Ordinance on the method of carrying out the classification of carcasses of animals for slaughter and the conditions for issuing certificates of competence of natural persons for that activity

of 19 August 2019
on the procedure for carrying out the classification of carcasses of animals for slaughter and the conditions for issuing certificates of professional competence for that activity
According to Article 18 (1) (l) of Act No. 110 / 1997 Coll., on Food and Tobacco Products and on the amendment and addition of certain related laws, hereinafter referred to as "the Act":
§ 1
Subject matter
This decree regulates, following the directly applicable European Union1) the way in which the classification, the marking of carcasses of animals for slaughter, the model of the protocol on classification, the manner and extent of communication of the results of the classification, the manner and extent of training, the composition of examinations and the issue of certificates of competence, its duration and the extension of the certificate.
§ 2
Definition of certain terms
For the purposes of this decree:
(a) the classifier of the person carrying out the classification of the carcase (2) of the animals to be slaughtered and meeting the conditions for carrying out the classification of the animals to be slaughtered laid down by law and by this decree;
(b) the cold weight of the carcase.
§ 3
Classification and labelling of carcases of pigs for slaughter weighing between 60 and 120 kg
(1) The classification of carcases of pigs for slaughter weighing between 60 and 120 kg shall be carried out in accordance with Part B of Annex IV to Regulation (EU) No 1308 / 2013 of the European Parliament and of the Council, using standard presentation (3) of the carcase and, where appropriate, alternative presentation (4) of the carcase and using methods approved for the Czech Republic by Commission Decision 2005 / 1 / EC.
(2) The classification of carcases of pigs for slaughter with the taking-over weight referred to in paragraph 1 may be carried out with the extraction of hail.
(3) After the classification referred to in paragraphs 1 and 2 has been carried out, the carcase of the pig shall be marked in accordance with Article 8 of Commission Delegated Regulation (EU) 2017 / 1182.
(4) The order of each cut to be slaughtered shall be determined by a continuous series of numbers, each time per slaughter day. This number shall be marked on the carcase of each cut slaughtered and each half-carcase and shall be identical to the serial number of the carcase in the classification report.
§ 4
Classification and labelling of carcases of pigs for slaughter weighing less than 60 kg and over 120 kg
(1) The carcase of a pig of slaughter weighing less than 60 kg and over 120 kg shall be classified in the quality class provided for in Annex 1 to this Regulation.
(2) After the carcase has been classified, the carcase shall be marked with the quality class referred to in paragraph 1. The marking shall be carried out in the same way as the carcase marking provided for in Section 3.
§ 5
Classification and labelling of carcases of bovine animals for slaughter
(1) The classification and labelling of carcases of bovine animals for slaughter is carried out in accordance with Part A of Annex IV to Regulation (EU) No 1308 / 2013 of the European Parliament and of the Council and Article 8 of Commission Delegated Regulation (EU) 2017 / 1182. In the case of use of the label, in addition to the mandatory information for classification marking, the registration number of the slaughterhouse, the identification or slaughter number of the animal, the date of slaughter and the weight of the carcase indicating whether the weight is hot or cold.
(2) The standard presentation referred to in Part A of Annex IV to Regulation (EU) No 1308 / 2013 of the European Parliament and of the Council and Article 6 of Commission Delegated Regulation (EU) 2017 / 1182 shall apply to the classification of the carcase of bovine animals for slaughter.
§ 6
Protocol on classification and the manner and extent of communication of the results of classification
(1) The models of the classification protocols are set out in Annexes 2 and 3 to this Decree.
(2) The protocol processes the classifier for the whole group of slaughter animals of the same species from one supplier delivered on one day.
(3) The food business operator operating the slaughterhouse shall send protocols on the classification of pigs for slaughter and bovine animals for slaughter no later than the fifth working day of the month following the classification date to the person responsible for keeping the central livestock records. When data are transmitted in a way that allows remote data transmission, the person responsible for keeping the central livestock register shall approve the format of the data file sent.
§ 7
Training of natural persons to carry out the classification
(1) The training of natural persons to carry out the classification of carcasses of slaughter animals is provided by the Ministry of Agriculture (hereinafter referred to as "Ministry") through the Research Institute of Animal Production, v. v. i. (hereinafter referred to as "Research Institute").
(2) The applicant submits an application for training to the Research Institute.
(3) The research institute shall notify the applicant in writing of the time and place of training.
(4) Before training, the applicant shall receive a range of subjects to be the subject of training, including a list of recommended study literature.
(5) Training consists of theoretical lectures and practical training. In the case of training for the classification and labelling of carcasses of bovine animals for slaughter, the tenderer shall, in addition to theoretical lectures and practical training, also receive practical training in slaughter operations under the guidance of a classifier of at least 14 days. At the end of the training, the candidate shall take a vocational examination (hereinafter referred to as "the test ') consisting of a theoretical and practical part.
§ 8
Test
(1) The examination shall be carried out before a minimum of three members of the examination committee appointed by the Ministry in such a way that the chair is always the representative of the Ministry, the other members of the panel are experts from the State Veterinary Administration and Research Institute. A written document shall be provided to the applicant for successful completion of the theoretical and practical part of the examination.
(2) The President shall direct the deliberations of the Commission and shall decide on the issues at issue relating to the examination.
(3) The Commission is bound by a set of questions and rules approved by the Ministry for the examination.
(4) If the candidate does not pass the test, he may repeat it not earlier than 15 days after the date of the unsuccessful test.
(5) The repeated examination shall be made by the tenderer only on the part in which he did not comply. A new deadline will be set for candidates who could not attend the test or repeat the test for serious reasons.
§ 9
Certificate of competence
(1) Certificate of professional competence shall be issued by the Ministry to the tenderer who:
(a) have passed the examination referred to in Article 8 (1); and
(b) meets the conditions for education and practice under Section 4a (5) of the Act.
(2) The certificate of competence issued by the Ministry shall include:
(a) an indication of the method (s) for which the tenderer has passed the test; and
(b) a personal number.
(3) The certificate shall be valid for 5 years from the date of issue.
(4) The classifier may request the Ministry to extend the validity of the certificate.
(5) An application for renewal of a certificate may be submitted not earlier than 3 months before the expiry of the certificate. The application shall be accompanied by proof of completion of the supplementary course for the classification of animals for slaughter, which the applicant has participated in during the last 12 months before the end of the certificate, with the research institute.
(6) The Ministry will assess whether the conditions for issuing the certificate continue to be fulfilled and, if applicable, extend the validity of the certificate to another 5 years.
§ 10
Technical Regulation
This Decree was notified in accordance with Directive (EU) 2015 / 1535 of the European Parliament and of the Council of 9 September 2015 laying down a procedure for the provision of information in the field of technical and information society services.
§ 11
Repeal
They shall be deleted:
1. Decree of the Ministry of Agriculture No. 194 / 2004 Coll., on how to carry out the classification of carcasses of slaughter animals and the conditions for issuing certificates of professional competence of natural persons for that activity.
2. Decree of the Ministry of Agriculture No. 324 / 2005 Coll., amending Decree No. 194 / 2004 Coll., on the method of carrying out the classification of carcasses of slaughter animals and the conditions for issuing certificates of competence of natural persons for that activity.
§ 12
Efficacy
This Regulation shall enter into force on 1 September 2019.
