change in the landscape of the area intended to change the current use for other uses of the unbuilt territory defined in the unbuilt territory of the territorial plan;
(m) the street line between the land and the public area;
(n) the construction line of the interface between the construction and the non-installed part of the plot, which determines the position of the edge of the building at the level of the grown or treated terrain; the construction line may be
1. closed, which specifies an interface continuously installed, of the entire length of the construction; or
2. open, which sets out interfaces interrupted by building gaps,
o) an unbuilt space in the existing continuous installation, including unbuilt corners intended for construction,
(p) the senior planning documentation shall:
1. the regulatory plan shall mean the territorial plan, the principles of territorial development and the territorial development plan;
2. a territorial plan means the principles of territorial development and a territorial development plan;
3. territorial development principles means a territorial development plan;
(q) follow-up zoning documentation for:
1. territorial development policy means the territorial development plan, the principles of territorial development, the territorial plan and the regulatory plan;
2. the territorial development plan means the principles of territorial development, the territorial plan and the regulatory plan;
3. territorial development principles shall mean a territorial plan and a regulatory plan;
4. the territorial plan shall mean the regulatory plan;
(r) the limit on the use of the territory of restrictions on changes in the territory in order to protect public interests, arising from legislation, or provided for under other legislation, or resulting from the characteristics of the territory;
(s) a diagram of the drawing showing, in a simplified form, phenomena of a scale smaller than those laid down for the individual planning documentation;
(t) an environment constructed or modified by man, including buildings and open spaces, both public and non-public,
(u) the rendering of a set of measures for the recovery of areas showing defects, in particular due to economic changes or the disability of natural disasters or major accidents;
v) architectural competition procedure for searching for the best architectural solution of the construction or contractor of the project documentation, in which the design of the architectural solution of the construction is presented and evaluated,
(w) urban competition procedure for seeking the best urban solution of the territory or the contractor of a territorial study or planning documentation, where proposals for urban solutions of the territory are submitted and evaluated.
Basic concepts of the building order
§ 13
In this law,
(a) the building of the above-ground building, including its underground part, concentrated in space and on the outside mainly closed by perimeter walls and roof structures;
(b) housing building in which more than half of the floor area serves housing;
(c) a family house housing structure in which more than half of the floor area serves housing, and which has no more than three separate apartments, no more than two above-ground and one underground floor and attic, or a third above-ground floor receded from the outer face of the perimeter of the building oriented towards the street line by at least 2 metres;
(d) accessibility of the creation of conditions for the separate and safe use of land and buildings by persons with mobility, visual or auditory disabilities, persons of advanced age, pregnant women and persons accompanying a child in a pram or a child under 3 years of age (hereinafter referred to as "person with reduced mobility or orientation") with a view to barrier-free use;
(e) building of the accommodation facility or part thereof for the provision of accommodation and services related thereto; the building of accommodation is not an apartment house, family house or building for family recreation,
(f) construction for trade construction with sales area,
(g) construction for the production and storage of buildings for industrial, craft or other production, and, where appropriate, of services having the character of production, and for the storage of products, materials and materials other than those referred to in (h);
(h) construction for agriculture of farm animals, accompanying construction for livestock, plant production and post-harvest treatment, construction for agricultural machinery, construction for storage of plant products, mineral fertilisers, plant protection products and products;
(i) a suite of rooms and, where applicable, one living room, which, by its technical design and equipment, meets the requirements for permanent housing;
(j) a special purpose apartment designed to accommodate persons with severe motor or people with severe visual impairment;
(k) rooms of a space-closed part of the building, defined by the floor, ceiling or roof construction and fixed walls;
(l) the residential part of the apartment which is intended for living complies with the housing requirements in terms of size, daylight, ventilation, heating and noise and has a floor area of at least 8 m2; the kitchen shall be considered a living room if the floor area is at least 12 m2; if the apartment is a single living room, its floor area must be at least 16 m2,
m) the living room is a room which, by its location, size and construction arrangement, meets the requirements for occupants;
(n) the floor area is the sum of the areas defined by the inner face of the vertical structures of the individual rooms and spaces designed for use in the building; In floors with inclined walls or inclined ceilings, it is defined by the inner face of the structures at a level of 1,2 m above the floor level; for semi-exposed or exposed spaces, the floor space shall be defined by a rectangular projection of the horizontal structure, instead of the missing vertical structures;
(o) the built-in surface of the construction area bounded by rectangular projection of the outer face of the circumferential structures of all the above and underground floors on a horizontal plane; the areas of the lodgers and arcs shall be counted; for semi-exposed objects (without certain circumferential walls), the built-in area is defined by the packaging lines led by the outer faces of vertical structures to a horizontal plane; for roofed structures or parts thereof without circumferential vertical structures, the installed surface is defined by a rectangular projection of the roof structure into a horizontal plane;
(p) the built-up plot of the plot sum of all the built-up areas of each building,
(q) a house for affordable rental housing, for which a planning contract for affordable rental housing is concluded, or which is defined as a house for affordable rental housing in a regulatory plan issued by the municipality, which is a builder.
§ 14
In this law,
(a) by the builder, the person who requests for the authorisation of the project or the removal of the construction, installation or landscaping for himself, and the person who carries out or removes the construction, installation or landscaping of the construction, in the absence of a construction entrepreneur acting in the course of his business;
(b) by a designer, a natural person authorised under an authorisation law to process land planning documentation, territorial studies and project documentation;
(c) the main project designer responsible for coordinating the documentation processing;
(d) the construction entrepreneur is authorised to carry out construction or assembly work as an object of his activity under the Trade Act;
(e) by the contractor of the construction works in the case of self-help forms of construction, or by the construction contractor,
(f) the construction of a natural person authorised under the Authorization Act to carry out or dispose of the construction,
(g) building supervision by professional supervision of the implementation or removal of construction, equipment or landscaping by self-help;
(h) supervision by the designer of the ongoing expert supervision of the compliance of the implementation of the project documentation with the project authorisation document and the implementation of the project in accordance with the project implementation documentation.

