DECLARATION
of 17 June 2020
amending Decree No. 98 / 2012 Coll., on Health Documentation, as amended
The Ministry of Health provides, pursuant to Section 120 of Act No. 372 / 2011 Coll., on health services and the conditions for their provision (Act on Health Services), as amended by Act No. 111 / 2019 Coll., for the implementation of Sections 69 (a) to (c) and Section 69c (2) of the Health Services Act:
Decree No. 98 / 2012 Coll., on Health Documentation, as amended by Decree No. 236 / 2013 Coll., Decree No. 364 / 2015 Coll. and Decree No. 137 / 2018 Coll., is amended as follows:
1. in Paragraph 1 (1) (b), the following point 4 is inserted after point 3:
'4. the correspondent address, if it is not identical to the address referred to in point 3, and if it is communicated to the patient, ';
Point 4 is renumbered point 5.
2. in Article 1 (1) (b), the following point 6 is added:
"6. a unique department patient identifier assigned to the patient by the Institute of Health Information and Statistics of the Czech Republic,"
3. in Article 1 (1) (i), the word "other" is replaced by the word "other."
4. in Article 1 (1), the following point (j) is inserted after point (i):
"(j) identification and contact details of the registering provider in the field of general medical practice or in the field of practical medicine for children and adolescents, if known to the provider;"
Points (j) and (k) shall be renumbered as points (k) and (l).
5. In Article 1, the following paragraph 3 is inserted after paragraph 2:
"(3) The medical documentation of the provider who has decided to manage the patient summary shall also contain data and records which are relevant to the management of the patient summary and are not listed in paragraph 1 or 2, to the extent set out in Annex 4 to this Regulation. ';
Paragraph 3 shall become paragraph 4.
6. In Article 2 (c), the words "or subsequent psychiatric bed care 'shall be inserted after the words" in the case of long-term bed care'.
7. In Article 3 (1), the words "the unique departmental identifier of the patient assigned to the patient by the Institute of Health Information and Statistics of the Czech Republic" shall be inserted after the words "has been assigned."
8. the following Sections 4a and 4b are inserted after Section 4:
(1) For the purpose of providing basic data on the patient's health status through the National Contact Point for Electronic Health ("National Contact Point"), the patient summary is kept electronically and structured to another provider in code systems that allow communication between the National Contact Point and the Provider that directs and transfers the patient summary to the National Contact Point. Code systems for patient summary management are publicly available on the Ministry of Health website. The content and structure of the patient summary is set out in Annex 4 to this Decree.
(2) A patient summary may be maintained for the purpose of transmitting to the National Contact Point, provided that the patient summary provider ensures its continued availability. The patient summary may be provided through the individual interface of the provider or a multi-provider exchange platform.
(3) The provider who decides on the management of the patient summary shall report to the administrator of the National Contact Point through a data message to the data box of the administrator for the purpose of establishing access to the National Contact Point, the management of the patient summary. The notification shall include:
(a) the provider's identification details to the extent of the trading firm or the name and identification number of the person, if assigned;
(b) the address of the information system interface of the provider for communication with the National Contact Point;
(c) the provider's encryption certificate intended for communication with the National Contact Point;
(d) the provision of the patient summary referred to in the second sentence of paragraph 2.
(4) The provider shall at the same time attach to the notification referred to in paragraph 3 a protocol demonstrating the conformity test of the interface of the information system operated in accordance with the operational documentation of the National Contact Point. The national contact point administrator shall ensure that the conformity test is carried out. The operational documentation of the National Contact Point is publicly available on the Ministry of Health website.
(1) The requirement for a patient summary submitted through the National Contact Point to the provider who has notified the National Contact Point of the management and provision of the patient summary shall include:
(a) patient identification according to § 1 (1) (b) (1) and (2); and
(b) the identification details of the provider of another European Union State requesting the patient summary and its healthcare professional.
(2) The patient summary requirement is transmitted via the provider's information system interface, which has been notified to the National Contact Point pursuant to § 4a (3) (b). '
9. In Annex 3, point 4, the words "100 years after the date of birth of the patient or 10 years after the death of the patient 'are replaced by the words" 10 years after the last provision of health services to the patient, in the case of a patient with an ordered protective treatment 30 years after the last provision of health services'.
10. In Annex 3, point 15 (c), the words "with the exception of carrying out this examination by an outpatient care provider in the field of dental medicine 'are inserted after the word" radiation'.
