DECLARATION
of 26 March 2020
amending Decree No 96 / 2018 Coll., on crops and propagating material of fruit genera and species and putting them into circulation
The Ministry of Agriculture shall determine, pursuant to Article 3 (2), (5), (6), (8) and (14), (6), (7), (7) (a), (b), (d) and (i), (7) (a), (d) and (g) to (j), (n), (p) and (s), (14) (6), (16) (12), (18) (12), (17) (a), (c), (f), (h) and (m), and (24) (9) of Act No. 219 / 2009 Coll., Act No. 331.), Act No. 331 / 2010 Coll.
Čl. I
Decree No 96 / 2018 Coll., on crops and propagating material of fruit genera and species and its putting into circulation, is amended as follows:
1. At the end of footnote 1, the sentence "Commission Implementing Directive (EU) 2019 / 1813 of 29 October 2019 amending Implementing Directive 2014 / 96 / EU on the labelling, sealing and packaging requirements for fruit plant propagating material and fruit plants intended for fruit production, falling within the scope of Council Directive 2008 / 90 / EC as regards the colour of the label for certified categories of propagating material and fruit plants and the content of the supplier's document shall be added to separate rows. Commission Implementing Directive (EU) 2020 / 177 of 11 February 2020 amending Council Directives 66 / 401 / EEC, 66 / 402 / EEC, 68 / 193 / EEC, 2002 / 55 / EC, 2002 / 56 / EC and 2002 / 57 / EC, Commission Directives 93 / 49 / EEC and 93 / 61 / EEC and Implementing Directives 2014 / 21 / EU and 2014 / 98 / EU as regards harmful plant organisms on seeds and other plant propagating material. ';
2. in Paragraph 3 (1), the words "Table 1 of Annex 1 and Annex 2 'are replaced by the words" Annexes 1 and 2';
3. in Paragraph 4 (2) (a):
"(a) are found by visual inspection carried out by the Institute in accordance with a category free of all regulated non-quarantine harmful organisms for the European Union (hereinafter referred to as" RNŠO ") listed in Annexes 1 and 2 to this Regulation in accordance with the conditions set out in Annex 4 to this Regulation, in case of doubt as to the presence of RNŠO listed in Annex 1 to this Regulation, the Institute or the supplier shall carry out a sample of the mother plant in advance, ';
4. in Article 4 (2) (b):
"(b) The institute or supplier shall carry out the sampling and testing of the mother plant in advance on the RNŠO listed in Annex 2 in accordance with the conditions laid down in Annex 4 to this Regulation, '.
5. in Paragraph 4 (2), point (c) shall be deleted;
Points (d) to (m) shall be renumbered (c) to (l).
6. Paragraph 4 (3) reads as follows:
"(3) In the case of a positive result of pre-stage testing of the mother plant on the RNSO listed in Annexes 1 and 2 to this Regulation, the supplier shall remove the infected mother plant from the grassland and, where appropriate, take appropriate measures in accordance with the conditions set out in Annex 4 to this Regulation. Those plants may continue to be recognised as basic or certified propagating material or be inspected as conformal propagating material if they fulfil the conditions laid down in Annex 4 to this Decree for those categories of propagating material. ';
7. in Article 4 (4) (a) and (b):
"(a) are found by a visual inspection carried out by the Institute, depending on the category free of all RNŠO listed in Annexes 1 and 2 thereto, in accordance with the conditions laid down in Annex 4 to this Regulation, in case of doubt as to the presence of RNŠO listed in Annex 1 thereto, the Institute or the supplier shall take samples of the basic mother plant,
(b) the Institute or the supplier shall carry out sampling and testing of the basic mother plant on the RNŠO listed in Annex 2 to this Decree in accordance with the conditions laid down in Annex 4 to this Decree, '.
8. in Article 4 (4), point (c) shall be deleted;
Points (d) to (j) shall be renumbered (c) to (i).
