fixing compensation for the expropriation of real estate to citizens and private legal persons
In order to ensure a uniform procedure for determining compensation for the expropriation of immovable property to citizens and private legal persons, the Minister of Finance shall, in agreement with the participating ministries and central authorities and after consulting the Regional National Committees pursuant to Article 31 (2) (b) of Act No. 87 / 1958 Coll., on the Construction Regulations and Article 4 of Government Regulation No. 52 / 1960 Coll., on the abolition of the State Building Committee:
Subject matter and scope
This decree provides for compensation for the expropriation of immovable property owned by citizens and private legal persons.
Personal property buildings
Family homes and residential areas of agricultural holdings
(1) The amount of the refund for the expropriation of family houses and residential areas of agricultural holdings is determined in accordance with the following table:

The amount thus calculated shall be reduced by 1% for each year of construction age, but not more than 80%.
The classification of houses and housing areas of agricultural holdings in each class is set out in Annex 1.
(2) A family house means a house where at least two-thirds of the total floor area of all rooms belong to the apartments and which contains not more than five living rooms, not including the kitchen, or where, with more than one room, the total floor area of the living rooms does not exceed 120 m2. *)
(3) The residential part of the agricultural estate is the part which, due to its internal layout and equipment, is intended for housing and the floor area of which does not exceed 120 m2.
(4) The living area for the calculation of the compensation for the family houses and the housing parts of the agricultural holdings shall be the floor area of the living rooms. *)
(5) The value of accessories and equipment (kitchen up to 12 m2 floor area, toilet, bathroom, pantry, hall, cellar, laundry, built-in garage, etc.) belonging to the given quality class I-IV is included in the replacement for 1 m2 of living area of the family house and residential area.
(6) The Regional National Committee may exceptionally authorise the fixing of the refund referred to in paragraph 1 also for the residential parts of small business establishments (forge, inn, shop, etc.) and for houses which are not family houses but, at the time of expropriation, they play the role of a family house due to their structure and user range.
Vacation cabins
(1) The amount of compensation for the expropriation of holiday huts is determined in accordance with the following table:

The inclusion of holiday huts in each class is given in Annex 2.
(2) The refund referred to in paragraph 1 shall be increased by 20% if the holiday cabin has an attic and by 60% if the holiday cabin has a continuous floor.
(3) The cottage is a temporary building of a lighter nature, used for relaxation and recreation, but not for permanent housing. * *)
(4) The built-in area for calculating the refund for the expropriation of holiday huts is the total built-in area of the building including the porch, but without accessories if it is outside the building, and without secondary structures (wood, tool gun, etc.).
Garage
(1) The amount of the refund for the expropriation of garages is determined in accordance with the following table:

(2) According to paragraph 1, only separate garages and garages shall be carried out in an annex to a family house which serves solely for the personal needs of the owner.
For separate garages which are leased and for garages which form an economic unit with privately owned buildings, the procedure laid down in Article 10 (1) shall be followed.
Fences
(1) The amount of the refund for the expropriation of fences is determined according to the following table:

(2) Pursuant to paragraph 1, compensation shall be fixed for fences up to a total length of 120 m for personal buildings or for land intended for the construction of family houses, holiday huts or for the establishment of a garden. Compensation for the expropriation of the rest of the fence over a specified length of 120 m and the privately owned fence for buildings shall be equal to the value of the material after deduction of demolition costs.
wells
(1) The amount of the refund for the expropriation of the well is determined in accordance with the following table:

The amount thus calculated shall be reduced by 1% for each year of construction age, but not more than 80%.
(2) Pursuant to paragraph 1, compensation shall be fixed for wells in use for personal buildings or land intended for the construction of family houses, holiday huts and for the establishment of gardens. A refund of 10% shall be fixed for wells which are not in use or which form an economic unit with privately owned constructions.
(3) The refunds referred to in paragraph 1 include accessories (pump, pump, etc.).
Small economic accessories for personal buildings
(1) The amount of the refund for the expropriation of small economic equipment is determined in accordance with the following table:

