DECLARATION
of 19 June 2015
amending Decree No. 16 / 2012 Coll., on the competence of persons driving a railway vehicle and persons conducting revisions, inspections and tests of designated technical equipment and amending Decree No. 101 / 1995 Coll., which gives rise to the Order on the health and professional competence of persons operating a railway, as amended
The Ministry of Transport provides pursuant to § 66 paragraph 1 of Act No. 266 / 1994 Coll., on Railways, as amended by Act No. 23 / 2000 Coll., Act No. 103 / 2004 Coll., Act No. 181 / 2006 Coll., Act No. 191 / 2006 Coll., Act No. 194 / 2010 Coll., Act No. 134 / 2011 Coll. and Act No. 64 / 2014 Coll., ("the Act ') for the implementation of § 46e (5) and § 46j (5) Act:
Čl. I
Decree No. 16 / 2012 Coll., on the competence of persons driving a railway vehicle and persons conducting revisions, inspections and tests of designated technical equipment, and amending Decree No. 101 / 1995 Coll., which gives rise to the Order on the Health and Proficiency of Persons in the Operation of Railways and Rail Transport, as amended, is amended as follows:
1. At the end of footnote 1, the sentence "Commission Directive 2014 / 82 / EU of 24 June 2014 amending Directive 2007 / 59 / EC of the European Parliament and of the Council as regards general expertise, health requirements and licence requirements is added. '.
2. in Article 5, the following paragraph 2 is inserted after paragraph 1:
"(2) The Commission, before which a special competence test is composed, has three members. The examination shall be completed no later than 1 year after completion of the training to obtain the relevant knowledge, skills and procedures. ';
Paragraphs 2 to 7 shall be renumbered paragraphs 3 to 8.
3. In Paragraph 5 (4), the words "to the extent of the messages and the communication method referred to in the European Union8 Regulation 'shall be added at the end of the second sentence and at the end of paragraph 4, the sentence" The applicant must be able to understand both the word and the letter in the Czech language and communicate in both words and letters at least at B1 level under the Common European Framework of Reference for Languages'.

4. In Paragraph 16 (2), at the end of the first sentence, the words "and to provide evidence of compliance with medical fitness' shall be added.
5. In Section 16, the sentence "General proficiency tests may be repeated twice at the end of paragraph 3. If the applicant does not pass the test even on the third experiment, he shall be re-trained to obtain the relevant knowledge, skills and procedures. The examination shall be completed no later than 1 year after completion of the training to obtain the relevant knowledge, skills and procedures. ';
6. Annex 1, including the title, shall read:

"Annex No 1 to Decree No 16 / 2012 Coll.
The scope and content of the basic general knowledge, skills and procedures necessary for the control of the track vehicle and the performance of the driver's activity and the scope and content of training to obtain the relevant knowledge, skills and procedures
(1) The basic general knowledge, skills and procedures necessary for the steering of the track vehicle and the performance of the driver's activities shall be:
"1.1. Operation of the driver, working environment, role and responsibility of the driver during the operation of railway transport, personal and special requirements arising from the duties of the driver
1.1.1. knowledge of the main content of the legislation and rules relating to the operation of railway transport and safety, in particular the requirements and procedures for certification of drivers, for the transport of dangerous goods, environmental protection and fire protection,
1.1.2. understanding of professional, staffing and specific requirements, in particular mostly independent work, shift work, personal protection and security,
1.1.3. understanding of the behaviour which is incompatible with the exercise of activities relevant to the safety of rail transport operations, in particular by drugs, alcohol, drugs and other psychoactive substances, diseases, stress, fatigue,
1.1.4. knowledge of operational regulations, in particular rules governing the operation of train drivers, use of track-side tables,
1.1.5. knowledge of the responsibilities and powers of stakeholders,
1.1.6. understanding the importance of accuracy in the performance of duties and working methods;
1.1.7. understanding of the aspects of safety and health at work, in particular the rules of conduct on and near the route, the rules of conduct when entering and leaving the driving vehicle safely, the methodology of organisation of work and of means of work, the rules of safety for workers and the use of personal protective equipment,
1.1.8. knowledge of the rules of behaviour in the performance of the driver's work, in particular stress management, management of extreme situations,
1.1.9. knowledge of the principles of environmental protection, in particular the cost-effective way of driving.
1.2. Organisation of railway transport
1.2.1. knowledge of principles, regulations and measures relating to safety in the organisation of railway transport,
1.2.2. identification of responsibilities and functions of stakeholders.
1.3. Basic requirements in the field of railway infrastructure
1.3.1. knowledge of the system and structural principles and parameters of railway infrastructure,
1.3.2. knowledge of the general characteristics of lines, railway stations, marshalling stations,
1.3.3. knowledge of railway structures, in particular bridges, tunnels, switches,
1.3.4. Knowledge of operating modes, in particular operations on a single and double track track,
1.3.5. knowledge of signalling and train control systems,
1.3.6. knowledge of safety devices, in particular hot-water indicators of bearing housings, smoke detectors in tunnels,
1.3.7. knowledge of technical design of power supply systems, in particular overhead contact lines, third rail.
1.4. Basic requirements of operational communication
1.4.1. knowledge of the importance of communication and communication procedures;
1.4.2. identification of contact persons in the operation of railway transport and their roles and responsibilities, in particular the staff of the railway operator, other staff on board the train and their duties;
1.4.3. identification of the situation requiring the initiation of communication;
1.4.4. understanding the methods of communication.
1.5. Train composition and technical requirements for freight and passenger railway vehicles
1.5.1. knowledge of types of traction, in particular electric, motor, steam,
1.5.2. knowledge of the arrangement of the groove vehicle, in particular chassis, chassis, driver's cab, protective systems,
1.5.3. knowledge of the systems for marking railway vehicles,
1.5.4. knowledge of train composition documentation;
1.5.5. knowledge of the various types of braking systems, calculation of the necessary braking percentages and scales,
1.5.6. determination of train speed,
1.5.7. identification of types of tractor and collision gear, maximum load and maximum force on hook,
1.5.8. knowledge of the functioning and purpose of the train management system.
1.6. General hazards in rail transport
1.6.1. understanding of the principles of transport safety,
1.6.2. Knowledge of the dangers associated with the operation of railway transport and the way in which it is reduced;
1.6.3. Knowledge of security-related events and understanding what behaviour or reactions are required;
1.6.4. knowledge of procedures for accidents involving persons, in particular evacuation,
1.6.5. Knowledge of the basic rules of the Order for the International Carriage of Dangerous Goods by Rail.
1.7. Basic physical principles
1.7.1. an understanding of the forces applied to the wheel of the groove vehicle,
1.7.2. identification of factors affecting acceleration and braking performance, in particular weather conditions, braking equipment, reduced adhesion, sand sprinkling,
1.7.3. control of electrical engineering bases, especially circuits, voltage measurement.
2. Training to obtain relevant knowledge, skills and procedures
Training to obtain basic general knowledge, skills and procedures shall cover the areas referred to in point 1 and shall be carried out at a minimum of 120 hours. ';
7. In Annex 3, Part 1.6. The following point 1.6.5 is added to transport safety:
"1.6.5. Knowledge of the safety management system for railway transport operations. ';

Efficacy
This Decree shall take effect on 1 July 2015.
