DECLARATION
of 17 February 2014
amending Decree of the Ministry of Transport No. 223 / 1995 Coll., on the eligibility of vessels to operate on inland waterways, as amended
The Ministry of Transport provides pursuant to Section 52 of Act No. 114 / 1995 Coll., on Inland Navigation, as amended by Act No. 358 / 1999 Coll., Act No. 118 / 2004 Coll. and Act No. 309 / 2008 Coll., for implementation of Sections 9 (1), 10 (2) and 18 (2) of this Act:
Decree No. 223 / 1995 Coll., on the eligibility of vessels to operate on inland waterways, as amended by Decree No. 83 / 2000 Coll., Decree No. 186 / 2005 Coll., Decree No. 6 / 2006 Coll., Decree No. 38 / 2006 Coll., Decree No. 173 / 2009 Coll., Decree No. 388 / 2009 Coll. and Decree No. 38 / 2010 Coll., is amended as follows:
1. In Article 1, the words "European Communities' are replaced by the words" European Union 'and footnote 1 is replaced by the following:
"(1) Directive 2006 / 87 / EC of the European Parliament and of the Council of 12 December 2006 laying down technical requirements for inland waterway vessels and repealing Council Directive 82 / 714 / EEC. Directive 2006 / 137 / EC of the European Parliament and of the Council of 18 December 2006 amending Directive 2006 / 87 / EC of the European Parliament and of the Council laying down technical requirements for inland waterway vessels. Commission Directive 2012 / 49 / EU of 10 December 2012 amending Annex II to Directive 2006 / 87 / EC of the European Parliament and of the Council laying down technical requirements for inland waterway vessels. ';
2. In Annex 1, Chapter 1.01, points 96 and 97 read:
"96) navigation light - light from signal lamps used to indicate vessels,
97) Light signal - light used to complete visual or audible signals, ';
3. In Annex No 1, Chapter 1.01, point 107, the word "or 'is replaced by the word" person' and the words "or, in the cases provided for in Commission Directive 2012 / 48 / EU amending the Annexes to Directive 2006 / 87 / EC of the European Parliament and of the Council laying down technical requirements for inland waterway vessels' are inserted.
4. In Annex No 1, Chapter 2.02.1 (b), the words "for in-service inspection, the minimum thickness of the bottom, outboard and side shell shall comply with the following conditions: For steel-based vessels, the minimum thickness of the tmin shall be the highest value determined from the formulae: 'are replaced by the words" for in-service inspection, the minimum required thickness of the bottom, outboard and the sides of steel-based vessels shall be the highest value determined from the formulae:'.
5. In Annex No 1, Chapter 6.05.4, including footnote 9, reads:
"6.05.5. Navigation lights, their covers and accessories shall be type-approved in accordance with the Government Regulation on Technical Requirements for Marine Equipment (9).

6. In Annex 1, Chapter 6.06.1, the second sentence is replaced by the sentence "Radar equipment and rate-of-turn indicators shall comply with the requirements of Parts I to III of Annex IX." Radar equipment and speed-of-turn indicators used on inland waterway vessels "of Directive 2006 / 87 / EC of the European Parliament and of the Council laying down technical requirements for inland waterway vessels and repealing Council Directive 82 / 714 / EEC, as amended by Directive 2006 / 137 / EC, Directive 2008 / 59 / EC, Directive 2008 / 87 / EC, Directive 2008 / 68 / EC, Directive 2008 / 126 / EC and Directive 2012 / 48 / EU. '.
7. Chapter 7.01.2 of Annex 1 reads as follows:
"7.01.2. Pressure vessels intended for the operation of the vessel shall be checked by the inspection body to verify that they are safe for operation:
(a) before its first entry into service;
(b) before re-entry into service after any modification or repair; and
(c) regularly at least every five years.
The check shall include an internal and external inspection. Containers with compressed air, the inner spaces of which cannot be properly checked or their condition cannot be clearly determined during internal inspection, shall be subjected to further non-destructive testing or hydraulic pressure testing. The inspection document shall include the date, conclusion of the inspection and the signature of the inspection body. ';
8. In Annex 1, Chapter 10.01.5, "and Directive 2008 / 126 / EC 'are replaced by" Directive 2008 / 126 / EC and Directive 2012 / 48 / EU'.
9. Chapter 10.02.1 of Annex 1 reads as follows:
"10.02.1. At least the following equipment shall be on board:
(a) radio telephony equipment;
(b) instruments and equipment required to transmit visual and acoustic signals and to indicate the vessel;
(c) independent emergency lights for the prescribed anchorages.
