amending Decree No 222 / 1995 Coll., on waterways, navigation in ports, common accident and transport of dangerous goods, as amended, and Decree No 67 / 2015 Coll., on rules on navigation (rules on navigation)
The Ministry of Transport provides pursuant to § 52 of Act No. 114 / 1995 Coll., on Inland Navigation, as amended by Act No. 358 / 1999 Coll., Act No. 118 / 2004 Coll., Act No. 309 / 2008 Coll., Act No. 187 / 2014 Coll. and Act No. 135 / 2019 Coll., ("the Act ') for the implementation of § 3 paragraphs 1 and 2, § 18 paragraphs 3, § 22 paragraphs 4 and § 29k of the Act:
Amendment of the Regulations on waterways, navigation in ports, common accidents and transport of dangerous goods
Decree No. 222 / 1995 Coll., on waterways, navigation in ports, common accident and transport of dangerous goods, as amended by Decree No. 412 / 2004 Coll., Decree No. 666 / 2004 Coll., Decree No. 423 / 2005 Coll., Decree No. 517 / 2006 Coll., Decree No. 44 / 2008 Coll., Decree No. 66 / 2015 Coll. and Decree No. 259 / 2016 Coll., are amended as follows:
1. in Article 2 (1), (2), (3) and (4), "part" is replaced by "paragraph."
2. In § 3 (a), the words "water flow Vltava from river km 241,40 (České Budějovice, Litvínovický potok) to river km 239,6 (České Budějovice, Jiráskova jej) including blind shoulder Vltava,
the water flow of Malš from the river km 1,757 (České Budějovice, water consumption for the heating plant) to the river km 0,00 (České Budějovice, to the mouth to the water stream Vltava), 'is replaced by the words "Water flow of Chrudimka from the river km 0,596 (road bridge - Pardubice) to the river km 0,00 (mouth to the water stream Elbe),
the water flow of Cidlina from the river km 2,113 (railway bridge - Libice nad Cidlina) to the river km 0,00 (mouth into the water stream Elbe), '.
3. in § 3 (a), the words "Lukewarm from river km 4,0 (Kolodje nad Lužnici)" shall be replaced by "Lukewarm from river km 4,20 (road bridge - Kolodje nad Lužnici)."
4. In Article 5 (1) (b), the words "made up 'are replaced by the words" made up'.
5. in Article 5 (1) (b) (1) and (2):
"1. in the river
for existing waterways, not less than 0,30 m;
for new and newly modified waterways or parts thereof, not less than 0,30 m for classification class 0, and not less than 0,50 m for classification class I, IV, V or Vb;
2. in the navigation channel
for existing waterways or parts thereof, at least as much as the current safety margin achieved,
for newly modified waterways or parts thereof, at least as much as the current achieved safety margin, but not less than 0,30 m for classification classes 0. and 0,50 m for classification classes I., IV, Vb.
for new waterways or parts thereof, not less than 0,30 m for classification class 0, not less than 0,50 m for classification class I and not less than 1,00 m for classification class IV, V or Vb. ';
6. in Article 5 (1), point (c) shall be deleted;
7. In Article 5, at the end of paragraph 2, the sentence "For new and newly modified waterways or their sections, the width of the fairway shall be calculated in accordance with Annex 2 to this Decree; the calculation of the width of the fairway in accordance with the first sentence shall be included in the documentation of the construction transmitted to the navigation authority for the purpose of issuing a binding opinion under the law. ';
8. Sections 29 to 34 are deleted, including the title.
9. Annex 2 shall read as follows:
"Annex No 2 to Decree No 222 / 1995 Coll.
Width of fairway
The widening of the fairway in curves is carried out on the inside of the arc, where the extended edge of the fairway is given by an evisistatic circle of radius R - e. It is possible to extend the fairway with the same value on both the outer and inner sides of the arc in tight conditions. In determining the size of the extension e, the following relationship is used for new and newly modified waterways:
e = L22R,
when:
e - calculation value of fairway expansion,
L - length of largest vessel or assembly,
R - radius of the inner edge of the fairway.
The resulting width of the fairway for new and newly modified waterways, excluding modifications to the nature of the fairway maintenance, reaches:
a) For the water path on the water stream flowing freely
B = the minimum width of the direct runway in accordance with § 5 (1) (a) (1) + (e); or
b) For a water journey with a level maintained by the help of a weir or in a navigation channel
B = 2b + 2Δb '+ Δb' + e, but not less than the width of the straight fairway according to § 5 (1) (a),
when:
b - the largest width of the vessel or assembly,
Δb '- side reserve of the fairway, for classification class W. or Vb. at least 5,0 m;
Δb '- mean fairway reserve, for classification class IV, Vb or V at least 5,0 m
Transition arc design
In the case of a large central angle, the auxiliary tangents t1 and t2, which intersect the normals at the beginning and end of the arc at half the distance between the unextended and extended edge of the fairway, shall touch the evisive circle with the radius R − e at two points T1 and T2. In the case of a small central angle and points of penetration of T1 and T2, they shall blend into one point T1,2,
when:
Rp - radius of transition circle,
t1, t2 - auxiliary tangents that intersect the normals at the beginning and end of the arc at half the distance between the unextended and extended edges of the fairway,
α - centre angle of arc,
β '- extreme angles created by tangents t1 and t2.
