Ministry of Foreign Affairs
The Ministry of Foreign Affairs states that on 22 November 1996 the Agreement between the Government of the Czech Republic and the Government of the Republic of Poland on border crossing points, crossing national borders and the principles of crossing national borders outside border crossing points was signed in Warsaw.
Pursuant to Article 12 (2) of the Agreement, the provisions of Articles 4, 5, 6, 8 and 9 thereof have been provisionally implemented on the 30th day following the date of signature of the Agreement and the Agreement entered into force on 2 July 1997 pursuant to paragraph 1 of that Article. On the date of entry into force of the Agreement, Articles 3, 3a and 1 of the Arrangement between the Government of the Czechoslovak Socialist Republic and the Government of the People's Republic of Poland on cooperation in the exercise of control in railway and road traffic across national borders of 8 July 1971, published including amendments and additions under No 50 / 1972 Coll., No 18 / 1974 Coll., No 72 / 1975 Coll. and No 466 / 1991 Coll.
The Czech version of the Agreement is hereby published at the same time.
AGREEMENT
between the Government of the Czech Republic and the Government of the Republic of Poland on border crossing points,
crossings on tourist paths intersecting national borders
and principles for crossing national borders outside border crossing points
The Government of the Czech Republic and the Government of the Republic of Poland, hereinafter referred to as "the Contracting Parties',
- led by efforts to contribute to the further development of mutual friendly relations,
- showing a desire to expand cooperation in the field of international trade, transport and movement of persons,
- seeking to facilitate the crossing of national borders in tourism,
- monitor the provision of appropriate conditions for the transfer of persons, means of transport and goods across national borders,
agree as follows:
1. The crossing of the national borders between the Czech Republic and the Republic of Poland shall take place at open border crossing points, except as provided for in this Agreement and other treaties by which the States of the Contracting Parties are bound.
2. The list of open border crossing points, including their scope of operation, is set out in Annex 1 to this Agreement.
1. The Contracting Parties shall, where justified, open additional border crossing points.
2. The list of border crossing points planned for opening is set out in Annex 2 to this Agreement.
3. The construction of new buildings at border crossing points shall take place by mutual agreement of the competent authorities of the States of the two Contracting Parties.
1. Each Contracting Party may suspend or restrict operations at individual border crossing points for reasons of security and public policy, serious hygiene-epidemiological reasons, natural disasters, as well as serious environmental threats caused by migration operations.
2. A Contracting Party intending to suspend or restrict operations at a border crossing point shall inform the other Contracting Party of its intention not later than five days before the planned suspension or restriction of border traffic.
3. In urgent cases, the notification referred to in paragraph 2 shall take place not later than 24 hours before the planned suspension or restriction of operation.
4. The Contracting Parties shall notify each other of the suspension or limitation of operations in connection with the envisaged reconstruction of premises at border crossing points or roads no later than three months before the start of the reconstruction work, indicating the expected date of termination of such work.
1. The crossing of national borders between the Czech Republic and the Republic of Poland at the crossing points on the tourist routes intersecting national borders is only allowed for the purpose of conducting tourism.
2. The list of crossing points on tourist routes intersecting national borders, including the extent of their operation, is set out in Annex 3 to this Agreement.
3. The competent authorities of the two States shall indicate the crossing points on the tourist routes intersecting the national borders and shall ensure constant information at those crossing points on the conditions for crossing the national borders.
Citizens of both Contracting Parties and citizens of third States listed in Annex 4 to this Agreement may cross the national borders referred to in Article 4 (1) on the basis of valid travel documents.
1. Persons crossing national borders at the crossing points listed in Annex 3 to this Agreement shall be subject to border and customs control.
2. Persons referred to in paragraph 1 may import and export without authorisation, customs duties, taxes and other charges, in accordance with the national law of each Contracting Party, in accordance with:
1 / items for personal use and consumption necessary for the journey and stay,
2 / sports and tourist needs subject to their re-export.
(3) Imports and exports of goods having a commercial character in terms of quantity, type and customs value shall not be permitted.
1. The competent authorities of the Czech Republic and the Republic of Poland may, by mutual agreement and with the agreement of the authorities of their States, give consent to crossing national borders in cases justified by economic needs or social needs.

2. The request for authorisation to cross the national borders referred to in paragraph 1 shall be made no later than 30 days before the date of the presumed crossing of the national borders.
3. Persons who have been granted consent pursuant to paragraph 1 shall be shown by a valid travel document and consent issued when crossing national borders.
The arrangements for cooperation in implementing the provisions of Articles 5 and 6 may be determined by the competent authorities of the Contracting Parties by mutual agreement.
The Contracting Parties shall inform each other by diplomatic means of which authorities of the Contracting Parties are deemed to be competent authorities within the meaning of this Agreement.
The provisions of Annexes 1, 2, 3 and 4 to this Agreement may be amended by means of a note exchange.
Articles 3, 3a and Annex No 1 shall cease to apply from the date of entry into force of this Agreement in relations between the Contracting Parties. Arrangement between the Government of the Czechoslovak Socialist Republic and the Government of the People's Republic of Poland on cooperation in the exercise of control in railway and road traffic across national borders, signed in Prague on 8 July 1971.
1. This Agreement shall be subject to approval in accordance with the national law of each Contracting Party, which shall be confirmed by means of an exchange of notes, and shall enter into force on the 30th day following receipt of a later note of such approval.
2. The Contracting Parties agree to provisionally implement the provisions of Articles 4, 5, 6, 8 and 9 of this Agreement on the 30th day following the date of its signature.
This Agreement shall be negotiated for an indefinite period. Each Contracting Party may denounce it by means of an exchange of notes. In this case, the Agreement shall expire six months after the date of receipt of the notice of termination.
Done at Warsaw, 22 November 1996, in two original copies, each in the Czech and Polish languages, the two texts being equally authentic.