9. Paragraph 4 (5) reads as follows:
"(5) In the case of a positive result of testing the basic mother plant on the RNŠO listed in Annexes 1 and 2 to this Decree, the supplier shall remove the infected basic mother plant from the crop and, where appropriate, take appropriate measures in accordance with the conditions set out in Annex 4 to this Decree. Such plants may continue to be recognised as certified propagating material or be inspected as conformal propagating material if they fulfil the conditions laid down in Annex 4 to this Decree for those categories of propagating material. ';
10. in Article 4 (6) (a) and (b):
"(a) are found by a visual inspection carried out by the Institute, depending on the category free of all RNŠO listed in Annexes 1 and 2 thereto, in accordance with the conditions laid down in Annex 4 to this Regulation, in case of doubt as to the presence of RNŠO listed in Annex 1 thereto, the Institute or the supplier shall carry out sampling of certified mother plants;
(b) the Institute or the supplier shall carry out sampling and testing of the certified mother plant on the RNŠO listed in Annex 2 in accordance with the conditions laid down in Annex 4 to this Decree, '.
11. in Article 4 (6), point (c) is deleted;
Points (d) to (f) shall be renumbered (c) to (e).
12. in Paragraph 4 (7):
"(7) In the case of a positive result of testing a certified mother plant on the RNŠO listed in Annexes 1 and 2 to this Regulation, the supplier shall remove the infected basic mother plant from the crop and, where appropriate, take appropriate measures in accordance with the conditions set out in Annex 4 to this Regulation. Such plants may continue to be inspected as conformal propagating material if they fulfil the conditions laid down in Annex 4 to this Decree for those categories of propagating material. ';
13. in Article 4 (8) (a) and (b):
"(a) are found by a visual inspection carried out by the Institute, depending on the category free of all RNŠO listed in Annexes 1 and 2 thereto, in accordance with the conditions laid down in Annex 4 to this Regulation, in case of doubt as to the presence of RNŠO listed in Annex 1 thereto, the Institute or the supplier shall take samples of certified nurseries,
(b) the Institute or supplier shall carry out the sampling and testing of the certified fruit crops on the RNŠO listed in Annex No 2 for this expulsion in accordance with the conditions laid down in Annex 4 to this Decree, '.
14. Paragraph 4 (9) reads:
"(9) In the case of a positive result of testing of certified fruit crops on RNŠO listed in Annexes 1 and 2 to this Decree, the supplier shall remove the infected fruit ledges from the crop and, where appropriate, take appropriate measures in accordance with the conditions set out in Annex 4 to this Regulation. These plants may continue to be inspected as conformal propagating material if they fulfil the conditions laid down in Annex 4 to this Decree for conformal propagating material. ';
15. In Article 4, at the end of paragraph 10, the sentence "The Institute or supplier shall transmit samples to the laboratory which is officially responsible for testing propagating material."
16. in Article 5 (5), the words "In the case" shall be replaced by the words "Unless otherwise stated," and the words "shall be deleted after the word" expedition ";
17. in Article 6 (3), the words "listed in Annex 8 to this Decree" shall be replaced by the words "The Institute publishes on its website."
18. In Article 9, the following paragraph 3 is inserted after paragraph 2, including footnote 5:
"(3) If the supplier's document is affixed to conformal propagating material, the colour of the supplier's document shall be yellow5).
5) Article 5 (3) of Commission Implementing Directive 2014 / 96 / EU, as amended by Commission Implementing Directive (EU) 2019 / 1813. '
Paragraphs 3 to 8 shall be renumbered paragraphs 4 to 9.
19. in Article 9 (5) (d):
"(d) the visual inspection carried out by the supplier on the grassland is practically free from RNŠO listed in Annexes 1 and 2 to this Decree, unless otherwise specified in Annex 4 to this Decree, in case of doubt as to the presence of RNŠO listed in Annex 1 to this Decree, the supplier shall carry out sampling and testing of the conformal material and matte crops concerned; in the case of cryoconservation storage, inspections and testing shall not be carried out; ';
20. In Article 9, the following paragraph 9 is inserted after paragraph 8:
"(9) The supplier shall take samples and testing of the conformal (CAC) mother plants and propagating material on the RNŠO listed in Annex 2 to this Decree, provided that they are subject to the requirements set out in Annex 4 to this Regulation. ';
Paragraph 9 shall become paragraph 10.
21. in Paragraph 9 (10), "7" is replaced by "9."