The classification of minor economic accessories in each class is set out in Annex 5.
(2) Small economic accessories are mainly small buildings, which serve personal needs (e.g. fuel lumber, tool column, etc.) and agricultural buildings.
(3) The procedure laid down in paragraph 1 shall be followed:
(a) for small buildings serving personal needs, up to 20 m2 of built-up area;
(b) for agricultural buildings up to 20 m2 of built-up area, where they are actually used for farming.
For the part of small buildings and agricultural buildings used for agricultural activities exceeding the declared area and for agricultural buildings not used for agricultural activities, the procedure laid down in Article 10 (1) shall apply.
(4) The replacement for 1 m2 of built-up area of small economic accessories includes the value of the accessories and equipment (soil, water sink, fertilizer, etc.) belonging to the given quality class I-III as set out in Annex 5.
Adjustment of refunds calculated
(1) Reductions from compensation for personal property buildings, taking into account the wear and age of the construction referred to in § 2- 7, are meant for normal maintenance. These reductions may be reduced or increased accordingly in the case of neglected maintenance and repairs when upgrading and general repairs are carried out.
(2) If the construction in personal ownership has been demonstrated to have been built partly before 1 June 1953 and partly after 1 June 1953, or where construction works built before 1 June 1953 have been modified (e.g. added rooms, floors, etc.) after 1 June 1953, the compensation for each part of the construction shall be determined separately according to the relevant tables.
(3) In order to assess whether the construction is a personal property construction built before or after 1 June 1953, the date of entry into use of the construction is the relevant date.
Reimbursement in other immovable property or in means of construction
(1) For the expropriated personal property, the construction office may grant compensation to the expropriated at its request or on the request of the expropriator in another similar construction which may be in personal ownership or in the means of construction, unless this is contrary to the general interest.
(2) Any differences in the value of both objects shall be settled in cash; to determine these differences, the value of both objects shall be calculated according to the tables for the buildings built after 1 June 1953 under this decree.
(3) If the expropriator does not have a replacement structure which may be privately owned, the National Committee may, where justified, provide such replacement according to the same principles. In such a case, the expropriator, if not a state organization, must pay the general cost of the construction; state organisations shall not provide compensation to the national committee.
Private buildings
(1) Compensation for the expropriation of a privately owned building is determined according to the following table:

The classification of residential buildings in each class shall be carried out in accordance with Annex 1, the garages referred to in Annex 3 and the economic buildings referred to in Annex 5.
(2) Privately owned buildings are all buildings owned by citizens and private legal persons, with the exception of those listed in § 2-7 of this Decree.
(3) Obstructed space for calculating the refund for expropriation is the basic space enclosed
(a) the lower level of the base circumferential masonry,
(b) above the outer surfaces of roofs;
(c) on the sides of the outer surfaces of the walls of the building.
Removal costs of uppers and other movable property
The transfer of uppers and other movable property of the user of the expropriated building to a new place of destination shall be subject to compensation at the level of reasonable and actually proven costs.
Outdoor treatment
Outdoor treatment (gatherings, paving of the yard, paths, etc.) shall be compensated for the value of the material obtained by demolition after deduction of demolition costs.
Land and land
Land for the construction of family houses, holiday houses and garden
(1) The compensation for the land shown to be intended for the construction of a family house (including a yard and garden) and for the construction of a holiday cottage or garden is fixed at 1 m2

The total compensation for land shown to be intended for the construction of a family house may not exceed:

The total compensation for the land shown to be intended for the construction of holiday huts and the establishment of a garden may amount to no more than half of these amounts.
(2) According to paragraph 1, compensation shall be determined for land on which a family house, holiday cottage or garden is already built at the time of expropriation.
(3) For the land referred to in paragraphs 1 and 2, the construction office may grant compensation to the expropriated person at his request or on the request of the expropriator on another parcel.
(4) In the case of the simultaneous expropriation of more land of the same type to one owner, the area shall be added and treated in accordance with paragraph 1.
Other land
(1) For other land, including those associated with the joint use of JZD, a replacement plot of national property shall be provided in the same or in another municipality.
(2) In the expropriation decision, the Building Office provides that the expropriated person is to be compensated on a replacement parcel provided by the district national committee in whose district the expropriated parcel is situated. The district national committee shall then transfer the replacement parcel to its possession for the request of the expropriated person.
(3) Where land is expropriated during the growing season, the so-called costs of the new crop, i.e. the costs actually incurred for the cultivation, fertilisation, sowing, etc., of agricultural crops on expropriated parcels, shall be reimbursed. Compensation for the costs of the new crop shall be granted at the level of the costs actually incurred and demonstrated. Compensation for the costs of the new crop on parcels combined for the joint use of single agricultural cooperatives shall be granted to the cooperative. *)
Permanent crops
(1) The compensation for fruit trees is determined in accordance with the following table:

