DECLARATION
of 10 June 2022
amending Decree No. 55 / 2011 Coll., on the activities of health workers and other professionals, as amended
According to Section 90 (2) (e) of Act No. 96 / 2004 Coll., on the conditions for obtaining and recognising eligibility for the pursuit of non-medical medical professions and for carrying out activities related to the provision of medical care and amending certain related laws (Act on non-medical medical medical professions), as amended by Act No. 125 / 2005 Coll. and Act No. 105 / 2011 Coll.:
Čl. I
Decree No. 55 / 2011 Coll., on the Activities of Medical Workers and Other Experts, as amended by Decree No. 2 / 2016 Coll., Decree No. 391 / 2017 Coll. and Decree No. 252 / 2019 Coll., is amended as follows:
1. In Article 2 (h), the words "processed in writing 'are replaced by the words" national procedure or other' and the word "Journal 'is replaced by" Bulletin'.
2. in Article 2 (i):
"(i) laboratory quality system means procedures in a laboratory which comply with the legislation, standards of CSN, EN or ISO, or standards related to the assurance and management of the quality of laboratory activities,"
footnote 2 is deleted.
3. In Article 2 (j), the words "other legislation (3) 'are replaced by the words" under the law governing in vitro medical devices and diagnostic medical devices ("the medical device').
footnote 3 is deleted.
4. In Article 2 (k), the words "evaluation of technical and physical parameters, including doses of radiation, calibration, maintenance of equipment, preparation and administration of radiopharmaceuticals and production of films' are replaced by the words" preparation and administration of radiopharmaceuticals'.
5. in Article 2 (l):
"(l) a medical device used for investigation or treatment in nuclear medicine, radiotherapy or radiodiagnostic therapy, which is a source of ionising radiation, imaging or detection system in nuclear medicine, or may affect the level of exposure of persons exposed to medical radiation."
6. Paragraph 3 (3), including footnote 9 and footnote references, is deleted.
Paragraph 4 shall become paragraph 3.
7. in Article 4 (1) (a):
"(a) evaluate the needs and levels of self-sufficiency of patients, the manifestations of their disease, risk factors, including using evaluation and measurement techniques used in nursing practice, in particular self-sufficiency tests, the risk of bed beds, pain assessment, state of consciousness, cognitive function and nutrition,"
8. in Article 4 (1) (b), the word "orientations" shall be deleted;
9. In Article 4 (1) (j), the words "in cooperation with a physiotherapist, an ergotherapist and a speech therapist in health care 'are deleted.
10. in Article 4 (1) (p), the words "funds 11) and linens" shall be replaced by the words "funds."
footnote 11 is deleted, including the footnote references.
11. in Article 4, at the end of paragraph 1, the dot is replaced by a comma and the following points (u) and (v) are added:
"(u) to exchange the urinary catheter in women and girls older than 3 years of age,
(v) to replace and remove peripheral venous catheters. "
12. in Article 4 (2), the words "or nurse with specialised competence in the relevant field" shall be inserted after the words "nurse with specialised competence in the relevant field" and the words "points (a) to (k), (o) and (p)" shall be replaced by "except for point (q)."
13. In Article 4, paragraphs 5 and 6 are added:
"(5) The general nurse, under the professional supervision of a doctor or a general nurse with specialised competence in the field concerned, may, on the indication of the physician, administer medicinal products to the epidural catheter to patients older than 3 years of age.
(6) The general nurse may, without professional supervision and without indication to the extent of her competence, conduct education and advice in the areas of health and healthy life promotion, including prevention, dissemination and reduction of disease occurrence, prepare health protection and promotion programmes and participate in the scope of her professional capacity to implement them. ';
14. in Article 4a (1) (i), the words "in cooperation with a physiotherapist, an ergotherapist, a general nurse, a nurse and a midwife" shall be deleted.
15. in Article 4a (1), the words "and the state of the mucous membranes" shall be added at the end of the text of point (j).
16. in Article 4a (4) and (5), the text "(l)" is replaced by "(n)";
17. in Article 4b (3) (a), the words "except for premature newborns" shall be deleted;
18. In Article 4b, paragraphs 6 and 7 are added:
"(6) A pediatric nurse under the professional supervision of a pediatric nurse with specialised competence in the relevant field may, based on the doctor's indication, administer medicinal products to the epidural catheter.
(7) A child nurse, without professional supervision and without indication to the extent of her professional competence, may conduct education and advice in the areas of health and healthy life promotion, including prevention, spread and reduction of disease occurrence, prepare health protection and promotion programmes and participate in their professional capacity to implement them. "

„§ 7
Radiological assistant
(1) The radiological assistant shall carry out the activities referred to in Article 3 (1) and may, without professional supervision, without indication and in accordance with the procedures laid down in the Law on specific health services for the provision of medical exposure (hereinafter referred to as the "medical exposure procedure").
