The Ministry of Foreign Affairs states that on 22 August 1994 the Trade Agreement between the Government of the Czech Republic and the Government of the Socialist Republic of Vietnam was signed in Prague.
The Agreement entered into force on 14 December 1994 on the basis of Article X thereof. The Agreement between the Government of the Czech Republic and the Slovak Federal Republic and the Government of the Socialist Republic of Vietnam on Mutual Trade and Payments of 20 February 1992 expires on this date.
The Czech version of the Agreement shall be published simultaneously.
TRADE AGREEMENT
between
Government of the Czech Republic
and the Government of the Socialist Republic of Vietnam
The Government of the Czech Republic and the Government of the Socialist Republic of Vietnam (hereinafter referred to as the "Contracting Parties'),
stating with satisfaction the development of trade and economic relations between them; and
led by the desire to further develop and strengthen these relations between the two States on the basis of equality and mutual benefit,
agree as follows:
The Parties shall, in accordance with their laws and regulations, take the necessary measures to facilitate and strengthen trade and economic relations between the two States on a long and stable basis.
The Contracting Parties shall grant each other treatment under the most favourable tariff and tax clauses as well as customs formalities and other matters relating to the export and import of goods originating in the State of the other Contracting Party.
The above provision shall not apply to:
(a) the advantages and exemptions which one of the Contracting Parties has granted or in the future to its neighbouring States in order to facilitate border traffic in trade;
(b) the advantages and exemptions which have been or will be granted in the future by either Party resulting from its participation in the field of free trade or customs union.
The Parties shall, in accordance with the laws and regulations in force in their States, create appropriate conditions for the development of different forms of commercial economic cooperation between legal and natural persons of both States (hereinafter referred to as "entities').
The import and export of goods and services between the entities of the two States will take place on the basis of contracts concluded under the provisions of this Agreement, the laws and regulations in force in both States in accordance with international trade practices and based on prices on international markets.
None of the Contracting Parties shall be liable for the obligations of their State entities arising from commercial transactions. They shall bear full responsibility for these obligations arising from the contracts concluded and any disputes shall be settled by the relevant bodies.
Payments between entities under this Agreement shall be made in freely convertible currency in accordance with the laws and regulations in force in both States.
All claims and obligations arising until 31 December 1992 between the legal predecessors of the Czech Republic (Czechoslovak Socialist Republic, Czechoslovak Federal Republic and Slovak Federal Republic), on the one hand, and the Socialist Republic of Vietnam, on the other hand, will be discussed and a special agreement will be concluded.
The Parties shall promote and facilitate the participation of exhibitors of their States in trade fairs and trade shows in the other State to expand trade relations between the two States. Exemptions from customs duties, taxes and other similar charges on articles and equipment intended for temporary use at trade fairs and exhibitions shall be governed by the laws and regulations in force in the State where these operations are carried out.
In order to facilitate the implementation of this Agreement, the Contracting Parties agree to establish: The Joint Commission shall be composed of representatives of the competent authorities of both Parties.
The Joint Commission shall meet alternately in the Czech Republic and the Socialist Republic of Vietnam whenever agreed by the competent authorities of both Parties.
With the entry into force of this Agreement, the Agreement between the Government of the Czech and Slovak Federal Republic and the Government of the Socialist Republic of Vietnam on Mutual Trade and Payments of 20 February 1992 will cease to apply in relations between the Czech Republic and the Socialist Republic of Vietnam.
This Agreement shall be subject to approval in accordance with the national law of each State and shall enter into force 30 days after receipt of the last note, where the Contracting Parties notify each other of the termination of the approval process.
This Agreement shall apply for a period of five years and shall be automatically extended for a further year unless one of the Contracting Parties notifies the other Contracting Party in writing of its intention to terminate it at least six months before its expiry.
This Agreement may be amended or supplemented by written agreement of the Contracting Parties.
Upon termination of this Agreement, its provisions shall continue to apply to contracts concluded during the period of validity of this Agreement until their full implementation.