Transition arc design for large centre angle
In the case of a large central angle α, the characteristic of the arc β 'can be determined according to the relation:
β '= arccosRi-eRi-e2, with α = γ + 2β'.
The design elements of transverse arcs shall be calculated according to the relation:
t '1,2 = (Ri − e). tg β', with beta '= β',
tRp = t '1,2 + t "1,2 and Rp = tRptgβ" 2.
The widening of the fairway on the inside of the arc shall in this case be divided into three sections. The inner section of the edge of the fairway at the centre angle y shall have the shape of an evisistent circle to the original arc of the edge of the fairway with radius R. The extreme sections of the edge of the runway shall have the character of transition circles with radii of Rp forming centre angles β. "The transition curves shall connect the original inner edge of the fairway in straight sections to the central arc in the form of an ecvisistane removed from the original edge by e.
Transition arc design for small centre angle
In the case of a small centre angle α, on an evisibility circle, the standard is created at the beginning and end of the arc at half the distance between the unextended and extended edge of the runway only one point. This applies: α = g + 2β '= 2β'.
The design parameters of a single transition curve shall be calculated from the relationships:

The widening of the fairway on the inner side of the arc will in this case consist of one transverse arc divided into two extremes. The transition arc will have a radius Rp and will copy the centre angle 2β '. The ecvisible circle at distance e from the edge of the original fairway intersects at a single point T1,2.

Amendment of the rules on navigation
Decree No. 67 / 2015 Coll., on rules on navigation traffic (rules on navigation) is amended as follows:
1. In § 5 (1) (g), the words "České Budějovice-Jiráskova jejším km 239,50" are replaced by the words "České Budějovice Budějovice km 241,40."
2. in Article 5 (1), the following point (p) is inserted after point (o):
"(p) Malá še še šeše km 1,60 to Zástaví 0,00 at water flow in the water profile České Budějovice 100 m3 / s and higher,"
Points (p) and (q) shall be renumbered as points (q) and (r).
3. in Article 5 (1) (q), "140" is replaced by "238."
4. In Paragraph 8 (1) (c), the word 'or' is replaced by 'vessels and, if not allocated, so'.
5. Paragraph 8 (2) reads as follows:
"(2) The distinguishing marks shall be indicated in clearly legible and indelible Latin letters or Arabic numerals. The height of the letters and digits of the registration mark referred to in paragraph 1 (a) shall not be less than 20 cm, in other markings less than 15 cm; the width of the letters and figures and the thickness of the draw shall be proportionate to their height; The letters and figures shall be of light colours on a dark background or a dark colour on a light background. ';
6. Paragraph 9 (1) reads as follows:
(1) The small vessel registered in the register of small vessels shall bear on the body the registration mark, which shall be the European vessel identification number and, if not allocated, the registration mark. The registration mark shall be marked on the outer sides of the two sides of the vessel near the bow and made in clearly legible Latin letters or Arabic numerals of a height of at least 10 cm. The letters and figures of the light colour on the dark background or the dark colour on the light background shall be used for the identification mark. ';
7. The heading of Section 40 reads:
"Signalling entry ban on unauthorised persons."
8. In the first sentence of Paragraph 40, the words "unauthorised persons' shall be added after the words" entry ban '.
9. In the last sentence of Paragraph 40, the words "the entry ban 'are replaced by the words" that character'.
10. The heading of Section 41 reads:
"Signalling smoking ban and tampering with open fire."
11. in Paragraph 41, the word "flame" is replaced by "open fire."
12. Article 53 shall be deleted, including the title.
13. In Paragraph 72, at the end of paragraph 3, the words "and the municipal police vessel in the exercise of its competence 'are added.
14. in Paragraph 85 (2) (a):
"(a) the vessels awaiting entry shall take their seats in one width in succession as close as possible to the shore in order not to close the fairway;"
15. in Paragraph 85 (2), the words "this shall not apply to vessels used in the management, maintenance, repair or modernisation of the waterway outside the normal operating time of the lock or when the lock of the lock is stopped."
16. in Paragraph 85 (4), the words "paragraph 1 (a)" shall be inserted after the words "§ 84";
17. in Paragraph 85 (4), the following point (a) is added:
"(a) a vessel used in the protection against floods in the event of flood hazards;"
Points (a) and (b) shall be renumbered points (b) and (c).
18. in Paragraph 85 (4) (c), including footnote 3,
"(c) a vessel to which, on the basis of its notification by means of a river information service system which has been made at least one hour before the expected time of entry into the lock, the lock operator has notified the required time of entry into the lock by means of a river information service system, if the vessel is
1. used for the operation of freight or passenger waterway transport3),
2. State Navigation Administration,
3. the armed forces of the Czech Republic,
4th Municipal Police,
5. water flow manager,
6. components of an integrated rescue system; or
7. used in connection with the construction, maintenance or operation of water works or other structures on water streams.
3) Paragraph 33 (1) of Act No. 114 / 1995 Coll., on Inland Navigation, as amended. '
19. In Paragraph 85, the following paragraph 5 is inserted after paragraph 4:
"(5) The vessel referred to in paragraph 4 shall, at the latest before entering the lock circuit, use the signal referred to in paragraph 26. ';
Paragraph 5 shall become paragraph 6.
20. Point 4 of Annex 5 reads as follows:
"4. Special signal
"
EFFECTIVE
This decree shall take effect on the 15th day following its publication, with the exception of Article II (12), which shall take effect 6 months after its publication.