The following vessels shall also be on board:
(a) marked collection container for ordinary waste;
(b) separate labelled containers with sealing seals made of steel or other durable non-flammable material of an appropriate size, of a capacity of not less than 10 litres, intended for assembly
(aa) oil-contaminated wipes;
(bb) hazardous or harmful solid waste;
(cc) hazardous or harmful liquid waste;
and to the right extent also for storage
(dd) sewage,
(ee) other oiled or oily waste.
10. In Annex 1, Chapter 10.03.1, "EN 3: 1996 'is replaced by" EN 37: 2007 and EN 3 - 8: 2007'.
11. in Annex 1, Chapter 10.03.2 reads:
"10.03.2. With regard to portable fire extinguishers referred to in paragraph 10.03.1 of this annex, powder extinguishers with a extinguishing capacity of at least 21 may be used Or other portable fire extinguishers with the same or higher extinguishing capability. They shall be suitable for Class A, B and C fires. However, spray foam fire extinguishers using waterfilm foam (AFFF-AR) and hardy to minus (-) 20 ° C are permitted on vessels without liquefied gas equipment, even if they are not suitable for Class C fires. These extinguishers shall have a minimum capacity of 9 litres with a extinguishing capacity of at least 13 A. All extinguishers shall be suitable for extinguishing fires in electrical systems up to 1000 V. ';
12. in Annex 1, in Chapters 10.03a.1, 15.10.4 (h), 15.11.3, 15.11.5, 15.11.13 (bb), 15.13.2 (d), 22a11.3, 24.02.2 (d), 24.05.13 (b), "sprinkler fire-fighting systems" shall be replaced by "stable sprinkler fire extinguishers."
13. in Annex 1, Chapter 10.03a.6 (a), the word "first" shall be inserted after the word "before."
14. in Annex 1, Chapter 10.03a.6 (c):
'(c) before re-entry into service after any major modification or repair;';
15. in Annex 1, Chapter 10.03b.3, "and Directive 2008 / 126 / EC" shall be replaced by "Directive 2008 / 126 / EC and Directive 2012 / 48 / EU."
16. in Annex No 1, Chapter 10.03b.9 (b) (aa), the word "first" shall be inserted after the word "before."
17. in Annex 1, Chapter 10.03b.9 (b) (cc):
"(cc) before re-entry into service after any major modification or repair; ';
18. Chapter 11.02.4 of Annex 1 reads as follows:
"11.02.4. The outer edges of the decks and side decks shall be fitted with a railing with a height of not less than 0,90 m or continuous railing according to European standard EN 711: 1995. Workplaces from which persons may fall from a height of more than 1 m shall be equipped with a railing or wall of the on-board esophagus with a height of not less than 0,90 m or continuous railing according to European standard EN 711: 1995. In cases where the side deck railing can be tilted,
(a) an intermediate handle of a diameter of 0,02 to 0,04 m shall be retrofitted to the deck esophagus at a height of 0,7 to 1,1 m; and
(b) in clearly visible positions at the edges of the side deck, the marks referred to in Appendix I, Figure 10 of Annex 1 to this Decree, having a diameter of not less than 0,015 m, shall be affixed
If there is no wall of the on-board esophagus, it is necessary to install a fixed rail. '
21. In Annex No 1, Chapter 11.12.6, the words "or repair or periodically at least every 10 years' shall be inserted after the words" modifications'.
22. In Annex No 1, at the end of Chapter 11.12.7, the sentence "The proof of inspection shall contain the date, conclusion of the inspection and signature of the inspection body."
23. In Annex 1, Chapter 11.12.8 is deleted.
24. Chapter 11.12.9 of Annex 1 reads as follows:
"11.12.9 The operator manual provided by the crane manufacturer shall be kept on board. These instructions shall include at least the operating range and function of the controls, the maximum permissible nominal load capacity according to crane unloading, the maximum permissible crane inclination, the installation and maintenance instructions and general technical data. ';
25. In Annex No 1, Chapter 14.13.1, the second sentence is deleted and the word "first 'is inserted after the word" before'.
26. In Annex No 1, at the end of Chapter 15.03.5, the sentence "The intended closure of the deck by tarpaulins and similar mobile devices shall be taken into account when calculating the lateral area."