(a) assist and instruct in intervention operations;
(b) take over, control and store medical devices;
(c) perform specific nursing care provided in connection with radiological procedures; and
(d) take over, control and store medicinal products10) and manipulate them.
(2) The radiological assistant, who is the practitioner with clinical responsibility for the practical part of the medical exposure, may, without professional supervision, without indication and in accordance with medical exposure procedures, carry out the practical part of the medical exposure in:
(a) standard skiagical displays;
(b) standard mammographic imaging performance including screening;
(c) an operating skiascopy and a skiascopy for navigation;
(d) bone densitometry;
(e) diagnostic performance in dental radiodiagnostic;
(f) standard medical irradiation techniques in radiotherapy; and
(g) standard diagnostic and therapeutic performance in nuclear medicine.
(3) Furthermore, a radiological assistant may, in accordance with medical exposure procedures:
(a) on the basis of an indication and under the direct direction of a radiological assistant with the appropriate specialised or specific competence to carry out the activities referred to in paragraphs 160 to 163;
(b) on the basis of the indication and under the professional supervision of the physician, apply the intravenous medicinal products required to perform the practical part of the medical exposure;
(c) on the basis of a doctor's indication and under the professional supervision of a doctor, a nurse for nuclear medicine or a specialist radiological assistant for nuclear medicine, to apply radiopharmaceuticals;
(d) carry out activities based on the indication and guidance of clinical radiological physics with special expertise in radiotherapy planning;
(e) without expert supervision based on the indication of the physician, to administer the medicinal product10) necessary to perform an examination of the digestive tract, airways, subcutaneous, skin and intramuscular injections,
(f) without professional supervision on the basis of the indication of the physician, perform therapeutic and imaging procedures in radiology using physical principles other than ionising radiation; and
(g) without professional supervision on the basis of the doctor's indication to introduce peripheral venous catheters. ';
footnotes 15, 45 and 46 are deleted, including the references to footnotes 45 and 46.
20. in Paragraph 8 (1) of the Introductory Part of the Provisions, the words "good laboratory practice" are replaced by the words "with laboratory quality system in particular."
21. in Article 8 (2) of the introductory part of the provision, the word "in particular" shall be inserted after the word "doctor."
22. in Article 12 (1) (b), the words "environmental and work environment components" shall be inserted after the words "material," including venous and capillary blood, "
23. in Article 15 (2) (c):
"(c) to operate and maintain a dental laboratory's medical devices and other equipment, with the exception of the use of a source of ionising radiation;"
24. In Article 16, the dot is replaced by a comma at the end of paragraph 1 and the following point (e) is added:
"(e) to carry out, to the extent of their professional competence, activities in the taking-over, inspection, handling and storage of medical devices and linens, their disinfection and sterilisation, and to ensure sufficient supplies thereof.";
25. in Article 16 (2) (g), the words "bleaching and similar aesthetic treatments," shall be deleted;
26. In Article 16, at the end of paragraph 3, the dot is replaced by a comma and the following point (e) is added:
"(e) perform, on the basis of the indication of the dental practitioner, the practical part of the medical exposure to dental X-ray equipment."
27. in Article 17 (1), the word "monitor" shall be inserted at the beginning of point (a) and the words "pulse oxymeter" shall be replaced by "other body parameters using medical devices."
28. in Article 17 (1), the following point (b) is inserted after point (a):
"(b) evaluate the manifestations of disease and risk factors and, on the basis of differential diagnosis, establish a preliminary diagnosis."
Points (b) to (k) shall be renumbered (c) to (l).
29. in Paragraph 17 (2) (d), "over 10 years of age" is replaced by "older than 3 years of age."
30. In Article 17, the words ", (u) and (v) and (4a) (1) (b) to (n) 'shall be added at the end of the text of paragraph 3.
31. in Paragraph 18 (2), the word "individual" shall be deleted;
32. the words "and medicinal products containing venen10)" shall be added at the end of Paragraph 18 (3).
33. In Paragraph 19, the words "and ensures that the medical devices transmitted to the patient are set up by the doctor 'shall be added at the end of paragraph 2.
