DECLARATION
of 24 June 2022
establishing the characteristics of adequate requirements for the provision of Internet access services and access to voice communication services in a fixed place and their quality parameters within the universal service
The Ministry of Industry and Trade provides pursuant to § 150 (2) of Act No. 127 / 2005 Coll., on Electronic Communications and on the amendment of certain related laws (Act on Electronic Communications), as amended by Act No. 110 / 2007 Coll., Act No. 153 / 2010 Coll., Act No. 468 / 2011 Coll., Act No. 214 / 2013 Coll., Act No. 258 / 2014 Coll. and Act No. 374 / 2021 Coll., for implementation of § 40 (7) and § 47 (3) of the Act on Electronic Communications:
Characterisation of the reasonable requirement to provide a service of Internet access at a fixed location, including the connection needed for the use of the service
(1) A reasonable requirement for the provision of a service under Section 40 (1) of the Electronic Communications Act is a requirement for one connection (1) in the place of residence of the consumer located in a building building in which there is at least one apartment according to the basic register of territorial identification, addresses and real estate.
(2) An adequate requirement under paragraph 1 shall not be a requirement:
(a) a consumer in whose place of residence a connection is already established enabling the use of an Internet access service in a fixed place meeting the limits of universal service quality parameters in accordance with Article 5;
(b) to the connection provided that at least one public mobile communications network is available at the site, enabling the use of services under Section 40 (2) of the Electronic Communications Act and meeting the limits of universal service quality parameters under Section 5; or
(c) the connection at a location marked as other areas, agricultural parcels, forest parcels or water areas, or where the connection would require costs significantly above the normal level. Costs significantly above the normal level are those of the universal service provider for establishing connections exceeding by more than 50% its average unit costs for establishing connections.
Characteristics of the adequate requirement to provide a voice communication service at a fixed location, including the connection needed for the use of the service
(1) A reasonable requirement for the provision of a service under Section 40 (3) of the Electronic Communications Act is a requirement for one connection at the consumer's place of residence, located in a building building in which there is at least one apartment according to the basic register of territorial identification, addresses and real estate.
(2) An adequate requirement under paragraph 1 shall not be a requirement:
(a) a consumer in whose place of residence a connection has already been established through which access to a voice communication service is granted in a fixed place, meeting the limits of universal service quality parameters in accordance with Article 5,
(b) to the connection provided that at least one public mobile communications network is available at a given point, enabling access to the voice communication service and meeting the limits of universal service quality parameters in accordance with Section 5; or
(c) the connection at a location marked as other areas, agricultural parcels, forest parcels or water areas, or where the connection would require costs significantly above the normal level. Costs significantly above the normal level are those of the universal service provider for establishing connections exceeding by more than 50% its average unit costs for establishing connections.
General Service Quality Parameters
(1) The quality parameter of universal Internet access service and voice communication service in a fixed location is
(a) the period during which the Internet access service or voice communication service is operational in a fixed place;
(b) frequency of failures;
(c) the time during which the failure is removed;
(d) the frequency of complaints for the settlement of the price.
(2) The quality parameter of universal Internet access service in a fixed location is further
(a) commonly available speed of Internet access service (download and input of data);
(b) delay in Internet access services.
(1) The period during which the Internet access service and access to voice communications services are put into operation in a fixed place is the period given in calendar days, from the date on which the consumer has made a binding order under § 40 (1) or (3) of the Electronic Communications Act to the time when the provision of the service begins.
(2) The frequency of failures is the ratio of the number of reasoned failure reports relating to the deterioration or interruption of the quality of the service submitted by the consumer to the total number of active connections to the universal service provider's network over a specified period of time; failure of telecommunications terminal equipment connected to the network termination point shall not be counted.
(3) The period during which the failure is removed shall be the period calculated in hours, from the time of notification of the failure referred to in paragraph 2 by the consumer to the provider of the Internet access service or voice communications service or from the time when the failure provider became aware of the failure, to the time when the service is restored with the parameters specified in the contract.
(4) The frequency of complaints for charging the price for the use of the Internet access service and the use of the voice communication service is the ratio of the number of legitimate complaints to the total number of all bills issued in the specified period.
(5) The commonly available speed of the Internet access service is defined as the download and upload rate, the value of which the consumer can predict and realistically achieve when using the service. The value of the commonly available speed corresponds to at least 60% of the value of the advertised speed and is available in 95% of the time in one calendar day. The speed is given in megabits per second (Mbit / s).
(6) The delay in the Internet access service (latency) represents the time between the time of sending the first bit of the packet from the source to the network where it is received by the target and then sent back to the source, and the time when the last bit of the sent packet reaches the source. It is given in milliseconds (ms).
The limit values for universal service quality parameters are set out in the Annex to this Decree.
Repeal
They shall be deleted:
1. Decree No. 162 / 2005 Coll., on determining the quality parameters of universal service and its limit values.
2. Decree No. 327 / 2006 Coll.
3. Decree No. 226 / 2012 Coll., amending Decree No. 327 / 2006 Coll., laying down the characteristics of adequate connection requirements in a fixed place to the public telephone network and access in a fixed place to a publicly available telephone service and the conditions for access to the Internet within the universal service.
4. Decree No. 227 / 2012 Coll., amending Decree No. 162 / 2005 Coll., on determining the quality parameters of universal service and its limit values.
Efficacy
This Decree shall take effect on 1 July 2022.