11. the following Annex 4 is inserted after Annex 3:

Patient Summary Content and Structure
A. Patient identification and contact details
(a) the name and, where appropriate, the name of the patient;
(b) the birth number, if assigned,
(c) the number and type of electronically readable document proving identity;
(d) date of birth;
(e) sex, if any,
(f) citizenship;
(g) the address of the place of permanent residence in the Czech Republic, if any, the place of registered residence in the Czech Republic,
(h) the patient's correspondent address, unless it is identical to the address referred to in (g);
(i) telephone number, e-mail address,
(j) the language (s) in which the patient communicates;
k) the unique department identifier of the patient assigned to the patient by the Institute of Health Information and Statistics of the Czech Republic.
B. Identification and contact details of the registering provider in the field of general practice or in the field of practical medicine for children and adolescents
(a) the trading firm or the name of the registrant, the identification number of the person, if assigned;
(b) telephone number, e-mail address.
C. Identification and contact details of legal representatives or guardians or contact persons under Section 33 of the Health Services Act
(a) the name and, where applicable, the names and surnames of the person;
(b) the relationship with the patient,
(c) telephone number, e-mail address.
D. Information on health insurance
Health insurance code and insured number, if this number is not the birth number.
E. Urgent information
(a) allergies:
1. verbal description,
2. structured encoded description, namely:
2.1. Date of detection,
2.2. Type of agents,
2.3. Kind of agents,
2.4. An allergic reaction,
2.5. degree of severity,
(b) other risk factors:
1. verbal description,
2. structured and coded description, namely:
2.1. Date of detection,
2.2. Type of risk factor,
Class 2.3.
F. Summary history
(a) a verbal description containing information on:
1. vaccination carried out,
2. past health problems and diagnoses,
3. significant surgical procedures related to past medical problems and diagnoses,
(b) a structured coded description containing information on:
1. vaccination, namely
1.1. Name of vaccine,
1.2. The substance code,
1.3. Date of vaccination,
2. past health problems and diagnoses, namely
2.1. Date or other timing of creation,
2.2. Date or other time limit for termination,
2.3. Health problem or diagnosis code,
3. major surgical procedures carried out, namely:
3.1. performance code,
3.2. Date of implementation,
3.3. Number of designs.
G. Current health problems and diagnoses and related data
(a) current health problems and diagnoses:
1. the date or other time-limit of origin;
2. the date or other time-limit of termination;
3. a description of the health problem or diagnosis by free text,
4. health problem or diagnosis code,
(b) significant surgical procedures related to current health problems and diagnoses:
1. a description of the surgical performance by free text,
2. power code,
3. Date of implementation,
4. number of designs,
(c) medical devices on which the patient's health depends or may depend:
1. verbal description,
2. date of implantation or beginning of use;
3. the code of the medical device,
(d) therapeutic recommendations which do not include medical treatment, date of registration, recommendations by free text;
(e) a verbal description of the patient's self-sufficiency or disability, the date of formation and the code.
H. Medicines used
(a) name and code of the medicinal product,
(b) force, form, method of administration, by code,
(c) quantity / dose, dosage,
(d) start and time of administration or date of termination of administration.
I. Lifestyle factors
(a) a verbal description of the factor,
(b) factor code,
(c) the date or other time-action of the determination of the start of action of the factor;
(d) quantity or unit of measurement.
J. Pregnancy
The code of the method of determining pregnancy and the expected date of delivery.
K. Physical finding
(a) blood pressure systolic and diastolic, heart rate and date of measurement;
(b) height and weight, namely value, unit and date of measurement.
L. Diagnostic tests
Blood group and Rh factor by text and code, date of determination.
M. Accompanying data
(a) the date of establishment of the patient summary;
(b) the date of the last update of the patient summary,
(c) the identification data of the provider that created the patient summary, namely the business firm or name, address of the place of business or the address of the place of business, the identification number of the person, if any, or other providers' identifiers;
(d) the name and, where appropriate, the names of the doctor who drew up the patient summary; for a patient summary supplemented by multiple doctors or resulting from data aggregation, this item is not included.
Note to Annex 4:
In the patient summary, the provider shall indicate in cases where he does not have any of the data which it records as being unknown to him. ';
Efficacy
This Decision shall enter into force on 1 July 2020.