34. in Paragraph 19 (3):
"(3) Where the medical device on which the biomedical technician carries out the activities referred to in paragraph 1 or 2 is a radiological device, he shall carry out those activities in cooperation with a clinical radiological physicist. ';
35. Paragraph 21, including the title and footnotes No 20 and 21, reads as follows:
„§ 21
Radiological technician
(1) The radiological technician shall carry out the activities referred to in Article 3 (1) and without professional supervision and in accordance with medical exposure procedures may:
(a) without indication to check compliance with requirements laid down by other legislation20), 21) when using radiological devices and other related medical devices;
(b) without indication to carry out and evaluate tests for the operational stability of the source of ionising radiation and for the operational testing of imaging and detection systems in nuclear medicine;
(c) without indication to perform basic clinical dosimetry in diagnostic and therapeutic procedures, including the recording and evaluation of doses supplied to patients in order to verify the accuracy of irradiation plans and activities of applied radiopharmaceuticals; and
(d) on the basis of the indication of the physician who is the practitioner, perform the practical part of the medical exposure in high dose brachytherapy (HDR brachytherapy).
(2) Furthermore, the radiological technician carries out activities related to the practical and physical part of the medical exposure in accordance with the medical exposure procedures, on the basis of the indication and according to the instructions
(a) clinical radiological physics in the optimisation of medical exposure;
(b) clinical radiological physics in the physico-technical part of medical exposure;
(c) clinical radiological physics with special expertise in radiotherapy planning; or
(d) clinical radiological physics with special competence for nuclear medicine in the planning of therapeutic performance in nuclear medicine.

36. in § 22 (1) (e):
"(e) to conduct individual, group and family admin therapy and supportive psychotherapy,"
37.Paragraph 22 (3) reads:
"(3) An adictologist, under the supervision of a doctor with a special specialised competence in the field of medical psychotherapy and with a specialised competence in the field of psychiatry or in the field of paediatric and adult psychiatry or with a special specialised competence in the field of addictive disease and other addictive substances and other addictions or psychotherapists, may cooperate in systematic individual, group and family psychotherapy."
38. In Article 22, the following paragraph 4 is added:
"(4) An adictologist under the supervision of a doctor with specialised competence in the field of psychiatry or in the field of childhood and adult psychiatry or a doctor with special specialised competence in the field of addictive disease in the field of addictive substances and other addictions may assist in psychiatric examinations. '
39. in Paragraph 23, the word "subsidiary" shall be inserted at the beginning of point (b).
40. In Article 23, the current text becomes paragraph 1 and the following paragraph 2 is added:
"(2) A health psychologist under the supervision of a psychotherapist may carry out systematic individual, group, emergent and family psychotherapy."
Article 41 (26), including the title, reads:
„§ 26
Radiological physicist
(1) The radiological physicist carries out activities under § 3 (1) and § 21.
(2) Furthermore, a radiological physicist may, in accordance with medical exposure procedures, on the basis of an indication and under the professional supervision of a clinical radiological physicist with an appropriate specific competence:
(a) to provide consultation and advice and to train other healthcare professionals and other professionals on matters relating to radiation protection in medical exposure and its optimisation;
(b) provide radiation protection in the provision of health care by the provider of health services, in particular radiation protection for workers, residents and patients under the atomic law; and
(c) verify radiotherapeutic plans by dosimetric and independent calculation.
(3) Furthermore, a radiological physicist may carry out activities in accordance with medical exposure procedures, on the basis of an indication and in accordance with the instructions of a clinical radiological physicist with appropriate specific competence in the introduction of new radiological equipment and physical methods into clinical practice. "
footnotes 23 and 24 are deleted.
42. In Article 27, the following paragraph 1 is added:
"(1) A professional in laboratory methods and in the preparation of medicinal products shall carry out the activities referred to in Article 3 (1) and shall carry out non-invasive biological and capillary blood sampling on the basis of the indication of a doctor or professional worker in laboratory methods and the preparation of medicinal products with specialised competence in the protection and promotion of public health. ';
Paragraphs 1 to 4 shall be renumbered paragraphs 2 to 5.
43. In Section 27 (2) of the Introductory Part of the provision, the words "carry out the activities referred to in Section 3 (1) and the words" good laboratory practice 'are replaced by the words "laboratory quality system'.
44. in § 27 (4), the text "§ 131" is replaced by "§ 143."
45. In Paragraph 27, the following paragraphs 5 to 7 are inserted after paragraph 4:
"(5) A specialist in laboratory methods and in the preparation of medicinal products working on the section of clinical haematology and transfusion services may, under the professional supervision of a specialist in laboratory methods and the preparation of medicinal products with specialised competence in clinical haematology and transfusion services or doctors with specialised competence in the field of haematology and transfusion medicine, carry out activities related to the manufacture of blood transfusions (13).
(6) An expert in laboratory methods and in the preparation of medicinal products working in the field of allergology and clinical immunology may, under the professional supervision of an expert in laboratory methods and the preparation of medicinal products with specialised competence in the field of allergology and clinical immunology, prepare individual or combined human autogenic vaccines.
