Government Regulation on the details of the service evaluation of civil servants and the link of the outcome of the service evaluation to the personal bonus of civil servants

of 8 June 2015
on the details of the professional evaluations of civil servants and the link of the outcome of the professional evaluations to the civil servant's personal bonus
The Government orders the implementation of Act No. 234 / 2014 Coll., on Civil Service ("the Act '):
§ 1
Evaluation criteria
A civil servant shall be assessed on the basis of the evaluation criteria listed in Annex 1 to this Regulation in the different areas assessed under Section 155 (3) of the Act (hereinafter referred to as "the area assessed '). The Staff Authority shall determine in advance from the list the criteria which reflect the needs of the Staff Regulations.
§ 2
The share of the areas evaluated in the outcome of the service evaluations
(1) The area evaluated shall be involved in the outcome of the professional evaluations of a civil servant who carries out a civil service at a post of service of between 5 and 10 grades.
(a) 15% for knowledge and skills;
(b) 70% in the case of the performance of a public service in terms of accuracy, speed and autonomy in accordance with the individual objectives set;
(c) 10% in the case of compliance with the Staff Regulations;
(d) 5% in the case of educational results.
(2) The area under assessment is involved in the outcome of the professional evaluation of a civil servant who carries out a civil service at a post of service in the 11th to 16th grade.
(a) 25% in the case of knowledge and skills;
(b) 60% in the case of the performance of a public service in terms of accuracy, speed and autonomy in accordance with the individual objectives set;
(c) 10% in the case of compliance with the Staff Regulations;
(d) 5% in the case of educational results.
§ 3
Classification of performance areas
(1) The area assessed under Sections 2 (1) (a) and (b) and 2 (2) (a) and (b) is classified
(a) 7 points if it is filled high above the requirements laid down therein;
(b) 5 points if it is carried out in excess of the entitlements to it;
(c) 3 points if it is fulfilled within the limits of the entitlements to it;
(d) 1 point where it is fulfilled in the context of claims against it with occasional reservations; or
(e) 0 points, if filled insufficiently.
(2) The area assessed under Sections 2 (1) (c) and (d) and 2 (2) (c) and (d) is classified
(a) 1 point if filled; or
(b) 0 points if it is insufficiently filled.
(3) The framework of entitlements referred to in paragraph 1 shall mean the average level of compliance with the assessment criteria required at the place of service.
(4) When selecting multiple criteria for the area to be evaluated in accordance with Articles 2 (1) (a) and (b) and 2 (2) (a) and (b), the area to be assessed shall be classified cumulatively for all selected criteria in the manner set out in paragraph 1.
(5) The area assessed under Sections 2 (1) (d) and 2 (2) (d) shall be classified as one point if training has not been required during the evaluation period.
(6) At the first service evaluation, a public servant shall be assigned 1 point for the area evaluated in accordance with Articles 2 (1) (d) and 2 (2) (d).
Conclusion of service evaluations
§ 4
The conclusion of the service evaluations shall be determined in accordance with the procedure laid down in Annex 2 to this Regulation, expressed verbally and shall include recommendations for granting, increasing, reducing or withdrawing a personal supplement to a civil servant or maintaining a personal supplement unchanged.
§ 5
(1) A civil servant who carries out a civil service at a post classified in the 5th to 10th grade was in the civil service
(a) excellent results where the result of the calculation referred to in Annex 2 to this Regulation is at least 4,7 points and 0 points have not been classified in any of the areas assessed under Article 2 (1) (a) and (b);
(b) good results if the result of the calculation referred to in Annex 2 to this Regulation is at least 3 points and not more than 4,69 points and 0 points have not been classified in any of the areas assessed under § 2 (1) (a) and (b);
(c) sufficient results where the result of the calculation referred to in Annex 2 to this Regulation is at least 0,9 points and not more than 2,99 points, or more than 2,99 points, but a civil servant has been classified in at least one of the areas under assessment in accordance with § 2 (1) (a) and (b), or
(d) non-compliant results where the result of the calculation referred to in Annex 2 to this Regulation is less than 0,9 points.
