THE LAW
of 18 March 2020
amending Act No. 354 / 2019 Coll., on Judicial Interpreters and Judicial Translators
Parliament has decided on this law of the Czech Republic:
Act No. 354 / 2019 Coll., on Judicial Interpreters and Judicial Translators, is amended as follows:
1. in Article 7 (1) (d), "(f) to (l)" shall be replaced by "(f) to (k)," "(f) to (m)" shall be replaced by "(f) to (l)," "(a) to (e)," "(a) to (g)" shall be replaced by "(f)" and "§ 14 (1) (d)" shall be replaced by "§ 14 (1) (c)."
2. in Article 14 (1), point (b) shall be deleted;
Points (c) and (d) shall be renumbered (b) and (c).
3. Paragraph 16 (1) (j) reads:
"(j) an indication of the refusal to conduct an interpretation pursuant to Article 19 (1) (c);"
4. in Article 16 (2), the following point (b) is inserted after point (a):
"(b) contact address,"
Points (b) and (c) shall be renumbered (c) and (d).
5. in Article 16 (3) (a), the words "five years have passed since the date on which the decision on the offence became final," shall be deleted;
6. in Article 16 (3), the following point (d) is inserted after point (c):
"(d) an indication of the refusal to conduct an interpretation pursuant to Paragraph 19 (2);"
Points (d) and (e) shall be renumbered as points (e) and (f).
7. In Article 19 (1), the word "or 'shall be deleted at the end of point (b) and the following point (c) shall be inserted after point (b):
"(c) there is insufficient expertise to perform an interpretative act; or"
Point (c) shall be renumbered (d).
8. In Article 19 (2), the words "or other serious reasons' shall be inserted after the word" obligations' and at the end of the text of paragraph 2, the sentence "The public authority shall notify the Ministry of refusal to conduct an interpretation act, which shall enter the indication of refusal, including the reason for refusal to conduct an interpretation act in the list of interpreters and translators'.
9. Article 22 shall be deleted;
10. In the second sentence of Paragraph 25, the word "a 'is replaced by" comma' and after the word "execution 'the words" the interpreter shall be informed of the subject matter of the interpretation and, where appropriate, of any other information in the file'.
11. in Article 27, paragraph 5 is deleted;
Paragraphs 6 and 7 shall become paragraphs 5 and 6.
12. in Paragraph 28 (3) (i), the words "even if contractual remuneration has been agreed" shall be deleted;
13. Paragraph 29 (5) is deleted.
Paragraph 6 shall become paragraph 5.
14. In the first sentence of Paragraph 35, the words "related to the performance of interpretation 'are inserted after the word" conduct'.
15. in Paragraph 37 (1), points (l) and (n) are deleted;
Points (m) and (o) shall be renumbered as points (l) and (m).
16. in Paragraph 37 (2), points (l) and (o) are deleted;
Points (m), (n) and (p) shall be renumbered as points (l), (m) and (n).
17. in Paragraph 37 (3) (a), "75 000" is replaced by "50 000," "m) to (o)" is replaced by "l) and (m)" and "n) to (p)" is replaced by "m) and (n)."
18. in Paragraph 37 (3) (b), "250 000" is replaced by "200 000" and "or (m)" is replaced by "or (l)."
19. in Paragraph 37 (3) (c), "500 000" is replaced by "300 000" and "(i) or (l)" is replaced by "or (i)."
20. in Paragraph 38 (1), point (f) is deleted;
Point (g) shall be renumbered as point (f).
21. in Paragraph 38 (2), point (f) shall be deleted;
Points (g) and (h) shall be renumbered as points (f) and (g).
22. in Paragraph 38 (3) (a), "75 000" is replaced by "50 000" and "(g) and (h) of paragraph 2" is replaced by "(f) and (g) of paragraph 2";
23. in Paragraph 38 (3) (b), "250 000" is replaced by "200 000" and "or (g)" is replaced by "or (f)."
24. in Paragraph 38 (3) (c), '500 000' is replaced by '300 000' and the words', (e) or (f) 'are replaced by' or (e) ';
Efficacy
This Act shall take effect on 1 January 2021.