(7) An expert in laboratory methods and in the preparation of medicinal products working on the section of protection and promotion of public health and on the section of epidemiology, microbiology and occupational medicine may perform under the professional supervision of a professional worker in laboratory methods and the preparation of medicinal products with specialised competence in the field of protection and promotion of public health or a doctor with specialised competence in the field of hygiene and epidemiology or in the field of medical microbiology or doctors with special specialised competence in the field of occupational medicine in the field of activity referred to in Section 137. '
Paragraph 5 shall become paragraph 8.
46. in Paragraph 28 (2):
"(2) Where the medical device on which the biomedical engineer carries out the activity referred to in paragraph 1 is a radiological device, he shall carry out those activities in cooperation with a clinical radiological physicist. ';
47. In Paragraph 29, the following paragraph 1 is added:
"(1) An expert in the protection and promotion of public health shall carry out the activities referred to in Article 3 (1) and shall carry out, without professional supervision on the basis of the indication of a doctor or professional worker in laboratory methods and the preparation of medicinal products with specialised competence in the field of protection and promotion of public health, the measurement, sampling of environmental and occupational components, non-invasive sampling of biological material, and the collection of venous and capillary blood for laboratory tests in the field of protection and support of public health, the collection of necessary data, which shall further analyse, process and propose appropriate measures."
The current text becomes paragraph 2.
48. In Paragraph 29 (2) of the Introductory Part of the provision, the words "carrying out the activities referred to in Paragraph 3 (1) and thereafter 'are deleted.
49. in Paragraph 29 (2), point (b) is deleted;
Points (c) to (g) shall be renumbered as points (b) to (f).
50. In Paragraph 29, at the end of paragraph 2, the dot is replaced by a comma and the following point (g) is added:
"(g) carry out diagnostic examinations when providing occupational medical services, in particular water cold test, pletysmography, spirometry, audiometry, ergometry and electromyography.";
51.In Paragraph 34 (b):
"(b) to operate and maintain the medical devices and other equipment of the dental laboratory, with the exception of the use of a source of ionising radiation;"
52nd Paragraph 36 (1) (a) reads as follows:
"(a) to exempt persons from the consequences of emergencies in carrying out rescue and disposal work in cooperation with other essential components of the integrated rescue system,";
53. In Article 36, at the end of paragraph 1, the dot is replaced by a comma and the following point (i) is added:
"(i) to carry out, within the scope of its professional competence, activities to address the consequences of emergencies in the execution of rescue and disposal operations within the framework of an integrated rescue system.";
54. the words "and physiotherapy" shall be added at the end of Paragraph 43 (a).
55. At the beginning of Part Four, the following Title I is inserted:

„HLAVA I

HEALTH WORKER WITH SPECIFIC ELIGIBILITY
§ 53a
Medical professional activities with specialised competence
A medical professional with specialised competence may, without professional supervision and without indication to the extent of his specialised competence in accordance with the Law on Medical Devices and the Public Health Insurance Act, prescribe medical devices except those which, even if the intended purpose is met, may endanger the health or life of a person if they are not used under the supervision of a physician under the law governing medical devices and in vitro diagnostic medical devices. ';
Head I to Title XX shall be renumbered Title II to Title XXI.
56. In Section 54 of the introductory part of the provision, the number "67 'is replaced by" 67a'.
57. In Paragraph 55 (1) of the introductory part of the first sentence, the word "receiving 'is replaced by the word" receiving'.
58. in § 55 (1) (a) (3), the words "perform tracheobronchial lavage in a patient with airways secured," shall be deleted;
59.In Article 55 (1) (a), the following point 4 is inserted after point 3:
"4. to treat a patient for home pulmonary ventilation, including the use of medical devices, evaluation of ventilation parameters, replacement of tracheostomy cannula during complications, to provide guidance to the patient and his designated persons on the use of medical devices,"
Points 4 and 5 shall be renumbered 5 and 6.
60. in Article 55 (1) (b) (2), the words "and boys over the age of 15 years" shall be inserted after the words "men."
61.In Paragraph 55 (1) (b) (6):
"6. to perform tracheobronchial lavage in a patient with airways,"
62. In Paragraph 55 (1) (b), at the end of point 10, the semicolon is replaced by a comma and the following points 11 to 16 are added:
"11. set ventilation parameters when providing domestic artificial lung ventilation, as determined by the indicating physician;
12. titration of medicinal products to achieve or maintain pre-defined physiological or laboratory values as determined by the prescribing physician;
13. perform removal of the central venous catheter,
14. introduce the Huber needle into the implanted port catheter and remove it;
