on the list of methodologies for the tests for differences, uniformity, stability and utility value of varieties
The Ministry of Agriculture provides pursuant to Article 30 (3) of Act No. 219 / 2003 Coll., on the putting into circulation of seeds and propagating plants and on the amendment of certain laws (Act on the circulation of seed and planting), as amended by Act No. 178 / 2006 Coll. and Act No. 295 / 2017 Coll.:
Preliminary provisions
This decree incorporates the relevant European Union1 regulations and provides for a list of the methodologies for field and laboratory tests for differences, uniformity, stability of varieties of agricultural species, vegetable species, grapes, hops, fruit genera and species and medicinal and aromatic plants, and a list of the methodologies for field and laboratory tests for the utility value of varieties of agricultural species, industrial chicory and vine.
Variety testing methodologies
(1) Methodology setting out the essential requirements for the organisation and conditions of the tests, the method of evaluation and an overview of the characteristics of the varieties tested means:
(a) protocols for tests of diversity, uniformity and stability in accordance with the directly applicable European Union2 ("Protocols") approved by the Community Plant Variety Office and published on its website;
(b) guidelines for testing the diversity, uniformity and stability of the Union for the protection of new plant varieties under the directly applicable Regulation of the European Union3 (hereinafter "test principles") approved by the Union for the protection of new plant varieties and published on its website;
(c) the methodology for tests of difference, uniformity and stability for the vine (4) approved by the Central Audit and Examination Institute (hereinafter referred to as the Institute) and published on its website;
(d) the national methodology for tests of difference, uniformity and stability (hereinafter referred to as the "national methodology"), approved by the Institute and published on its website,
(e) the general methodology for tests of difference, uniformity and stability, approved by the Union for the protection of new plant varieties, which is an integral part of the protocols and principles of testing for all genera and species and methodologies for tests of difference, uniformity and stability for vine, published on its website;
(f) the methodology for testing the use value of agricultural species, industrial chicory and vine 5) approved by the Institute (hereinafter referred to as the "use value test methodology") and published on its website;
(g) the general methodology of the use-value testing approved by the Institute, which is an integral part of the methodology for the use-value testing of the species concerned, published on its website; or
(h) the special test methodologies for tests on the utility value of agricultural species approved by the Institute, which are an integral part of the methodology for tests on the utility value of the species concerned, published on its website.
(2) Testing for the difference, uniformity and stability of varieties of agricultural and vegetable species shall cover all the characteristics of the protocols and, where appropriate, at least all the characters indicated by an asterisk in the test principles, provided that the observation of the characters is not prevented by the expression of other characters and that the conditions of the environment under which testing takes place do not prevent the expression of the sign.
(3) The conditions of the tests, the method of assessment and an overview of the characteristics of the varieties tested meet the requirements of the methodologies set out in Sections 3 to 8.
General methods for testing varieties
(1) The procedures for ensuring uniform conduct of tests on varieties of all genera and species are laid down in the general methodology for tests on difference, uniformity and stability and the general methodology for tests on the value of use set out in Annex 1 to this Decree.
(2) The general methodology for tests of difference, uniformity and stability of varieties of all genera and species shall be that set out in Annex 1 to this Decree, Table 1.1.
(3) For tests on the value of use of varieties of agricultural species, vine and chicory, the general methodology for testing the value of use referred to in Annex 1 to this Decree, Table 1.2, shall be used.
Methods for testing varieties of agricultural species
(1) In addition to the general methodology for tests for differences, uniformity and stability referred to in Article 3 (2), the following shall apply:
(a) the protocols listed in Annex 2 to this Decree, Table 2.1a) for the agricultural species listed in this table;
(b) the national methodologies listed in Annex 2 to this Decree, Table 2.1c) for agricultural species listed in this table;
(c) the principles of testing set out in Annex 2 to this Decree, Table 2.2 for agricultural species in that table.
(2) In addition to the general methodology for testing the value of agricultural varieties referred to in Section 3 (3), the methodologies for testing the value of use set out in Annex 2 to this Decree, Table 2.3a) for agricultural species listed in this table and, in the case of certain types of cereals and sugar beet, the methodologies for special tests for tests of use value for agricultural species listed in Annex 2 to this Regulation, Table 2.3b) shall apply.
(3) In the case of conservation varieties, only the characteristics referred to in Article 2 (2) may be used to assess the diversity and stability of the varieties in question.
(a) in the technical questionnaires of the protocols listed in Annex 2 to this Decree, Table 2.1a) for the agricultural species listed in this table,
(b) in the technical questionnaires of the test principles listed in Annex 2 to this Decree, Table 2.2 for the agricultural species listed in that table;
the relevant protocols and test principles shall be used to assess uniformity. However, if the level of uniformity is determined on the basis of different types, a population standard of 10% and a probability of acceptance of at least 90% 7 shall apply).
(4) As regards uniformity, it is sufficient that organic varieties suitable for organic production belonging to the species listed in Part 1 of Table No 2.1b of Annex No 2 to this Decree fulfil only the conditions set out in Part 2 of Table No 2.1b of Annex No 2 to this Decree.
(5) As regards the value of use, it is sufficient that organic varieties suitable for organic production belonging to the species listed in Part 1 of Table No 2.3c of Annex No 2 to this Decree comply only with the conditions set out in Part 2 of Table No 2.3c of Annex No 2 to this Decree.