For the age between the introduction and the year of acquisition of fertility, the refund shall be determined by interpolation. According to her, the replacement for, for example, a 10-year-old peanut would make
25 + 90-2515 × 10 = 68,30 CZK.
For an age higher than that of the acquisition of fertility, the refund shall be reduced for each year by the amounts shown in the last column of the table. For example, the replacement for a 50-year-old walnut will be 90 - [(50-15) x 1,30] = 44,50 CZK. The total compensation for fruit trees may not exceed 3000 CZK.
(2) The compensation for vineyards and vineyard equipment is determined according to the following table:

The value of the vineyard plant is included in the replacement for 1 m2 of vineyard crop.
The total compensation for vineyards and vineyard facilities may amount to a maximum of 5000 CZK.

The total compensation for hop crops and hop plants may amount to a maximum of 2000 CZK.
(4) The compensation for forest crops is determined according to the following table:

The total compensation for forest crops may amount to a maximum of 1500 CZK. Wood in expropriated forest areas belongs to expropriators. The expropriator shall arrange for its extraction in accordance with the instructions and in cooperation, where appropriate, through organisations which have expropriated forests in professional management and are also responsible for the purchase of raw wood from those forests.
(5) Compensation for permanent crops on parcels combined for the common use of single agricultural cooperatives is granted to the cooperative. *)
Costs of removing portable buildings and other objects from land
Removal or transfer of portable structures and other objects on land not forming part of them and not being expropriated shall be subject to compensation at the level of reasonable and truly verifiable costs (including the cost of placing the objects in a new place).
Replacement construction of flats
(1) The District National Committees organise replacement construction for privately owned expropriated residential buildings in accordance with the principles approved to solve the housing problem, primarily through cooperative construction of cheap, modern multi-storey houses.
(2) The expropriator, in cooperation with the relevant district (local) national committees, will ensure that the owners of private-owned housing are given priority to obtaining a flat in a cooperative building on the site or in close proximity to the workplace, or that investment and project preparation of the concentrated construction of multi-storey houses in a cooperative manner.
Exceptions to the fixing of refunds
(1) In order to provide the means to obtain an adequate replacement apartment in cooperative construction or in a family home or in the acquisition of personal property replacement buildings referred to in § 3-7, to owners to whom the compensation calculated in accordance with the tables for buildings built before 1 June 1953, the District National Committee may authorise the grant of compensation for their application up to the amount calculated in accordance with the tables for buildings built after 1 June 1953, but not more than 80 000 Kčs. The owner's undertaking to acquire an adequate replacement apartment in the cooperative building or in the family house or in the personal ownership of the replacement building referred to in § 3-7 must be specified in the expropriation decision.
(2) In exceptional cases where even a refund calculated according to the tables for buildings built after 1 June 1953 would not be sufficient to obtain an adequate flat in cooperative housing, the district national committee may authorise the increase of compensation up to the amount of a member's share in the housing cooperative (e.g. families with multiple children, pensioners with small pensions, etc.).
(3) In the case of the co-ownership of privately owned dwellings, an exemption may be granted under paragraphs 1 and 2 only to the co-owner who needs to buy a replacement apartment. An exemption may be granted only up to an amount corresponding to the share of the co-owner.
(4) The exemption referred to in paragraphs 1 and 2 may not be granted to owners who own more than one building of the same kind (two family houses, two holiday homes, etc.), owners of private-owned dwellings who do not need to acquire a replacement apartment and where their permission is not in accordance with the interests of our company. In particular, the exemption shall not be granted to members of former exploitation classes, persons punished for illegal activity and owners who acquired the expropriated property for speculative purposes.
(5) The exemption provided for in paragraph 1 shall also not be authorised when expropriating objects acquired by the owner by an allocation from the Czech State under the rules on the distribution of confiscated property. In such cases, however, the compensation may be increased up to the amount of the members' shares in a reasonable flat in the housing cooperative.
(6) When expropriating private-owned residential buildings, the expropriator may provide the owners with an advance payment for the replacement of such buildings up to the amount calculated in accordance with the tables for buildings built up until 1 June 1953, if this is necessary for the early start of replacement residential construction in a cooperative manner. The deposit will be lodged for the benefit of the owner on behalf of the respective building housing cooperative. If the owner of the cooperative's flat refuses an additional flat, the advance will be refunded to the expropriator.
