DECLARATION
of 24 June 2025
amending Decree No. 408 / 2015 Coll., on Electricity Market Rules, as amended
The Energy Regulatory Authority shall determine pursuant to Article 98a (2) (h) of Act No. 458 / 2000 Coll., on the Terms and Conditions of Business and on the Performance of State Administration in the Energy Sector and on the Amendment of Certain Laws (Energy Act), as amended by Act No. 158 / 2009 Coll., Act No. 211 / 2011 Coll., Act No. 90 / 2014 Coll., Act No. 131 / 2015 Coll., Act No. 165 / 2021 Coll., Act No. 469 / 2023 Coll. and Act No. 87 / 2025 Coll., Act No. 131 / 2015 Coll., and Act No. 382 / 2021 Coll.
Decree No. 408 / 2015 Coll., on Electricity Market Rules, as amended by Decree No. 127 / 2017 Coll., Decree No. 302 / 2020 Coll., Decree No. 125 / 2021 Coll., Decree No. 490 / 2021 Coll., Decree No. 404 / 2022 Coll., Decree No. 6 / 2024 Coll. and Decree No. 156 / 2024 Coll., is amended as follows:
1. in Article 1 (1) (f), the words "and means of settlement" shall be deleted;
2. in Paragraph 1 (1) (m):
"(m) the scope, timing and procedure of publication, provision and disclosure by the market operator and the data centre;"
3. in Article 1 (1) (o), the words "electricity storage facilities" shall be inserted after the words "electricity storage facilities."
4. In Article 1 (1) (p), the words "assessing shared electricity 'are replaced by the words" taking into account shared electricity and storing electricity' and the words "and storing electricity 'are added at the end of the text of the letter.
5. in Article 1 (2) (a), the word "hourly" shall be replaced by "quarter-hour" and a comma shall be inserted after "and the purchase price."
6. in Paragraph 1 (2) (b), "hourly" is replaced by "quarter-hour."
7. In Article 1, at the end of paragraph 2, the dot is replaced by a comma and the following point (e) is added:
"(e) the procedure for determining the amount of electricity withdrawn from the transmission or distribution system for the storage of electricity and re-supplied to the transmission or distribution system from the storage facility and the range of data transmitted by the operator of the electricity storage facility, the electricity producer or the customer of the secondary measuring device.";
8. In Article 10 (5), the words "and its' are replaced by the words" or electricity storage facilities and their 'and the words "or 16d' are inserted after the words" Article 16b '.
9. The heading above the designation of Section 16 reads: "Registration of demand points and their transfer points, transmission points, electricity storage facilities, transmission systems and distribution systems."
10. In Article 16 (1), the words "identification codes' are inserted after the word" code lists' and the words "identification code codes' are inserted after the word" code lists'.
11. in Article 16 (2), the following point (c) is inserted after point (b):
"(c) the transmission points of the electricity storage facility;"
Points (c) and (d) shall be renumbered points (d) and (e).
12. in Article 16 (2) (d), "a" is replaced by "dot" and "e" is deleted;
13. In Article 16, the following paragraph 8 is added:
"(8) The transmission system operator or distribution system operator shall ensure the registration of the interconnection of identification code numbers of the same transfer point in the market operator information system. ';
14. in Article 16a (4), the words "or electricity storage facilities" shall be inserted after the words "or at the end of the text of the paragraph, the words" or the point of transfer of electricity storage facilities as referred to in Article 16d "shall be added;
15. in Article 16a, paragraph 5 is deleted;
Paragraph 6 shall become paragraph 5.
16. in Article 16a (5), the word "decision" shall be replaced by the word "notice."
17. in Article 16b, the following paragraph 4 is added:
"(4) Where an electricity storage facility is connected at the transmission point referred to in paragraph 1 or 3, the relevant transmission or distribution system operator shall register the flag of the electricity storage facility with the identification code registered in accordance with paragraph 1 or 3. ';
18. After Paragraph 16c, the following Section 16d is inserted:
Procedure for registration of the electricity storage facility transfer point
(1) Where a power storage facility has one or more power supply points, the relevant transmission or distribution system operator
(a) assign and register an 18-digit identification code to each of the transfer points of that electricity storage facility, with a signal of an electricity storage facility; or
(b) where the electricity generation facility is connected at the transmission point, it shall assign and register the transmission point referred to in Article 16b, or assign a registered 18-digit identification code for the supply with an indication of the electricity storage facility referred to in point (a) to the transmission point of that electricity plant pursuant to Article 16b (1).
