DECLARATION
of 23 January 2018
amending Decree No. 500 / 2006 Coll., on Territorial Analysis Documentation, Territorial Planning Documentation and how to register the Territorial Planning Activities, as amended by Decree No. 458 / 2012 Coll.
The Ministry of Local Development provides pursuant to § 193 of Act No. 183 / 2006 Coll., on Territorial Planning and Construction Regulations (Construction Act), as amended by Act No. 227 / 2009 Coll., Act No. 350 / 2012 Coll., Act No. 39 / 2015 Coll. and Act No. 225 / 2017 Coll.:
Čl. I
Decree No. 500 / 2006 Coll., on Territorial Analysis Documentation, Territorial Planning Documentation and how to register the Territorial Planning Activities, as amended by Decree No. 458 / 2012 Coll., is amended as follows:
1. in Article 2 (a), the words "corridors" shall be inserted after the words "drawing of surfaces."
2. In Article 2, at the end of point (c), the dot is replaced by a comma and the following point (d) is added:
"(d) by means of urban compositional compositions the composition of selected spaces, parts of urban and landscape elements in order to create and protect their harmonious relations, such as view horizons, panoramas, urban and visual axes, transparency, dominance, appropriate standards and proportions."
3. In Article 2, the current text becomes paragraph 1 and the following paragraphs 2 and 3 are added:
"(2) The complete version of the zoning documentation shall contain the text and graphic part of the zoning documentation, as applicable after updating the territorial development principles, the modification of the zoning plan or the regulatory plan, and from the justification of the coordination drawing of the entire territory of the county or the entire territory of the municipality or the entire area covered by the regulatory plan. In the case of a zoning plan for a defined part of the territory of the capital city of Prague, the full text and graphic part of the zoning plan, as in force after the change of the zoning plan, and from the justification of the coordination drawing for the whole defined part of the territory of the capital of Prague.
(3) A machine-readable format for the needs of land planning activities means a format of a data file with a structure that allows software to easily find, recognise and extract specific information from that data file, including individual data and its internal structure. ';
4. In the heading of Part Two, the words "and Paragraph 29 (3) 'are inserted after the number" 2'.
5. in Article 4 (1) (a), the words' including the identification and evaluation of the state and development of the territory, its values, the limits on the use of the territory, the identification and evaluation of the plans to make changes in the territory 'shall be deleted;
6. in Paragraph 4 (1) (b):
"(b) analysis of the sustainable development of the territory,"
7. In Article 4, the following point (c) is added at the end of paragraph 1:
"(c) data on the territory, findings resulting from surveys of the territory, other relevant information available and, where appropriate, data generated by the analysis of the information collected (hereinafter referred to as the" territorial analysis database ").";
8. Paragraph 4 (2) reads as follows:
"(2) The documentation for the analysis of the sustainable development of the territory shall include:
(a) the identification and evaluation of the state and development of the territory, its values and the limits of use of the territory, all in particular broken down by:
1. broader territorial relations,
2. spatial and functional layout of the territory,
3. the settlement structure;
4. socio-demographic conditions and housing,
5. nature and landscape,
6. water mode and rock environment,
7. environmental quality,
8. agricultural land fund and land intended for forest functions,
9. civil amenities, including accessibility and public space;
10. Transport and technical infrastructure, including their availability;
11. Economic and economic conditions,
12. recreation and tourism,
13. safety and protection of the population;
(b) the identification and evaluation of plans to make changes in the territory. ";
9. in Paragraph 4, the following paragraphs 3 and 4 are inserted after paragraph 2:
"(3) The analysis of the sustainable development of the territory shall include:
(a) the identification and evaluation of positives and negatives in the territory, broken down in particular:
1. broader territorial relations,
2. spatial and functional layout of the territory,
3. the settlement structure;
4. socio-demographic conditions and housing,
5. nature and landscape,
6. water mode and rock environment,
7. environmental quality,
8. agricultural land fund and land intended for forest functions,
9. civil amenities, including accessibility and public space;
10. Transport and technical infrastructure, including their availability;
11. Economic and economic conditions,
12. recreation and tourism,
13. safety and protection of the population;
(b) assessing the territorial conditions and potential of the different pillars of the sustainable development of the territory, for the favourable environment, for economic development and for the cohesion of the population community, including their links and trends in the development of the territory;
(c) identification of problems to deal with in territorial planning documents, where appropriate in territorial studies, including in particular requirements for mitigation or limitation of urban, transport and health defects, conflicts of plans to make changes in the territory and conflicts of these projects with limits on the use of the territory and values in the territory, for the elimination or mitigation of negative effects in the territory, for the use of potential for the development of the territory and for the reduction of the unbalanced relationship of conditions for the favourable environment, for economic development and for the cohesion of the population community.