22. in Article 9, the following paragraph 11 is added:
"(11) Conformal propagating material shall be produced in accordance with the crop site and production area requirements laid down in Annex 4 to this Decree. ';
23. In Article 11, the words "listed in Annex 8 to this Order 'are replaced by the words" published on the Institute's website'.
24. In Section 12, the words "listed in Annex 9 to this Decree 'are replaced by the words" The Institute publishes on its website'.
(25) Annexes 1 to 4 shall read as follows:

Requirements to be met by propagating material with regard to the relevant genera, species and categories of propagating material and testing conditions
The propagating material shall comply with the requirements concerning quarantine harmful organisms for the European Union and quarantine harmful organisms for protected zones laid down in implementing acts adopted pursuant to Regulation (EU) 2016 / 2031, as well as the measures adopted pursuant to Article 30 (1) of that Regulation.
In addition, they shall comply with the following requirements for the relevant genera or species and categories.
1. Castanea sativa Mill.
(a) All categories
Visual show
Visual shows shall be carried out once a year.
Sampling and testing
Sampling and testing shall be carried out in case of doubt as to the presence of RNSO listed in Annex 1.
(b) Propagating material
Requirements for the place of the crop, surrounding area and area of production of propagating material
In the case where a derogation is granted for the production of pre-stage propagating material in spatial isolation in accordance with Commission Implementing Decision (EU) 2017 / 925, the following requirements concerning Cryphonectria parasitica (Murrill) Barr shall apply:
(i) propagating material and fruit fillings are produced in areas known to be free from Cryphonectria parasitica (Murrill) Barr; or
(ii) no symptoms of Cryphonectria parasitica (Murrill) Barr have been observed at the place of production on the propagating material and fruit crops in advance since the beginning of the last complete growing cycle.
(c) Basic propagating material
Requirements for the place of the crop, surrounding area and area of production of propagating material
(i) propagating material and fruit fillings of basic propagating material are produced in areas known to be free from Cryphonectria parasitica (Murrill) Barr; or
(ii) no symptoms of Cryphonectria parasitica (Murrill) Barr have been observed at the place of production on propagating material and fruit crops of basic propagating material since the beginning of the last complete growing cycle.
(d) Certified propagating material and conformal material (CAC)
Requirements for the place of the crop, surrounding area and area of production of propagating material
(i) propagating material and fruit straws certified and conformal (CAC) are produced in areas known to be free from Cryphonectria parasitica (Murrill) Barr; or
(ii) no symptoms of Cryphonectria parasitica (Murrill) Barr have been observed at the place of production on propagating material and fruit crops certified and conformed (CAC) since the beginning of the last complete growing season; or
(iii) the propagating material and fruit fillings certified and conformal (CAC) showing signs of the presence of Cryphonectria parasitica (Murrill) Barr have been removed, the remaining propagating material and fruit fillings are inspected regularly each week and no symptoms are observed at the manufacturing site within three weeks prior to dispatch.
2. Citrus L., Fortuna Swingle and Poncirus Raf.
(a) Propagating material
Visual show
Visual shows are performed twice a year.
Sampling and testing
Samples shall be taken each year from each pre-basic mother plant and tested for the presence of Spiroplasma citri Saglio et al. From each mother plant in the preceding stage, three years after its recognition as a mother plant in the preceding stage and subsequently at three-year intervals, samples shall be taken and tested for Citrus tristeza virus (EU isolates).
From each mother plant in the preceding stage, six years after its recognition as a mother plant in the preceding stage and thereafter at six-year intervals, samples shall be taken and tested for the presence of RNSO - other than Citrus tristeza virus (EU isolates) and Spiroplasma citri Saglio et al. - listed in Annex 2 and, in case of doubt, also for the presence of RNSO listed in Annex 1.
(b) Basic propagating material
Visual show
A visual inspection shall be carried out twice a year with regard to Citrus tristeza virus (EU isolates), Spiroplasma citri Saglio et al. and Plenodomus tracheiphilus (Petri) Gruyter, Aveskamp & Verkley. A visual inspection shall be carried out once a year with regard to all RNŠO - other than Citrus tristeza virus (EU isolates), Spiroplasma citri Saglio et al. and Plenodomus tracheiphilus (Petri) Gruyter, Aveskamp & Verkley - listed in Annexes 1 and 2.