ČÁST DRUHÁ

ORGANISATION AND PUBLIC MANAGEMENT

HLAVA I

CONSTRUCTION MANAGEMENT
§ 15
General provisions
The scope of this Act is exercised by the Government, the Ministry of Regional Development ("the Ministry '), the zoning authorities, construction offices, municipalities, and regions.
§ 16
Municipality and Region
The municipality and the county shall continuously monitor the application of their territorial planning documentation and evaluate it under this law. Where there is a change in the conditions under which the planning documentation has been issued, the planning documentation concerned shall be amended.
§ 17
Transport and energy construction office
(1) The Transport and Energy Building Office is an administrative office with national competence in the matters of the construction order under the Ministry of Transport.
(2) Prague is the headquarters of the Transport and Energy Building Office.
(3) The Ministry of Transport is designated by the Ministry of Transport by decree.
(4) The head of the Transport and Energy Building Office is the Director. For the purposes of the Civil Service Act, the Ministry of Transport is the direct superior administrative office of the Transport and Energy Building Office.
(5) The selection, appointment and removal of the Director are governed by the Civil Service Act.
§ 18
Synergies of public authorities
(1) The zoning authorities and the construction authorities shall, in exercising their competence, cooperate with the public interest authorities concerned under other legislation.
(2) The construction office shall discuss the observations and binding opinions delivered by the authorities concerned. In order to discuss observations and binding opinions or to eliminate discrepancies, the construction office may convene joint negotiations with the authorities concerned. The joint action shall be non-public and a protocol shall be drawn up on its progress and conclusions. The construction office shall notify the authorities concerned of its performance at least 5 days in advance. If appropriate, the construction office shall invite the builder and other parties to act jointly. In such a case, the construction office shall order a joint hearing as an oral hearing.
(3) If, in accordance with the procedure laid down in paragraph 2, there is no conflict between the construction office and the authorities concerned and between the authorities concerned, the procedure shall be followed in accordance with the administrative rules.
(4) Where the authorities concerned lay down in their observations or binding opinion the conditions which have become part of the decision of the construction office, they shall check compliance with them in cooperation with the construction office.

HLAVA II

SCOPE IN TERRITORIAL PLANNING MATTERS
§ 19
General provisions
(1) The scope of territorial planning matters is exercised by the government and the territorial planning authorities, which are:
(a) the Ministry;
(b) Ministry of Defence,
(c) zoning authorities; and
(d) a municipal authority which has obtained confirmation of compliance with the qualification requirements for the pursuit of a territorial planning activity.
(2) The local planning authorities are municipal authorities with extended competence and regional authorities.
(3) Furthermore, the town council, the district council, the municipal council and the county council are responsible for the territorial planning matters.
§ 20
Government
Government
(a) approve the policy of architecture and building culture;
(b) decide on the acquisition of a territorial development policy;
(c) approve the territorial development policy;
(d) discuss and approve the report on the implementation of the territorial development and architecture and building culture policy;
(e) issue a territorial development plan;
(f) discuss and approve a report on the implementation of the territorial development plan;
(g) issue territorial measures on the construction closure when changes are made to national territory;
(h) issue territorial measures on the rendering of territories if they affect their importance, scope or use of territories of several regions or states.
§ 21
Ministry
(1) The Ministry is a superior administrative body of the regional authorities as zoning authorities.
(2) Ministry
(a) exercise control over spatial planning matters;
(b) procure a policy of architecture and building culture;
(c) procure territorial development policy;