(4) The territorial analysis database is kept up to date and consists of the observed phenomena as set out in Annex 1 to this Decree. The database of territorial analytical documents of municipalities shall be drawn up at least in accordance with Part A of Annex 1 to this Regulation, in the details and scope necessary for the procurement of territorial plans and regulatory plans. The database of territorial analysis of the region shall be drawn up in accordance with Annex 1 to this Order in the details and scope necessary for the acquisition of the principles of territorial development. The Regional Authority may, in the processing of the database of territorial analysis, provide synergies to the zoning authorities in its administrative district. ';
Paragraphs 3 to 5 shall be renumbered paragraphs 5 to 7.
10. In Article 4 (5), the words "the text part, the graphic part, as well as the information on its formation, acquisition, processing, possible approval or entry into effect (hereinafter referred to as" the passport data on the territory ') shall read "the text part, the graphic part'. The text part contains a description of the territory data, the graphic part contains a representation of the territory data including the scale and legend used 'is replaced by' a text part which includes a description of the territory data and geographical data processed in a machine-readable format ', and at the end of the paragraph, the sentence" The provider of the territory data, including the pastiff, may provide the territory data to the spatial planning authorities for reasons of efficiency through the regional authority, which may apply to them within the scope of its administrative district and subsequently provide them to the spatial planning authorities in its administrative area'.
11. in Paragraph 4 (6):
"(6) The graphical part of the territorial analysis material shall, as a general rule, be processed in the framework of the acquisition of a full update of the territorial analysis material. The graphical part of the documentation for the analysis of the sustainable development of the territory of the territorial analysis shall contain a drawing of the values of the territory, including the values of cultural, natural and civilisation, a drawing of the limits on the use of the territory and a drawing of the plans to make changes in the territory. The graphical part of the analysis of the sustainable development of the territory of the territory of the region of analysis contains a drawing of problems to be solved in the territorial planning documents and, where appropriate, in the territorial studies (" problem drawing '). Territorial analytical supporting documents may be supplemented by additional drawings, diagrams, tables, graphs or cartograms.';
12. In § 6 (1) second sentence, § 13 (1) second sentence and § 19 (1) second sentence, the word "Content" shall be replaced by the words "Content" and the words "established" shall be replaced by "established."
13. in the third sentence of Article 6 (1), "the content referred to in the Annex" is replaced by "the Annex."
14. in Articles 6 (3) and 13 (4), the words "and structure" shall be inserted after the words "Content," and the words "established" shall be replaced by "established."
15. in Paragraph 8 (2) of the introductory part of the provision, the word "Copy" shall be replaced by the words "Full text" and the words "including the legal status after the last update of the principles of territorial development," shall be replaced by "after the update of the principles of territorial development";
16. Article 10 shall be deleted;
17. In the title of Title II, "§ 55 (6) 'is replaced by" § 55 (7)';
18. In the third sentence of Article 13 (1), the words "the content referred to in the Annex 'shall be replaced by the words" the Annex' and, at the end of the paragraph, the sentence "The structure of the text part of the zoning plan referred to in Annex 7 shall apply mutatis mutandis if the nature of the matter cannot be treated mutatis mutandis. ';
19. In Paragraph 13 (2), the first sentence is replaced by the following: "For particularly large areas, a drawing of the basic structure of the territory and separate drawings of the landscape layout and public infrastructure concept may be published on a scale of 1: 25 000. Where a territorial plan with elements of the regulatory plan is developed for a defined part of the territory of the municipality, that part of the territorial plan may be issued as a separate drawing on the scale of the cadastral map. ';
20. In the fourth sentence of Paragraph 13 (2), the words "or more 'are replaced by the words" or, where appropriate, on the scale of 1: 50 000 or 1: 25 000'.