Sampling and testing
In the case of basic mother plants which have been kept in insect protection facilities, samples shall be taken from each basic mother plant every three years and tested for Citrus tristeza virus (EU isolates). Samples shall be taken every three years from a representative part of the basic mother plants and tested for the presence of Spiroplasma citri Saglio et al.
In the case of basic mother plants which have not been kept in insect protection facilities, samples shall be taken each year from a representative part of basic mother plants and tested for Citrus tristeza virus (EU isolates) and Spiroplasma citri Saglio et al., so that all mother plants are tested within 2 years. In the case of a positive test result for Citrus tristeza virus (EU isolates), samples shall be taken and tested from all basic mother plants at the production site. A representative part of the basic mother plants which have not been kept in an insect-protected establishment shall be sampled every six years and tested for the presence of RNŠO - other than Citrus tristeza virus (EU isolates) and Spiroplasma citri Saglio et al. - listed in Annexes 1 and 2.
(c) Certified propagating material
Visual show
A visual inspection shall be carried out twice a year with regard to Citrus tristeza virus (EU isolates), Spiroplasma citri Saglio et al. and Plenodomus tracheiphilus (Petri) Gruyter, Aveskamp & Verkley. A visual inspection shall be carried out once a year with regard to all RNŠO - other than Citrus tristeza virus (EU isolates), Spiroplasma citri Saglio et al. and Plenodomus tracheiphilus (Petri) Gruyter, Aveskamp & Verkley - listed in Annexes 1 and 2.
Sampling and testing
In the case of certified mother plants which have been kept in insect-proof facilities, samples shall be taken every four years from a representative part of certified mother plants and tested for Citrus tristeza virus (EU isolates) so that all mother plants are tested at an interval of 8 years.
In the case of certified mother plants which have not been kept in insect-protected establishments, samples shall be taken each year from a representative part of certified mother plants and tested for Citrus tristeza virus (EU isolates) so that all mother plants are tested at an interval of 3 years. In case of doubt, samples shall be taken from a representative part of certified mother plants which have not been kept in an insect protection facility and tested for the presence of RNŠO - other than Citrus tristeza virus (EU isolates) listed in Annexes 1 and 2.
In the case of a positive test result for Citrus tristeza virus (EU isolates), samples shall be taken and tested from all certified mother plants at the production site.
(d) Basic and certified propagating material
Requirements for the place of the crop, surrounding area and area of production of propagating material
(i) propagating material and fruit straws basic and certified are produced in areas known to be free from Citrus tristeza virus (EU isolates), Spiroplasma citri Saglio et al. and Plenodomus tracheiphilus (Petri) Gruyter, Avescamp & Verkley; or
(ii) in the case of propagating material and fruit crops which have been grown in insect-proof establishments, no signs of the presence of Spiroplasma citri Saglio et al. or Plenodomus tracheiphilus (Petri) Gruyter, Avescamp & Verkley and of the material have been observed prior to marketing and tested on Citrus tristeza virus (EU isolates); or
(iii) in the case of propagating material and fruit crops certified, which have not been grown in insect-proof establishments, no signs of the presence of Spiroplasm citri Saglio et al. or Plenodomus tracheiphilus (Petri) Gruyter, Avescamp & Verkley have been observed on the propagating material and specified fruit crops during the last complete growing season and samples have been taken from a representative part of the material and tested on the body Citrus tristeza virus (EU isolates); or
(iv) in the case of propagating material and fruit crops certified and not grown in insect-proof establishments:
- signs of the presence of Plenodomus tracheiphilus (Petri) Gruyter, Aveskamp & Verkley or Spiroplasma citri Saglio et al. have been observed in up to 2% of the production material and fruit crops certified at the place of production, and the propagating material and specified fruit fillings and any plants with signs of infestation in the immediate vicinity have been removed and immediately destroyed, and
- a representative part of the propagating material and fruit crops of the certified category were sampled and tested for Citrus tristeza virus (EU isolates) before being placed on the market and, during the last complete growing season, no more than 2% of the propagating material and fruit crops of the certified category were found to be positive at the place of production. The propagating material and fruit fillings in question have been removed and immediately destroyed. The propagating material and fruit fillings in the immediate vicinity were subjected to random sampling and testing and all propagating material and fruit plants found to be positive were removed and immediately destroyed.
