The Ministry of Foreign Affairs announces that on 26 June 1995 the Treaty between the Government of the Czech Republic and the Government of the Slovak Republic on the exchange of data from information funds contained in the criminal record was signed in Bratislava.
The Treaty entered into force on the date of its signature pursuant to Article 10, i.e. 26 June 1995.
The Czech version of the Treaty is hereby published at the same time.
TREATY
between the Government of the Czech Republic and the Government of the Slovak Republic
on the exchange of information from information funds contained in the criminal record
The Government of the Czech Republic and the Government of the Slovak Republic (hereinafter referred to as the "Contracting Parties'),
in order to maintain the functionality, effectiveness and economy of the use of criminal record information funds and to carry out the gradual exchange of information funds contained in the criminal records of both States, they have agreed as follows:
(1) The Contracting Parties shall provide each other with information on the content of the criminal record on the final conviction of a citizen of the requesting Contracting Party which, at the date of entry into force of this Treaty, is in the Register of Penalties of the requested Contracting Party.
(2) The application is submitted or handled for the Czech Republic The Register of Penalties based in Prague and for the Slovak Republic The Register of Penalties of the General Prosecutor of the Slovak Republic in Bratislava.
The application shall contain an indication of the nationality of the person who relates to the information requested. For the purpose of proving citizenship, the rules of the requesting Contracting Party shall be determined.
Pursuant to the same principles as set out in Articles 1 and 2 of this Treaty, information on the content of criminal certificates and the final conviction of a non-citizen of any Contracting Party shall be sought.
No translation of the application under this Treaty and the documents drawn up shall be necessary.
The provision of information under this Agreement shall be free of charge.
The Parties shall ensure the protection of the information provided under their national data protection legislation in information systems.
The Ministry of Justice of the Czech Republic and the Prosecutor General of the Slovak Republic agree in the implementing protocol to this Treaty the procedure of the authorities of both Contracting Parties when transmitting information.
This Treaty shall not affect obligations arising from other international agreements for the Contracting Parties.
This Agreement shall be concluded for a period of five years and shall be automatically extended for a further year, unless one of the Contracting Parties denies it in writing no later than six months before the expiry of the period of validity.
This Treaty shall enter into force on the date of signature by both Contracting Parties.
Dane v Bratislava on 26 June 1995 in two original copies, each in the Czech and Slovak languages, the two texts being equally authentic.