21. In Paragraph 14 (2) of the introductory part of the provision, the word "Copy" shall be replaced by the words "Full text" and the words "including the legal status following the last amendment to the zoning plan," shall be replaced by the words "after the last amendment to the zoning plan";
22. in Article 15 (d), the words "the demonstration of impossibility to use the defined standstill area and" shall be deleted;
23. Article 16 shall be deleted;
24. In Title III, "K § 61 (5), § 64 (7) and Article 66 (6) 'is replaced by" K § 61 (3), § 64 (6) and Article 66 (5)'.
25. in Paragraph 20 (2) of the introductory part of the provision, the word "Copy" shall be replaced by "Full text" and the words "including the legal status following the last amendment to the regulatory plan," shall be replaced by "the last amendment to the regulatory plan";

Content of the territorial development principles
I. Content of the territorial development principles
(1) The text part of the territorial development principles includes the concept of the development of the region's territory, determining the essential requirements for its efficient and economical arrangements, expressed in:
(a) setting out the priorities of regional spatial planning to ensure the sustainable development of the territory, including taking into account the priorities set out in the territorial development policy;
(b) the specification of the definition of development areas and development axes (Article 32 (1) (b) of the Building Act) as defined in the territorial development policy and the definition of areas with increased requirements for changes in territories which are of relevance beyond the territory of several municipalities (supra-local development areas and supra-local development axes);
(c) clarification of the definition of specific areas [Paragraph 32 (1) (c) of the Construction Act] as defined in the territorial development policy and the definition of other specific areas of superlocal importance;
(d) the specification of areas and corridors [Paragraph 32 (1) (d) of the Construction Act] as defined in the territorial development policy and the definition of areas and corridors of supra-local importance, including areas and corridors of public infrastructure, the territorial system of environmental stability and the territorial reserves, for areas of land use reserves to be tested;
(e) specifying the territorial conditions of the concept of the protection and development of the natural, cultural and civilisation values of the territory of the region;
(f) determination of the target qualities of the landscape 13), including territorial conditions for their conservation or achievement;
(g) the definition of public-service buildings, public-service measures, structures and measures to ensure the defence and security of the State and of the designated rendering territories for which rights to land and buildings may be expropriated;
(h) laying down requirements for the coordination of the territorial planning activities of municipalities and for solutions in the territorial planning documentation of municipalities, taking into account in particular the conditions for the restoration and development of the housing structure;
(i) the definition of areas and corridors which provide for an examination of changes in their use of territorial studies;
(j) the definition of areas and corridors in which the acquisition and issue of a regulatory plan by the regional authorities is a condition for deciding on changes to their use, including whether it will be a regulatory plan on initiative or upon request, and the deadlines for the issue of a regulatory plan on the initiative;
(k) the assignment of the regulatory plan to the extent specified in Annex 9 for the area or corridor defined in accordance with (j);
(l) setting the order of changes in the territory (phase-out), if appropriate,
(m) the setting of compensatory measures under Section 37 (8) of the Construction Act.
The demarcated areas, axes, areas and corridors shall lay down requirements for their use, criteria and conditions for subsequent decisions on possible variations of changes in the territory and for their assessment, in particular with regard to their future use, relevance, possible threats, development and risks.
At the end of the text section, data shall be provided on the number of sheets of territorial development principles and the number of drawings of the graphic section.
(2) The graphical part of the territorial development principles includes:
(a) a drawing of the layout of the region's territory containing in particular development areas, development axes and specific areas;
(b) drawing of areas and corridors, including the territorial system of environmental stability;
(c) landscape drawing 13) for which target qualities are established;
(d) drawing of public utility structures, measures and rendering;
(e) a drawing of the areas, areas and corridors in which an examination of changes in their use of territorial studies is required or the acquisition and issue of a regulatory plan is required;
(f) drawing, as appropriate, of the order of changes in the territory (stage).
Where appropriate, the drawings referred to in points (a) and (b) may be subdivided into separate drawings. The graphical part can be supplemented by diagrams.
