DECLARATION
of 8 June 2015
on certain conditions for the work of crew members
The Ministry of Transport provides pursuant to § 85 (1) of Act No. 61 / 2000 Coll., on maritime navigation, as amended by Act No. 310 / 2008 Coll., Act No. 261 / 2011 Coll., Act No. 64 / 2014 Coll. and Act No. 81 / 2015 Coll., for implementation of § 12n (7), § 63e (3), § 66 (2), § 67 (1) (b) and § 67 (2) and (4) of this Act:
§ 1
Subject matter
This decree implements the relevant provisions of the European Union1) and provides for
(a) requirements for accommodation, operating, office and catering areas, storage and cooling areas for food and drink preparation, leisure and leisure facilities, sanitary and sanitary facilities and special areas for the ship's sick (hereinafter referred to as "ship's premises"), their number, dimensions, materials and equipment used;
(b) equipment for ships of equipment, pharmaceuticals and medical devices;
(c) a list of medicines and medical devices which the holder of a medical certificate is authorised to issue from the ship's medical kit only on the basis of a decision of the consulting physician;
(d) the manner in which medicines and medical devices are maintained in the ship's medicine cabinet, the management of medicines and medical devices and their control system;
(e) the content of the extended first aid course;
(f) the content of the records of treated persons during navigation;
(g) the details of the description of the measures by which the operator of the ship ensures compliance of the conditions for the work of the crew of the ship with the legislation governing the requirements for seagoing work (2) (hereinafter referred to as "the elements of the description of the measures"); and
(h) the model of the working time record of the crew member.
§ 2
Terms
For the purposes of this decree:
(a) gross tonnage, calculated in accordance with the International Convention for the Measurement of Ships, to which the Czech Republic is bound (3), to be declared in registered tonnes (RT);
(b) ships designated for a specific purpose by a ship with a gross tonnage greater than 500 gross of the mechanical propulsion on which it operates, other than crew members carrying out its safe sea navigation, of more than 12 other persons carrying out activities related to that specific purpose;
(c) the collision bulkhead of the first watertight bulkhead in the hull from the bow in accordance with the International Convention on the Safety of Life at Sea, to which the Czech Republic is bound (4), separating the first watertight section from other areas in the hull;
(d) the load mark affixed to the side of the ship, marked in accordance with the International Convention on the Load Mark, to which the Czech Republic is bound (5).
§ 3
Minimum ceiling height
The minimum height of the ceiling in all areas of the ship intended for accommodation, rest, meals and, where appropriate, treatment of crew members shall be 203 centimetres.
Accommodation spaces
§ 4
(1) The ship shall be equipped with a sufficient number of bedrooms for each crew member to have a separate bedroom. The bedrooms for men and women must be separate.
(2) The first sentence of paragraph 1 shall not apply to ships of less than 3 000 gross tonnage and to ships intended for a specific purpose. The number of bedrooms on a ship of less than 3 000 gross tonnage shall be considered sufficient if it is ensured that no more than two crew members occupy one bedroom.
(3) The ship shall be equipped with an adjacent living room, a daytime room or other equivalent space for the commander, the first engineer officer and the first cabin officer.
§ 5
The bedroom shall be located above the level of the load mark in the centre or rear part of the ship. If the size, type or purpose of the ship does not allow the position in the centre or rear of the ship, the bedroom may exceptionally be placed in the front of the ship. The bedroom cannot be placed in front of the collision bulkhead.
§ 6
(1) The bedrooms must be located in such a way that there is no direct opening from the cargo compartment, machinery room, ship's kitchen, storage space, drying facilities or common sanitary facilities. The parts of the bulkheads which separate these places from the bedrooms and the outer bulkheads shall be made of steel or other approved material and shall be watertight and gas-tight.
(2) The materials used for the construction of inner bulkheads, linings and linings, floors and joints must be suitable for the purpose and must contribute to ensuring a healthy environment on board.
§ 7
(1) The bedrooms shall be so placed as to ensure their illumination by natural light.
(2) The bedroom shall also be equipped with sufficient artificial lighting.
§ 8
(1) The smallest floor area of the bedroom is:
(a) 4,5 m2 on a ship of less than 3 000 gross tonnage;
(b) 5,5 m2 on a ship with a gross tonnage of 3 000 RT to 10 000 RT,
(c) 7 m2 on a ship of over 10 000 gross tonnage.
(2) The floor area of the bedroom on a ship of less than 3 000 gross tonnage occupied by 2 crew members shall be at least 7 m2.
(3) If a member of the crew of the ship in an officer's capacity does not have a private living room, a day room or other equivalent space, the smallest floor area of the bedroom for him designed makes
(a) 7,5 m2 on a ship of less than 3 000 gross tonnage;
(b) 8,5 m2 on a ship with a gross tonnage of 3 000 RT to 10 000 RT;
(c) 10m2 on a ship of over 10 000 gross tonnage.
