Communication from the Ministry of Foreign Affairs on the negotiation of the Trade Agreement between the Government of the Czech Republic and the Government of the Eastern Republic of Uruguay

The Ministry of Foreign Affairs states that a Trade Agreement between the Government of the Czech Republic and the Government of the Eastern Republic of Uruguay was signed in Montevideo on 26 September 1996.
The Agreement entered into force on 2 December 1998 on the basis of Article 12 thereof. The Trade Agreement between the Czechoslovak Socialist Republic and the Eastern Republic of Uruguay of 17 June 1982 expired on that date.
The Czech version of the Agreement is hereby published at the same time.
TRADE AGREEMENT
between the Government of the Czech Republic and the Government of the Eastern Republic of Uruguay
Government of the Czech Republic and Government of the Eastern Republic of Uruguay, hereinafter referred to as "the Parties',
taking into account the friendly relations that connect both states,
recognising the important role that trade plays in promoting economic development,
to strengthen economic and trade relations between the two States,
agree on the following:
The Parties shall promote the development and deepening of trade relations between the two States in accordance with the laws in force in each of them. To this end, they will assist, facilitate and encourage commercial cooperation between natural and / or legal persons of both States.
The two Parties undertake to grant each other the treatment of the most favoured nation clause in all respect of imports and exports of products between the two States in accordance with the provisions of the General Agreement on Tariffs and Trade 1994 / World Trade Organisation (GATT 1994 / WTO).
However, Article 2 shall not apply to:
(a) the advantages, permits and exemptions granted or granted to neighbouring States for the purpose of facilitating transport and trade in border areas;
(b) benefits and / or exemptions granted or granted by each Party within the customs union and free trade areas to which it is or will be a member.
Exports and imports of goods will take place in accordance with international trade rules and legislation in force in each Party State.
In order to promote and facilitate trade within the framework of this Agreement, the Parties shall, in accordance with the internal legislation in force, take all necessary measures to ensure the issue of export or import licences whenever such licences are necessary.
All payments resulting from commercial contracts concluded between natural and / or legal persons of both States shall be made in freely convertible currency in accordance with the laws in force in each State.
The Parties shall provide the necessary concessions for the organisation of trade fairs, exhibitions, conferences and other activities to promote mutual trade in accordance with the legislation in force in each State.
In accordance with the laws in force in each State, the Parties shall exempt:
(a) samples and goods without commercial value and commercial promotional materials;
(b) articles and goods temporarily imported and intended for trade fairs and exhibitions;
(c) equipment intended for experiments, tests and scientific research in accordance with the programmes established under this Agreement.
Where products benefiting from the advantage referred to in this Article would be sold, import duties, taxes and other import charges shall be applied to them in accordance with the legislation in force in each Party State.
In order to ensure the implementation of this Agreement and to promote economic and trade cooperation between the two States, the Parties shall establish a Joint Czech-Uruguay Commission.
The Joint Commission shall propose measures and activities of common interest, as well as monitoring their implementation, undertake the coordination necessary for the implementation of this Agreement and seek new areas of cooperation.
The Joint Czech-Uruguay Commission will meet by mutual agreement, if necessary or at the request of one of the Parties. Its meetings will take place alternately in the Czech Republic and the Eastern Republic of Uruguay.
If necessary The Joint Commission will be able to set up subcommittees and call on specialists and advisers to attend its meetings.
Any problem, dispute or differences of opinion that would arise between the Parties in the interpretation and application of this Agreement will be addressed by direct negotiations between them.
The Parties, by mutual agreement, will be able to amend, revise or modify this Agreement in writing and by diplomatic means. This amendment, revision or modification which enters into force on the date set by the Joint Agreement of the Parties shall not affect the rights and obligations arising from this Agreement before the date of such amendment, revision or modification.
This Agreement shall enter into force on the date of the exchange of diplomatic notes confirming compliance with the formalities required for its approval by the relevant legislation.
Entry into force of this Agreement Trade Agreement between the Czechoslovak Socialist Republic and the Eastern Republic of Uruguay, signed in Montevideo on 17 June 1982 as regards the Czech Republic and the Eastern Republic of Uruguay.
The Agreement shall be valid for five years and shall be automatically extended by one year until one of the Parties has officially notified its intention to terminate it in writing, no later than six months before the expiry of the current Agreement.
The provisions of this Agreement shall continue to apply on expiry of this Agreement to contracts which have not been fulfilled before the date of expiry of this Agreement.
In good faith, the competent agents shall sign this Agreement in two identical originals, each in the Czech and Spanish languages, each of which shall be equally authentic.