II. Content of the justification for the principles of territorial development
(1) The text part of the statement of reasons for the principles of territorial development contains, in addition to the elements resulting from the administrative rules and the elements referred to in § 40 (1) and (2) of the Building Act, in particular:
(a) evaluation of the coordination of the use of the territory in terms of broader (trans-regional) relations;
(b) an assessment of the fulfilment of the conditions resulting from any observations made by the competent authorities of neighbouring States and the results of their consultations;
(c) assessment of compliance with the requirements and conditions for the processing of the draft update of the principles of territorial development, or of the draft new principles of territorial development, contained in the report on the application of the principles of territorial development, or assessment of compliance with the requirements contained in the regional council's decision on the content of the update of the principles of territorial development obtained by the shortened procedure or in accordance with the procedure laid down in Article 42 (6) of the Construction Act, or assessment of compliance, where appropriate
1. with the approved selection of the most appropriate variant and conditions for its adaptation in the case of the procedure under Paragraph 38 (2) of the Building Act,
2. with guidelines for the processing of the draft principles of territorial development in the case of a procedure under Section 38 (3) of the Building Act;
3. the decision to update the principles of territorial development and its content in the case of the procedure under Section 42 (6) of the Building Act;
(d) a list of matters relating to the development of the territory of the State which are not covered by the territorial development policy (Section 36 (1) of the Building Act), justifying the need to define them;
(e) a qualified estimate of the Land Fund records for areas and corridors of republican and supra-local importance;
(f) for updating the territorial development principles, text indicating changes.
(2) The graphical part of the justification for the principles of territorial development contains in particular:
(a) a coordination drawing;
(b) a drawing of broader relations, documenting links in the territory of neighbouring regions or neighbouring States, as appropriate.

Content and structure of the assessment of the expected effects of the territorial development principles and the territorial plan on the sustainable development of the territory
The effects that can reasonably be expected shall be evaluated to the extent, details and degree of specificity that the land planning documentation is procured. The effects shall be determined by an expert estimate.
A. Assessment of the effects of the principles of territorial development or of the zoning plan on the environment, drawn up in accordance with an annex to the building law, where the competent authority has applied a requirement for such evaluation.
B. Evaluation of the effects of the territorial development principles or the territorial plan on European sites or bird areas, unless the nature conservation authority has ruled out a significant impact on those territories.
C. Assessment of the effects on the facts found in the territorial analysis.
D. Any evaluation of the effects on other factors affected by the proposed solution but not covered by the territorial analysis, such as those identified in the additional surveys and analyses.
E. Evaluation of the contribution of the territorial development principles or the spatial plan to the fulfilment of the territorial planning priorities to ensure the sustainable development of the territories contained in the territorial development policy or in the territorial development principles.
F. Evaluation of the effects on the sustainable development of the territory - summary.
Evaluation of the effects of the territorial development principles or the territorial plan on improving territorial conditions for the favourable environment, economic development and the cohesion and consistency of the communities of the inhabitants of the territory. ';

I. Content and structure of the zoning plan
(1) The text part of the zoning plan contains:
(a) the definition of the established territory;
(b) the basic concept of developing the territory of the municipality, protecting and developing its values;
(c) urban concept, including urban composition, delineation of areas with different uses, stoppable areas, rebuilding areas and the housing green system;
(d) the concept of public infrastructure, including the conditions for its placement, the definition of areas and corridors for public infrastructure, including the setting of conditions for their use;
(e) the concept of landscape layout, including the definition of areas with different uses, land change areas and the setting of conditions for their use, the territorial system of ecological stability, landscape permeability, anti-erosion measures, flood protection, recreation, mining of mineral deposits and the like;
(f) laying down the conditions for the use of areas with different uses for the purpose of determining the predominant purpose of the use (main use), where it can be established, the permissible use, the unacceptable use (including those in which the location of the buildings, installations and other measures for the purposes referred to in Paragraph 18 (5) of the Construction Act is excluded), and, where appropriate, the setting of the conditional use of those areas and the setting of the conditions of the spatial layout, including the basic conditions for the protection of the landscape (for example, the height regulation of the building, nature and structure of the buildings, and the intensity of their use);
(g) the definition of public-service buildings, public-service measures, structures and measures to ensure the defence and security of the State and of the areas of rendering for which land and construction rights can be expropriated;
(h) the definition of public utility buildings and public spaces for which the right to pre-purchase may be applied, indicating in whose favour the right to pre-purchase is established, the parcel numbers of the land, the name of the cadastral territory and, where applicable, other information pursuant to Section 8 of the cadastral law;
(i) the setting of compensatory measures under Section 50 (6) of the Construction Act.