(7) Adequate housing in cooperative housing is an apartment whose floor area for living rooms corresponds to the number of members of the user's household. *)
(1) The compensation provided for in Article 18 (1), (2), (3) and (5) paid to the owner for an interest-free account set up under the rules on the acquisition of property by socialist organisations by citizens and private legal entities * *) is specifically linked to the provision of a replacement apartment in cooperative construction or in a family home, or to the measures of another personal replacement building referred to in § 3-7. The expropriator shall inform the State Savings Bank, when making the refund, that it is an assigned refund.
(2) If the owner does not use the linked refund for the purpose allowed, within five years of the date of the lodging of the refund in an interest-free account, he shall be obliged to return to the organisation the difference between the refund granted pursuant to Paragraph 18 (1), (2), (3) and (5) and the refund calculated in accordance with the tables for the buildings built before 1 June 1953; in the expropriation decision, that difference must be calculated and the obligation to repay it laid down.
(3) The provisions of paragraph 2 shall also apply if, within five years of the completion of the construction, the owner sells it or if, at the same time, his membership of the building housing cooperative is terminated by the presentation, exclusion or cancellation.
Pre-use of real estate
(1) No compensation shall be granted for the preliminary use of land. For the preliminary use of other real estate, a compensation of 2,5% per year shall be granted on the basis of the amount which the property would have been subject to under § 2- 7 and § 10 of the Decree.
(2) Reimbursement for the provisional use of real estate shall not be granted where the property to be expropriated has been put into use under Government Decree No. 50 / 1955 Coll..
(3) Compensation for the pre-use of real estate shall not be reduced by the total compensation for the property on expropriation.
Common provisions
(1) The expropriator shall submit to the construction office, together with the request for expropriation, a proposal for the method and amount of the refund.
(2) If the owner fulfils the conditions set out in Paragraph 18, he may request an exemption through the construction office.
(1) The provisions of this Decree also apply to the contractual acquisition of real estate by socialist organisations from citizens and private legal persons.
(2) An organisation intending to redeem the land shall submit a duly substantiated proposal to the district national committee in whose area the land is situated for the provision of the replacement parcel to the owner.
(3) The district national committee will transfer the replacement parcel, if it is in its administration, to the administration of the purchasing organisation. The purchasing organisation shall then conclude an exchange agreement with the owner. If the buyer is an organisation other than a state organisation, the replacement parcel shall be transferred free of charge to its ownership.
(4) The decision to authorise the exemption provided for in Paragraph 18 for the contractual acquisition of real estate shall set the amount of the refund and the difference referred to in Paragraph 19 (2) shall be calculated; the contract obliges the owner to refund the difference if he does not use the purchase price for the permitted purpose within 5 years of the date of its composition in an interest-free account and if the owner sells or ceases to sell it within 5 years of the completion of the construction, or if his membership of the building housing cooperative is terminated at the same time by the presentation, exclusion or cancellation of the contract.
This Decree applies to all cases of expropriation and contractual acquisition of real estate by socialist organisations from citizens and private legal persons for which the decision or contract is not legally effective at the date of its effectiveness.
Final provisions
(1) In exceptional cases, the Ministry of Finance may allow exemptions from this decree.
(2) All provisions contrary to this Decree shall be repealed; In particular, Decree No 228 / 1951 Ú. l, as amended by Decree No 44 / 1952 Ú. l, Decree No 258 / 1951 Ú. v., as amended by Decree No 69 / 1952 Ú. v., on determining compensation for expropriation and for the prior use of real estate, and Article 44 of Decree No 144 / 1959 Ú. l, which is implemented by the Law on the Construction Regulations, is hereby repealed.
This decree shall take effect on the day of its publication.

Classification of garages by quality in 3 classes
Class I:
Walled garages with reinforced concrete ceiling, heat insulated, with steel doors, with insulation against ground moisture, with electric lighting and motor socket, with water supply, with sewerage, with washing plate in front of the garage.
Class II:
Light wall garages with non-burning ceiling, roller shutter or garage with steel structure, covered sheets with partial thermal insulation, with tin doors or roller shutters, with electric lighting, sink. Water tap is available in the distance of up to 20 m