(e) Conformal (CAC) propagating material
Visual show
Visual shows shall be carried out once a year.
Sampling and testing
Conformal (CAC) propagating material and fruit straws shall be obtained from an identified source of material which has been found to be free from RNŠO as described in Annex 2 by visual inspection, sampling and testing.
Where an identified source of material has been stored in insect protection facilities, samples shall be taken from a representative part of the material every eight years and tested for Citrus tristeza virus (EU isolates).
Where the identified source of material has not been stored in insect protection facilities, samples shall be taken from a representative part of the material every three years and tested for Citrus tristeza virus (EU isolates).
Requirements for the place of the crop, surrounding area and area of production of propagating material
(i) conformal propagating material and fruit straws are produced in areas known to be free from Citrus tristeza virus (EU isolates), Spiroplasma citri Saglio et al. and Plenodomus tracheiphilus (Petri) Gruyter, Aveskamp & Verkley; or
(ii) in the case of conformal propagating material and fruit crops which have been grown in insect-proof establishments, signs of the presence of Spiroplasma citri Saglio et al. or Plenodomus tracheiphilus (Petri) Gruyter, Avescamp & Verkley have not been observed during the last completed growing season of that propagating material and those fruit crops and the material has been subjected to random sampling and testing for Citrus tristeza virus (EU isolates) before marketing; or
(iii) in the case of conformal propagating material and fruit crops which have not been grown in insect-proof establishments, the symptoms of the presence of Spiroplasma citri Saglio et al. or Plenodomus tracheiphilus (Petri) Gruyter, Avescamp & Verkley have not been observed during the last completed growing season at the place of production of that propagating material and those fruit crops and any plants with signs of infestation in the immediate vicinity have been removed and immediately destroyed and samples have been taken from a representative part of the material before marketing and tested for the Citrus tristeza virus (EU isolates); or
(iv) in the case of propagating material and fruit crops not grown in insect-proof establishments:
- signs of the occurrence of Spiroplasma citri Saglio et al. or Plenodomus tracheiphilus (Petri) Gruyter, Avescamp & Verkley have been observed in not more than 2% of the propagating material and fruit crops of the conformal material at the place of production and given propagating material and given fruit protrusions and any plants with signs of infestation in the immediate vicinity have been removed and immediately destroyed, and
- a representative part of the propagating material and fruit crops of conformal material (CAC) have been sampled and tested for the presence of Citrus tristeza virus (EU isolates) before being placed on the market and no more than 2% of the propagating material and fruit crops of conformal material (CAC) were found to be positive at the place of production during the last complete growing season. The propagating material and fruit fillings in question have been removed and immediately destroyed. The propagating material and fruit fillings in the immediate vicinity were subjected to random sampling and testing and all propagating material and fruit plants found to be positive were removed and immediately destroyed.
3. Corylus avellana L.
All categories
Visual show
Visual shows shall be carried out once a year.
Sampling and testing
Sampling and testing shall be carried out in case of doubt as to the presence of RNSO listed in Annexes 1 and 2.
4. Cydonia obernga Mill.
(a) All categories
Visual show
Visual inspections of Erwinia amylovora (Burrill) Winslow et al. shall be carried out during the last completed growing season. For all RNŠO other than Erwinia amylovora (Burrill) Winslow et al. visual shows are performed once a year.
(b) Propagating material
Sampling and testing
15 years after its recognition as pre-basic mother plants and thereafter at 15-year intervals, samples shall be taken and tested for the presence of RNSO - other than diseases caused by viruses similar to organisms and viroids - listed in Annex 2 and, in case of doubt, also the presence of RNSO listed in Annex 1.