(2) A civil servant who carries out a civil service at a post classified in the 11th to 16th grade was in the civil service
(a) excellent results where the result of the calculation referred to in Annex 2 to this Regulation is at least 4,6 points and 0 points have not been classified in any of the areas under assessment under § 2 (2) (a) and (b);
(b) good results where the result of the calculation referred to in Annex 2 to this Regulation is at least 3,2 points and not more than 4,59 points and 0 points have not been classified with any of the areas assessed under § 2 (2) (a) and (b);
(c) sufficient results where the result of the calculation referred to in Annex 2 to this Regulation is at least 0,9 points and not more than 3,19 points, or more than 3,19 points, but a civil servant has been classified in at least one of the areas under assessment in accordance with § 2 (2) (a) and (b), or
(d) non-compliant results where the result of the calculation referred to in Annex 2 to this Regulation is less than 0,9 points.
§ 6
Amount of the personal surcharge
(1) As regards the civil servants who, pursuant to Article 5,
(a) excellent results, the personal charge may not exceed 50% of the highest grade wage fare in the grade to which the post of employment at which the civil servant performs the civil service is included;
(b) good results, the personal charge shall not exceed 30% of the salary of the highest grade in the grade to which the post of employment at which the civil servant carries out the civil service is included;
(c) sufficient results, the personal charge shall not exceed 10% of the salary of the highest grade in the grade to which the post of employment at which the civil servant performs the civil service is included; or
(d) non-compliant results, no personal supplement may be granted; such a public servant shall be removed from the granted personal fee.
(2) A personal surcharge of up to 100% of the premium of the highest grade in the grade to which the post of employment in which the civil servant carries out the public service may be granted to a civil servant who is an excellent, generally recognised expert, who carries out the public service at a post in the 10th to 16th grade, who has achieved excellent results in the public service and who has achieved a calculation in accordance with Annex 2 to this Regulation at least 5,6 points.
Common and transitional provisions
§ 7
A staff evaluation shall be carried out for those civil servants who, during the previous calendar year, performed a civil service for more than 6 months, if not for the case referred to in the third sentence of Paragraph 155 (2).
§ 8
(1) A public servant who has formed an employment relationship in accordance with § 185 to 188, § 190 to 192 or § 194 of the Act and who has been granted a personal allowance of more than the permissible amount provided for in § 6 (1) (a) and (b), may, on the basis of the outcome of the first professional evaluation, be granted a personal allowance of up to date for the period of the second professional evaluation, provided that the civil servant has achieved a personal allowance of up to date,
(a) the good results and the amount of the personal allowance awarded exceed 30% but does not exceed 50% of the salary of the highest grade in the grade to which the post of employment of a civil servant is assigned; or
(b) the sufficient results and the amount of the personal allowance granted exceed 10% but does not exceed 30% of the salary of the highest grade in the grade to which the post of employment of the civil servant is classified.
(2) If the amount of the personal premium awarded exceeds the maximum amount referred to in paragraph 1 before the first service evaluation, the personal allowance shall be reduced accordingly for the period between the first and the second service evaluation.
§ 9
The official evaluation for the calendar year 2015 shall be carried out for those civil servants who performed the civil service in the calendar year 2015 for more than 2 months.
§ 10
Efficacy
This Regulation shall enter into force on 1 July 2015.

Method of calculating the outcome of the staff evaluation of a civil servant
1. in the place of service classified in the 5th to 10th grade, follow the formula
V1 = 0,15 × A + 0,7 × B + 0,1 × C + 0,05 × D,
2. at a post in the 11th to 16th grade, follow the formula
V2 = 0,25 × A + 0,6 × B + 0,1 × C + 0,05 × D,
where
The V1 is the result of the professional evaluation of a civil servant in a post classified in the 5th to 10th grade,
The V2 is the result of the professional evaluation of a civil servant in a post classified in the 11th to 16th grade,
A is the number of points obtained according to the classification given in § 3 for the area of knowledge and skills evaluated,
B is the number of points obtained under the classification referred to in § 3 for the area of performance of the public service in terms of accuracy, speed and autonomy in accordance with the individual objectives set,
C is the number of points obtained in accordance with the classification referred to in § 3 for the field of professional discipline evaluated,
D is the number of points obtained according to the classification given in § 3 for the area evaluated by the educational results.