§ 9
Provisions for ships intended for a specific purpose
(1) The smallest floor area of the bedroom for the crew on a ship intended for a specific purpose is:
(a) 7,5 m2 if occupied by two crew members;
(b) 11,5 m2, if occupied by three crew members;
(c) 14,5 m2, if occupied by four crew members;
(d) 3,6 m2 per crew member in a bedroom occupied by more than four crew members.
(2) If a crew member of a ship designated for a particular purpose in an officer's capacity is not available to a private living room, a day room or other equivalent space, the smallest floor area of his accommodation per person shall be:
(a) 7,5 m2 for level of operations officers; and
(b) 8,5 m2 for command level officers.
§ 10
Other bedroom equipment
(1) The bedroom shall be equipped with separate beds for each crew member. The inner dimensions of the bed are at least 198 x 80 cm.
(2) Each crew member shall have a lockable wardrobe with a capacity of not less than 475 litres and a socket, or other equivalent space, of not less than 56 litres in the bedroom. If the drawer is part of the wardrobe, the volume of the wardrobe with the drawer must be at least 500 litres. The wardrobe must be equipped with a shelf.
(3) All bedrooms shall be equipped with a fixed, folding or sliding table or counter and seat furniture.
(4) All bedrooms must be equipped with a sink with warm and cold running fresh water, unless the sink is located in its own private bathroom.
(5) The bedrooms shall be equipped to facilitate cleaning.
§ 11
Office, operating and leisure facilities
(1) Each ship must be equipped with separate offices or joint ship offices for the on-board and machinery departments.
(2) Each ship must have an appropriately located and equipped laundry.
(3) Each ship shall have an open deck rest area accessible to all crew members at the time of their leave.
§ 12
Food and beverage preparation facilities
(1) Each ship must be equipped with facilities for preparing meals, meals and refreshments of crew members on duty. The spaces of the ship's kitchens, prepared meals and canteens must comply with the provisions of Section 23 of Act No. 258 / 2000 Coll., on the Protection of Public Health and on the amendment of certain related laws.
(2) The equipment of kitchens and prepared meals must contain elements of protection against the fall of vessels or their spill.
(3) The dining facilities shall be properly equipped with furniture and equipment, taking into account the number of crew members who will use them. The dining tables shall include anti-slip equipment for tableware.
(4) The dining area must be located outside the bedroom area and as close as possible to the ship's kitchen. Paragraph 7 shall apply mutatis mutandis for the illumination of the dining space.
§ 13
Sanitary facilities
(1) Each crew member shall have appropriate access to sanitary facilities complying with health and hygiene standards. Separate sanitary facilities must be provided for men and women.
(2) All spaces with sanitary facilities shall be located in such a way as to ensure that they are ventilated into the open space outside the ship.
(3) On each ship, sanitary facilities shall be readily accessible from the navigating bridge and the machinery room or machinery room control area.
(4) At least one toilet, one sink and one bath or shower shall be located in an appropriate place for every six crew members of the ship without their personal sanitary facilities.
(5) Hot and cold running fresh water must be available in all washrooms.
§ 14
Special rooms for sick
If the crew of a ship whose voyage exceeds three days, 15 or more members shall be provided with special facilities for the sick used solely for medical purposes. Such premises shall be easily accessible under all weather conditions and shall allow for rapid and proper care of the sick.
§ 15
Other mandatory equipment
(1) The accommodation spaces, each separate cabin of the radio station and the central control room shall be equipped with air conditioning.
(2) Paragraph 1 shall not apply to ships operating regularly in an area where the use of air conditioning does not require mild climatic conditions.
(3) All spaces of the ship shall be equipped with an appropriate heating system.
(4) Paragraph 3 shall not apply to ships operating exclusively in tropical areas.
(5) The windows and doors of the ship's compartment must be equipped with removable insect-proof nets on a regular basis in ports with a large presence of insects. The premises of the ship shall also be equipped with insect control devices.
(6) Paragraph 5 shall not apply to the premises of a ship equipped with an air-conditioning or ventilation device with forced air flow.
§ 16
(1) Paragraphs 4 (3), 11 (1), 12 (4), first sentence and 13 (3) shall not apply to ships of less than 3 000 gross tonnage.
(2) Paragraphs 8, 9, 10 (4), 11 (2) and 15 (1) shall not apply to ships of less than 200 gross tonnage in addition to the provisions referred to in paragraph 1.
§ 17
Equipment of ships of equipment, pharmaceuticals and medical devices
In order to ensure the health services provided to ship crew members, the ship shall be equipped with at least the equipment, pharmaceuticals and medical devices listed in Annex 1 to this Regulation and the ship health manual. The total quantity of medicines and medical devices shall correspond to the number of crew members, the nature of the journey, the nature of the cargo and the activities to be carried out during the journey.