(6) The Institute shall report to the other Member States and to the European Commission by 31 December each year until 31 December 2030 on the number of applications for the registration of varieties suitable for organic production and on the results of the tests for differences, uniformity and stability and the value of use for varieties suitable for organic production. The first sentence shall be reported for the calendar year.
Methods for testing varieties of vegetable species
(1) In addition to the general methodology for tests for differences, uniformity and stability referred to in Article 3 (2), the following shall apply:
(a) the protocols listed in Annex 3 to this Decree, Table 3.1a) for the vegetable species listed in this table;
(b) the test principles set out in Annex 3 to this Decree, Table 3.2 for vegetable species in this table.
(2) In addition to the general methodology for testing the value of industrial chicory varieties referred to in § 3 (3), the methodology for testing the value of chicory referred to in Annex 3 to this Decree, Table 3.3, shall be used.
(3) In the case of conservation varieties and varieties developed for cultivation under special conditions, only the characteristics referred to in Article 2 (2) may be used to assess the diversity and stability of the varieties and varieties in question.
(a) in the technical questionnaires of the protocols listed in Annex 3 to this Decree, Table 3.1a) for vegetable species listed in this table,
(b) in the technical questionnaires of the test principles set out in Annex 3 to this Decree, Table 3.2 for vegetable species in this table;
the relevant protocols and test principles shall be used to assess uniformity. However, where the level of uniformity is determined on the basis of different types, a population standard of 10% and a probability of acceptance of at least 90% 8 shall apply.
(4) As regards uniformity, it is sufficient that organic varieties suitable for organic production belonging to the species listed in Part 1 of Table No 3.1b of Annex 3 to this Decree only satisfy the conditions set out in Part 2 of Table No 3.1b of Annex 3 to this Decree.
(5) The Institute shall report to the other Member States and to the European Commission by 31 December each year until 31 December 2030 on the number of applications for the registration of varieties suitable for organic production and on the results of the tests for differences, uniformity and stability concerning varieties suitable for organic production. The first sentence shall be reported for the calendar year.
Methods for testing vine varieties
(1) In addition to the general methodology for the tests for differences, uniformity and stability referred to in Article 3 (2), the methodology for the tests for variance, uniformity and stability for vine varieties set out in Annex 4 to this Regulation, Table 4.1, shall apply.
(2) In addition to the general methodology for testing the value of wine varieties referred to in § 3 (2), the method of testing the value of wine varieties listed in Annex 4 to this Decree, Table 4.2, shall be used.
Methods for testing fruit varieties and species
In addition to the general methodology for tests for differences, uniformity and stability referred to in Article 3 (2), the following shall apply:
(a) the protocols listed in Annex 5 to this Decree, Table 5.1 for fruit genera and species listed in this table,
(b) the principles of testing set out in Annex 5 to this Decree, Table 5.2 for fruit genera and species listed in that table.
Methodology for testing varieties of other species listed in the second list
In addition to the general methodology for tests on differences, uniformity and stability referred to in Article 3 (2), the varieties of hops and species whose varieties may be registered on a voluntary basis shall be subject to:
(a) the protocols listed in Annex 6 to this Decree, Table 6.1 for other species in this table,
(b) the test principles set out in Annex 6 to this Decree, Table 6.2 for other species in this table, or
(c) the national methodologies listed in Annex 6 to this Decree, Table 6.3 for other species in this table.

They shall be deleted:

| 1. Zkoušení užitné hodnoty musí být prováděno za ekologických podmínek v souladu s ustanoveními nařízení (EU) 2018/848, a zejména s obecnými zásadami podle čl. 5 písm. d), e), f) a g) a s pravidly rostlinné výroby podle čl. 12 tohoto nařízení EU. | ||
| 2. Při zkoušení odrůd a hodnocení výsledků zkoušek musí být zohledněny zvláštní potřeby a cíle ekologického zemědělství. Musí být zkoušena odolnost nebo tolerance vůči chorobám a přizpůsobení se různým místním půdním a klimatickým podmínkám. | ||
| 3. Není-li Ústav schopen zajistit zkoušení za ekologických podmínek nebo zkoušení určitých vlastností, včetně náchylnosti k chorobám, může být zkoušení provedeno podle jednoho z těchto bodů: | ||
| a) | pod dohledem Ústavu v prostorách ekologických šlechtitelů nebo v ekologických hospodářstvích; | |
| b) | za podmínek s nízkými vstupy a s minimálním ošetřením; | |
| c) | v jiném členském státě, pokud byly mezi členskými státy uzavřeny dvoustranné dohody s cílem dosáhnout zkoušení za ekologických podmínek. | |
| Odrůda vykazuje uspokojivou užitnou hodnotu, pokud při srovnání s jinými ekologickými odrůdami vhodnými pro ekologickou produkci zapsanými do katalogu daného členského státu její celkové vlastnosti nabízejí, alespoň pokud jde o produkci v určitém regionu, jednoznačné zlepšení buď pro pěstování, nebo pro využití výpěstků nebo produktů z nich získaných. Pro účely zkoušení užitné hodnoty se za obzvláště hodnotné považují vynikající vlastnosti pro zemědělskou produkci, pokud jde o zemědělské postupy a produkci potravin nebo krmiv, které představují výhody pro ekologické zemědělství. | ||
| 4. Ústav stanoví různé zkušební podmínky, které jsou přizpůsobeny zvláštním potřebám ekologického zemědělství, a na žádost žadatele provede v rozsahu své kapacity zkoušky zvláštních znaků a vlastností, pokud jsou k dispozici reprodukovatelné metody. | ||