(2) Where a power storage facility has one or more transmission points for the collection of electricity, the relevant transmission or distribution system operator shall assign and register an 18-digit identification code for the sampling point referred to in Article 16a with a signal of the electricity storage facility. ';
19. in Paragraph 17 (1), the word "inactive" shall be deleted;
20. In Article 17 (2) of the Introductory Part of the provision, the words "or the transmission point of the production plant for the TVS 'shall be inserted after the words" sampling point'.
21. in Article 17 (2), point (b) is deleted;
Point (c) shall be renumbered (b).
22. in Article 17 (2) (b), the words "or the transmission point of the production plant for the TVS" shall be inserted after the words "sampling point."

"(2) The responsibility for the derogation at the point of collection and at the point to cover the losses of the transmission or distribution system operator, with the exception of the point of demand of the customer operating the electricity generation or storage facility in accordance with Section 28 (5) of the Energy Act, shall always have only one clearing entity. The responsibility for the derogation for a power plant or storage facility, including a power plant or a storage facility operated by a customer in accordance with Article 28 (5) of the Energy Act, may be held by two different clearing entities, with one clearing entity being responsible for the derogation at the sampling point and the transmission point of the production facility for the TVS, and the other being responsible for the derogation at the transmission points of the power plant for the supply of electricity to the network. ';
29. in Article 18 (3), the words "the point of transmission of the electricity storage facility" shall be inserted after the words "this system."
30. In the first sentence of Article 18 (5), the words "the point of transmission of the electricity storage facility 'shall be inserted after the words" the point of transmission of the electricity storage facility'; the words "the point of transmission of the electricity storage facility 'shall be inserted after the word" the point of transmission of the power storage facility'; the words "the electricity or the point of transmission of the electricity storage facility 'shall be inserted after the word" the producer'; the words "the electricity operator of the electricity storage facility 'shall be inserted after the word" the last';

"(1) The distribution system operator shall transmit to the market operator daily within 11.00 hours for each assessment interval of the preceding day and for each distribution system operated by it the actual value of electricity supplies and withdrawals.
(a) at the transmission points of power generating plants with measurements of type A, B and C of category C1, C2 and C3;
(b) at customer sampling points with measurement types A, B and C of category C1, C2 and C3;
(c) at transfer points between distribution systems with measurement types A, B and C of category C1, C2 and C3,
(d) at the measuring points between different regions of type diagrams with measurements of type A, B and C of category C1, C2 and C3; and
(e) not specified in (a) to (d) with type A measurements.
(2) Where the market operator does not receive the values of supplies and electricity withdrawals at the transfer point or the measurement point between the regions of type diagrams with the measurement of type B or C of category C1, C2 or C3 as referred to in paragraph 1, it shall use the values calculated as an average of the values in force at the same assessment intervals of the same calendar days over a period of 4 last weeks stored in the market operator's system. If the market operator does not have data for this period of time, it shall use zero for settlement of deviations. ';
40. in Article 20 (1), the following point (b) is inserted after point (a):
"(b) at the transfer points of electricity storage facilities with measurements of type A, B and C of category C1, C2 and C3,";
Points (b) to (e) shall be renumbered (c) to (f).
41. in Paragraph 20 (1) (f), "(d)" is replaced by "(e)."
42. In Paragraph 20 (3), the words "individual measurement points between regions of type diagrams with measurement of type C of category C1, C2 and C3," are deleted.
43. In Paragraph 20 (4), the words "measuring points between regions of type diagrams with measurement of type C of category C1, C2 and C3" are deleted.