Requirements for the place of the crop, surrounding area and area of production of propagating material
In the case where a derogation for the production of pre-stage propagating material is permitted in spatial isolation in accordance with Commission Implementing Decision (EU) 2017 / 925, the following requirements concerning Erwinia amylovora (Burrill) Winslow et al.:
(i) the propagating material and fruit fillings are produced in pre-stage areas known to be free from Erwinia amylovora (Burrill) Winslow et al., or
(ii) the propagating material and fruit fillings of the propagating material at the place of production have been examined during the last completed growing season and all propagating material and fruit fillings with symptoms of Erwinia amylovora (Burrill) Winslow et al., and all surrounding host plants have been immediately removed and destroyed.
(c) Basic propagating material
Sampling and testing
The representative part of the basic mother plants shall be sampled and tested for the presence of RNSO - other than diseases caused by viruses similar to organisms and viroids - listed in Annex 2 and, in case of doubt, also the presence of RNSO listed in Annex 1, on the basis of the risk assessment of the plant concerned.
(d) Certified propagating material
Sampling and testing
A representative part of certified mother plants shall be sampled and tested for the presence of RNSO - other than diseases caused by viruses similar to organisms and viroids - listed in Annex 2 and, in case of doubt, also the presence of RNSO listed in Annex 1, on the basis of an assessment of the risk of infection of the plants concerned every 15 years.
The certified fruit crops shall be sampled and tested in case of doubt as to the presence of RNSO listed in Annexes 1 and 2.
(e) Basic and certified propagating material
Requirements for the place of the crop, surrounding area and area of production of propagating material
(i) propagating material and fruit straws of the basic and certified category are produced in areas known to be free from Erwinia amylovora (Burrill) Winslow et al., or
(ii) propagating material and fruit straws of the basic and certified category at the place of production have been overlooked during the last completed growing season and all propagating material and fruit straws with symptoms of Erwinia amylovora (Burrill) Winslow et al. and all surrounding host plants have been immediately removed and destroyed.
(f) Conformal (CAC) propagating material
Sampling and testing
Sampling and testing shall be carried out in case of doubt as to the presence of RNSO listed in Annexes 1 and 2.
Requirements for the place of the crop, surrounding area and area of production of propagating material
(i) propagating material and fruit straws of conformal (CAC) propagating material are produced in areas known to be free from Erwinia amylovora (Burrill) Winslow et al., or
(ii) the propagating material and fruit straws of the conformal (CAC) propagating material at the place of production have been inspected during the last completed growing season and all propagating material and fruit straws with symptoms of Erwinia amylovora (Burrill) Winslow et al. and all surrounding host plants have been immediately removed and destroyed.
5. Ficus carica L.
All categories
Visual show
Visual shows shall be carried out once a year.
Sampling and testing
Sampling and testing shall be carried out in case of doubt as to the presence of RNSO listed in Annex 1.
6. Fragaria L.
(a) All categories
Visual show
Visual inspections shall be carried out twice a year during the growing season. Fragaria L. leaves are visually inspected for the presence of Phytophthora fragariae. C.J. Hickman.
In the case of propagating material and fruit crops produced by micropropagation and kept for less than three months, only one visual inspection shall be necessary during that period.
(b) Propagating material
Sampling and testing
From each pre-basic mother plant, one year after its recognition as pre-basic mother plants and thereafter every growing season, samples shall be taken and tested for the presence of RNSO listed in Annex 2 and, in case of doubt, also for the presence of RNSO listed in Annex 1.
(c) Basic propagating material
Sampling and testing
In the event of symptoms of Phytophthora fragariae C. J. Hickman's presence on leaves, samples shall be taken and tested from a representative sample of roots. Sample collection and testing shall be carried out if the visual inspection shows unclear signs of the following viruses: Arabis mosaic virus, Raspberry ringspot virus, Strawberry crinkle virus, Strawberry latent ringspot virus, Strawberry milk yellow edge virus, Strawberry vein banding virus and Tomato black ring virus. Sampling and testing shall be carried out in case of doubt as to the occurrence of RNŠO - other than Arabis mosaic virus, Phytophthora fragariae C. J. Hickman, Raspberry ringspot virus, Strawberry crinkle virus, Strawberry latent ringspot virus, Strawberry milk yellow edge virus, Strawberry vein banding virus and Tomato black ring virus - listed in Annexes 1 and 2.
