GOVERNMENT REGULATION
of 14 June 1995
amending and supplementing Government Decree No 79 / 1994 Coll., on the pay ratios of armed forces, security forces and services, customs authorities, fire protection officers and employees of certain other organisations (Staff Regulations)
The Government orders pursuant to § 23 (b) to (f) of Act No. 143 / 1992 Coll., on the salary and remuneration of on-call time in the budget and in certain other organisations and bodies, as amended by Act No. 40 / 1994 Coll. (hereinafter referred to as the Act):
Government Decree No 79 / 1994 Coll., on the pay ratios of armed forces, security forces and services, customs authorities, fire protection officers and employees of certain other organisations (Staff Regulations) shall be amended as follows:
1. in Paragraph 1 (1) (d), the words "Fire Protection Corps" shall be replaced by the words "Fire Rescue Corps of the Czech Republic";
2. Paragraph 1 (2) (c) reads as follows:
"(c) a member and a civil servant of the Prison Service and a civil servant of the Ministry of Justice who shall continuously supervise the execution of the detention and imprisonment,"
3. the words "the Czech Republic" shall be deleted from Paragraph 1 (2) (d).
4. in Paragraph 1 (2) (e), "member of the Fire Protection Corps" shall be replaced by "member and civil servant of the Fire Department of the Czech Republic,"
5. In Paragraph 1 (2) (g), the following is added at the beginning: "a civil servant of the Office for Foreign Relations and Information and."
6.
"(b) to the fourth and higher grades, but for a maximum period of four years, unless otherwise specified."
7. In the introductory sentence of Article 4 (3), "two years' is replaced by" four years'.
8. in Paragraph 4 (3), the following point (g) is inserted after point (f):
'( g) has acquired professional and pedagogical competence under the Specific Regulation (9).
9) § 1 of the Decree of the Ministry of Education of the Czech Republic No. 59 / 1985 Coll., on the professional and pedagogical competence of teaching staff and on the identification of educational establishments in which teachers have the status of teachers. "
9. Paragraph 4 is deleted.

"(a) the practice in the field of required work achieved after the completion of the degree of education laid down in the catalogue or in a separate provision [Paragraph 4 (3) (g)] or requested by the employer [Paragraph 4 (3) (d)] or after the end of secondary vocational education for a staff member in the fourth grade or full secondary education and higher vocational education for a staff member in the eighth grade or Bachelor's education for a staff member in the ninth grade;"
11. Article 5 (1) (e), including Notes 5 and 10, reads as follows:
"(e) maternity and other maternity leave or permanent childcare to the extent appropriate to the length of maternity and other maternity leave in force at the time of such care under a special provision, (5) if the woman was not simultaneously in the day-to-daystudy (10) in preparation for the profession or for the period of personal care of a long-term severely disabled minor child who required exceptional care, provided that she was not placed in an institution for such children, but up to a maximum of six years.
5) For example Act No. 99 / 1948 Coll., on National Insurance, Act No. 58 / 1964 Coll., on Increased Care for Pregnant Women and Mothers, Act No. 65 / 1965 Coll., Labour Code, as amended.
10) Paragraph 20 (1) of Act No. 29 / 1984 Coll., on the System of Primary and Secondary Schools (Education Act). Section 29 of Act No. 172 / 1990 Coll., on Higher Education. '
12. in Paragraph 6 (2), the words "Fire Protection Corps" are replaced by the words "Fire Rescue Corps of the Czech Republic."
13. Article 7 (3), including footnote 11, reads as follows:
"(3) If the employer pursuant to a special Regulation (11) exceeds the limit of the appropriations for salaries and on remuneration for on-call or extra-tariff components, a staff member who is the statutory body of the employer may not be granted a personal surcharge for a period of six calendar months following the month in which the overrun was found.
11) Articles 3 (1) and 5 (1) of Decree of the Government No 48 / 1995 Coll., on regulating the amount of appropriations spent on salaries and on duty charges in the budget and in certain other organisations and bodies.
Paragraph 3 shall become paragraph 4.
14. in Paragraph 9 (2), the words "Fire Protection Corps" are replaced by the words "Fire Rescue Corps of the Czech Republic"; The abbreviation "PO" for all grades is deleted.
15. in Paragraph 10 (6), the words "Fire Protection Corps" are replaced by the words "Fire Rescue Corps of the Czech Republic."
16. in Article 10, the following paragraphs 9 to 13 are inserted after paragraph 8, including footnote 12:
"(9) A medical worker, 12) whose work is linked to an exceptional burden consisting of continuous direct care of persons in psychiatric and gerontological departments of bed facilities, is provided with a surcharge of CZK 100 to CZK 500 per month.
(10) The staff of the sanitary service, which consistently performs and provides hygiene supervision outside the regular place of service, is provided with a surcharge of CZK 200 to CZK 800 per month.
(11) Employees - a member of the medical rescue group are offered an extra charge of 500 CZK to 2000 CZK per month.
(12) Employees who consistently provide health care in operating rooms, anesthesiologiccoruscitation departments, intensive care units and oncology are provided with a surcharge of 200 CZK to 1000 CZK per month.
(13) The master of vocational education, whose performance is linked to an extraordinary neuropsychological burden consisting of continuous supervision of pupils who are at increased risk of injury due to the use of machines, tools, or devices which are used for the acquisition of practical skills and habits in workshops and the workplace of apprenticeships in vocational training, is provided with an additional fee of 200 CZK to 800 CZK per month.