44. in Paragraph 20 (5):
"(5) The distribution system operator shall transmit to the market operator no later than 18.00 hours on the fifth working day following the end of the calendar month for each assessment interval of the preceding month and for each of its operating distribution systems an accurate value as referred to in paragraph 1 as well as the actual values of the supplies and withdrawals of electricity at each transfer point between distribution systems with a measurement of type C of category C4. ';
45. in Article 20 (6), the words "including the actual values of electricity withdrawals at the transmission points of the aggregate sampling point with type C measurement" shall be deleted;
46. in Paragraph 20a (3):
"(3) If a market operator does not receive values from the data centre in accordance with § 65i (4), it shall use the values in accordance with § 20 to settle the deviations. '
47. Paragraph 21 shall be deleted, including the title.
48. in Paragraph 22 (1), the following point (c) is inserted after point (b):
"(c) to the point of transmission of each individual electricity storage facility;"
Points (c) and (d) shall be renumbered points (d) and (e).
49. in § 22 (2) (a) and (b), the words "and § 20 (1) (a), § 20 (5)" shall be replaced by the words "§ 20 (1) and § 20 (5)";

54. in Article 26 (1) (a):
"(a) the daily settlement of deviations as the difference between the actual values of the electricity supply of the type A, B and C of the category C1, C2 and C3 of the local distribution system and the preliminary values of the electricity supply of the type C of the category C4 of the local distribution system and the sum of the actual values of the electricity consumption at the sampling points and the transmission points between the distribution systems of the type A, B and C of the category C1, C2 and C3 of the local distribution system and the preliminary values of the electricity demand at the transmission points between the distribution systems of the type C of the category C4 of the local distribution system, or ';
55. in Article 26 (1) (b), the words "and transfer points between distribution systems with measurement types A, B and C" shall be inserted after the words "C3."
56. In Article 26 (5), the words "including the aggregate sample point with measurement of type C of category C4 'are deleted.
57. In Article 27 (6), the words "and the quantity of electricity not recovered or not delivered in electricity storage facilities' shall be inserted after the words" electricity generation plants' and the word "transmitted 'shall be replaced by the word" transmitted'.
58. In Paragraph 28 (3), the word "decision 'is replaced by the word" purpose'.
59. In Article 29 (7), the words "or the end of the emergency prevention under Article 31 (1) (b) 'are inserted after the words" emergency' and the words "or the end of the emergency prevention under Article 31 (1) (b) 'are added.
60.Paragraph 31 (1) reads as follows:
"(1) The special settlement regime shall apply to the whole electricity system and to all settlement entities. The market operator shall carry out the settlement of deviations for each assessment interval in the special assessment intervals regime for which the TSO
(a) declare an emergency in the electricity system for the entire territory of the State; or
(b) on the basis of the information provided by the market operator referred to in paragraph 3, notify the prevention of an emergency in the electricity system for the entire territory of the State. "
61. In Paragraph 31, the following paragraphs 3 to 6 are inserted after paragraph 2:
"(3) If the market operator does not notify the clearing entities on the basis of the submitted bilateral transaction data for the assessment intervals on the relevant day of supply of the contracted amount of electricity for the obligation to supply electricity to the electricity system and the contracted amount of electricity for the obligation to withdraw electricity from the electricity system within 23.00 hours of the day preceding the relevant date of delivery, and at the same time does not disclose to the participants of the organised short-term market for any of these evaluation intervals the size of their supply of electricity and the supply of electricity agreed on the day and intraday market, it shall inform the TSO of this situation and its expected duration.
(4) For the purposes of this Regulation, the following definitions apply: (b) the communication by the market operator to the TSO for which the assessment intervals on the relevant day of supply have made available to the clearing entities the contracted amount of electricity for the obligation to supply electricity to the electricity system and the contracted amount of electricity for the obligation to withdraw electricity from the electricity system or to disclose to participants in the organised short-term market the size of their supply and the collection of electricity agreed on a day or intraday market.
(5) The special settlement regime shall apply to the entire evaluation period during which an emergency as referred to in paragraph 1 (a) is declared or terminated or an emergency prevention as referred to in paragraph 1 (b) is notified or terminated.
(6) The notification or termination of an emergency as referred to in paragraph 1 (a) and notification or termination of an emergency as referred to in paragraph 1 (b) shall be notified by the TSO to the market operator without undue delay. ';
Paragraphs 3 to 6 shall be renumbered paragraphs 7 to 10.
62. In Paragraph 31 (7), the word "decision 'is replaced by" measure'.

"(7) The market operator shall, at the request of an existing supplier, make available to another market operator or clearing entity, in the information system of the market operator, data on the transfer point of the demand point, the transfer point of the power plant or the transfer point of the storage facility to which it supplies or receives electricity. The market operator shall make these data available to the extent that the existing electricity supplier has access to them.