§ 18
How to maintain and manage medicines and medical devices
(1) All medicinal products and medical devices must be stored in a separate ship's infirmary or premises intended for that purpose (hereinafter referred to as "ship's infirmary"). The key to the ship's infirmary must be deposited with the doctor. If the doctor is not present on the ship, the key shall be stored with the master or the duty officer.
(2) The medicinal products and medical devices which are marked with the L symbol in Annex 1 to this Regulation must be stored in a separate cabinet in the ship's infirmary. The key to this box must be placed with the doctor. If a doctor is not present on the ship, the key shall be kept with the master of the ship or the duty officer and shall be available to the crew member holding the medical certificate.
(3) The holder of a medical certificate shall be entitled to issue medicinal products and medical devices marked with the L symbol in Annex 1 to this Regulation only on the basis of a decision of the consulting physician.
§ 19
Control of the state of medicines and medical devices
(1) The doctor will check the state of the medicines and medical devices regularly. Non-compliant medicinal products and medical devices, with expired shelf life, stored or prepared under conditions other than prescribed, shall be disposed of in accordance with other legislation6). If the doctor is not present on the ship, the medical certificate holder shall be regularly checked.
(2) A health diary record shall be made on the health check of medicines and medical devices. An annex to the health journal shall be a surveillance document containing a list of medicinal products and medical devices, including the contents of first-aid pharmaceuticals located in lifeboats and lifeboats, their prescribed quantity in accordance with Annex 1 to this Regulation and the actual quantity on board. The inspection document shall also include the name of the ship, the flag of the State of registration of the ship and the port of registry of the ship and the place and date of the control of the medicinal products and medical devices.
(3) Any record of the health records of medicinal products and medical devices and the inspection document shall be certified by the person responsible for the inspection and by the master of the ship.
§ 20
Content of the extended first aid course
The content of the extended first aid course consists of:
(a) the recap of knowledge obtained through basic first aid and first aid courses under an international agreement governing the standards of training, qualifications and watchkeeping of seafarers, which is part of the legal order of the Czech Republic (7);
(b) extended first aid and care for injured persons
1. in the case of head and spine injuries,
2. in the event of injury to the ears, nose, neck and eyes,
3. external and internal bleeding,
4. in burns, scalding, frostbite,
5. In the event of sprains, fractures and muscle injuries,
6. injuries, including healing methods and prevention of infection,
7. in acute abdominal events,
8. Treatment of open injuries and knowledge of bandage techniques,
9. Pain control information; and
10. information on stitch and wound clamping techniques;
(c) general principles and procedures for treating the sick;
(d) extended first aid for health problems in particular:
1. in the event of sudden illness,
2. in sexually transmitted diseases, and
3. in tropical and infectious diseases,
(e) basic information on alcoholism and toxicomania;
(f) extended first aid for toothache,
(g) extended first aid for gynaecological problems, pregnancy and childbirth;
(h) extended first aid and care for survivors;
(i) measures in the event of death at sea;
(j) hygiene including sterilisation, disinfection and disinsectisation,
(k) disease prevention including vaccination;
(i) principles of record keeping and knowledge of maritime health regulations.
§ 21
Contents of records of treated persons during navigation
The records of treated persons during the voyage shall include in particular:
(a) identification of the treated person;
(b) the name and, where applicable, the name, surname and signature of the doctor or medical certificate holder who made the entry in the register;
(c) date of registration, date and time of treatment;
(d) information on the state of health of the treated person, the course and outcome of the treatment and other relevant circumstances relating to the condition of the treated person and the procedure; and
(e) a description of the consultation with the doctor, if it has been consulted by radio or satellite.
§ 22
Details of the description of the measure
The details of the description of the measure are set out in Annex 2 to this Decree.
§ 23
Working time form
The model of the working time form of the crew members of the ship is set out in Annex 3 to this decree.
§ 24
Efficacy
This Decree shall take effect on 1 July 2015.

Details of the description of the measure
The description of the measure shall include a description of the rules and procedures by which the ship operator ensures compliance with the requirements of:
1. minimum age for the employment of crew members;
2. the establishment of pre-boarding medical procedures for crew members;
3. the competence of the crew of the ship according to the functions in which they will be employed on the ship;
4. the rules governing the conclusion of contracts of crew members and their formalities or the required employment contract form;
5. the rules on selection and cooperation with employment intermediaries, where the owner or service operator of such organisations,
6. working and rest hours,
7. the occupancy of the ship by the crew members, including their number, functional composition and qualifications,
8. accommodation on board,
9. spaces with leisure and leisure equipment,
10. food and supply security,
11. Safety and health and accident prevention,
12. provision of first aid and necessary care for crew members on board the ship,
13. Method of handling complaints on board a ship; and
14. wage security.