27. in Annex 1, Chapter 15.03.9 (a):
"(a) For status 1, bulkheads may be considered as undamaged if the distance between the two adjacent bulkheads is greater than the length of the damage. The longitudinal bulkheads at a distance of less than B / 3 from the hull, measured perpendicular to the median plane of the vessel in the plane of the maximum permissible draught, shall not be taken into account for the purposes of the calculation. A niche in a transverse bulkhead which is more than 2,5 m long shall be regarded as a longitudinal bulkhead. ';
28. Chapter 15.06.1 of Annex 1 reads as follows:
"15.06.1 Passenger rooms shall:
(a) be located on all decks beyond the plane of the collision bulkhead and, if located below the bulkhead deck, in front of the plane of the aft bulkhead;
(b) be gas-tight separated from machinery spaces and boiler rooms;
(c) be so arranged that the planes of vision referred to in Chapter 6.02 do not pass through them.
The deck areas which are closed not only from the top but are also completely or partially closed on the sides by tarpaulins or similar mobile devices shall meet the same requirements as closed passenger compartments. ';
29. In Annex 1, Chapter 15.06.7, the words "and Directive 2008 / 126 / EC 'are replaced by the words" Directive 2008 / 126 / EC and Directive 2012 / 48 / EU'.
30. Chapter 15.06.15 of Annex 1 reads as follows:
"15.06.15 The superstructures or their roofs, consisting entirely of panoramic panes and closures created by tarpaulins or similar mobile devices and their supporting structures, shall be designed in such a way and may only be made of such materials as to minimise the risk of injury to persons on board in the event of an accident. ';
31. in Annex 1, Chapter 15.11.2 (a):
"(a) The dividing walls between the rooms shall be designed in accordance with the following tables:
"(aa) Table for dividing walls between rooms where no stable sprinkler fire extinguishers are installed according to drop 10.033a

(1) The partitioning walls between control posts and internal assembly spaces shall correspond to type A0, but for external assembly spaces only to type B15.
(2) The partitioning walls between the common spaces and the internal assembly spaces must correspond to type A30, but only type B15 for external assembly spaces.
(3) The partitioning walls between cabins, the partitioning walls between cabins and corridors and the vertical partitioning walls separating common spaces according to Chapter 15.11.10 shall correspond to type B15 for rooms equipped with systems of stable sprinkler fire extinguishers of type B0. The separation walls between cabins and saunas shall correspond to type A0, for rooms equipped with systems of stable sprinkler fire extinguishers of type B15.
(4) The dividing walls between machinery spaces according to Chapter 15.07 and Article 15.10.6 shall correspond to type A60; in other cases it shall correspond to type A0.
(5) The partitioning walls between storage spaces for flammable liquids and between control stations and assembly spaces shall correspond to type A60, in the case of rooms equipped with systems with stable sprinkler fire extinguishers of type A30.
(6) Type B15 is sufficient for dividing walls between kitchens on the one hand and cold stores and food storage facilities on the other.
(bb) Table for dividing walls between rooms in which stable sprinkler fire extinguishers are installed according to Chapter 10.03a

(5) The partitioning walls between storage spaces for flammable liquids and between control stations and assembly spaces shall correspond to type A60, in the case of rooms equipped with systems with stable sprinkler fire extinguishers of type A30.
(6) Type B15 is sufficient for dividing walls between kitchens on the one hand and cold stores and food storage facilities on the other. "
32. Chapter 15.11.4 of Annex 1 reads as follows:
"15.11.4 The ceilings and wall linings in social spaces, including basic structures, must be made of non-combustible materials, except surfaces which must at least limit the flame spread of the flame, provided that such spaces are not fitted with a stable pressurised fire extinguishing device according to droplets 10.033a. The first sentence does not apply to saunas. '
33. In Annex 1, the following Chapter 15.11.7a is inserted after Chapter 15.11.7:
"15.11.7a Protective sails or similar mobile devices with which the decks are completely or partially closed and their supporting structures shall at least restrict the flame spread. ';
34. In Annex 1, Chapter 15.11.17, the words "and Directive 2008 / 126 / EC 'are replaced by the words" Directive 2008 / 126 / EC and Directive 2012 / 48 / EU'.
35. in Annex 1, Chapter 15.14.1:
"15.14.1. Passenger ships shall be equipped with sewage collection tanks as defined in Chapter 15.14.2 or on-board sewage treatment plants as defined in Chapter 15.14.3. ';
36. In Annex No 1, the following Chapters 15.14.3 to 15.14.9 are inserted after Chapter 15.14.2:
"15.14.3. On-board sewage treatment plants shall comply with the limits set out in Table 1.

(1) The total organic carbon (TOC) may be declared for inspection instead of chemical oxygen consumption (COD).
15.14.4 Compliance with the limit values shall be demonstrated by type-approval in accordance with Commission Directive 2012 / 49 / EU amending Annex II to Directive 2006 / 87 / EC of the European Parliament and of the Council laying down technical requirements for inland waterway vessels.