(8) The market operator shall make available, at the request of the distribution system operator in the market operator information system, to the supplier, the clearing entity, the transmission system operator or the other distribution system operator, data on the transmission point between the transmission system and its operating distribution system or the transmission point between its operating distribution system and another distribution system. The market operator shall make these data available to the extent that the operator of the distribution system has access to them. ';
84. In Paragraph 49, the following paragraph 7 is inserted after paragraph 6:
"(7) Where electricity storage facilities and electricity generation facilities, the electricity storage facility operator, the electricity storage facility operator, the electricity producer or the customer are connected at the transmission point to determine the amount of electricity withdrawn from the transmission system or the distribution system and resupplied to the transmission system or distribution system from the electricity storage facility to the transmission system operator or distribution system operator electronically published by the transmission system operator or distribution system operator on its website by the sixth working day of the following month, the data shall be transmitted by the downstream electricity generation unit on the initial and final state of the measured amount of electricity produced in kWh in the preceding month. ';
Paragraphs 7 and 8 shall be renumbered paragraphs 8 and 9.
85. the following Section 49b is inserted after Section 49a, which includes the title:
Quantities of electricity collected for storage and supplied back from the storage facility
(1) The quantity of electricity withdrawn from the transmission or distribution system for the storage of electricity and re-supplied to the transmission or distribution system from the storage facility for the preceding month is the value of the amount of electricity supplied from the transmission point where the electricity storage facility is connected to the transmission or distribution system designated by the transmission system operator or distribution system operator from the measurement data recorded for the previous month. Where electricity storage facilities and electricity production facilities are connected at the transmission point, the transmission system operator or distribution system operator shall determine the amount of electricity withdrawn from the transmission system or distribution system for storage and resupplied to the transmission or distribution system from the storage facility for the preceding month as the difference between the value according to the first sentence and the value of the amount of electricity produced for the previous month determined on the basis of the data transmitted pursuant to Article 49 (7).
(2) Where the value of the quantity of electricity produced in the previous month is greater than the value of the quantity of electricity delivered from that transfer point to the transmission system or distribution system, the value of the quantity of electricity withdrawn from the transmission or distribution system for the storage of electricity and returned to the transmission or distribution system from the storage facility for the previous month shall be zero.
(3) The amount of electricity at evaluation intervals in which the settlement entity, transmission system operator or distribution system operator has not been assigned to the identification code of the transfer point in which the electricity storage facility is connected in the previous month, does not include the first sentence in the determination of the amount of electricity referred to in paragraph 1. ';
86. The following Section 54a is inserted after Section 54:
(1) Where an electricity storage facility is connected at the transfer point, Paragraph 53 (3) shall apply mutatis mutandis.
(2) In the transmission point referred to in paragraph 1, where the electricity generation plant of the manufacturer of the first category is not connected, the operator of the electricity storage facility, the electricity producer or the customer shall not pay for the reserved capacity for the demand point transfer point or the payment for the power consumption according to the nominal current value of the main circuit breaker before the demand point electric meter, provided that, in a given month, the value of the quantity of electricity withdrawn from the transmission system or distribution system and returned to the transmission system or distribution system from the storage facility referred to in Article 49b is at least eighty per cent of the amount of electricity withdrawn from the transmission system or distribution system at the transmission point determined from the measurement data from the transmission system operator or distribution system. ';
87.In Paragraph 55 (1) (e), the words "and in" shall be replaced by a comma and at the end of the text of the letter the words "and transmission points of the electricity storage facility" shall be added.
88. In Articles 55 (1) (h) and 55 (9), "hourly" is replaced by "quarter-hour."
89. In Article 55 (6), the words "a quarter-hour 'shall be inserted after the words" approach'.

Operation to verify the technology of the electricity storage installation operator
The maximum value of the quarter-hour electrical power supply and consumption measured at the transmission point of the power storage facility during the operation for the verification of the technology may not exceed the value of the reserved power and power consumption agreed in the connection contract. ';
95.9. in Paragraph 61a, the words "the value of the quarter-hour electric power supply and take-off measured" shall be replaced by "the quarter-hour power supplied and the maximum quarter-hour power withdrawn."