At the conclusion of the text section, the number of pages of the zoning plan and the number of drawings of the graphic section shall be indicated.
(2) If appropriate, the text part of the zoning plan shall also contain:
(a) the definition of areas and corridors of territorial reserves and the determination of possible future use, including the conditions for its examination;
(b) the definition of the areas in which decisions on changes in the territory are subject to an agreement on parking;
(c) the definition of areas and corridors in which decisions on changes in the territory are made subject to the processing of a territorial study, the setting of the conditions for its acquisition and the reasonable time limits for the entry of data on that study into the register of planning activities;
(d) the definition of areas and corridors in which the decision on changes in the territory is conditional on the issue of a regulatory plan, the award of a regulatory plan to the extent specified in Annex 9, the determination of whether it will be a regulatory plan on the initiative or at the request and, for the regulatory plan, the setting of a reasonable time limit for its issue,
(e) setting the order of changes in the territory (etapization);
(f) the definition of architecturally or urbanistically important building 14).
(3) In the case of a zoning plan for part of the territory of the capital city of Prague, the text part also contains the definition of the area.
(4) The graphic part of the zoning plan contains:
(a) a drawing of a basic breakdown of the territory, indicating the boundaries of the built-up territory, the built-up areas, the conversion areas and the areas and corridors of the land reserves and the areas and corridors in which the decision on changes in the territory is subject to the conclusion of a parcelation agreement, the processing of a territorial study or the issue of a regulatory plan, and the definition of a part of the territorial plan with the elements of the regulatory plan;
(b) the main drawing containing the urban concept, the definition of areas with different uses, the built-up territory, the built-up areas and the rebuilding areas, the concept of landscape layout, including landscape changes and the territorial system of ecological stability, the concept of public infrastructure, including the definition of areas and corridors for transport and technical infrastructure, areas and corridors for territorial reserves; where appropriate, urban planning, landscape layout and public infrastructure design may be processed in separate drawings,
(c) drawing of public utility structures, measures and rendering;
(d) drawing, as appropriate, of the order of changes in the territory (stage),
(e) a separate drawing, as appropriate, of the part of the zoning plan with the elements of the regulatory plan.
The graphical part can be supplemented by diagrams.
II. Content of the justification for the zoning plan
(1) The text part of the statement of reasons for the zoning plan contains, in addition to the formalities resulting from the administrative rules and formalities provided for in § 53 (4) and (5) of the construction law, in particular:
(a) an evaluation of the coordination of the use of the territory in terms of broader relations within the territory;
(b) evaluation of compliance with the award requirements or assessment of compliance with the requirements contained in the municipal council decision on the content of the change of the zoning plan purchased by the shortened procedure or, where appropriate, evaluation of compliance
1. with the approved selection of the most appropriate variant and conditions for its modification in the case of the procedure under Section 51 (2) of the Building Act,
2. with guidelines for the processing of the draft zoning plan in the case of the procedure under Section 51 (3) of the Building Act,
3. with instructions for redrafting the proposal in the case of the procedure under Section 53 (3) of the Building Act,
4. with guidance on the modification of the draft zoning plan in the case of the procedure under Section 54 (3) of the Building Act,
5. the decision to acquire or modify the zoning plan and its content in the case of a procedure under Paragraph 55 (3) of the Construction Act;
(c) a list of matters of supra-local importance which are not addressed in the principles of territorial development (Section 43 (1) of the Building Act), justifying the need to define them;
(d) a list of the elements of the regulatory plan, justifying their definition;
(e) an assessment of the expected consequences of the proposed solution on the agricultural land fund and the land intended to fulfil the forest function;
(f) for the change of the zoning plan, the text indicating the changes.
(2) The graphical part of the justification for the zoning plan contains in particular:
(a) a coordination drawing;
(b) a drawing of broader relations, documenting links in the territory of neighbouring municipalities, regions and states, where appropriate;
(c) a drawing of the forecast soil fund records.