A copy of the type-approval certificate and a record of the parameters of the on-board sewage treatment plant shall be carried on board the ship.
15.14.5 The values given in Table 2 shall be complied with during operation.

15.14.6 Procedures using chlorine products are not permitted. It is also not allowed to dilute sewage to reduce the specific load and to remove it.
15.14.7 Waste sludge must be stored, stored and discharged in such a way as to avoid contamination of the environment with waste sludge. The vessel shall be equipped with a waste sludge management plan.
15.14.8 Waste water treatment plants which have been placed on board the ship may be operated only after the manufacturer has carried out the performance test. The on-board sewage treatment plant shall be indicated under item 52 of the certificate, together with the name, number of the approved type, serial number and year of manufacture. Any significant modification of the on-board sewage treatment plant affecting waste water treatment shall be followed by a specific test to determine the current status of the on-board sewage treatment plant in relation to the components listed in the record of parameters of the on-board sewage treatment plant, calibration and setting of these parameters.
15.14.9 It is necessary to perform regular maintenance at the on-board sewage treatment plant according to the manufacturer's instructions to ensure that it is in perfect working condition. There shall be a service book in which maintenance can be verified. ';
37. in Annex No 1, Chapter 15.15.08, the words "and Directive 2008 / 126 / EC 'are replaced by the words" Directive 2008 / 126 / EC and Directive 2012 / 48 / EU';
38. In Annex No 1 to Chapters 22.03.1 to 22.03.9:
"22.03.1 Chapters 22.03.2 to 22.03.10 apply to vessels exceeding 110 m except passenger ships.
22.03.2 The baseline values for the calculation of stability, the mass of the empty vessel and the centre of gravity shall be determined by means of a tilting test carried out in accordance with Annex I to IMO Resolution MSC 267 (85).
22.03.3 The applicant may demonstrate by calculation on the basis of the method of loss of buoyancy that the ability and stability of the vessel is adequate in the event of flooding. All calculations shall be made with unrestricted descent and slope. Sufficient floating and stability of the vessel in the event of flooding shall be demonstrated with a load corresponding to the maximum permissible draught of the vessel and evenly distributed to all sub-deck cargo areas, with full loading of the supplies and fuel. The calculation in the case of unevenly distributed load shall be made for the least favourable loading conditions. The stability calculation shall be carried out on board. For this purpose, on the basis of the mathematical calculation, sufficient stability must be demonstrated in intermediate flooding (25%, 50% and 75% of final flooding and, where appropriate, in the phase immediately preceding the transverse equilibrium position) and in the final stage of flooding under the loading conditions mentioned above.
22.03.4 The following assumptions shall be taken into account for the impaired condition:
(a) Range of lateral damage
longitudinal: not less than 0,10 L,
transverse: 0,59 m,
vertical: from the bottom upwards without restriction.
(b) Range of floor damage
longitudinal: not less than 0,10 L,
transverse: 3,00 m,
vertical: from the base 0,39 m upwards, except the waste pit.
(c) All bulkheads in the damaged area shall be regarded as damaged, meaning that division must be chosen so that the vessel is able to sail after flooding of two or more adjacent compartments in the longitudinal direction. Only the status of 1 separation must be taken into account for the main engine room, i.e. the end bulkheads of the engine room shall be considered as undamaged.
In case of damage to the bottom, adjacent sections in the transverse direction shall also be considered flooded.
(d) Floating
Floating capacity is assumed to be 95%.
If the calculation shows that the average navigability of a compartment is less than 95%, the calculated value may be used.
The values used shall not be less than:
- machinery spaces and operating rooms: 85%
- underboard cargo spaces: 70%
- double bottom, fuel tanks, ballast tanks, etc., depending on their function, if they are considered to be full or empty for a vessel with the greatest permissible submersion: 0 or 95%.
(e) The calculation of the effect of free level in intermediate flooding shall be based on the gross surface area of damaged compartments.
22.03.5 For all intermediate stages of flooding according to Chapter 22.03.3, the following criteria shall be met:
(a) the angle of inclination of the angle of inclination in the equilibrium position of the intermediate stage of flooding concerned shall not exceed 15 ° (5 ° in the case of unsecured containers);
(b) above the tilting in the equilibrium position of the intermediate stage concerned, the positive part of the tilting arm curve of the lever shall show the value of the tilting arm of the lever GZ ≥ 0,02 m (0,03 m in the case of unsecured containers) until the first unprotected opening has been submerged or the angle of tilting has been reached (15 ° in the case of unsecured containers);
(c) non-watertight openings shall not be submerged until the tilting has been achieved in the equilibrium position of the intermediate stage of flooding concerned.