Paragraph 9 shall become paragraph 14.
17. in Paragraph 10 (14), "paragraphs 2 and 4 to 7" shall be replaced by "paragraphs 2, 4 to 7 and 9 to 13."
18. Article 12, including the title and notes No 13), 14), 15) and 16) shall read as follows:
Further salary
(1) Staff members shall be entitled to an additional salary in each half of the calendar year, provided that they have worked for at least 65 days for one employer in the same service relationship or for one employer in the same employment relationship, provided that such employment or employment does not end in the first half of the year before 30 June and in the second half of the year before 30 November or 31 December, if the staff member has worked for a specified number of days until December. The performance of the service in service and the performance of the work in employment with the same employer shall not be counted. Compliance with the terms of the same employment relationship with one employer is not required if the change of employer is made and the transfer of rights and obligations from employment relationships by law. 13)
(2) The working day shall be the day on which the staff member:
(a) he has worked the bulk of his shift;
(b) has taken a holiday for half of its shift and more;
(c) have taken a replacement leave for overtime or a holiday work in the range of half of its shift and more;
(d) he was unable to perform work on the employer's part 14) in the range of half of his shift and more;
(e) he did not work because his usual working day was a holiday.
(3) The working day may only be counted for one reason referred to in paragraph 2.
(4) A staff member who is employed after a fixed weekly working period of 15) and whose employer has laid down weekly working hours unevenly, 16) shall be assessed as an employee who has worked five working days in the calendar week, even if his working hours are not allocated to all working days of the week. Paragraphs 2 (b) to (e) shall apply mutatis mutandis.
(5) The amount of the additional salary shall be the sum of the amounts of the fee, the value surcharge, the management premium, the personal and special allowance, except for the surcharge provided for in Paragraph 10 (8), to which the staff member was last entitled or who was last assigned to him by the employer, unless otherwise specified.
(6) The next salary for the first half of the calendar year shall be payable together with the salary for the month of June and the second half of the calendar year together with the salary for the month of November. If entitlement is established in the second half of the calendar year until December, the additional salary shall be payable together with the salary for that month.

19. In Paragraph 14 (1), the following shall be added at the end: "where the number of employees concerned by this method of determining the salary tariff and the rules for determining the salary tariff within the limits of the first to 10th grade of the relevant grade are agreed in a collective agreement or laid down in an internal provision '.
20. In Article 14, the following paragraphs 7 and 8 are added:
"(7) An investigator in the field of security services, who carries out work included in the catalogue of work in the 10th grade, may be assigned by the employer to that grade for a period of more than four years once he has completed his bachelor's education.
(8) The staff referred to in paragraph 7 shall account for the full period of experience in the field of the required work acquired after the Bachelor's education and shall deduct the period of two years until the period of deductible practice. ';

25. Annex No. 1 to the Work Catalogue, Section A, Part V - Military authorities of the ground army, paragraph 17 of the examples of work No 10.01., 10.02. and 12.01.:
"10.01. Management, command and all-round security of a war-based brigade or military training area (Commander and Deputy Chief of Brigade and Military Training Area).
10.02. 26. Annex No. 1: Work Catalogue, Section B, Part III - Flight and air traffic, in point 51, the heading "Grade 7" and the example of Work No. 7.01 is added:
"7.01. The pilot-in-command of an ultra-light aeroplane in the provision of e.g. aerial observations, field monitoring, carrying out specific tasks (hang pilot). ';

The conditions for the staff member's entitlement to another salary for the second half of 1995 (Paragraph 12) shall be established as from 1 July 1995.
This Regulation shall enter into force on 1 August 1995.