22.03.6 During the final stage of flooding the following criteria shall be met:
(a) the lower edge of non-watertight openings (e.g. doors, windows, esophageal entrances) shall not be less than 0,10 m above the waterline in the disturbed state;
(b) the angle of inclination in equilibrium shall not exceed 12 ° (5 ° in the case of unsecured containers);
(c) above the tilting position of the intermediate stage of flooding concerned, the positive part of the tilting arm curve of the lever shall show the value of the tilting arm of the lever GZ ≥ 0,05 m and the space under the curve shall reach at least 0,0065 m.rad until the first unprotected opening has been immersed or the angle of inclination of the latter 27 ° (10 ° in the case of unsecured containers) has been reached;
(d) if the non-watertight openings are immersed before the equilibrium is reached, the spaces allowing access to be flooded must be considered for the purpose of calculating the intact stability.
22.03.7 The following conditions shall be met if there are transverse flooding openings to reduce disproportionately flooding:
(a) IMO Resolution A.266 (VIII) applies to the calculation of transverse flooding;
(b) they must operate alone;
(c) they must not be equipped with a sealing device;
(d) the total compensation period may not exceed 15 minutes.
22.03.8 If openings which could result in additional flooding of undamaged compartments can be closed watertight, an easily readable instruction shall be placed on the closing devices on both sides:
"Close immediately after passage."
22.03.9 The evidence shall be deemed to have been provided by calculation in accordance with Chapter 22.03.3 to 22.03.7, provided that the result of the calculations on impaired stability under Part 9 of the Regulations annexed to the Europe Agreement on the International Carriage of Dangerous Goods by Inland Waterways (ADN) is positive. ';
39. The following Chapter 22.03.10 is inserted after Chapter 22.03.9:
"22.03.10 If this is necessary to meet the requirements of Chapter 22.03.3, the plane of the maximum permissible draught shall be re-established. ';
40. in Annex 1, Chapter 22.04.2 (c):
"(c) are built as dual-hull vessels in accordance with the ADN, the fixed-load vessels being covered by Sections 9.1.0.91 to 9.1.0.95 and the tanker ships, paragraph 9.3.2. 11.7 and Sections 9.3.2.13 to 9.3.2.15 or paragraph 9.3.3.11.7 and Sections 9.3.3.13 to 9.3.3.15 of Part 9 of the ADN; ';
41. in Annex 1, Chapter 22.04.2 (d), the words "and Directive 2008 / 126 / EC" shall be replaced by the words "Directive 2008 / 126 / EC and Directive 2012 / 48 / EU."
42. In Annex 1, Chapter 22a.10.1 (d), "and Directive 2008 / 126 / EC" is replaced by "Directive 2008 / 126 / EC and Directive 2012 / 48 / EU."
43. In Annex 1, Chapter 22a11.1, the words "and Directive 2008 / 126 / EC" are replaced by the words "Directive 2008 / 126 / EC and Directive 2012 / 48 / EU."
44. in Annex 1, Chapter 24.02.2 (e), the words "Chapter 11.02.4" shall be deleted;
45. in Annex 1, Chapter 24.02.2 (g), the word "a" shall be replaced by a comma and the words "cap. 5.03.5" shall be inserted after the words "cap. 11.02.4.
46. In Annex 1, Chapter 24.02.2 (j), the words "Chapter 11.02.4, first sentence," shall be inserted after the words "Chapter 10.03a."
47. in Annex 1, Chapter 24.02.2 (m), the words "Chapter 15.03.9" shall be inserted after the words "15.03.8,";

50. In Annex No 1, Chapter 24.02.2, at the end of point (v), the dot is replaced by a comma and the following points (x) to (z) are added:
"(x) the requirements of Chapter 10.02.1, second sentence (b), Chapter 15.06.1, second sentence and Chapter 15.06.15 at the latest when the vessel's certificate is renewed,
(y) the requirements of the first sentence of Chapter 15.06.1 and of Chapter 15.06.15 on assembly, which are part of superstructures consisting wholly or partly of panoramic boards, at the latest on renewal of the certificate after 1 January 2045,
(z) the requirements of droplets 15.14.3 to 15.14.5, if the limit and control values do not exceed the values given in droplets 15.14.3 and 15.14.5 more than twice as high, a certificate has been issued to the on-board sewage treatment plant confirming that it is capacity-compliant with the normal load on board the vessel and a waste sludge management system is in place that is suitable for operating the sewage treatment plant on board the passenger ship. ';
